Mayor Memmesheimer called the meeting to order and led in the salute to the flag. Invocation was given by Rev. R. W. Durnal, of the Invocation Emanuel ;Baptist Church. Present•at Roll Call: Councilmen: Fawcett, Ortuno Roll Call Johnson, Memmesheimer Absent: Councilman Romero .Also Present: City Attorney Williams, City Engineer Kirkgaard, Supt. of Light & Water Dept. Smith, and City Clerk -Administrative Officer Miller Mayor Memmesheimer asked if there were any corrections �or ommissions to the minutes of December 2, 1957- Approval of Councilman Johnson stated that on Page 1 relative Minutes - to the appropriation of North§ide Park Plan, the 12-2-57 & motion should read "the plan be approved for the 12-16-57 westerly part of the park." On -Page 89 the spelling and classification should be "Mr. Dynes, Field Representative for Supervisor Legg-" With no further corrections, the minutes ordered approved as corrected. Mayor Memmesheimer asked if these were any corrections, or -omissions to the minutes of December 16, 1957• Councilman Johnson stated that on Page 20 the third item relative to the Chamber of Commerce Committee reviewing lease, that the motion made on November 25th be stated that "The Council would delay all .should action on the lease until the report of the Chamber of Commerce Committee had been submitted." On Page 40 relative to Odie Burton termination that mploy- after the work "that" insert the words "the employ- ment!'-. ment:'-. On Page 60 the second sentence of item 5, the word "would" should have been "could". With no further corrections, the minutes were ordered approved. Councilman Romero entered the meeting at 7::45 P.M. No- 3704 of the City of Azusa, California, describing certain proposed changes in the work and proceedings under Resolution of Intention, Resolution No. 3653; de- claring`its intention to order said proposed changes and fixing time and place for hearing objections to said proposed changes and giving notice thereof. Said Resolution No, 3701 was published in the Azusa Herald and Pomotropic December 26, 1957. Moved by,Councilman Ortuno, seconded by Councilman Fawcett and ordered carried that the-Affadavit of Publication for Resolution N0,3701 be filed. The City Clerk announced that no written protests had been received in his office up to the time set for the hearing. The,Mayor asked for any oral protests or any other persons. -,desiring to be heard- None appeared before the -;Council to be heard. This Resolution was published December 5, 12, 1957, in .the"Azusa Herald and Pomotropio and in the Los Angeles Daily Journal. Moved by Councilman Romero, seconded by Councilman Ortuno that further reading of this Ordinance be waived. With no objections, motion ordered carried. The Mayor stated that this is the time and place -set by Resolution No. 3687 for hearing any objections or protests of the proposed designated Southerly Annexation'Distriot No. 28. 'The City Clerk presented the Affidavit of Publication o£.Resolution No. 3687 setting January 6th, the hour of 800 -P.M, in the Council Chambers of the City Hall, as the time and place of hearing objections. This Resolution was published December 5, 120 1957, in the Azusa Herald and Pomotropic and in the Los Angeles Daily Journal. No. 28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEX ATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED SOUTHERLY ANNEXATION DISTRICT N0, 28 TO THE CITY OF AZUSA. CITY HALL AZUSA, CALIFORNIA MONDAY JANUARY 6, 1958 Moved by-Couhoilman Fawcett, seconded by Council- man'•Ortuno that further reading of this Ordinance be waived. Mayor Memmesheimer announced that this was the time and place set for the hearing on the appeal filed .by Meljao Industrial Properties Incorporated of the adverse decision of the Planning Commission of their application to rezone property owned by them from R-1 to M-1. The.City Clerk presented the Affidavit of Publica- tion of the notice of the proposed change of bounda- ries which appeared in the Azusa Herald and Pomo- tropic on December 19, 1957• Also presented was the list of the names and addressee of property owners within.300 feet of the affected area to whom notices of the hearing had been mailed. The Planning Commis- sion''at the meeting of November 69 1957, and by Resolution No. 24 of that Commission, disapproved a change of zone'elassifioation requested by the Meljac Industrial Properties Incorporated after a public :hearing: .On•Nove'mber 18, 1957, Meljac Industrial Properties Incorporated filed an appeal with the City Clerk on said decision of'the Planning Commission. The Planning'Commission filed with the City Council on December 26, 1957, its report setting forth the reason for denial of the request of the petition. The City.Clerk stated