The City Council of the City of Azusa met in regular
session at the above time and place.
Mayor Memmesheimer called the meeting to order and
led in the salute to the flag.
Invocation was given by Rev. R. W. Durnal, of the Invocation
Emanuel ;Baptist Church.

Mayor Memmesheimer asked if there were any corrections

Councilman Johnson stated that on Page 1 relative

Mayor Memmesheimer asked if these were any corrections,
or -omissions to the minutes of December 16, 1957•
Councilman Johnson stated that on Page 20 the third
item relative to the Chamber of Commerce Committee
reviewing lease, that the motion made on November 25th
be stated that "The Council would delay all

Said Resolution No, 3701 was published in the Azusa
Herald and Pomotropic December 26, 1957.

The City Clerk announced that no written protests had
been received in his office up to the time set for
the hearing. The,Mayor asked for any oral protests

The Mayor stated that this is the time and place

Mayor Memmesheimer announced that this was the time
and place set for the hearing on the appeal filed
.by Meljao Industrial Properties Incorporated of
the adverse decision of the Planning Commission of
their application to rezone property owned by them
from R-1 to M-1.
The.City Clerk presented the Affidavit of Publica-
tion of the notice of the proposed change of bounda-
ries which appeared in the Azusa Herald and Pomo-
tropic on December 19, 1957• Also presented was
the list of the names and addressee of property owners
within.300 feet of the affected area to whom notices
of the hearing had been mailed. The Planning Commis-
sion''at the meeting of November 69 1957, and by
Resolution No. 24 of that Commission, disapproved a
change of zone'elassifioation requested by the Meljac
Industrial Properties Incorporated after a public
:hearing:
.On•Nove'mber 18, 1957, Meljac Industrial Properties
Incorporated filed an appeal with the City Clerk on
said decision of'the Planning Commission. The
Planning'Commission filed with the City Council on
December 26, 1957, its report setting forth the
reason for denial of the request of the petition.
The City.Clerk stated that no written objections or
'protests had been received in his office.
Mayor Memmesheimer asked if any persons in the audi-
ence.wished to comment on this petition for rezoning.
Mr. Harold Reed, 181 No, Allen Avenue, Pasadena,
appeared before the City Council and stated that he
favored the change of the R-1 area to M-1 as requested
by the petitioners.
Mr..Ray.Kigma, 440 E. Front Street, Covina, of Meljac
Industrial Properties Incorporated, appeared before
the ,Council and stated his reasons for requesting the
change from R-1 to M-1 of the easterly 50 feet of
their property. It was pointed out by Mr. Klema that
if the 50 foot strip remained in an R-1 zoning it
would create an awkward condition, since this could
be used only for those uses permitted in the residen-
tial 'zone. Mr. Klema requested that this easterly
50 feet•,be permitted to be used for parking in con-
nection'with the Industrial Tract plan for the area.
Mr. Klema stated also that a concrete block wall
would be constructed, dividing the M-1 property from
the adjacent R-1 property.
Mayor-Memmesheimer-asked if there was anyone else
who wished to speak for or against this matter at
thie'time. No one came forward. -
It'was moved by Councilman Romero, that this matter
"be referred back to the Planning Commission for
additional information of Street plans within the
proposed tract. This motion died for lack of a
second.
Fuither'discussion was held on this subject, and in
particular of the following facts: that under the
.old'Ordinance No. 409 the area had been zoned as a
buffer zone and under the new zoning Ordinance no
'consideration had been taken of defined property
lines in rezoning this 50 foot strip to R-1; that,
as now stated, no buildings could be erected on the
easterly 100 feet of the lots, and -if rezoned,
conditions,00uld be placed on the property so that
the easterly 50 feet could be used only for parking.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett that the City Council uphold the appeal and
that the City Council authorize the City Attorney to
prepare an Ordinance amending Ordinance No. 535 to

,Russ.Davis Ford submitted an amended bid on January
6th`, due -.to the fact that he had included a larger
size tire than was called for in the specifications
-when -submitting the original bid. The amended bid
of Russ Davis Ford totaled 04766.00 plus tax.
It was recommended that the original low bid of
Norman King Dodge be accepted.
Moved by•Counoilman Ortuno„ seconded by Councilman
,Fawcett that the recommendation be accepted for the
purchase'of the two dump trucks from Norman King
Dodge and that the bid bonds and checks be returned
to the unsuocessful bidders. This motion carried
unanimously.

