The City Council of the City of Azusa met in regular
session at*the,above time and place.
Mayor Memmesheimer called the meeting to order and led
in the salute to the flag.
Invocation was given by Councilman Warren Teasley.
Present at Roll Call: Councilmen: Johnson, Teasley,
Memmesheimer
Absent: Councilmen: Fawcett, Ortuno
Also Present: City Attorney Williams, Supt. of
Light & Water Smith, Supt, of
Public Works Brusnahan, City
Engineer Kirkgaard, and City Clerk -
Administrative Officer Miller.
Mayor Memmesheimer asked if there were any corrections
to the minutes of June 2, 1958.
Councilman Johnson stated that on Page 9, the item re-
garding•John Littlefield's commendation by the Chief
'of -Police, motion should read "that the letter be filed
'in -his personnel folder".
On Page 12,Councilman Johnson stated that the second
item should read "Councilman Johnson stated that she
had received an inquiry regarding the possibility of
having crosswalks painted at Slauson Park", etc.
With no further corrections, the minutes were approved
as corrected.
Mayor Memmesheimer asked if there were any corrections
to the minutes of June 16, 1958. With no corrections,
.,,the" minutes were approved as written.
At the hour of 7:30 P.M. bids were received and
opened for the purchase of the house located north
of the Public Works Building. This house is to be
moved. Only one bid, in the amount of $211.00, was
received.
Moved by Councilman Teasley, seconded by Councilman
Johnson and ordered carried that the bid be rejected
and that -the Administrative Officer be authorized to
readvertise for bids. It was also stipulated that
the bidder be requested to advise Council where the
building is to be relocated upon removal from the
Dalton Avenue address.

WHEREAS, this City Council desires to make
certain changes in Assessment No. 1955-8 following

Section 1. That this City Council hereby
makes a'contribution pursuant to Section 5375 of the

WHEREAS, the Superintendent of Streets of the
City of"Azusa, California, has heretofore filed in the
office of the City Clerk of said city an assessment
and diagram for that certain work or improvement in
said city'done under and pursuant to the Improvement
Act of"1911, Division 7 of the Streets and Highways
Code of California, and resolution of intention,

WHEREAS, after the filing of said assessment
and diagram the said City Clerk has, as required by
law, given notice of the filing of said assessment
and of the time fixed in said notice for hearing by
this City Council, and affidavits of publication, post-
ing and mailing of such notice have been approved by
this City Council and are on file; and
WHEREAS, at the time and place fixed in such
notice and as duly continued a hearing was duly held
by this City Council at which all written appeals,
protests or objections, if any, were duly presented
and read, and all persons desiring to be heard thereon
were heard, and this City Council gave all persons
present an opportunity to be heard in respect of any
matter relating to said work or improvement, to any
act or determination of the Superintendent of Streets
or the City Engineer of said city in relation thereto,
to the contract for said work or the performance of
said contract, to the correctness of said assessment
or said diagram, or to any other act, determination
or -proceedings of said Superintendent of Streets or
said Engineer, or to any matter relating to said work,
the assessment district or the proceedings therefor,

'heard have been heard by this City Council, and this
City Council is fully informed in the premises; and
WHEREAS, this City Council has ordered cer-
tain changes in said assessment as set forthrin
Resolution No. 3771 adopted on the 7th day of July,

NOW, THEREFORE, the City Council of the City
of -Azusa; California, DOES HEREBY FIND, RESOLVE,
DETERMINE AND ORDER As follows:
Section 1. That said hearing has been duly
held; that each and every step in the proceeding prior
to and including the hearing has been duly and regularly
taken; that this City Council is satisfied with the
correctness of the assessment, the diagram, and the
proceedings and all matters relating thereto, and all
protests, objections, or appeals be and the same are
hereby overruled and denied, and this City Council
does hereby confirm said proceedings and said assess-

