HomeMy WebLinkAboutOrdinance No. 721 ORDINANCE NO. 721 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CERTAIN PROVISIONS OF THE AZUSA MUNICIPAL CODE RELATING TO LOT SPLITS AND SUBDIVISIONS. The City Council of the City of Azusa does ordain as follows: SECTION 1. Section 9100.3 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 9100.3. DEFINITION OF SUBDIVISION. 'Subdivision', for the purposes of this Chapter, shall have the meaning ascribed to said word in Section 11535 of the Health and Safety Code of the State and shall be subject to all of the terms and conditions set forth in said Section. " SECTION 2. Section 9300 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 9300. COMPLIANCE REQUIRED. IN LOT SPLITS. Any person dividing any lot, piece or parcel of land, or any contiguous parcels of land, into two or more portions for the purpose of sale, whether immediate or future, of one or more of such portions, shall comply with the provisions of Chapter 1 of this Article, and the provisions of the Subdivision Map Act of the State relating to subdivisions, except as hereinafter in this Chapter expressly provided. " SECTION 3. Section 9301 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 9301. EXCEPTIONS. Compliance with the provisions of Chapter 1 of this Article and of the Subdivision Map Act of the State relating to subdivisions are not required when all of the following conditions are present: (a) A Record of Survey Map in form satisfactory to the City Engineer covering the entire lot, piece or parcel of land to be divided is filed in triplicate with the City Engineer accompanied by a filing fee of $5.00. (b) The said lot, piece or parcel of land is to be divided into not more than four parcels or lots, and all such parcels or lots abut upon a dedicated and improved public street and comply with all applicable minimum requirements of this City as to size, shape and area. (c) No dedication or improvement for street opening or widening is proposed or required in connection with the division of such lot, piece or parcel of land. (f) The approval of the City Engineer or the Planning Com- mission has been obtained and endorsed upon at least one copy of such Record of Survey Map. " -1- SECTION LI . Section 9306 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 9306. INFORMAL MAP. In those instances where adequate surveys have already been made and recorded and no additional survey is required, the City Engineer may authorize the filing of an informal map in such form as he may prescribe in lieu of a Record of Survey Map, and the said map shall then be treated in all respects as a Record of Survey Map hereunder except that it need not be recorded in the office of the County Recorder. " SECTION 5. The Azusa Municipal Code is hereby amended by the addition thereto of a new Section 9307 reading as follows: "SECTION 9307. CEMETERY LOTS. This Chapter shall not apply to land dedicated for cemetery purposes under the Health and Safety Code of the State . " SECTION 6. The City Clerk shall certify to the passage of this ordinance and shall publish the same as required by law.
