Ttie'City Council of the City of Azusa met in a special
meeting at the above time and place.
Present at�Roll Call: Councilmen: Fawcett, Ortuno, Roll Call
Johnson, Teasley, Memmesheimer
Also Present; City Attorney Williams, and City
Clerk -Administrative Officer Miller
The',City Clerk read the following notice setting forth
the special meeting:
BY ORDER OF THE MAYOR there will be a SPECIAL
MEETING OF THE MEMBERS OF THE CITY COUNCIL OF THE CITY
OF AZUSA to be held in the Council Chambers at 5:45 P.M.
on Tuesday, September 23, 1958.
The business of the meeting will be:
'a. To authorize employment of special counsel to
represent the City as an interested party in
Case No. 6148 before the Public Utilities
Commission, concerning the proper treatment
for rate fixing purposes to be accorded ac-
'.celerated amortization and accelerated
depreciation.
b. To consider approval of a joint exercise of
Tower agreement with the Cities of Sierra Madre,
Monterey Park and Alhambra for the protection of
water rights and for the formation of one or more
:i Water Districts.
The above notice of special meeting was served on members
of the.City Council prior to 24 hours of the time set for
the meeting.
City Attorney Williams explained to the Council that
the hearing called before the Public Utilities Commission
concerned the proper treatment for rate fixing purposes
to be accorded accelerated amortization and accelerated
depreciation (Case No. 6140). Attorney Williams also
stated that Mr. Preston Turner, City Attorney for the
City of Anaheim, was representing the Cities of Riverside
and Anaheim at this Commission hearing.
Since this is a hearing in which the Utility Companies
are vitally interested, and because of the possibility
of an effect of cost of power to the City, he recommended
that the City of Azusa join with Riverside and Anaheim
in engaging Mr. Turner as special counsel to represent
Azusa. .Mr. Turner's fees would, therefore, be split
between the three Cities.
Councilman Johnson offered the following Resolution
entitled: -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
-AUTHORIZING THE EMPLOYMENT OF SPECIAL COUNSEL TO RE-
PRESENT THE CITY AS AN INTERESTED PARTY IN CASE NO. 6148
BEFORE.THE•PUBLIC UTILITIES COMMISSION OF THE STATE OF
CALIFORNIA, CONCERNING THE PROPER TREATMENT FOR RATE
FIXING PURPOSES TO BE ACCORDED ACCELERATED AMORTIZATION
AND ACCELERATED DEPRECIATION.
Moved by Councilman Johnson, seconded by Councilman
Ortuno, and ordered carried that further reading be
waived.
Moved by Councilman Johnson, seconded by Councilman
Ortuno that the Resolution be adopted. This Resolu-
tion was then passed and adopted by the following vote
of Council:

The second item to be covered under the Notice of Water Power
Special Meeting was presented by the City Attorney. Agreement
The City Attorney stated that he had met with repre-
,-sentative§ from the Cities of Alhambra, Monterey Park,
and Sierra Madre to discuss the manner by which these
Cities would be best protected in the matter of water
rights.. -It was the opinion of these representatives
that the best protection of water rights and water ser-
vice for the various Cities would be the formation of
one or more water districts of which these Cities would
be,a part. It was felt that by so doing, it would be
possible,to remain outside the water district proposed
by the Upper San Gabriel Valley Water Association. Dis-
cussion on the pros and cons of the proposed Upper San
Gabriel Valley Water Association plan was held. The
City Attorney outlined the manner in which a district is
formed, and also presented an agreement between the four
above-named Cities. The four Cities contracting to this
agreement would associate themselves together for the
purpose of resisting the formation of any municipal water
districts that would not be to their mutual interest, and
the sponsoring of any water district which would be to
their mutual interest, and taking steps to protect any
water rights and prevent unjust charges to such Cities.
The agreement would authorize the City of Alhambra to be
the administrator of all activities, collector of all
funds, and to employ the necessary personnel to carry out
'the conditions of the agreement.
The four Cities agree to contribute immediately an agre-
gate sum of $7500.00 for the purpose of carrying out the
conditions of the agreement. The cost to each City would
be made upon a population basis. This agreement was read
in full by the City Attorney.
Moved by Councilman Ortuno, seconded by Councilman Teasley
-that the City of Azusa approve the agreement and that the
Mayor and City Clerk be authorized to execute the agreement.
This motion carried by the following vote:
AYES: Councilmen: Fawcett, Ortuno, Teasley, Memmesheimer
NOES: Councilmen: Johnson
ABSENT: Councilmen: None
Moved by Councilman Ortuno, seconded by Councilman Adjournment
Johnson that the meeting adjourn. Motion ordered
carried.
