Mayor Memmesheimer called the meeting to order. ,Present at Roll Call: Councilmen: Fawcett, Ortuno, Teasley, Memmesheimer Absent: Councilman: Johnson 165 7:30 P.M. Call to Order Roll Call Also,. Present: Supt. of Light and Water Smith, City Clerk -Administrative Officer V.F.W. Miller authorized Mr. Clifford H. Powers, who was recently granted a C.H.Powers conditional use permit for the construction of a request for medical building at 6130 N. Citrus Avenue, appeared ingress and before Council to request some means of granting him egress on ingress and egress to his property from Citrus Avenue Citrus Ave. . by allowing a 20 foot drive. When Mr. Powers previously property sold some of his property to subdividers, the tract map, when received, showed the driveway access as being closed up. Moved,by Councilman Ortuno, seconded by Councilman Res. 3859 - Teasley, and unanimously,carried that the City Attorney Accepting be -authorized to prepare the necessary papers, preferably Quitclaim Deed a Grant of Easement, to allow Mr. Powers ingress and portion of egress -on Citrus Avenue. Calera St. Moved by Councilman Ortuno, seconded by Councilman Teasley, -and ordered carried that further reading be waived. Moved by Councilman Ortuno, seconded by Councilman Fawcett, that the Resolution be adopted. This Res- olution was then passed and adopted by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Teasley, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: Johnson and numbered Resolution No. 3859• The Planning Commission advised Council that they had prepared two Resolutions for the purpose of clarifying portions of the Zoning Ordinance: (1) Rest Homes (which are defined, but have no specific place in the Zoning Ordinance) should be added to uses permitted in C-2 (Restricted Commercial). Res. to be prepared re clarification of Zoning Ord, A request was received from the Veterans of Foreign V.F.W. Wars for permission to sponsor a Flag Day parade in authorized Azusa. to sponsor Moved'by Councilman Fawcett, seconded by Councilman Flag Day Teasley, and unanimously carried that the request be parade granted and the permit for the parade be issued, all details to be worked out with the Police Department with the cooperation of the other Departments. A Resolution was prepared for the acceptance of a deed for a portion of Calera Street adjoining the Powell School on Mauna Loa. Councilman Ortuno offered the following Resolution Res. 3859 - entitled: Accepting Quitclaim Deed A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA portion of ACCEPTING A QUITCLAIM DEED AND DIRECTING THE RECORDA- Calera St. TION THEREOF. Moved by Councilman Ortuno, seconded by Councilman Teasley, -and ordered carried that further reading be waived. Moved by Councilman Ortuno, seconded by Councilman Fawcett, that the Resolution be adopted. Moved by Councilman Ortuno, seconded by Councilman Fawcett, and ordered carried that the City Attorney review the Resolutions and if in order, prepare the necessary papers for the clarification of the Zoning Ordinance. Notification was given by the Planning Commission that Mr. E, J.'Dvorak had been granted a Variance to allow .for the construction of a twenty unit apartment house on adjoining lots having more than 13,000 square feet in area. This property is described as Lots 31 and 32, `Block 77, Map of Azusa. Approval was requested of Tentative Tract Map No.17395 for a 3J acre tract with R-3 zoning on South Azusa Avenue, between 1st Street and Azusa Lane. The map, however, was not available at the meeting for inspection by members of the Council. Moved by Councilman Teasley, seconded by Councilman Ortuno, and ordered carried that the matter be tabled until the next regular meeting. The Planning Commission notified Council that they had interviewed one Planning Consultant and have plans to interview another. They further stated that a recom- mendation for the employment and tasks to be accom- plished by a Consultant will be submitted to Council shortly. The Chief of Police requested confirmation of the ap- pointments of Gordon E. Silvius, George L. Morse, and Richard A. Lara, as Sergeants, effective 2-16-59. The three men named are the top three on the current eligi- bility list. After consulting with the Department Head, it was,recommended by the Administrative Officer that the three men being appointed to Sergeant be placed on Step.3 of the salary range of Sergeant, but with each man retaining the anniversary date of his appointment and with credit for the length of time served in Step 4 as Patrolman to apply towards the 18 months necessary between'Step 3 and Step 4 of Sergeant. Moved by Councilman Fawcett, seconded by Councilman Teasley, and unanimously carried that the recommendation of the Department Head and the Administrative Officer be accepted and that the three men named be appointed Ser- geant at Step 3 of the salary range, effective 2-16-59. 