CONFERENCE WITH LABOR NEGOTIATORS - Pursuant to California Government Code, Section 54957.6. City Negotiator: Sergio Gonzalez, City Manager and Tanya Bragg, Director of Human Resources & Risk Management Organizations: SEIU (Service Employees International Union- Local 721), ACEA (Azusa City Employees Association), AMMA (Azusa Middle Management Association), APOA (Azusa Police Officers Association), CAPP (Civilian Association of Police Personnel), and APMA (Azusa Police Middle Management Association), Unrepresented Employees. 2. CONFERENCE WITH LEGAL COUNSEL – THREAT OF LITIGATION – Pursuant to California Government Code, Section 54956.9(d)(2). One potential case – 975 W. NOTICE TO THE PUBLIC FOR REGULAR MEETING In compliance with Government code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Foothill Blvd.; copies for public view are at the Azusa City Library - 729 N. Dalton Ave., Azusa Police Department Lobby - 725 N. Alameda Ave., and the City of Azusa Web Page www.ci.azusa.ca.us. Persons who wish to speak during the Public Participation portion of the Agenda or on a Public Hearing item, shall fill out a card requesting to speak and shall submit it to the City Clerk prior to 7:30 P.M.; cards submitted after will not be accepted. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items within the subject matter jurisdiction of the council/agency board that are not listed on this agenda or are listed on this agenda as an item other than a public hearing item. Members of the audience will have the opportunity to address the city council/agency board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the council/agency board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. The council/agency board will respond after public comment has been received. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments shall be handled after the speaker has completed his/her comments. (Oral Report) 2. City Clerk: NOTICE IS HEREBY GIVEN that the following City Commissioners terms of office will expire on September 30, 2019: 2 positions Library Commission 3 positions Park & Recreation Commission 1 position Personnel Board 2 positions Planning Commission The following City Commissioner term of office has been vacated and will expire on September 30, 2020: 1 position Park & Recreation Commission Applications for these positions will be accepted in the Office of the City Clerk through 5:00 p.m. on Wednesday, August 14, 2019. Alameda, and at: www.ci.azusa.ca.us. D. SCHEDULED ITEMS 1. ADOPTION OF FISCAL YEAR 2019/20 CITY, UTILITIES, PUBLIC FINANCING AUTHORITY, AND SUCCESSOR AGENCY OPERATING AND CAPITAL IMPROVEMENT PLAN BUDGETS AND CITY GOALS AND PRIORITIES. RECOMMENDED ACTION: 1) Approve Resolution 2019-C20, A Resolution of the City Council of the City of Azusa adopting the budget and approving appropriations for the City of Azusa for the fiscal year commencing July 1, 2019 and ending June 30, 2020; 2) Approve Resolution 2019-UB06, A Resolution of the Utility Board of the City of Azusa adopting the budget and approving appropriations for Utilities for the fiscal year commencing July 1, 2019 and ending June 30, 2020; 3) Approve Resolution 2019-P1, A Resolution of the Azusa Public Financing Authority of the City of Azusa adopting the budget and approving appropriations for the Authority for the fiscal year commencing July 1, 2019 and ending June 30, 2020; and 4) Approve Resolution 2019-R09, A Resolution of the Successor Agency for the Former Redevelopment Agency of the City of Azusa adopting the budget and approving appropriations for the Agency for the fiscal year commencing July 1, 2019 and ending June 30, 2020; and 5) Reaffirm the attached City of Azusa Fiscal Year 2019/20 City Council Goals and Priorities. 2. DISCUSSION AND DIRECTION REGARDING PROPOSED COMMERCIAL AND OVERSIZED VEHICLE ORDINANCE. 6/17/2019 - 4 - RECOMMENDED ACTION: Review the information contained in this report and provide direction regarding a proposed oversized vehicle ordinance. E. CONSENT CALENDAR The Consent Calendar adopting the printed recommended actions will be enacted with one vote. If Councilmembers or Staff wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. 1. MINUTES OF THE SPECIAL MEETING OF MAY 28, 2019. RECOMMENDED ACTION: Approve minutes as written. 2. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED MAY 31, 2019 THROUGH JUNE 12, 2019. RECOMMENDED ACTION: Adopt Resolution No. 2019-C21 allowing certain claims and demands and specifying the funds out of which the same are to be paid. 3. HUMAN RESOURCES ACTION ITEMS. RECOMMENDED ACTION: Approve the Personnel Action Requests in accordance with the City of Azusa Civil Service Rules Section 5.7.5 and applicable Memorandum of Understanding(s). 