ORDINANCE NO. 667
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AZUSA AMENDING THE AZUSA MUNICIPAL CODE BY THE
ADDITION THERETO OF A NEW SECTION RELATING TO
RESIDENTIAL DEVELOPMENT IN HILLSIDE AREAS.
The City Council of the City of Azusa does ordain as
follows:
SECTION 1. The City Council does hereby find, determine and
declare that the following amendments of the zoning ordinance have been
duly initiated, that notice of hearing thereon has been duly given and
published, that public hearings thereon were duly held by the Planning
Commission and by the City Council and that the public convenience and
necessity and the general welfare require that the following amendments
be made.
SECTION 2. The Azusa Municipal Code is hereby amended by
the addition thereto of a new Section 9208.60 reading as follows:
"SECTION 9208.60. RESIDENTIAL DEVELOPMENT IN HILLSIDE AREAS.
(a) INTENT AND PURPOSE.
It is recognized that when developing residential prop-
erties in hilly terrain, certain standards and regulations normal
to flat terrain do not apply. The purpose of this Chapter is to
set forth property development standards to permit residential
development within the hilly areas of the City and in so doing
to protect the health, safety and general welfare.
(b) DESIGNATED ZONES.
For the purposes of identification the hillside single
family residential zones shall be known as 1R-1-H-10, 000' and
1R-1-H-20,000' and shall be so designated on the Official Zoning
Map.
(c) MINIMUM LOT SIZE.
1. Each lot within the R-1-H-10,000 Zone shall have
a minimum area of not less than 10, 000 square feet and a
minimum width, measured at the building line, of not less
than 80 feet.
2. Each lot within the R-1-H-20,000 Zone shall have
a minimum area of not less than 20,000 square feet and a
minimum width, measured at the building line, of not less
than 90 feet .
(d) SLOPING LOTS, TERRACED LOTS AND USABLE AREA - DEFINED.
For the purpose of this Chapter, Hillside lots shall be
classified into two types: 'sloping lots ' and 'terraced lots ' .
1. Sloping lots shall be defined as residential lots
having a fall from front to rear, rear to front, side to
side or diagonally across the lot of 5% or more over at
least 50% of such lot, and upon which natural grade shall
not have been disturbed over more than 50% of the area of
the lot .
2. Terraced lots shall be defined as residential lots
that have been artificially or mechanically graded over at
least 50% of the area of the lot.

3 . Usable area shall be defined as a relatively
flat area having a slope of less than 5% in any direction.
(e) USABLE AREA - REQUIRED.
Where terraced lots are created, each such lot shall have
the following minimum usable area:
1. In an R-1-H-10,000 Zone, every lot shall have a
minimum usable area of not less than 50% of the area of
the lot or 7,000 square feet, whichever is greater; such
usable area having a minimum depth of not less than 100
feet, and a minimum width, measured at the building line,
of not less than 60 feet .
2 . In an R-1-H-20,000 Zone, every lot shall have a
minimum usable area of not less than 50% of the area of
the lot or 14, 000 square feet, whichever is greater; such
usable area having a minimum depth of not less than 100
feet, and a minimum width, measured at the building line,
of not less than 70 feet .
(f) YARDS.
On lots within the R-1-H-10,000 and R-1-H-20,000 Zones
there shall be established and maintained:
1. Front Yard. Each sloping or terraced lot, as
defined above, shall have a continuous front yard of not
less than 25 feet . Provided, however, that an enclosed
garage whose door openin ,sfor vehicles are placed at, or
approximately at, right angles to the street, may be
located within such front yard but shall not be erected
less than 8 feet from the front property line.
2. Side Yard.
a. Each terraced lot shall have a continuous
side yard on each side of the lot of not less than
5 feet on one side and not less than 10 feet on the
opposite side. The slope of such side yard shall
not exceed 5% in any direction.
b. Each sloping lot shall have a continuous
side yard on each side of the lot of not less than
10 feet.
c . Side yards on the street side of all corner
lots shall be not less than 15 feet.
3. Rear Yard. Each sloping and terraced lot shall
have a continuous rear yard on each lot of not less than 5
feet . Provided, however, that the provisions of Subsections
9808.60 (g), (h), and (i), below, shall apply.
(g) OUTDOOR LIVING SPACE.
1. Terraced Lots.
a. Each terraced lot shall contain at least one
permanent open outdoor living space to the rear of
the building line, and such outdoor living space
shall contain the following minimum areas:

