The City Council of the City of Azusa met in regular
session at the above tine and place.

Mayor Memmesheimer called the meeting to order and led
in the salute to the flags

Invocation was given,by Rev. Paul Farrell, pastor of
the First Christian Church.

Call to Order
Invocation
Mayor Memmesheimer asked if there were any corrections Approval of
to the minutes of the meeting of September 151 1958. Minutes -
Councilman Johnson stated that on Page 2, the item re- 9-15-58 and
garding the Redevelopment Area should be corrected to 9-23-58
read "Health and Safety Code" instead of Government Code.
The Administrative Officer stated that on Page 3, the
item relating to the Newburgh Street improvements, motion
should read "that the improvements of street, paving, curbs,
gutters, and sidewalks on Newburgh Street to 625.34 feet
south,on the east side of Azusa Avenue and from Azusa
Avenue to Donna Beth on Newburgh Street and from Newburgh
Street to 220.92 -feet south on Donna Beth, be accepted."
With no further corrections, the minutes were approved as
corrected.
Mayor Memmesheimer asked if there were any corrections to
the minutes of September 23, 1958. With no corrections,
the minutes were approved as submitted.
It was recommended by the Department Head and Personnel
Board that Martin Lopez, Maintenance Man I. be raised
to Step 3, $330., effective 10-16-58.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett,'and ordered carried that the recommendation
of the Department Head and Personnel Board be accepted
and. the step raise be granted.
It was recommended by the Department Head that Joan
McKinney, Steno -Clerk, be raised to Step 5, $383,
effective 10-16-58. This recommendation, through an
oversight, was not presented to the Personnel Board
in time for their last meeting.
Moved by`Councilman Fawcett, seconded by Councilman
Ortuno, and ordered carried that the recommendation
of -Mr. Kirkgaard for the step raise of Joan McKinneJA
be accepted, and the raise approved subject to Personnel
Board recommendation.
The Committee studying light rates recommended that
"Trial 3-A" be accepted and that Mr. Wayne Johnson be
instructed to prepare the necessary rate tables, rules
and regulations, and governing ordinances for Council
consideration.
Moved by Councilman Teasley, seconded by Councilman
-Ortuno, and unanimously carried that the matter be re-
ferred to Mr. Wayne Johnson to set up the tables,
necessary rules and regulations, and governing Ord-
inance under 'Trial 3-A".
A Resolution was prepared approving an electrical dis-
tribution agreement with Lee and Daniels.

THE,CITY CLERK TO ATTEST SAME.
Moved by Councilman Fawcett, seconded by Councilman
Teasley and ordered carried that further reading be
waived.
Moved by Councilman Fawcett, seconded by Councilman
Teasley that the Resolution be adopted. This Resolu-
tion.was then passed and adopted by the following vote
of Council:

A Consumer's agreement and application for installation Consumer's
of water mains between Assets Reconstruction Corporation Agreement -
and the City of Azusa was presented for Council approval. Assets Recon -

Supt. Smith requested permission to attend the American V. Smith and
Water Works Conference in Los Angeles, October 28-31, W.Teasley to
with an expense advance of $125.00. attend Am.
Moved by Councilman Fawcett, seconded by Councilman Water Works
Ortuno, and unanimously carried that Supt. Smith be Conference
authorized to attend the Water Conference in Los Angeles
with an expense advance of $125.00 to be accounted for.
Councilman Teasley stated that he would also like author-
ization to attend a portion of the Water Works Conference.
Moved;�by Councilman Fawcett, seconded by Councilman
Ortuno, and unanimously carried that Councilman Teasley
be authorized to attend the Water Works Conference as
time permits, and that he be reimbursed for all necessary
expenses.
Supt. Smith requested that an Ordinance be prepared

