The City Council of the City of Azusa met in regular
session at the above time and place.
Mayor Memmesheimer called the meeting to order and led
in the salute to the flag.
Invocation was given by Rev. Ben Paroulek, pastor ct
the -:First Presbyterian Church.
Present at Roll Call: Councilmen: Fawcett, Ortuno,
Johnson, Romero, Memmesheimer
Absents Councilmen: None
Also present: City Attorney Williams; Supt. of Light
& Water Smith, Supt. of P. W. Brusnahan, City
Engineer Kirkgaard, Fire Chief Madison, and
City Clerk -Administrative Officer Miller
Mayor._Memmesheimer asked if there were any corrections
or.ommissions to the minutes of March 3, 1958.
Councilman -Johnson stated that on Page 1, regarding
property annexation, the mane of Attorney Snidow 4:_
should be shown as Attorney H. A. Snidow, rather
than A. L. Snidow, in two separate paragraphs.
On Page 3, first paragraph, the strip of land to be
.acquired by the State should be described as 10! x
1001. 'With no further corrections, the minutes stood
,ppproved as corrected.
The Council was notified that on March 7, 1958s at
10:00 A.M.'in the office of the City Clerk in answer
to -Notice Inviting Bids for the Paramount Ave. im-
provement project (State Gas Tax Project #39D a 39E
City Prgjeot 162). Bids were opened in the presence
of Councilman Fawcett, City Engineer Kirkgaard and
City Clerk Miller. Bids received were as follows:

be returned. This motion carried by the following

On Tuesday, March 119_1958, at 10:00-A.M. bids were
opened in the Office of the City Clerk in answer to
Notice Inviting Bids for the construction of a Library
Building. Present at the bid opening were: Council-
man Ortuno and Councilman Romero, City Engineer Kirk-
gaard, Architect Parker, Librarian Alexander, Library
Board member Snyder, and the City Clerk. The bidders
and net bids, which include all items requested, such
as community room, driveway, electrical vault.' and
travertine are as follows:

Submitted with each bid was a Bidders Bond in the
amount of 10% of the bid. A report was given as
to the financial responsibility of the low bidder:
Moved by -Councilman Johnson, seconded by Councilman
'Ortuno that the.contract be awarded to Herman
Rempel, including all alternates, contingent upon
furnishing of the necessary bonds, and that the bonds
of the unsuccessful bidders be returned. This motion
carried unanimously.
At.this time, Councilman Johnson brought up the
subject of a new reservoir for the City.
Moved by Councilman Johnson, seconded by Councilman
Ortuno and unanimously carried that the City Engineer
be -instructed to start planning for a new reservoir
and appurtenances.
Authorization was requested to make arrangements for
the'removal of trees on the library site, in order
that they will be removed by the time construction
is to begin.
Moved by Councilman Romero, seconded by Councilman
Ortuno and ordered carried that the City Administrator
be authorized to make the necessary arrangements for
-the removal of trees at the library site.
%he Administrative Officer stated that the owners of
Lot 13, Block 31 had offered to sell this property
to the City for KOOO.00 with the City to bear all
escrow costs. This lot is between the two parcels
now owned by the City. .
Moved by -Councilman Fawcett, seconded by Councilman
Orturio,that the City purchase the designated property
on Dalton Avenue at the price of $8,000.00 plus escrow
fees,land.the Administrative Officer take whatever
steps are necessary to proceed with the purchase of

A cashiers check in the amount of 109 of the.bid was
submitted by Russ Davis Ford. No bid bonds or checks
accompanied the other bids.
A'letter was received from the Chief of Police request-
irig'that'the low bid of Russ Davis Ford on the Fairlane
Model be accepted, as the Fairlanes.would have a
greater trade-in value than the lower priced Custon 300.
Moved by Councilman Fawcett, seconded by Councilman
Romero that the suggestion of the Chief of Police.be
accepted and the City Administrator be authorized to
award the bid of Russ Davis Ford Co. on the Fairlane
Ford's. This motion carried by the following vote:

opened in the Office of the City Clerk for the labor:on
installing street light standards in answer to Notice
Inviting Bids. Present at opening were: Councilman
Fawcett, -City Engineer Kirkgaard, Supt. of Light &
.Water -Smith, and City Clerk Miller. Bids and bid bonds
for 10%.of the bid were received from all bidders, ex-
cept the City of Azusa Light & Water Dept. Bids reg

The City,Engineer and Supt. of Light & Water recommended
that -the bids be rejected and that the Light & Water
Department do the work.
Councilman Johnson asked that the City Attorney deter-
mine if Sections 4000-4007 of the Government Code were
applicable in this case, and in particular the require-
ments.to be met by the City Engineer.
Moved by Councilman Johnson, seconded by Councilman
Ortuno and unanimously carried that the matter be
tabled until the next meeting for a report from the
City Attorney.
Moved by Councilman Ortuno, seconded by Councilman
Romero, and unanimously carried that the City Attorney
be,authorized to prepare a Resolution in the event
bids.are,rejected.
At this time, Almo Landi of 5920 N. Ranburn appeared
before the Council to inquire how soon Street lights
would-be installed in their tract. Mr. Landi was ad-
vised that they would probably have,lighting within
60 to 90' days.