that no written objections or 'protests had been received in his office. Mayor Memmesheimer asked if any persons in the audi- ence.wished to comment on this petition for rezoning. Mr. Harold Reed, 181 No, Allen Avenue, Pasadena, appeared before the City Council and stated that he favored the change of the R-1 area to M-1 as requested by the petitioners. Mr..Ray.Kigma, 440 E. Front Street, Covina, of Meljac Industrial Properties Incorporated, appeared before the ,Council and stated his reasons for requesting the change from R-1 to M-1 of the easterly 50 feet of their property. It was pointed out by Mr. Klema that if the 50 foot strip remained in an R-1 zoning it would create an awkward condition, since this could be used only for those uses permitted in the residen- tial 'zone. Mr. Klema requested that this easterly 50 feet•,be permitted to be used for parking in con- nection'with the Industrial Tract plan for the area. Mr. Klema stated also that a concrete block wall would be constructed, dividing the M-1 property from the adjacent R-1 property. Mayor-Memmesheimer-asked if there was anyone else who wished to speak for or against this matter at thie'time. No one came forward. - It'was moved by Councilman Romero, that this matter "be referred back to the Planning Commission for additional information of Street plans within the proposed tract. This motion died for lack of a second. Fuither'discussion was held on this subject, and in particular of the following facts: that under the .old'Ordinance No. 409 the area had been zoned as a buffer zone and under the new zoning Ordinance no 'consideration had been taken of defined property lines in rezoning this 50 foot strip to R-1; that, as now stated, no buildings could be erected on the easterly 100 feet of the lots, and -if rezoned, conditions,00uld be placed on the property so that the easterly 50 feet could be used only for parking. Moved by Councilman Ortuno, seconded by Councilman Fawcett that the City Council uphold the appeal and that the City Council authorize the City Attorney to prepare an Ordinance amending Ordinance No. 535 to include the area described in the description by the Page 3 141 Zone change as approved requested by Meljac In- dustrial Properties, Inc. Harvester 5548.44 - 375.00 5173.44 Plus tax Bid bond or check were submitted with each bid as ,required. ,Russ.Davis Ford submitted an amended bid on January 6th`, due -.to the fact that he had included a larger size tire than was called for in the specifications -when -submitting the original bid. The amended bid of Russ Davis Ford totaled 04766.00 plus tax. It was recommended that the original low bid of Norman King Dodge be accepted. Moved by•Counoilman Ortuno„ seconded by Councilman ,Fawcett that the recommendation be accepted for the purchase'of the two dump trucks from Norman King Dodge and that the bid bonds and checks be returned to the unsuocessful bidders. This motion carried unanimously. On Friday, December 27, 1957, at 10:00 A.M. bids Animal: Shelter were opened in the officefof the City Clerk in bids rejected answer to the notice inviting bids for the con- struction of an animal shelter for the City of Azusa: Present at the opening of bids were Councilman Fawcett and Ortuno, City Engineer Kirkgaard, Chief of Police Kendrick, and the City Clerk: The'City Clerk presented the Affidavit of Publica- tion of the notice inviting bids which appeared in 'the"Azusa Herald and Pomotropic on December 23, 1957. No. 3705 - entitled: Building Animal Shelter by Day A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF Labor AZUSA DECLARING THAT A PROJECT FOR THE CONSTRUCTION OF AN ANIMAL SHELTER CAN BE PERFORMED MORE ECONOMI- CALLY BY DAY LABOR AND ORDERING THE PROJECT DONE IN .THAT MANNER. Moved by Oouncilman Romero, seconded by Councilman Fawcett that further reading of this Resolution be waived.- With no objections, motion ordered carried. At'the meeting of December 4, 1957s the Azusa Varianoe Planning Commission by Resolution No. 28 granted petition of a,00nditional use permit and variance to permit M. Shay the construction of a dwelling of less area than dropped required in the R-lA zone, more particularly described as Lot 6, Tract 14540• On December 18, 1957, a petition was filed in the office of the City Clerk by owners of property in the immediate vicinity appealing the decision of the -Azusa Planning Commission pertaining to the variance granted to Lot 6, Tract 14540, On January 49 19589 a letter was received from Marian B. Shay, petitioner for the conditional use permit and variance, notifying the City that she no longer had interest in acquiring the proper- ty in question. Moved'by Councilman Ortuno, seconded by Councilman Romero, that Mrs. Shay's letter be -filed and