The City Council of the City of Azusa met in regular session at the above time and place. Mayor Memmesheimer called the meeting to order and led Call to Order in the salute to the flag. Invocation was given by Rev. 0. L. Swain, Pastor of Invocation the First Assembly of God Church. Present at Roll Call: Councilmen: Ortuno, Johnson, Roll Call Teasley, Memmesheimer Absent: Councilmen: Fawcett Also Present: City Attorney Williams, Supt. of Light & Water Smith, Fire Chief Madison, and City Clerk -Admini- strative Officer Miller Mayor Memmesheimer asked if there were any corrections or omissions to the meeting of May 19, 1958. With no corrections, the minutes were approved as written. The hour_ of 7:30 P.M. was set for the continued hearing on the 1911 Act Proceedings (1955-8)• Mr.'Cornejius Ayon, 117 N. Alameda Avenue, again appeared before Council to state that he had in- stalled his sidewalks on parcels 15 and 16 before the proceedings for the 1911 Act had started. It was determined by Council that these two parcels had -been assessed in error. Moved by Councilman Teasley, seconded by Councilman Ortuno and unanimously carried that these two parcels be dropped from the Assessment District, as they were assessed in error, and that this hearing be continued until the next regular Council meeting on July 7th at 7:30 P.M. Moved by Councilman Teasley, seconded by Councilman Memmesheimer and unanimously carried that the City ask O'Melveny and Myers whether the City can contribute the amounts assessed in error. Moved'by Councilman Memmesheimer, seconded by Councilman Teasley and unanimously carried that in the event the Approval of Minutes 5-19-58 City can absorb the assessment on the two parcels assessed in error, the necessary Resolution be drafted so stating, and -in the event it is not possible, that the necessary additions be made to each of the other assessments. Mrs. Frances Brocomontes, 166 No. Dalton Avenue,.stated again that the work done on Lot 22, Mountain View Tract, was very unsatisfactory, as the driveway did not line up with the fence gate, which had been -installed previously. Moved by,Councilman Teasley, seconded by Councilman .Johnson and unanimously carried that the Public Works Department be authorized to make whatever corrections are necessary, at no additional cost to the owners. Mr. Turnmire, 118 S. Virginia Avenue, appeared before Council to ask how the assessments were figured. He stated that his assessment was $435.99, while his neighbor who lived on a corner and has more frontage, wasoonly assessed $274.94. Mr. Kirkgaard was asked to contact Mr. Turnmire personally and explain how these figures were determined. Mr. Manual Rubio, Lot 13, Bloxk 64 stated that the assessment on his property was $15.24, and asked whether this would be increased because of the two parcels which had been assessed in error. He also asked how and when this assessment could bejpaid. Mr. Rubio was advised by the attorney of the manner in which the assessment is paid. Continued Hearing, 1911 Act 368 CITY HALL . AZUSA, CALIFORNIA MONDAY, JUNE 16, 1958 Page 2 A request was received from the Fire Chief for the purchase of a new 1250 gallon pumper for the Depart- ment. This vehicle, to be built by the Crown Coach Company'of Los Angeles to specifications of Mr. Madison, would possibly be on display at the Inter- national Conference of Fire Chiefs in Los Angeles, if the order was placed now. A representative of the Crown Coach Company appeared before Council and described the features of the pumper truck. Moved by councilman Teasley, seconded by Councilman Ortuno and ordered carried that the Administrative Officer be authorized to issue a purchase order for the vehicle as described for immediate delivery (a period of 150 - 170 daysj, and that the guarantee in the proposal be studied by the City Attorney, and that the purchase be a cash purchase from surplus funds. This motion carried by the following vote: AYES:'' Councilmen: Ortuno, Johnson, Teasley, I Memmesheimer NOES: .Councilmen: None • ABSENT: Councilmen: Fawcett Mr::John MCCoomb, from the Division of Highways, appeared before Council to advise them that the State Highway Department could not accept the deed to the strip of land 100 feet by 10 feet, located on North San Gabriel Avenue, as the State could not accept deeds which had conditions placed on them. The City Attorney stated that he felt the City should retain these conditions, and further suggested that the -City withdraw the deed, and if a new deed is ten- dered,',,the:City reserve the water easements as well as'for'elebtricity. Moved by Councilman Ortuno, seconded by Councilman Teasley and unanimously carried that Council accept the recommendation of the City Attorney. This was•the time set for the continued hearing on the zonlM 'of proposed Southerly Annexation #31, the south side of -Gladstone Street, extending westerly from the Little Dalton Wash. Mr. Reed Tibbetts, 17025 E. Orkney, stated that he had no objection to continuing the hearing further,�provided a definite date be set. He also presented another petition with 24 signatures pro- testing