within the City limits without first obtaining per-
mission from the City Council.
Moved by Councilman Fawcett, seconded by Councilman
Teasley and unanimously carried that the City Attorney
be instructed to prepare an Ordinance regulating the
serving of water within the City of Azusa.
Mrs. Delaney, owner of property on South Azusa Avenue,
who had requested permission to address the Council,
did -not appear at the meeting.
Mr. Tscharner appeared before Council and stated that
Redevelopment
he has received a letter from the Housing and Home
Area to be
Finance Agency asking that the redevelopment area be
reduced in
reduced in size due to limited funds being made avail-

able by the Government. Mr. Tscharner stated that a
-new application must be filed with the Agency within
six weeks in order for the City to hold their position
in line for funds.
Mr. Tscharner announced that he had received a decision Decision -
from the District Court of Appeal of the State of City vs.
California in the case of the Jehovah's Witnesses versus Jehovah's Wit.

Azusa. Mr. Tscharner stated that in the
contentions of the City had been upheld.

In`regard to another matter, Mr. Tscharner stated he
had received a complaint that a person had dug up part
oflthe parkway in front of the neighbor's home and put
concrete in the parkway. Mr. Tscharner requested that
the person be required to remove the concrete.
Moved by Councilman Teasley, seconded by Councilman
Fawbett; and ordered carried that the matter be referred
to the'Administrative Officer for study and report to
Council�at the next meeting.
A request was received from Mr. Radford of the Watershed
Commission asking that the City adopt a motion request-
ing the'County to reseed the burned watersheds resulting
from the recent forest fires. Notice was also given of
aImeeting to be held at the Bradbury City Hall on Oct-
ober;7th regarding action to be requested on flood control
conditions. Representatives of the Cities of Bradbury,
Duarte. -Monrovia, and Azusa were requested to attend.
Moved'by Councilman Fawcett, seconded by Councilman
Teasley, and unanimously carried that the City Council
request the Los Angeles Board of Supervisors to reseed
the burned areas affecting the four Cities of Bradbury,
Duarte, Monrovia, and Azusa.
The hour of 8:00 P.M. was set for the protest hearing in
regard to Southerly Annexation District No. 31, located
on Gladstone Street, west of the Little Dalton Wash.
The Administrative Officer presented the affidavit of
publication of the Notice of Hearing and stated that all
property owners in the area involved had been advised.
No written protests had been received, and no one was
present in the audience to protest.
Councilman Teasley stated that the County had a new SRD
zoning, Scientific Research Development, which he would
like'to have considered for the area in question, and
suggested that the zoning of this area be referred back
to the Planning Commission for study.
Moved by Councilman Johnson, seconded by Councilman
Fawcett, and ordered carried that the hearing be closed.
This was the time set for the public hearing regarding
the proposed amendment to the Zoning Ordinance No. 535,
Section 9231,13, in regard to variances. The City Clerk
presented the affidavit of publication giving notice of
Proposed Amendment and stated that there were no written
protests filed in his office. No one in the audience
wished to protest. ,
Moved by Councilman Fawcett, seconded by Councilman
Ortuno,-and ordered carried that the hearing be closed.
This was the time set for the proposed zone change
from M-1 to M-2 of the J. C. Daniels property, located
in the vicinity of Orange Avenue on 9th Street. This
change was recommended by the Planning Commission.
The City Clerk presented the Affidavit of Publication
giving Notice of Hearing and list of names of property
owners within 300 feet to whom notices were mailed.
The'City Clerk had a petition containing 147 names of
persons opposed to the zone change, which had been
filed with him at the meeting of September 15, 1958.
Mayor Memmesheimer asked whether there were any per-
sons in the audience wishing to protest the proposed
zone change. Those appearing to protest were:
James Harkee, 925 N. Sunset Avenue, stating that the
present zoning was too lenient for the neighborhood.