Civil Service List IV - Civil Engineering Assistant
was presented to Council. The two certified for
appointment were:
Mr. Gary Salmon, Glendale lot
Mr. Peter Pfeiler, E1 Monte 2nd
-Both applicants, however, have stated that they would
not accept the appointment on the first step of the
current salary range.
The Personnel Board and the City Engineer recommended
..to the Council that the salary range for the position
6f Civil Engineering Assistant be changed from range
#34 ($402-61o) to #35 ($5274641), in view of the
difficulty in recruiting people for this position.
Moved by Councilman Teasley, seconded by Councilman
Memmesheimer and unanimously carried that the City
Attorney be authorized to prepare a Resolution
changing the salary range of the Civil Engineering
Assistant from Range #34 to Range #35, to be effective
as of 8-1-58.
The hour of 8:00 P.M. was set for public hearing on
the recommended zone change Case #29 (Cunningham
property) from R -lb to C-2. The City Clerk presented
--the affidavit of publication giving notice of the
hearing which was published in the Azusa Herald on
June 26th, and presented the list of property owners
within 300 feet of the area to whom notices of the
hearing.had.been sent.
-'Mayor Memmesheimer suggested that inasmuch as
,two of the Council members were absent, the hearing be
continued,until an -adjourned meeting to be set for
Tuesday, July 15th, as he felt there should be a full
Council to discuss this problem.
Mr. Morrie Matcha, Attorney for Mr. Cunningham,
stated that he agreed with the Mayor and requested that
,this hearing be continued until the evening of July 15.
James Scalo, 321 W. Ashby Street, said that he
felt that inasmuch as the hearing had been set for this
date, that it should be held tonight.

-Mr. Larry G. Dela-Faye, 1507 N. Sunset, stated
that he had already released a statement to the press in
which he asked that one of the absent members of Council
disqualify -himself because he had evidence that this
4mber was biased in his opinion before the subject ever
came before Council. Mayor Memmesheimer stated he felt
this absent member should have an opportunity to hear
the charges against him and to express his opinion on
the matter.
Moved by Councilman Johnson, seconded by Councilman
Teasley and ordered carried that the hearing be con-
tinued until an adjourned meeting on July 15th at
8:30 P.M.
The City Clerk was asked to forward copies of the
statement released by Mr. Dela-Faye to Councilmen
Ortuno and Fawcett, and to have all the records on
this matter, minutes, letters, etc. available for -the
meeting of the 15th.
The hour of 8:00 P.M. was set for the public hearing
on the recommended zone change from C-2 to R -lc of
Lot,37, Tract 13824, located at 447 S. Louise Avenue.
The Administrative Officer presented the affidavit
of publication -giving notice of the hearing and a
list of names of the persons within 300 feet to vh om
notices had been sent. He announced that he had re-
ceived no written protests. Mayor Memmesheimer asked
if there was anyone in the audience in favor of or
against the recommended zoning. There was none.
Moved by Councilman Teasley, seconded by Councilman
Johnson and ordered carried that the hearing be
closed.'` -
Moved by Councilman Teasley, seconded by Councilman
Johnson and ordered carried that the City Attorney be
instructed to prepare the necessary Ordinance ordering
the rezoning of the property to R -lc from C-2.
Council was notified by the Planning Commission that
the date of July 9th had been set for the hearing on
the rezoning of the 400 block on the west side of
Alameda Avenue from R-2 to R-3.
A request was received from the Light and Water t;
Department as to whether the Council wished to have
the,water mains extended on Azusa Avenue south of
Gladstone Street in order to serve the areas annexed
to the City. It was pointed out that several bus-
ineas developments are scheduled there in the future.
The estimated price for this work is $7,500.00.
Moved 6y.Councilman Johnson, seconded by Councilman
Teasley and ordered carried that the City Engineer
be'instructed to prepare plans and specifications for
bids on the water line extension to be presented to
Council at the earliest date.
It was suggested by the City Clerk that before Council
acts,.on amending the Light and Power rates, they may
wish to,appoint a committee to further study the report
of Mr..Johnson and Mr. Wehe and make a recommendation
to Council.
Mayor'Memmesheimer suggested that the Superintendent
of Light and Water, Councilmen Ortuno and Teasley, and
the Administrative Officer study this report further
and make their recommendation to Council.
Moved by Councilman Johnson, seconded by Councilman
Memmesheimer that the recommendation of Mayor Memmesheimer
be accepted. This motion ordered carried.