167 Page 2 Variance granted E.J.Dvorak Approval of Ten. At the.last meeting of the Park and Recreation Com- Park & Rea. mission discussion was held as to the proposed Ord- recommendat inance,relative to the flying of motor power model re Ord. on airplanes. It was recommended by the Commission that model airpl the Ordinance be enacted with the following amendment: "with the exception of places designated by the Park and Recreation Commission". Moved by Councilman Fawcett, seconded by Councilman Ortuno, and ordered carried that the recommendation of the Park and Recreation Commission be accepted, and the City Attorney authorized to prepare a new Ordinance including the suggested amendment. sss CITY HALL AZUSA, CALIFORNIA TUESDAY, FEBRUARY 17, 1959 Notification was given by the Park and Recreation Com- mission of the resignation of Mrs. Ruthellen Foltz from the Commission, effective immediately. Moved by Councilman Ortuno, seconded by Councilman Fawcett, and ordered carried that the resignation be accepted with regrets, and that the Administrative Officer write a letter of commendation to Mrs. Foltz. It was recommended by Mayor Memmesheimer that Mrs. Catalina Ramirez, who has previously served on the Commission, be appointed to the Park and Recreation .-Commission. Mbved iby Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that the recommendation kof Mayor Memmesheimer be accepted and that Mrs. Catalina Ramirez be appointed to the Park and Recrea- tion Commission to serve for the duration of the term of Mrs.' -Foltz. ,Authority was requested for the City Attorney to sign Tax Cancellation for Highway Purposes, Authority No. 41426. Moved by Councilman Fawcett, seconded by Councilman Teasley, and ordered carried that the City Attorney be'authorized to sign the Tax Cancellation. An Ordinance was prepared authorizing the new Light rates to be set by Resolution. Councilman Fawcett offered for its first reading the following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA RELATING TO THE ADOPTION OF RATES AND CHARGES AND RULES AND REGULATIONS OF THE LIGHT AND POWER DEPARTMENT. This Ordinance was read in full. Moved by Councilman Ortuno, seconded by Councilman Teasley, and unanimously carried that authority be given for the p^ inting of rates, rules and regulations to accompany the Resolution regarding the light rates. The Treasurer's Financial Statement as of January 31, 1959, was submitted to Council. The statement shows: Bank Balances, exclusive of Investment Account, $372,698.27; Treasury Bills, $400,000.00; Earnings on Bills and Deposits, $31,867.10; or a total of $804,565.27. Notice was given that the statement of income and ex- penditures for the Chamber of Commerce for the quarter ending December 31, 1958, has been received and is on file in the Clerk's office. Notice was also given that a statement in the amount of $156.70 for work done so far on the accomplishment of the Chamber of Commerce brochure has been received. Authorization was given previously for payment of this statement. The City Clerk stated that communications had been received from the "Daughters of the American Colonists" with accompanying Resolutions recommending local gov- ernments to: ,,(1) Void the promotion or enactment of Fair Employment Practice legislation; 2 Opposing Urban Renewal 3 Oppose Mental Health Program; 4 Urge rescinding, voiding, etc. the treaty with the United Nations Organization; (5) Oppose "Metro" or UNESCO - Metropolitan Area Government. 269 Page,3 Resignation Mrs. R.Foltz from Park & Rec. Notice was given that carbon copies of communications forwarded by Councilman Johnson regarding the request for an easement for road purposes from the Corps of Engineers have been received in the Clerks office. Moved by Councilman Fawcett, seconded by Councilman Teasley, and ordered carried that the communications be•filed. A'letter was received from the Muscular Dystrophy Association of America requesting permission to con- duct fund-raising campaigns in the City during the 'month of December, 1959. „ Moved by Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that the request be •referred to the Chief of Police with power to act. Councilman Fawcett stated that signs relating to City promotion or events should be placed in a location and in such a manner so as not to detract from the beauty`of the Civic Center. Notice