the proposed "M" zoning - Mr. R. C. Muldrow, 444 S. Angeleno Avenue, said he would like some information as to what type of buildings would be constructed if an "M" zoning were permitted. Mr. James Simning, 444 S. Grandin Avenue, stated that he did not want any type of manufacturing to be permitted. Moved by,Councilman Ortuno, seconded by Councilman Teasley, and unanimously carried that the hearing be tabled until the July 21st Council meeting and that a .plot plan be presented showing the type of structure and type of manufacturing, eliminating many types of objectionable businesses. It was.requested by the City Employees' Association, through the Personnel Board, that City employees be permitted -to serve on jury duty without loss of pay, and that.the City be reimbursed whatever compensation is received by the employee for serving on jury. Requests were received for the widening and improving of Industrial Street from George Avenue to Lucky,Avenue, -as the poor condition of the street hampers development of -industry in the area. This is a 30 foot wide street. Moved by Councilman Teasley, seconded by Councilman Ortuno and ordered carried that the City Attorney, Administrative Officer and the City Engineer contact the property owners on this street to determine their attitude on dedication of the street and report back to Council. Council was notified that Mr. A. Vela, a part-time draftsman'.in the Engineering Department, submitted his resignation as of June 20, 1958, to accept a position in another City. Moved by Councilman Ortuno, seconded by Councilman 'Johnson and ordered carried that the resignation be `accepted. Comments on the proposed amendments to Ordinance 410 were submitted to the Council members. Moved,bq,•Councilman Ortuno, seconded by Councilman Johnson and ordered carried that this matter be tabled until the meeting of July 7th for further investigation and study. Notification was given that the Pasadena Avenue pedestrian bridge was completed as of June 10, 1958. Notification was given that the Engineer had sub- mitted a report for initial and supplemental allocations for the City to the Los Angeles Flood Control District regarding the proposed Storm Drain Bond Issue which will appear on the November ballot. Moved by Councilman Johnson, seconded by Councilman Teasley and ordered carried that discussion as to appr'oval.of Tract Map 21502, Walker Built Hames, be tabled until the meeting of July 7th for further study,,as this subject was not on the agenda. Mr. Dominguez, owner of property on Third Street at Pasadena Avenue, appeared before Council and stated that he had some time previously agreed to dedicate a portion of Third Street, and install curbs, gutters and sidewalks on his own property, but had now been asked by the City Engineer to install cross gutters as well on Pasadena Avenue. He did not feel that he should pay for the cross gutters, as they were not mentioned at the time of the dedication acceptance. Moved by Councilman Ortuno, seconded by Councilman Teasley and unanimously carried that the cross gutters be deleted from the Engineer's plan as an expense to Mr. Dominguez, and that he should be asked to pay only for curbs, gutters, and sidewalks. 371 Step raises: Richard Lara Ann McKinney Hugh Nichols Industrial St. improvement A. Irwindale Avenue. This is in accordance with the agreement between the Edison Company and the City of Azusa. Moved by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that the Mayor be author- ized to sign the letter. A request was received from the Park & Recreation Dedicate Commission that a Resolution be prepared to clear City parks the titles and dedicate all City parks. In the matter of the disputed land ownership at Condemnation Slauson Park, it was suggested that the City may proceedings - wisti to start condemnation proceedings, which would Slauson Park be easier than settling the matter by negotiations. Moved by Councilman Ortuno, seconded by Councilman Johnson, and ordered carried that condemnation proceedings be instituted 60 days from this date unless an agreement is made in the interim. Mayor Memmesheimer stated that there was a Resolution whereby'Council could adjourn at 10:30 P.M., and asked whether they wished to adjourn or go on with the business of the evening. Moved by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that the meeting continue until all business is completed. It was requested by the Park and Recreation Commissica School children that the policy be continued for employing school to be hired for children for summer work in the City. The suggestion part-time was made that children who are residents of Azusa be summer work employed on a part-time basis to work in any Depart- ment where they may be of assistance. Moved by Councilman Ortuno, seconded by Councilman Johnson and ordered carried that a Resolution be drawn up covering the employment of part-time school children during the summer months. This was the time scheduled for the 2nd reading of Ord. 572 - the Ordinance amending Ordinance 535 so as to rezone rezoning certair premises at Gladstone Street and Clydebank Avenue premises owned.by Mr. James Church. Councilman Ortuno offered for its second reading the following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ORDINANCE NO. 535 SO AS TO REZONE CERTAIN PREMISES. Moved by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that further reading be waived. Moved by Councilman Ortuno, seconded by Councilman Memmesheimer that this Ordinance be passed and adopted. The Ordinance was then passed and adopted by the following vote of Council: AYES: Councilmen: Ortuno, Teasley, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: Fawcett and numbered Ordinance 572. 