The Planning Commission sent notification to the Council Alpha Beta
that.the date for hearing on the zone change of Alpha parking lot
Beta'parking lot from "P" to "C-3" had been reset to hearing date
March 19, 1958. reset to 3-19
The Planning Commission also notified the Council that Public hear -
the, date of April 16, 19589 at 7:30'P.M, has been set ing on Free -
as the.time for the public hearing on the proposed way 4-16-58
Foothill Freeway alignment.
The Planning Commission at their last meeting con-
sidered the situation that has arisen on the property
located on the -northwest corner of Gladstone Street
and', -Louise Avenue, owned by Mr. and Mrs. Fred Mexia.
The' Mexias had previously obtained a zone change from
°R-1V,to'"C-2" after stating that they wished to so-
tablish e_beauty shop and patio furniture store on
this property. However, they now state that they wish
to'sell,the rear 80 feet of the property to Mr. Donald
Zak, who plans to erect a building and establish a
"neighborhood" bar.
Application has been made to the Alcoholic Beverage
Control by Mr. Zak for an On -Sale beer license at 719
14Gladstone Street with July 1, 1958, as the estimated
time that the premises would be ready.

Chief.Kendrick protested issuance of the license "On
the grounds that to do so would aggravate an already
existing police problem!.
-Moved by 6ouncilman Fawcett, seconded by Councilman
Romero and ordered carried that the Administrative
Officer be authorized to send a letter to the Depart-
ment of Alcoholic Beverage Control,,advising them that
the City wishes to protest issuance of the license on
the, grounds that a possible police problem would be
created, and requesting that if a hearing is to be
held,,it be held in Azusa.
The Superintendent of Light and Water requested
permission to sell two -tons of scrap iron junk and
two -tons of scrap.copper junk.
Moved by Councilman Ortuno, seconded by Councilman
Romero,.and unanimously carried that the Supt. of
'Light and Water and the Administrative Officer be
granted permission to dispose of the scrap metal and
to -accept -the beat price offer.
Authorization was also requested by the Light and
Water Dept. to contract with the Pittsburgh Tank and
Tower Company to descale and paint the interior and
exterior of the 100,000 gallon elevated water tank
at,a price of approximately $965.00. According to
the' Supt. of Light and Water, no estimate can be made
at•this time of repairs needed to the interior of the
tank;`but they should be slight. The repair charge
made.by the Company for welding seams is $2.65 per
lineal foot, and for fill -welding pitssis $.55 each.
The costs of repairs will be known upon inspection
after the tank is drained.

the signing of the contract with the Pittsburgh Tank

A,request was received from the County Fire Protection
for fire"hydrant service outside the City limits on
Gladstone Street east of Irwindale Avenue. A proposed
agreement was submitted by the Fire Protection District
agreeing to furnish the fire hydrants and labor for
Installation and to pay a monthly charge of $1.00 per
hydrant. The water is to be used only for fire fight-

minutes,per week.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and ordered carried that the matter be tabled
until.the next meeting for further study by the City
Attorney, Administrative Officer, Supt. of Light and
Water, and the Fire Chief.
A_request was received from the developers of Tract
21808 to omit the concrete curbs and sidewalks on
Peckham Road extending south from First Street, and
to substitute asphaltic concrete extending to the
Property line.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and unanimously carried that permission be
granted to omit concrete curbing and concrete side-
walks in Tract 21808 along Peckham Road, and that
permission be granted to substitute asphaltic concrete
to the property line with the depth of the concrete to
be no less than 2 inches.
Authorization was requested by the Street Department
to purchase a three yard street sweeper at an ap-
proximate cost of $11,000.00, as the sweeper now in
use is ten years old.
Moved by Counoimman Ortuno, seconded by Councilman
Romero and ordered carried that the Supt. of Public
Works, Chairman of Public Works and the Administrative
Officer be authorized to obtain proposals on a 3 yard
street sweeper and present the proposals to Council.
A request was received by the Public Works Dept. to
authorize the -Personnel Board to hold an examination
for'Maintenance Man I.
Moved by'Counoilman Ortuno, seconded by Councilman
Romero and ordered carried that inasmuch as there
are two men on the eligibility list at this time,
the request for a new examination be denied.