that no further action be taken by the City Council on the petition for variance. The Administrative Officer stated that he was Action on informed that the Park and Recreation Commission bath house at''iheir last meeting had recommended that the tabled proposed renovation of the bath house not be considered at this time due to the high cost. It was suggested by the Commission that this money be applied against a new bath house to be constructed at the west end of the pool. Moved by Councilman Johnson, seconded by Councilman ,Romero•that further action on this matter be tabled until official minutes of the Commission have been received. This motion carried unanimously. The.Park and Recreation Commission recommended Pedestrian that a crosswalk be painted on Orange Avenue crosswalk opposite Hollyvale Street leading to the Recreation auth on Orange Building. at Hollyvale Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the Public Works Dept. be authorized to paint the crosswalk as reoom- mended. A letter was received from Mrs. Frances Bodeau Tree removal requesting that a tree in front on the property at policy 415 E. Foothill Blvd* be removed as it creates an reaffirmed inconvenience to persons entering and leaving this property. _'14f CITY BALL AZUSA, CALIFORNIA MONDAY JANUARY 6, 1958 Page 6 147 .Moved by Councilman Fawcett, seconded by Councilman Romero that the Park and Recreation Commission be notified that the policy established by the City sets forth that the City will remove trees that hre hazardous or diseased, but that healthy trees can be be.removed by property owners at their expense with approval of the Commission. This motion carried unanimously. .It was suggested that the writer of the letter be informed,of the City Policy. Notice was received on the Annual California and .Pacifio'Southwest Recreation Conference to be held in Fresno February 16-19, 1958. Mr. Pacifico has been appointed Chairman of the Proceedings Committee for this Conference. It is requested that the Council make a determination of who shall attend -this Conference. Moved by Councilman Fawcett, seconded by Councilman Ortuno, that Mr. Pacifioo and one member of the -Park and Recreation Commission be authorized to attend this Conference and that an advance allowance of $150.00 each be granted. The Gladstone School District Board of Trustees --.proposed to have annexed to the City of Azusa the school site described as Tract 23546, located at the'southeast corner of Citrus Avenue and Gladstone Street, approximately 17.198 acres. This annexation would be in accord with Section 35201 at seq. of the Government Code. r It was pointed out that the Edison Company had been 'requested to furnish a statement of the amount expend- ed so far in this project. This amount is expected .to be nominal. Moved'by Councilman Ortuno, seconded by Councilman Fawcett that the City Attorney be instructed to -prepare the necessary Resolution to be submitted to the Board of Supervisors initiating the annexation proceedings. Haltern Street, appeared before the Council and requested that those areas annexed 'to the City be considered in the street lighting project. Moved by Councilman Fawcett, seconded by Councilman Ortuno�that since about 909 of the City-wide light- ing project has been completed, Res. No. 3058 be amended to allow the street lighting program to include -those areas within the City as of January 1, 1958. The City Attorney reported that upon communicating Joint letter with the City Attorneys of Anaheim and Riverside, to P.P.C. At was the general opinion that a letter should not deferred be submitted to the F.P.C. setting forth the oppo- site view from that forwarded by the City of Colton relative to the rate increase granted the Edison Company by the California P. U. C'. It was felt that no action should be taken until a definite course is indicated. The City -Attorney stated that a Resolution had been prepared designating taxation districts for the fiscal year 1958-59. District No. 2 would comprise those areas annexed to -the City since 1918. Braun on Friday, January 39 1958, for the purpose of nego- tiating the purchase of a Park site on the east side.,of Pasadena Avenue north of Gladstone St. Mr- Walker has submitted a proposed'price of $36,725, with the understanding that the City will pay for the improvements required on their half of Russell Street,,`at the same time, or before, the adjoining subdivision is improved. It was the opinion of the City's representative that .,this price for the property was fair to all concerned. Davis submitted a proposal of 0513.42# or if a,modern Low Boy pump was desired, an additional change of $125.00 plus sales tax would be made. Discussion was held relative to the two bids submitted.