Azusa Car Wash for furnishing electric power was
presented to Council.

struction of required concrete cross -gutters, concrete
driveways and driveway aprons; construction of concrete
sidewalks, installation of water mains, valves and
hydrants, sanitary sewers, ornamental street lights;
WITH THE FOLLOWING EXCEPTICK S:
that the paving installed be not less than three inches
of asphaltic concrete with aggregates to conform to
Seetion-20, of the State Highway'Specifications of
August, 1954 using 85-100 Asphalt conforming to Section
54 0£ the aforementioned specifications, with the fur-
ther exception that within 75 feet of the curb line of
Pasadena and Cerritos Avenues the paving on Russell St.
be 4 inches in thickness;
AND IN ADDITION
the installation of concrete sidewalks on Cerritos
and Pasadena Avenues and curb returns and drainage
structures as shown on Drawing 1175 dated March 29,

It was further recommended that a concrete block wall
'be erected on the property frontages on Cerritos Avenue
and Gladstone Street.
Mr, Herbert Braun and Mr. Ted Walsh appeared before
.Council and asked that the right-of-way of the streets
except Russell Street be reduced from 56 feet to 50 feet.
This would allow 36 feet of paving between curbs with 7
feet parkways containing 4 feet sidewalks. The Council,
after discussion, agreed to the request of Mr. Braun and
Mr. Walsh.
Moved by Councilman Teasley, seconded by Councilman
Memmetheimer that the tentative map of Tract No. 20502
be approved subject to the conditions as recommended,
except the street width (right-of-way) other than Russell
Street be 50 feet. This motion carried unanimously.

Police Chief Kendrick requested authorization to

Moved by Councilman Johnson that the request be denied
and the -Chief be permitted to attend the League of
California Cities Conference to be held in Los Angeles
at approximately the same time. This motion died for
lack' of a second.
Mayor Memmesheimer recommended that the Police and
Fire Chiefs be permitted to attend International
Conferences at least every other year as they receive
training and information valuable to the City in the
operation of their Departments, and that they be
granted mileage allowance to be -stipulated in a new
mileage -policy which should be adopted.
Moved by -Councilman Teasley, seconded by Councilman
Memmehheimer that the Chief of Police be granted
permission to attend the Conference in Miami Beach,
Florida, by private vehicle if desired, but the time
allotted not to exceed the time required for rail
travel. This motion carried by the following vote:

NOES: Councilmen: Johnson
ABSENT: Councilmen: Fawcett, Ortuno
Mayor Memmesheimer stated that this vote was an ex-
pression of authorization for attendance and not
setting forth any expense allowance, since three aye
votes are required to authorize expenses to be granted.

park on Pasadena Avenue.

liability in these claims, and that they be referred
'.to the Insurance Company.
.The Ordinance amending Ord. #410 relating to sub-
divisions, introduced on May 5th having been altered,
,it,now becomes necessary to reintroduce the Ordinance
for its first reading.

RELATING TO TAXI STANDS.
Moved by Councilman Teasley, seconded by Councilman
Johnson and ordered carried that further reading be
waived.
' The first reading of the proposed Ordinance providing
for the purchase and sale of supplies, services an
equipment was held over for further study.
The City's insurance carrier was contacted relative
to the revised agreement of health services between
the County and the City, in respect to the City being
Meld -liable for acts of County employees while being
employed, -by the City in connection with health ser-
vices: It was the opinion of the insurance carrier
that the City would be covered for liability when
County employees were acting for the City in the per-
formance of duties.

Johnson and ordered carried that authorization be
_ granted for the signing of the revised agreement for
health services.

