Mayor Memmesheimer called the meeting to order and led in the salute to the flag. Invocation was -given by Rev. Ray Durnal of the Emanuel Invocation Baptist Church. Present at Roll Call: Councilmen: Fawcett, Ortuno, Roll Call Johnson, Teasley, Memmeshelmer. 'Also Present: City Attorney Williams, Supt. of Light and Water Smith, Supt. of Public Works Brusnahan, City Engineer Kirkgaard, Fire Chief Madison, and City Clerk -Adminis- trative Officer Miller Mayor-Memmesheimer asked if there were any corrections Approval of or'omissions to the minutes of April 15, 1958. With no Minutes 4-15-58 corrections, the minutes were approved as written. and 4-21-58 Mayor'Memmesheimer asked if there were any corrections or omissions to the minutes of April 21 1958. Councilman Johnson stated that on Page 4, paragraph 1 should read "decorative masonry screening in front of the'Public Works Building". On Page 5, item 3, Councilman Johnson stated that the resignation of Margarite Boyer should be effective :May 31, 1958. With -no further corrections, the minutes were approved as 'corrected. onFriday, May 2, 1958, bids on the North Loren Avenue Sewer project sewer -project ##206 were opened in the office of the bid awarded to City Clerk in answer to Notice Inviting Bids published M. D. Burke in the Azusa Herald and Pomotropic on April 17 and 24, 1958.• Bids were opened in the presence of the City Engineer, Councilman Fawcett, Councilman Teasley, and Mrs. Marilyn Torrey, in the absence of the City Clerk. I_.' � .� ;3r. _307 CITY HALL AZUSA, CALIFORNIA MONDAY, MAY 5, 1958 Page 2 Council` was notified that Mr. Jens Solem had been Planning Comm. elected Chairman to the Planning Commission and that officers electe< Mr. Stephen Paul was appointed Vice -Chairman. It was determined that in accordance with the Government Code the.Vice-Chairman was to be elected, rather than ap- pointed, and the Planning Commission is to be asked to make this correction. The hour of 8:00 P.M. was set for public hearing on the proposed rezoning of Lots 17 and 18, Block 29, Map of.Azusa (Alpha Beta Parking Lot) from "P" to "C-3". The City Clerk announced that he had received no written protests. Mayor Memmesheimer asked if there were any oral protests, and there being none, 'the hearing was brought to a close. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the recommendation of the Planning Commission be accepted changing the zone'from "P" to "C-3", and that the City Attorney be instructed to draw up an amendment to the Zoning Ord- inance setting forth this change. The Planning Commission gave notice that a public hearing will be held at 8:00 P.M. on May 21st on the rezoning of the westerly side of Alameda Avenue, between Fourth and Fifth Streets, from "R-2" to 11R -311 - ,Council was also notified that a public hearing will be held May 21st at 8:30 P.M. on rezoning of the property located at the Northwest corner of Gladstone Street and Louise Avenue. The Planning Commission expressed disapproval of the zone change to "M-1" of proposed Annexation No. 31, located'on the south side of Gladstone Street, ex - 'tending westerly from Little Dalton Wash, and -'recommended that if the property be annexed,it be zoned."R-lc" Attorney -Huston A. Snidow appeared before the Council on.behalf of the property owners to inquire whether an appeal of the Planning Commission decision could be 'filed at this time, and if so he would enter an appeal. Moved'by Councilman Ortuno, seconded by Councilman Teasley"and unanimously carried that the City Council appeal the decision of the Planning Commission, and that a•hearing be set for June 2nd at 8:00 P.M., and that -the necessary publication be made and notices mailed. The Planning Commission reported that, after two Public Hearings on the route location for the pro- posed Foothill Freeway, and after considering the disadvantage to the City economically from the pos- sible•loss of industrial payroll, loss of property taxes, unnatural division of the City and school areas, etc., it recommended to the Council that effort be made to have further studies made by the State Division of Highways of a route further to the south, such as the route shown on the State's plan along Gladstone Street. Moved by Councilman Ortuno, seconded by Councilman Teasley that the City Attorney be intructed to pre- pare a Resolution advising the Division of Highways that the Division's preferred route of the•)proposed Foothill Freeway through Azusa is not acceptable to the City'Council, and that the Council is more in favor of a route in the vicinity of Gladstone Street, Public hearing on re-zoninngg of Lots 17 & 18, Block 29 Public hearing May 21st on rezoning west- erly side of Alameda Public hearing May 21 on rezon- ing corner Glad- stone & Louise Public hearing June 2 on appeal of zoning on Annexation #31 Southerly Freeway route preferred 9 i CITY. HALL AZUSA, CALIFORNIA MONDAY, MAY 5, 1958 as shown in the State's study designated by the "blue" line, except, that as the route approaches the easterly part"of the City it continue in a line along Gladstone Street, instead of veering in a northeasterly direction which causes an undesirable splitting of residential tracts. This motion carried unanimously. Upon approval of the Resolution, copies are to be sent to neighboring Cities requesting these Cities to support, by.Resolution, the City of Azusa in its desire to have the route of the proposed Foothill Freeway in the vicinity of Gladstone Street instead of the so-called preferred route,as now designated by the Division of Highways. Notice has been received that the General Felt Products Company is moving out of the City, and it was suggested by Superintendent Smith that the matter of the trans- former bank serving General Felt, which is located on property owned by Mr. Jack Palo, be cleared up at this time before new occupants move into the building. Moved by Councilman Ortuno, seconded by Councilman Fawcett and ordered carried that the matter be referred to the -City Attorney, City Engineer, Supt. of Light and Water; and the Administrative Officer