Ortuno that permission be granted to employ the top
man on the current eligibility list for Maintenance

Councilman Romero brought up the question of furnish-
ing trees to residents in areas where curbs and side-
walks have recently been installed. He was advised,
.however, that in other areas the trees have been fur-
nished at cost by the Junior Chamber of Commerce, but
have been paid for by the home owners, and that it
would be'impossible to do differently at this time.
Moved•by Councilman Romero, seconded by Councilman
Fawoett•-and ordered carried that the Supt. of Public
'Works be authorized to investigate the streets which
hive,recently had curbs, gutters and sidewalks In -
.'stalled with the possibility of selling trees at
.cost to home owners in those areas, and to report
back to'Counoil.
A request was received from Fire Chief Madison for
permission to hold the annual'Spring Clean Up Week
between May 17 and 7:00 A.M. May 26, and necessary
expenditures be allowed for this project.
Chief Madison also requested that the committee for
making arrangements for this campaign be composed of
the following: Mayor Memmesheimer, Police Chief
Kendrick, Public Works Chairman, Public Works Supt.

Romero.and ordered carried that the.City Attorney be
authorized to sign the Cancellation of erroneous as-
sessmeni of taxes, Authority No. 1263 and No- 3427.
The matter of the General Telephone Company claim
•was.lagain brought before Council. The Council was
notified that three representatives of the Telephone
Company met with the City Engineer,,City Attorney,
and the,Administrative Officer to discuss the claims
for ,damages done to the conduit on November 5. 69 79
1957 in the vicinity of Azusa Avenue and'Gladstone
Street when water lines were being installed by the
City. After discussion of the claims, it was agreed
that the City might have been responsible for one break
in the conduit on Gladstone Street and possibly both
parties at fault through misunderstandings on the other
breaks.- Since the amount of the claims were relatively
small,' and to save court costs, an agreement was made
whereby.the City would pay one-half the total price of
'$he claims.
.'Moved by Councilman Fawcett, seoonded'by Councilman
Romero and ordered carried that the City settle the
claims with the Telephone Company for 50% of the bill
sent to the City.
It had previously been recommended by the'Council
that the Zoning Ordinance be amended by creating a
new zone which would allow Professional offices in
an "R-1" zone, probably a "Residential -Professional"
zone. However, after discussion by the City Attorney,
City Engineer, and Administrative Officer, it was felt
that it would be advisable to amend Section 9208.10,
paragraph e, of the Zoning Ordinance No. 535 to include
professional offices in an "R-1" zone after a public

Officer be authorized to advise the Planning Commission
that the Council is in accordance with altering Section
9208.10,'paragraph e, of the "R-1"zoning to include the
professional offices, and in addition that the section
referring to the size of signs be amended to conform.

A new Resolution was presented re: Annexation of the
Gladstone School District property located at Gladstone
Street and Citrus Avenue. At the time the previous
Resolution No. 3710, was adopted, the Tract, as de-
scribediin the petition, had not been recorded in the
Office of the County Recorder, and the Board of Super-
visors has requested a new Resolutibn..be submitted con-
taining the legal description approved by the Boundary
Commission.
Councilman Ortuno offered the following Resolution

Mr. Henry Dominguez of 238 No. Pasadena Avenue,
appeared before the Council to state that he would
be,willing to dedicate one-half of Third Street, and
that if the City paves the street, he would agree to
install his own curbs, gutters and sidewalks. The
City Council has agreed to accept the dedication, and
the necessary papers are to be drawn up for signing.

Moved by Councilman Fawcett, seconded by Councilman
Romero,.and unanimously carried that the City Engineer
be authorized to have the plans and specs for the
North Loren Avenue project ready for presentation at
the next Council meeting whether or not the dedication
for the*rest of the Avenue has been obtained.
The Treasurer's Financial Statement as of February 28, Treasurer's
1958, was presented to Council. The report shows a Report filed
bank balance of $513,618.54 Treasury Bills $400,000.00,
earnings on Treasury Bills $25,390.25, or a total of
$939,008.79•
Moved by Councilman Ortuno, seconded by Councilman
Romero and ordered carried that the report be filed.