374.- i CITY HALL AZUSA, CALIFORNIA MONDAY, JUNE 16, 1958 _;The City Engineer was directed to attach a certificate bo Ordinance 572 upon the completion of conditions outlined in said Ordinance. Upon the filing of the certificate, the Ordinance will be in force. It was requested that the 2nd reading of the Ordinance amending Ordinance 410 relating to sub- divisions be held over until the July 7th meeting. A.Resolution was prepared for accepting a Grant of Easement from Mrs. Launee M. Malone. Councilman Johnson offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF _ AZUSA ACCEPTING A GRANT OF EASEMENT AND DIRECTING THE RECORDATION THEREOF. Moved -by Councilman Johnson, seconded by Councilman Ortuno and ordered carried that further reading be waived. Permission was requested for the Attorney to sign tax Atty. authorizes cancellations for Highway purposes, Authority Nos. to sign tax -•387322 38702, 38735, 38734, 3$733, 38779, 38777, and cancellations 38776 for the widening of Azusa Avenue. Moved by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that the City Attorney be -authorized to sign the above mentioned tax can- cellations. Councilman Ortuno offered for its second reading the Ord. 573 - following Ordinance approving Annexation #30 entitled: Easterly Annex. #30 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXA- TION OF CERTAIN UNINHABITED TERRITORY DESIGNATED EASTERLY ANNEXATION DISTRICT NO. 30 TO THE CITY OF •AZUSA. Thisreement sets up the minimum monthly payment of .00, which is what the City has paid in recent years. The City Attorney said that the '376 377 CITY HALL AZUSA, CALIFORNIA MONDAY, JUNE 16, 1958 Page 6 agreement states that the City is responsible for any County workers who are inured while enforcing their .rules, and suggested that the City check to make certain that their liability insurance will cover contracted liability. Mr. Williams suggested that if the City does not now have this coverage, that the insurance be changed. The Administrative Officer was requested to check into the insurance coverage. Chief of Police Kendrick asked Council approval of the C. K. Neer appointment of Charles K. Neer to the position of apptd. Sgj., Sergeant, effective June 16, 1958. Police Dept. Moved by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that the appointment be approved. The Treasurer submitted the Financial Statement as of Treasurer's May 31, 1958, showing a bank balance, exclusive of Statement Investment Account, 5929011.14; Treasury Bills, $400,000.00; earnings on bills $26,426.75; or a total of $1,018,437.89. Moved by Councilman Johnson, seconded by Councilman Ortuno and ordered carried that the report be filed. Requests were received from the National Little League Leagues requests and.the'American Little League for the loan of City for bleachers bleachers. Moved by,Councilman Ortuno, seconded by Court ilman Johnson and ordered carried that each League be granted -the use of one half the number of bleachers available. It was'determined that Councilman Ortuno, Mayor pro tempore, be the official alternate delegate. Council was notified that the Division of Highways Admin. Officer received City Resolution No. 3754 regarding the to consult proposed Foothill Freeway. It was stated that this Hwy. Div. re: Resolution and letter would be forwarded to the proposed California Highway Commission for consideration, Freeway but•was not determined whether the local Los Angeles Highway Division plans to do any further study on the'Southern route in accordance with Council request. The Administrative Officer was asked to inquire as'to whether the Highway Department plans to make further'study of the recommended Southerly route, and ' " if they -do not, a Resolution should be prepared to the.State Highway Department requesting that they study the southerly route preferred by the City. Temple Sholom requested permission to run a "Fun Temple Sholom n Festival" at the V.F.W. grounds on Sunday, July 27th. request.for This consists of a carnival and circus show, mer- festival chandise sales, games, kiddie rides and food con- cessions. Councilman Teasley offered the following Resolution Bills and entitled: Requisitions, Res. #3770 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Moved by -Councilman Teasley, seconded by Councilman Ortuno that this Resolution be passed and adopted. Councilman Johnson submitted her expense account for ,.,the Mayor -Councilmen Conference held in San Diego and returned a check in the amount of $44.50.