to see whether a solution to the problem can be arrived at as soon as possible. Mr. Sid Buskin of the Crown Covina Tract appeared before Council to inquire as to the status of street lighting in•his,area at this time. He was advised that the lighting would possibly be completed within 60 days. -In answer to further inquiries, Mr. Buskin was advised that the lights would have overhead wiring due to cost, and.also that the residents in the area would not be assessed for the street lights. It was requested by the City Engineer that the Mayor or the City Clerk be authorized to sign escrow instru- ctions on the Lee -Daniel property exchange. The ex- penses to the City will be $9G6.75, plus Title Insurance on the City's property and one-half the escrow fee. Moved,by Councilman Fawcett, seconded by Councilman Ortuno and ordered carried that authorization be given for. -the signing of the escrow papers. Recommendation was made by the City Engineer that the Council accept a deed for dedication to full width of Donna Beth Street, of land owned by the Valleydale Baptist Church. This matter was tabled until the next meeting for the City Attorney to draw up the necessary Resolution of Acceptance. The City of Duarte wrote to the City Council asking that Azusa join them in writing a letter to Mr. Sam R. Res. 3745 re: Councilman Fawcett offered the following Resolution Weed abatement entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, DECLARING WEEDS, RUBBISH AND DIRT UPON PARKWAYS, SIDEWALKS OR PRIVATE PROPERTY IN THE CITY OF AZUSA TO BE A PUBLIC NUISANCE, PURSUANT TO TITLE 4, DIVISION 3, PART 2, CHAPTER 13, ARTICLE 3, (SECTION 39560 to 39587 INCLUSIVE OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA). Moved by Councilman Fawcett, seconded by Councilman Ortuno and ordered carried that further reading of this Resolution be waived. A public hearing will be held at the Council meeting of.May=19th, at 7:30 P.M. to the end that said nuisance be.abated. McQueen, Covina, for a business for taxi -cab license to operate a taxi service in the City of license Azusa, recommending that the license be granted. Mr. McQueen appeared before Council in support of his application, and Mr. Lou Servia, owner of the Azusa Taxi, appeared to appeal for denial of the application. Moved by Councilman Ortuno, seconded by Councilman Johnson and unanimously carried that this matter be tabled for further study. A report was received from the Police Department on Report re: photographic services and operation of the dark room. dark room It'was pointed out that a cost estimate for fixing up a dark room cannot be made until a•location is selected. It was decided that this matter be held over for further study, and that the City Engineer work towards suggestions for the dark room. A letter was presented from C. J. Flynn submitting C. J. Flynn his resignation from the Police Reserve Corps effect- resignation ive May 1; 1958. A request was received from Fire Chief Madison for Purchase of authorization to trade their fire truck unit 845, fire unit which is a 1949 Dodge, for a new one -ton pick-up patrol truck equipped. Chief Madison estimated that the cost authorized ofequipping such a truck would be approximately denied $2,500.00 and that the equipment would be transfer- able to any future unit which might be purchased. Moved by Councilman Ortuno, seconded by Councilman Teasley -and ordered carried that the Administrative Officer be'authorized to obtain proposals for the purchase of a truck as requested. An Ordinance was prepared making amendments to the 1st reading Subdivision Ordinance, No. 410. Ord. amending Councilman Ortuno offered for its first reading the, Subdivision following Ordinance entitled: Ord. No. 410 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ORDINANCE NO. 410 RELATING TO SUBDIVISIONS. The Chamber of Commerce Quarterly Financial Report and'the report for the month of April were presented to Council. Moved by Councilman Johnson, seconded by Councilman Fawcett and ordered carried that the report be filed. The,City,Administrator advised Council that he had received a report from the Board of Equalization in answer to a request for an explanation of a reduction of -,'sales tax revenues to the City for one period. The Board reported that this reduction was due to a refund made to a firm that had paid double sales tax. Moved,by Councilman Teasley, seconded by Councilman Ortuno and ordered carried that the report be filed. The Administrative Officer presented a written pro- posal from Carl Reynolds, Accountant, offering his services to the City for about 22 hours each week at a fee of $4.72 per hour. Moved by Councilman Fawcett, seconded by Courn ilman Ortuno that the Administrative Officer be authorized to employ Carl Reynolds to assist the Accounting Department, at $4.72 per hour, for a period not to exceed 90 days. The Ground Observer Corps requested funds to send a G.O.C. Conf. representative to the California G.O.C. Conference funds granted in Fresno on May 15, 16 and 17. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the request be granted, and that $60.00 expenses be advanced. The Sociedad Progresista Mexicana invited the Council Council invited to attend their Presentation of the Colors on May 25 to Color Pres. at the Parish Hall, and to a luncheon which will be of Soc. Mayor Memmesheimer reported that there would be a Cnclman Teasley Watershed Committee meeting on May 7th at 10:00 A.M. to attend Water - in -the State Building. Councilman Teasley was shed meeting delegated to attend this meeting. Councilman Ortuno brought up the subject of asking Admin. Officer the -.School Board to pave the lot on Fourth Street to write School between Pasadena and Soldano Avenues where the Supt. re: paving busses'park. There is loose dirt there now, and of parking lot a'dust nuisance is created by the traffic in the .parking.lot. Moved by Councilman Fawcett, seconded by Councilman Ortuno and ordered carried that the Administrative Officer be authorized to write a letter to the School Board relative to the subject.
