AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AZUSA AMENDING SECTION 9230.85 OF THE AZUSA MUNICIPAL
CODE RELATING TO PROCEDURE FOR THE APPROVAL OF PRECISE
PLANS OF DESIGN.
The City Council of the City of Azusa does ordain as
follows:
SECTION 1. The City Council does hereby find, determine
and declare that the following amendment of the zoning ordinance has
been duly initiated, that notice of hearing thereon has been duly
given and published, that public hearings thereon were duly held by
the Planning Commission and by the City Council and that the public
convenience and necessity and the general welfare require that the
following amendment be made.
SECTION 2. Section 9230.85 of the Azusa Municipal Code
is hereby amended to read as follows:
"SECTION 9230.85. PROCEDURE.
Application for approval of a precise plan of design
shall be made in such form as the Planning Commission shall
prescribe. The procedure (but not the grounds) set forth in
Sections 9231.21 through 9231.28 of this Code shall apply to
the processing and approval or rejection of proposed precise
plans of design, subject, however, to the following exceptions:
(a) Upon filing of an application and prior to setting
the same for hearing before the Planning Commission, the
Secretary shall refer it to the City Planner. If the City
Planner determines that none of the grounds for rejection as
set forth in Section 9230.84 exist, he shall endorse his
approval thereon in writing within five days after the date
of filing. His approval may be subject to express written
alterations or conditions if the applicant accepts the same
in writing. Such approval shall be final and terminate the
proceedings; otherwise, it shall be set for hearing before
the Planning Commission.
(b) Notice of hearings need be given only by mail and
only to the applicant and to the owner or owners of the property
subject to the precise plan. Notice may be dispensed with and
the hearing set within ten days or less of the date of filing
if all persons entitled to notice waive the same in writing
filed with the Secretary of the Planning Commission.
(c) The decision of the Planning Commission shall be
final and effective ten days after its written determination
unless within said time a written appeal is filed by applicant
or by any such owner or by action of the City Council or any
member thereof.
(d) A filing fee in the amount of $5.00 shall be paid
at the time of filing the application with the Secretary of
the Planning Commission.
(e) Applicant need not comply with Section 9231.21(a) 3
of the Azusa Municipal Code requiring a list of the names and
addresses of all owners of real property within three hundred
feet of the external boundaries of the property involved. "

SECTION 3 . The City Clerk shall certify to the passage
of this ordinance and shall publish the same as required by law.

introduced and placed upon its first reading at a regular meeting of
the City Council on the 20th day of March , 1961. That, there-
after, said ordinance was duly adopted and passed at a regular meeting
of the City Council on the 3rd day of April , 1961, by the
following vote, to-wit:
