The City Council of the City of Azusa met in adjourned session at the above time and place. Present at Roll Call: Councilmen: Fawcett, Ortuno, Roll Call Johnson, Teasley, Memmesheimer Also Present: Supt. of Light and Water Smith and City Clerk -Administrative Officer Miller. The first subject was further consideration of the budget for the fiscal year 1958-59• The Administrative Officer reported to the Council that some of the cities in the area that had previously been expected,to hold the line on salary increases had granted small percentage increases to their employees. It was recommended that if the Council was to give consideration to a salary increase, that a fringe benefit, such as a Major Medical Insurance program be considered in lieu of a percentage increase. Discussion was held on the subject of increase and fringe benefits. The Council determindd to allocate $,12,000. in the budget to be used either as a percentage salary increase or insurance program after investigation by a committee of Council members and City employees. Moved -by Councilman Fawcett, seconded by Councilman Ortuno that the budget be adopted as adjusted and the deficit•be cared for by a transfer to general funds. This motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Teasley, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None The second reading of the Ordinance amending Section Ord. 574- 19-A of Ordinance No. 410 was presented. Amending Sec. Councilman Johnson offered the following Ordinance1 -A of Ord. entitled:' 91-0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING=SECTION 19-A OF ORDINANCE N0. 410 REQUIRING SUBDIVIDERS TO DEDICATE AND IMPROVE AREAS FOR PARK AND RECREATION PURPOSES. ',Moved by Councilman Johnson, seconded by Councilman Ortuno that this Ordinance be adopted. This Ordinance was read in full. The second reading of the Ordinance amending Ordinance 410 -relating to subdivisions is to be held over until the meeting of July 21, 1958. Councilmen Ortuno offered for its second reading the following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REGULATING THE OPERATION OF TAXICABS. Moved by Councilman Ortuno, seconded by Councilman Teasley that further reading be waived. This motion ordered carried. Moved by Councilman Fawcett, seconded by Councilman Ortuno that further reading of this Ordinance be waived. Motion Ordered carried. Moved by Councilman Fawcett, seconded by Councilman Oituno that the Ordinance be adopted. This Ordinance was passed and adopted by the following vote of Council: AYES: -Councilmen: NOES: Councilmen: ABSENT:, Councilmen: Fawcett, Ortuno, Memmesheimer None Johnson, Teasley, None and numbered Ordinance No. 577. The City Clerk asked Council whether they wished to have all applications for solicitors' licenses come before Council for approval, or if they wished to act on only the more unusual applications for permits. Council stated -that they wished to have all solicitors' appli- cations presented to Council. The City Clerk presented a letter of thanks from the Old Timers Club of the Upper San Gabriel Valley thanking them for the privilege of meeting at the Recreation Center on May 30, 1958, for their annual picnic, and also asking that if the Gum Grove site, if obtained for a park, could be named "Pioneer Park". Communications were ordered filed. 405. 2nd reading Ord. amending #410 held over Ord. 576 re: Operation of taxicabs Ord. 577 - Amending provisions of Ord. 438 re taxi stands Council to approve all solicitors' applications Ltr. of thanks from Old Timer Club 406- CITY HALL AZUSA, CALIFORNIA TUESDAY, JULY 15, 1958 A Resolution was presented accepting Grant of Easement for sewer and electric lines from John W. Belcoe. Councilman Johnson offered the following Resolution entitled:" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ACCEPTING GRANT OF EASEMENT AND DIRECTING THE RECORDA- TION THEREOF. Moved by -Councilman Johnson, seconded by Councilman Ortuno that further beading be waived. This motion ordered carried. Councilman Fawcett offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AMENDMENT NO. 1 TO THE AGREEMENT FOR MAINT- ENANCE OF STATE HIGHWAY IN THE CITY OF AZUSA. Moved by Councilman Fawcett, seconded by Councilman Ortuno that further reading be waived. This motion ordered carried. Councilmen: Res. 3780 - Approving amendment #1 to agreement for Maintenance of St. Hwy. in Azusa Fawcett, Ortuno, Johnson, Teasley, Memmesheimer None None and numbered Resolution No. 3780. A letter was presented from the Azusa Library Board recommending to Council that Mrs. B. F. Wheelehan, Sr. and Edward C. Snyder be re -appointed to the Library Board. Moved'by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the recommendation of the Library Board be accepted re -appointing Mrs. B..F. Wheelehan, Sr. and Edward C. Snyder