4. REQUEST TO APPROVE PROFESSIONAL SERVICES AGREEMENT WITH LDM ASSOCIATES, INC. FOR ADMINISTRATIVE AND LABOR COMPLIANCE SERVICES FOR THE CITY OF AZUSA COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM. RECOMMENDED ACTION: Approve a Professional Services Agreement with LDM Associates, Inc. for Community Development Block Grant (CDBG) administrative and labor compliance services in an amount not to exceed $40,000 for FY 2019-20; and Authorize the City Manager to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. 5. APPROVAL OF UPDATED MOU AGREEMENT BETWEEN THE CITY AND TASKFORCE FOR REGIONAL AUTOTHEFT PREVENTION. RECOMMENDED ACTION: Approve the Updated Memorandum of Understanding (MOU) between the Los Angeles County Sheriff’s Department, Taskforce for Regional Auto theft Prevention (TRAP) and the City of Azusa to continue participation in TRAP; and Authorize the City Manager to execute, in a form acceptable to the City Attorney, the MOU on behalf of the City. 6. AUTHORIZATION TO USE GENERAL FUND INSURANCE RESERVE FUNDS TO SETTLE CLAIMS. 6/17/2019 - 5 - RECOMMENDED ACTION: If a settlement is reached, approve the disbursement of funds up to $614,084.66 from the City’s designated Insurance Reserve account to settle two Worker’s Compensation claims. 7. ADOPT RESOLUTION APPROVING THE AZUSA-RMC JOINT POWERS AUTHORITY BUDGET FOR FISCAL YEAR 2019-20. RECOMMENDED ACTION: Adopt Resolution No. 2019-C22 approving the Azusa-RMC Joint Powers Authority Budget for Fiscal Year 2019-20. 8. RENEWAL OF JAIL SERVICES WITH THE G4S SECURE SOLUTIONS (USA) INC. RECOMMENDED ACTION: Approve the renewal of the Operating Contract for the Azusa City Jail with the G4S Secure Solutions (USA) Inc. for another three (3) year term with two additional optional one (1) year terms.; and Authorize the City Manager to execute the agreement, subject to changes made by the City Attorney and Human Resources Director to the insurance and indemnity provisions as recommended by the City’s insurance carrier, on behalf of the City. 9. AUTHORIZATION TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH TKE ENGINEERING, INC. FOR THE FOOTHILL BOULEVARD PAVEMENT REHABILITATION FROM AZUSA AVENUE TO ALOSTA AVENUE PROJECT. RECOMMENDED ACTION: Authorize the City Manager to enter into a professional services agreement with TKE Engineering, Inc. for a not to exceed fee of $74,140 to provide professional engineering services for the Foothill Boulevard Pavement Rehabilitation from Azusa Avenue to Alosta Avenue Project. 10. ADOPTION OF GANN APPROPRIATIONS LIMIT FOR FISCAL YEAR 2019-20. RECOMMENDED ACTION: Adopt Resolution No. 2019-C23, approving and adopting the Annual Appropriations Limit for the Fiscal Year 2019-20 in the Amount of $343,668,853. 11. REQUEST TO APPROVE TEMPLATE FOR LICENSE AGREEMENT FOR TEMPORARY ACCESS TO CITY-OWNED TRASH ENCLOSURES IN THE DOWNTOWN. RECOMMENDED ACTION: Approve a template for a License Agreement to allow temporary access to City-owned trash enclosures located in the City’s Downtown; and Authorize the City Manager to prepare and execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. 12. APPROVAL OF CITY-COUNTY MUNICIPAL SERVICES AGREEMENT WITH COUNTY OF LOS ANGELES DEPARTMENT OF ANIMAL CARE AND CONTROL. 6/17/2019 - 6 - RECOMMENDED ACTION: Authorize the Police Department to enter into a five-year agreement with the County of Los Angeles Department of Animal Care and Control for an estimated amount of $190,000 for Fiscal Year 2019-20. 13. APPROVAL OF AMENDED AND RESTATED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 721. RECOMMENDED ACTION: Approval of amended and restated Memorandum of Understanding between the City of Azusa and the Service Employee International Union. 14. APPROVAL OF AMENDED AND RESTATED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE AZUSA POLICE MANAGEMENT ASSOCIATION. RECOMMENDED ACTION: Approve the amended and restated Memorandum of Understanding between the City of Azusa and the Azusa Police Management Association in draft format; and Authorize the City Manager to execute the agreement, subject to non-substantive changes to the MOU provisions. 15. APPROVAL OF AMENDED AND RESTATED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE AZUSA POLICE OFFICERS ASSOCIATION. RECOMMENDED ACTION: Approve the amended and restated Memorandum of Understanding between the City of Azusa and the Azusa Police Officers’ Association in draft format; and Authorize the City Manager to execute the agreement, subject to non-substantive changes to the MOU provisions. 16. CITY TREASURER’S STATEMENT OF CASH AND INVESTMENT BALANCES FOR THE MONTH OF APRIL 2019. RECOMMENDED ACTION: Approve the issuance of Blanket Purchase Orders detailed on the attached schedule, in an amount of $25,000 or more as outlined in Sec. 2-518 (a) of the Azusa Municipal Code. 17. BLANKET PURCHASE ORDERS OVER $25,000 FOR FISCAL YEAR 2019-2020 (CITY AND SUCCESSOR AGENCY). RECOMMENDED ACTION: Receive, review, and file the City Treasurer’s Report for the month of April 2019. F. ADJOURNMENT.