was given that a copy of the minutes of the Board -of Directors, meeting of the League for February has been received and is on file in the Clerk's office. A letter was received from the Upper San Gabriel Valley Water Association to ascertain whether or not the City of Azusa intends to maintain producer membership in the Association for the current year. This membership re- quires payment of dues and assessments, statements of which have previously been forwarded to the City. Moved by Councilman Ortuno, seconded by Councilman Fawcett, and ordered carried that the Administrative Officer write a letter to the Association stating that they are willing to pay the dues and continue membership in the Association, but that they do not wish to pay the assessment inasmuch as the money is being used for the formation of a water district. Notice was given bf the regular meeting of the Los Angeles•County Watershed Commission to be held in Pasadena on Friday, February 27th. Councilmen Teasley is to attend this meeting, and Councilman Fawdett will attend the Civil Defense meeting on the same day. The California Municipal Utilities Association has quested,approval of the adoption by their group of Resolution urging Congress to appropriate funds fo the fiscal year 1960 to permit immediate design and construction of the Trinity River Division of the Central Valley Project by the Federal Government. Moved by Councilman Fawcett, seconded by Councilman Ortuno, and ordered carried that the correspondence be filed. A letter was received from the California Roadside Council stating they had submitted two bills to Legis- lature in regard to different aspects of the billboard regulation problem. Assn. letter Moved by Councilman Fawcett, seconded by Councilman filed Teasley, and ordered carried that the communication be filed. A'letter was received from the American Little League Am. Little stating,that when the area on West First Street was League request fenced for them, the League field was left without a referred to gate. It was stated that damage was done to the field Supt;-of:-Publ: -by vehicles being driven through the opening, and a Works request'was made for a gate to be furnished as soon as possible. Moved by Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that the request be re- ferred to the Superintendent of Public Works with 'power to act. It was suggested by the Administrative Officer that Committee to a Committee be selected to study the best use to be study plans made of the old Library Building. It was recommended for use of by Mayor Memmesheimer that a committee composed of the old Library 'City -Engineer, Supt. of Light and Water, Supt. of Public building Works, Fire Chief, Councilmen Fawcett and Teasley, and the Administrative Officer determine the best use to be made of the old Library building. Moded-•by Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that the recommendation of the Mayor for the Committee be approved. A Resolution was prepared regarding the route of the proposed freeway. Councilman Ortuno offered the following Resolution Res. 3860 - entitled: Re Freeway location A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA RECOMMENDING TO THE DIVISION OF HIGHWAYS OF THE STATE OF CALIFORNIA A ROUTE FOR THE PROPOSED FOOTHILL FREEWAY THROUGH THE CITY OF AZUSA. This Resolution was read in full. Moved by Councilman Ortuno, seconded by Councilman Teasley, that the Resolution be adopted. This Res- olution was then passed and adopted by the following vote of -Council: AYES:- 'Councilmen: Fawcett, NOES: Councilmen: None ABSENT: Councilmen: Johnson Ortuno, Teasley, Memmesheimer and numbered Resolution No. 3860. It,.was stated that Councilman Teasley would represent the City Council at the public hearing on February 18th in regard to the freeway location. -Councilman Ortuno offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING_ CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Moved by Councilman Ortuno, seconded by Councilman Fawcett, that the Resolution be adopted. A•Resblution was prepared granting the General Telephone Company the variance approved at the Council meeting of February 16th. Councilman Ortuno offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE TO THE GENERAL TELEPHONE COMPANY. This Resolution was read in full. Moved -by Councilman Ortuno, seconded by Councilman Teasley, that the Resolution be adopted. It was requested that authority be given for payment in the amount of $350.00 for sandblasting of the City Hall buildings. Moved by Councilman Ortuno, seconded by Councilman Fawcett, and unanimously carried that payment be authorized.