William Worsley, 930 N. Orange Avenue, stating that
it would be a detriment to the neighborhood.
Mrs. John Gray, 525 Crescent Drive, stated that a
petition had been presented to Council before the
current, zoning was granted.
Joseph W. Phillips, 935 N. Sunset, objected to the
excessive noise, etc.
Moved by Councilman Johnson, seconded by Councilman
Fawcett, and ordered carried that the hearing be
closed.
Moved•by Councilman Johnson, seconded by Councilman
Fawcett that the request for M-2 zoning be denied.
Tkiis motion carried unanimously.
Notice was given that the Planning Commission has re-
commended a zone change from R -lc to P of Lot 106,
Tract 13824 (444 S. Vernon Avenue).
Moved by Councilman Fawcett, seconded by Councilman
Ortuno, and ordered carried that a public hearing be
set for 8:00 P.M. at the meeting of November 3rd.
A request was received from Harold Johnson, Engineer
for Tract 21808, requesting an extension of time on
this Tract. The owners of the Tract have indicated
that they will put up the bond for sewers, if the City
will give them definite information as to where the
hook -in will be with the City main.
The City Engineer reported that the Corps of Engineers
are now requesting the City to obtain an easement over
their lands from the County Recreation Department, since
theiarea,at the.iSahta Fe Dam is being considered for
recreation activities. The Engineer also stated that
difficulty has been met on acquiring the sewer line on
Irwindale Avenue as disposal of the line has been de-
legated to General Service Commission.
Moved by Councilman Teasley, seconded by Councilman
Fawcett, and ordered carried that letters signed by
,the Mayor be addressed to the representative in Wash-
ington requesting their assistance in helping the City
to obtain the line or permission to tie into it.
Moved by Councilman Fawcett, seconded by Councilman
Teasley, and unanimously carried that a six months
extension be authorized on Tract 21808.
Notice was given that the Planning Commission members
planning to attend the League of California Cities
Conference are Mr. Solem, Mr. Nelson, and Mr. Downard.
A committee report was received from the City Engineer,
Police Chief and Fire Chief on the State Highways
recommendation for traffic signals on Azusa Avenue
and -San Gabriel Avenue. The committee recommended
that the signals be installed, as suggested by the
State, and also recommended that the State Highway
Division be requested to remove the excess crown and/
or,decrease the curb face on Azusa Avenue.
Moved by Councilman Fawcett, seconded by Councilman
Teasley that the recommendation of the Committee be
accepted and that authorization be given to negotiate
with the State on the contract for the traffic signals.

The City,Engineer has suggested creating the position
of "Senior Civil Engineering Assistant" with a salary
range of 36, and further recommended that if the appli-
cant holds a Civil Engineer's license from the State of
California, the range be set at 37.
Moved by Councilman Fawcett, seconded by Councilman
Teasley, and unanimously carried that this matter be
referred to the Personnel Board with a favorable recom-
mendation from Council.
The -'Committee selected to consider the possibility of
buying a'used street grader at a price of $13,000, with
a trade-in allowance of $1,000. for the worn out grader
owned;by the City and $400. trade-in for an obsolete
water wagon, has recommended the purchase of the grader.
Moved°by Councilman Fawcett, seconded by Councilman
.Teasley, and unanimously carried that the recommendation
for:thepurchase of the used grader be accepted.
It was recommended that, rather than go to bid on
uniforms for use of the Public Works Department, better
service'could be obtained by negotiations with a dealer
in this area.
Moved by Councilman Fawcett, seconded by Councilman
Teasley, and unanimously carried that the Administrative
Officer be authorized to negotiate for prices on uniforms
to'be"used by the Public Works Department and present the
prices to Council.
Upon the request of Council, Superintendent of Public
Works Brusnahan investigated the unpaved alley south
of Ninth Street between Alameda and Dalton Avenues. It
was recommended by the Supt, of Public Works that this
alley be paved.
Moved by Councilman Fawcett, seconded by Councilman
Orturio, and ordered carried that authorization be given
for -the paving of the alley south of Ninth Street,
located between Alameda and Dalton Avenues.
Supt. Brusnahan reported that he had been offered $600
for the.'purchase of a sewage pump, for Whibh the City
has no use.
Moved by Councilman Teasley, seconded by Councilman
Fawcett,'and ordered carried that the Administrative
Officer.be authorized to negotiate for the sale of the
sewage pump at a price of no less than $600.