Mr. S. E. Eddy, Electrical Engineer for the Library
Building, suggested that a letter be addressed to the
Electrical Inspector of the Building and Safety Div-
ision requesting Modification of the Building Ordin-
ance in order that the installation of fixtures for
the flourescent lamps on the Library building can be
made.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett and unanimously carried that the Administrative
Officer be authorized to sign a letter to the Electrical
Inspector of the Building and Safety Division requesting
modification in the wiring in the Library building.
Two Proclamations were presented for the Mayor's
signature: the first Proclaiming the month of
March 6 through April 6, Easter Sunday, as Easter
Seal Month; the second Proclaiming the week of
March 24 through March 29 as Community Concert Week.
Moved by Councilman Johnson, seconded by Councilman
Romero and ordered carried that the Mayor be author-
ized to sign the Proclamations for Easter Seal Month
and Community Concert Week.
A- request was received from J. B. Dauer of San Gabriel,
California, for permission to locate a permanent
"Kiddieland" on the lot adjacent to Thelma's Cafe at
976 -W. -Foothill Blvd.
Moved by Councilman Romero, seconded by Councilman
Ortuno and ordered carried that the matter be referred
to the Chief of Police to investigate and report to
.Council.
A -request was received by the San Gabriel Valley
Kennel Club for permission to hold their annual Dog
Show in Memorial Park on April 20, 1958. This Show
has been held at the Civic Center Park in previous
years, but the change was requested due to the con-
struction work on the Library building.
Moved,by Councilman Romero, seconded by Councilman
Fawcett and unanimously carried that permission be
granted to hold the Kennel Club Dog Show at Memorial
Park, and that the matter be handled under the same
conditions as in previous years.
A letter was presented from the Foothill School
officials requesting that a 4 way stop sign be
erected at the intersection of E. Haltern Street
and N. Fenimore Avenue. It was suggested by the
Chief of Police and Administrative Officer that a
stop sign also be placed at the intersection of
Fenimore•Avenue and Gladstone Street, subject to
approval and recommendation of the City Engineer.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and ordered carried that the matter be tabled
until the next meeting for a report By the City
Engineer'.
The Azusa City Employees Association requested
permission for one member of their Association to
attend the Santa Barbara Meeting of the California
League of City Employees Associations, to be held
April'll, 12, and 13, 1958. They request that the
employee be permitted to attend without loss of pay
for`'April 11th, and other expenses will be borne by
the Association.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and ordered carried that the request of the
Employees Association be granted allowing one member
of the Association to attend the Santa Barbara Cpn-
`ference in April with no pay loss.

A request was received from the League of California
Cities that they receive written permission from the
City to=use and publish any data they can obtain from
the National Board of Fire Underwriters relative to
fire grading.
Moved by Councilman Romero, seconded by Councilman
Ortuao and ordered carried that the Administrative
Officer give written consent to the League of Calif-
ornia Cities to use any data released by the Nat'l
Board of Fire Underwriters.
A -request was received that a budget of $100.00 for
the balance of this year be set up for the Mayor's
'Safety Committee. In the past, members of the Com-
mittee have frequently had to buy trophies, etc.
With their own cash.
Moved by Councilman Romero, seconded by Councilman
Fawcett that the request be granted for a $100.00
budget to be set up for the Mayor's Safety Committee.
This motion carried unanimously.
Authorization was requested for permission to proceed
with study and obtaining proposals for tabulating
equipment for City Accounting. This would be I.B.M.
and similar companies, who make and lease tabulating
equipment:
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and unanimously carried that the Administrative
Officer be authorized to check further on the matter of
tabulating equipment, including Electro Data, and that
the proposals and costs be presented to Council.
-Mayor Memmesheimer requested instructions from the
Council re: Van Tassel Canyon for presentation to
the Sanitation District.
Moved,,by Councilman Johnson that this matter be
tabled until April Fool's Day, 1968. This motion
died for lack of a second.
The�City Attorney read a letter from Mr. Robert
Hastings, Attorney for Frank Hixon, reminding the
City and the County Sanitation District that Mr.
Hixon's,option expires on April 21st of this year.
Mr. Hastings further suggested that, based on the
Sanitation District report, and in order to save
time and money, either the District or the City
advise him of their continued interest in Van Tassel
Canyon.
Moved by. Councilman Fawcett, seconded by Councilman
Ortuno that in view of the County Sanitation District's
report, the proposed lease with Frank Hixon in Van
Tassel -Canyon be abandoned, and that the City Attorney
be instructed to negotiate with the Hixons and the
County Sanitation District along the lines and within
the confines of the County Sanitation District Report.

Azusa Agricultural Water Company advising them that at
the January 20th meeting of the Board of Directors,
Clarence H. Fawcett, as representative of the City of
.Azusa, was elected Vice -President of the Board of
Directors.

the report notifying them that Councilman Fawcett
was elected Vice -President of the Azusa Agricultural
Water Company Board of Directors.
The Administrative Officer requested that the City City Atty. to