On December 18, 1957, a petition was filed in the
office of the City Clerk by owners of property in
the immediate vicinity appealing the decision of
the -Azusa Planning Commission pertaining to the
variance granted to Lot 6, Tract 14540,
On January 49 19589 a letter was received from
Marian B. Shay, petitioner for the conditional
use permit and variance, notifying the City that
she no longer had interest in acquiring the proper-
ty in question.
Moved'by Councilman Ortuno, seconded by Councilman
Romero, that Mrs. Shay's letter be -filed and that
no further action be taken by the City Council on
the petition for variance.

that a crosswalk be painted on Orange Avenue crosswalk
opposite Hollyvale Street leading to the Recreation auth on Orange

Moved by Councilman Fawcett, seconded by Councilman
Romero and unanimously carried that the Public Works
Dept. be authorized to paint the crosswalk as reoom-
mended.
A letter was received from Mrs. Frances Bodeau Tree removal
requesting that a tree in front on the property at policy
415 E. Foothill Blvd* be removed as it creates an reaffirmed
inconvenience to persons entering and leaving this
property.

Romero that the Park and Recreation Commission be
notified that the policy established by the City
sets forth that the City will remove trees that hre
hazardous or diseased, but that healthy trees can be
be.removed by property owners at their expense with
approval of the Commission. This motion carried
unanimously.
.It was suggested that the writer of the letter be
informed,of the City Policy.
Notice was received on the Annual California and
.Pacifio'Southwest Recreation Conference to be held
in Fresno February 16-19, 1958. Mr. Pacifico has
been appointed Chairman of the Proceedings Committee
for this Conference. It is requested that the
Council make a determination of who shall attend
-this Conference.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno, that Mr. Pacifioo and one member of the
-Park and Recreation Commission be authorized to
attend this Conference and that an advance allowance
of $150.00 each be granted. Thi's motion carried
unanimously.
The Gladstone School District Board of Trustees
--.proposed to have annexed to the City of Azusa the
school site described as Tract 23546, located at
the'southeast corner of Citrus Avenue and Gladstone
Street, approximately 17.198 acres. This annexation
would be in accord with Section 35201 at seq. of the
Government Code.
r It was pointed out that the Edison Company had been
'requested to furnish a statement of the amount expend-
ed so far in this project. This amount is expected
.to be nominal.

lighting project.

the improvements required on their half of Russell
Street,,`at the same time, or before, the adjoining
subdivision is improved.
It was the opinion of the City's representative that
.,this price for the property was fair to all concerned.

Ortuno that the Cit enter into escrow for the
acquisition of the 4.93 acres under consideration
and the,seller furnish the title of insurance and
that other escrow fees be borne in the usual manner.

0415.55. Davis submitted a proposal of 0513.42# or
if a,modern Low Boy pump was desired, an additional
change of $125.00 plus sales tax would be made.
Discussion was held relative to the two bids submitted.
Moved by Councilman Romero, seconded by Councilman
Fawcett that the proposal of Ray Davis be accepted
with the' modern Low Boy pump to be supplied. This
motion carried unanimously.
It'was requested by the Azusa Coordinating Council
that Mrs. Alma Abel be authorized to attend the
Governor's Conference on Youth in Sacramento,
February -11, 12, 1958•
Moved'by Councilman Romero, seconded by Councilman
Fawcett that Mrs. Abel be authorized to attend the
Conference and the $100.00 advance expense allowance
be granted. This motion carried unanimously.

It was again brought to the attention of the City
Council that the air conditioning and cooling
,system installed by R. E. Manns Co. and engineered
by-Hinkstrom-Norcross Co. was still giving unsat-
isfactory performance. It is recommended that
consideration be given of instituting legal action
'in order to make the Companies comply with the
contract.
-Moved by Councilman Romero, seconded by Councilman
Ortuno, and unanimously carried that this matter be
,referred to the City Attorney for appropriate action.
,The -City Council having authorized overtime work
for the,Engineering Department, clarification should
be -made as to whether the City Engineer would be
entitled,to overtime pay.