Mrs. Frances Madrigal, Clerk -typist in the Recreation F. Madrigal
Department, requested a six months leave of absence as leave denied,
of November 15, 1958, for maternity reasons. It was placed on
pointed out that Mrs. Madrigal was still on her pro- elig. list
bationary period under her present classification.
Movedby Councilman Fawcett, seconded by Councilman
Teasley, that the request for the leave be denied, but
that Mrs. Madrigal's name be placed on the eligibility
list for future employment. This motion carried unanimously.
It was requested by the Recreation Director that an
examination be given for Stene -Clerk for the Recreation
Department, due to the fact that Mrs. Madrigal will be
leaving as of November 15th.
Moved by Councilman Johnson, seconded by Councilman
Ortuno, and ordered carried that the Personnel Bard
be authorized to hold an examination for Steno -Clerk.
It was recommended that the Recreation Director, due to
the nature of his duties, be granted a monthly mileage
allowance for the use of his personal car.
Moved by Councilman Ortuno, seconded by Councilman
Teasley that the Recreation Director be allowed $60.00
monthly mileage for the use of his personal car in his
duties. This motion carried by the following vote:

The legal description on Annexation District No. 22 did not
include enough of Citrus Avenue to guarantee Mr. Powers
access to his property, therefore, it was recommended that
the Resolution initiating the annexation be repealed and
new boundaries submitted to the Commission.

County Building Code. This Ordinance will encompass

Councilman Fawcett offered for its first reading the

- After reading the title of said Ordinance and the title
of.each of 'said Codes, it was moved by Councilman
,Fawcett, seconded by Councilman Ortuno, and unanimously
carried that further reading be waived.
Moved by'Councilman Fawcett, seconded by Councilman
Ortuno, and unanimously carried that public hearing be
set fdr,the meeting of November 3, 1958, and authorizing
the Administrative Officer to publish notice of the hearing.
Authorization was requested for the City Attorney to City Atty. to
sign Cancellation of Taxes for Highway Purposes, sign tax

Moved by Councilman Fawcett, seconded by Councilman
Ortuno,:and unanimously carried that the City Attorney
be authorized to sign the Tax Cancellation.
Upon,review of the franchise and agreement with the City Atty.
Pacific Electric Railway in connection with the proposed recommendation
abandonment of a section of the line, the City Attorney re P.E.Railway
suggested that the City could agree to the rails and ties abandonment
being left in the Street if:
1. -The Pacific Electric received P.U.C. approval for
abandonment of the line.
2. The franchise is properly amended.
3. The Pacific Electric Railway conveys to the City
Fee,Title for its 80 x 530 feet right of way ex-
tending easterly from Pasadena Avenue.
It was the opinion of the City Engineer that if the
80' x 530' parcel was given to thb City, the City would
do the necessary paving over the rails.

Moved by Councilman Fawcett, seconded by Councilman
Ortuno, that the City Engineer be authorized to
negotiate with the Pacific Electric along the lines
suggested by the City Attorney. This motion carried
by the following vote:

ABSENT: Councilmen: None
Mr. Robert Talley of the Downtown Businessmen's
Association Committee on Off -Street Parking stated
that -Mr: and Mrs. Singleton, owners of the property
being considered for a parking site, would be willing
to enter into a five year lease with the City at $150.00
per month clear to them, with option by the City for re-
newal,and renegotiation. It was determined by Council
that if -the Association would care for the clearing,
paving, approaches, bumper guards and striping, the City
would pay for necessary fencing and lighting of the lot.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno', and ordered carried that the City Attorney and
the Administrative Officer be authorized to negotiate
the lease with the Singletons, along with the off-street
parking committee, and return to Council for approval.
Authorization is given for the lease to be signed upon
deposit with the City of sufficient funds to make the
necessary improvements.
Councilman Ortuno offered for its first reading the
following Ordinance entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA
AMENDING TROVISIONS OF ORDINANCE NO. 535 RELATING TO
THE -GRANTING OF VARIANCES.
Moved by, Councilman Ortuno, seconded by Councilman
Fawcett,.and unanimously carried that further reading
be waived.
A Resolution was prepared honoring Sheriff Biscailuz
upon his retirement.
Councilman Johnson offered the following Resolution
entitled: '
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
COMMENDING EUGENE W. BISCAILUZ UPON HIS RETIREMENT AS
SHERIFF OF THE COUNTY OF LOS ANGELES.