to the Board. A letter was presented from A. 0. Hanke, Agent for the Metropolitan.and Greyhound Bus Station, requesting per- mission to place two benches at the bus stop on the south side of Foothill Blvd., Just east of the corner of Foothill Blvd. and Azusa Avenue. Moved by Councilman Fawcett, seconded by Councilman Teasley and ordered carried that permission to place the -benches at the bus stop be granted, and the license be issued. A copy of a Resolution of the City of Covina, County of Los Angeles, State of California, requesting the Los Angeles County Board of Supervisors to "Hold the Line" on County expenditures, was presented to Council, and It was requested by Covina that Azusa forward a similar Resolution to the Board of Supervisors. Mrs. B. F. Wheelehan, Sr. & Edw. Snyder re-apptd. to Library Board Permission granted for benches at bus stop City Atty'. to prepare Res. asking L.A. Bd. Supervisor, to curtail exp M, CITY HALL AZUSA, CALIFORNIA TUESDAY, JULY 15, 1958 Moved by Councilman Fawcett, seconded by Councilman Teasley and ordered carried that authorization be given for the City Attorney to draft a Resolution to ,the Board of Supervisors similar to that of Covina. .-'A letter prepared by City Engineer Kirkgaard to the Board of Supervisors requesting adjustment on the proposed storm drain allotment was presented to Council for approval. Moved by Councilman Teasley, seconded by Councilman Ortuno and ordered carried that Mayor Memmesheimer be`authorized to sign the letter to the Board of Supervisors as drafted by the City Engineer. Council -'was notified that a letter has been received from M. B. Costello, fee appraiser, stating that he was available to perform the work relating to appraisals to be made in connection with the widening, etc: on Industrial Street at a fee of $50.00 per diem. This matter is being held over until the regular meeting'of July 21st. 8:15 -P.M. - the meeting recessed until 8:30 P.M., the time set for the continued hearing on the rezoning of the Cunningham property. '8:36'P.M: City Attorney Williams entered the meeting, and Council reconvened for Zone Change Case No. 29, Cunningham property, from R-1 to C-2. The continued public hearing began with the reading -.of the Planning Commission Resolution No. 48 recom- mending a change of zone classification from R -lb to C-2: ,,This Resolution was passed at a Planning Com- mission meeting on the 21st of May, 1958• At this Cime Councilman Ortuno stated that he felt he had no obligation to disqualify himself on this matter, and that he had not been asked to disqualify Himself when the area was annexed to the City. Morrie'Matcha, Attorney -at -Law, 736 N. Azusa Avenue, representing Mr. Max Cunningham in this hearing, appeared before Council to appeal for the rezoning. .He�stated that the area under consideration was not in •.a location suitable for a residence, and further stated that his client was dealing with three separate oil companies on the possibility of erecting a gasol- ine service station at the area in question providing the C-2 zoning is granted. James'Scalo, 321 Ashby Street, appeared before Council to present arguments against the proposed rezoning. He,also:presented a diagram of the areas in question and stated that the majority of the home owners in Crystal Canyon Estates were against the proposed rezoning. Larry Dela-Faye, 1507 N. Sunset, stated that the resi- dents.of the area in question were interested in living ,in,a strictly residential zone, and that they did not wish to Have stores in their area. Moved•by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that the hearing be closed. Councilman Ortuno offered to disqualify himself from voting. Other members of Council and the City Attor- ney stated they could see no reason for him to dis- qualify himself, but that the decision was up to him. Councilman Ortuno stated that he would disqualify himself from voting. Moved by Councilman Fawcett, seconded by Councilman Teasley that the recommendation of the Planning Commission be accepted in granting C-2 zoning. Mayor Memmesheimer stated that he was opposed to the C-2 zoning without restrictions on the land adjoining ,the property to the west, but that he approved of the C-2 zoning where the cafe now exists. Zoning C -f an -'Ordinance be drawn and introduced zoning this of covenant property C-2 if and when there has been recorded a recorded that covenant covering that part of the property under area is to be discussion, which will lie west of proposed San used only for Gabriel Avenue, to the effect that it will be used R or service - only for residential purposes or an automobile station service station, this covenant to run to the benefit of,the City and adjacent property particularly to the West. The amendment to the motion was seconded by Councilman Teasley.