The. City Attorney presented a Resolution regarding
City employees serving on jury duty.
Councilman Johnson offered the following Resolution Res. 3774 -

RELATING TO THE COMPENSATION OF EMPLOYEES OF THE CITY

This Resolution was read in full.
Moved by Councilman Johnson, seconded by Councilman
Teasley that this Resolution be adopted. The Resol-
ution was then passed and adopted by the following
vote of Council:

Resolution No. 3774.
The City Attorney stated that he had prepared an
Ordinance at the request of the Police Chief to
prohibit certain persons to be on or about certain
establishments.
Councilmen Teasley offered the following Ordinance 1st reading
entitled: Ord. re: gyms,
health studios,
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA etc.
PROHIBITING CERTAIN PERSONS FROM WORKING OR LOITERING
IN OR ABOUT ANY GYMNASIUM, BODY BUILDING OR REDUCING
STUDIO, MASSAGE PARLOR OR TURKISH OR STEAM BATH
ESTABLISHMENT.
Moved -by Councilman Teasley, seconded by Councilman
Johnson and unanimously carried that further reading
be'waived.
' The Memorandum of Agreement for expenditure of Gas
.Tax funds allocation for major city streets was
presented to Council. The following projects had
been submitted by the City Engineer to the State:
Project No. 48, Major Streets Maintenance, amount
$10,000.; Project No. 49, Widen, grade, etc. of
Fifth•Street from Virginia Avenue to Azusa Avenue,
$52,560.; or a total of $62,560.
Councilman Johnson offered the following Resolution

Teasley that the Resolution be adopted. The Resolu-

Resolution No. 3777.
A request was received from the property owners on
Arrow Highway between Cerritos and Citrus Avenues
for annexation to the City with a C zoning.
Moved by Councilman Teasley, seconded by Councilman
Johnson and ordered carried that the matter be re-
ferred to the Planning Commission and that the
Administrative Officer be granted permission to
send the legal description to the Boundary Commission
for approval.
,A request was previously received from Ted Hebert
and E. A. Aguilar, owners of property at Gladstone
and Clydebank for annexation to the City with an
M•zoning. This has already been referred to the
Planning Commission with favorable reaction, subject
to,public hearing.
Moved by,Councilman Teasley, seconded by Councilman
Memmesheimer and unanimously carried that the Admini-
strative Officer be authorized to forward the legal
description of the above-mentioned property to the
Boundary Commission.
The Administrative Officer stated that he had re-
ceived a request for the possible adoption of an
Ordinance regulating Going Out of Business Sales,
Fire Sales, etc. At the present time there is no
limit regulating the length of these sales.

be instructed to prepare an Ordinance regulating
such sales.
Council was notified of the League of California
L.C.C. Meeting
Cities meeting to be held July 17, 1958, at Inglewood.

Permission was requested to draw a check in advance
to cover the cost of reservations.
Moved by Councilman Teasley, seconded by Councilman
-Johnson and ordered carried that the Administrative
Officer be authorized to draw a check in advance to
cover the cost of reservations for the League of
California Cities meeting.
The Administrative Officer stated that he had held a

Hwy. Dept. re
of, Highways in which the Administrative Officer was
Freeway study
advised that the Highway Department is studying the
route suggested by the City through Azusa, and are
also studying other possible routes. It was hoped
that some definite plans would be reached by the end
of July.
Before the presentation of the Resolution regarding Uniform
Bills and Requisitions, Councilman Johnson questioned purchases to
the check in the account of $1,228. to Bill's Spprting be authorized
Goods for the purchase of uniforms, etc. by the
Recreation Department.
Moved by Councilman Memmesheimer, seconded by Councilman
Johnson and ordered carried that the Administrative
Officer issue a directive from"the Council to the
Recreation Department that before any further purchase
of'uniforms is made, a request should be presented to
Council for authorization.
Councilman Johnson also questioned the Mayor's expense
account, and stated that she thought he had been
authorized to attend the Band Revue in National City
.for the day only, not to spend the night. The Mayor's
expense account was withdrawn from the Demands and held
over'for the next meeting.
Councilman Teasley offered the following Resolution Res. 3778,
entitled: Claims and
Demands
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE
FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.
Moved by Councilman Teasley, seconded by Councilman
Memmesheimer that this Resolution be adopted. The Res-
olution was then passed and adopted by the following