The City Attorney requested authorization to obtain a
condemnation report on the property referred to in the
above Resolution.
Moved by Councilman Johnson, seconded by Councilman
Ortuno, and ordered carried that the City Attorney be
authorized to obtain a condemnation report on the property
by Slauson Park.
It was reported to Council that the employees had voted,
by -a majority of 67 to 49, for the Blue Cross Hospital
Plan, -which _ is a basic plan with a super -imposed major
medical. The employees also voted for a life insurance
policy of $1,000. per employee.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno, 'and unanimously carried that authorization be
given for the drawing of a contract on the insurance
program to be submitted to Council for approval.
The Jugadores Club requested permission to sponsor a
benefit'dance at the Parish Hall on November 14, 1958.
Moved by -Councilman Ortuno, seconded by Councilman
Fawcett, and ordered carried that this matter be
referred -to the Chief of Police with power to act.
Application for a solicitor's license was requested
by the Interstate Utilities Corporation. This Corp-
oration has been licensed in the City in the past.
Moved by Councilman Ortuno, seconded by Councilman
Teasley, and ordered carried that the license be
granted.
Notice was given of a hearing to be held before the
Public Utilities Commission on the application of the
Western'Union Telegraph Company for a rate increase.
Moved by Councilman Johnson, seconded by Councilman
Ortuno, and ordered carried that the notice be filed.
Notice was received from the County Auditor of rates
to be charged for City Prosecutor services during the
fiscal year 1958-59. They are: $7.49 an hour for
Deputy District Attorneys 1, 2, and 3; and $3.80 an
hour for legal secretaries and statement reporters.
Moved by Councilman Ortuno, seconded by Councilman
Teasley, and ordered carried that the report be filed.
A report was submitted by the Committee selected to
study the proposed site and fire station. The Committee
stated that they had viewed the land owned by the City
on -Angeleno Avenue, which is 100 feet frontage by 150
feet depth, and recommended that the City acquire the
lot to the south and adjoining, which has a dimension
of 50 feet by 150 feet. It was also suggested that the
City acquire two 50 ft. lots on Sunset Avenue, abutting
onto the first 100 feet on Angeleno Avenue. This would
give an "L" shaped parcel of land with 100 feet on
Sunset Avenue, 300 feet along Sixth Street, and 150 feet
on Angeleno Avenue. This area would give sufficient
room for off-street parking, testing pit, drying rack,
training tower, and other needed facilities.

Teasley, and unanimously carried that the recommendation
of the Committee be approved and authorization be given
for the Administrative Officer to obtain an appraisal of
the property located south of the City -owned property on
Angeleno, and of the property along Sixth Street and
Sunset Avenue.

Mr. Charles Gaines, President of the Chamber of Commerce, C. of C. to

half.. The Administrative Officer was asked to make re freeway
arrangements for a meeting between the Chamber and Mr.

Azusa the latter part of November.

from 1125 W. Foothill Blvd. to 1038 Bayless St., Azusa.
This dwelling is a new model home.

Councilman Ortuno presented a letter stating that Ltr. from
pursuant to Section 33,235 of the Health and Safety Cnclman Ortunc
Code of the State of California, he is the owner of re ownership
property located on Alameda Avenue within the limits of property in
of the Redevelopment Agency Area. It was stated, Redevelopment
however, that when the Redevelopment Area is reduced Area
in size, this property will no longer fall within the
area.