(1) R-1-H-10,000 . . . . 1500 square feet .
(2) R-1-H-20,000 . . . . 2000 square feet.
b . The minimum dimension of such outdoor living
space shall average not less than 20 feet and at its
narrowest dimension shall be not less than 15 feet .
Spaces with a dimension of less than 15 feet shall
not be calculated when determining the required out-
door living space.
c . The gradient or slope of any required outdoor
living space shall not exceed 5% in any direction.
d. Patios, including patio roofs, may be erected
within the required outdoor living space provided
such patios are open on at least two sides. Patios
enclosed with walls, windows, screens or any other
contrivance shall not be considered as open. Swimming,
wading, or fish pools may be constructed within the
required outdoor living space provided such do not
occupy more than 50% of such space.
e . Vehicular driveways when lying to the rear
of the building line shall not be calculated as part
of the required outdoor living space.
2. Sloping Lots.
a. Each sloping lot shall contain permanent open
outdoor living space or spaces to the rear of the
building line and such outdoor living space or spaces
shall contain the following minimum area:
(1) R-1-H-10,000. . . . A total area of 1500 square
feet with each such space containing not
less than 500 square feet .
(2) R-1-H-20,000. . . . A total area of 2,000 square
feet with each such space containing not less
than 500 square feet .
b . The minimum dimension of such outdoor living
spaces shall average not less than 20 feet and at its
narrowest dimension shall be not less than 15 feet .
c . The provisions of Subsections 9208.60 (g)l.c,
d, and e shall apply also to sloping lots.
(h) MINIMUM DISTANCE BETWEEN BUILDINGS AND STRUCTURES AND
THE TOE OR TOP OF SLOPES.
1. No building or structure shall be permitted to be
erected closer to the toe or top of cut or fill slopes than
the distances set forth in the following table:

and toe of slope where slope is side, 10 feet on

c . Between buildings or structures 15 feet unless

2. In addition to these regulations relating to distance
from toe or top of slope, the provisions of this Section regard-
ing minimum lot size, usable area, yards and outdoor living
space shall be complied with.
3. For the purposes of this paragraph, swimming, diving
and fish pools, constructed on the lot, shall be considered
as structures.
(i) RETAINING WAT.T..S
1. Properly designed retaining walls, approved by the
City Engineer, may be permitted to retain portions of front,
side and rear slopes provided that the height of such wall
does not exceed 6 feet . Provided further, that such retaining
walls may be permitted to be located on side and rear property
lines when the vertical distance between adjacent properties
does not exceed 6 feet. Such vertical distance shall be
measured at the property line where such wall is to be located.
A properly designed fence or wall may be constructed on top of
retaining walls located on side and rear property lines pro-
vided that the design and height of such fence or wall is in
conformity with City codes and ordinances governing same.
2. No building or structure shall be located closer than
5 feet from any retaining wall with the exception of retaining
walls that are an integral part of an approved dwelling,
accessory building or any other approved structure.
3. When retaining walls are used to increase the usable
area around buildings and structures, the minimum distance
between such retaining walls and a building or structure shall
be as set forth in Subsection 9208.60 (h) above. "
SECTION 3 . The City Clerk shall certify to the passage of this
ordinance and shall publish the same as required by law.

and placed upon its first reading at a regular meeting of the City Council
on the 20th day of March , 1961. That, thereafter, said ordinance
was duly adopted and passed at a regular meeting of the City Council on
the 3rd day of April , 1961, by the following vote, to-wit:
