The stoppage resulted with moderate floor damage to the residence at 930 W. Fifth Street which is owned by Sergio and Lori Guzman. The Public Works Department along with Insurance Adjusters Carl Warren and Company have made numerous attempts to resolve Claim No. 91-63 to a mutual agreement. Many factors have arisen during the course of this claim i.e. ; soil contamination, the families personal health and the installation of a new sewer lateral. An outside service has been retained as an impartial third party. The most current recommendation from Carl Warren and Company is for the City to reconstruct the nearest manhole. The existing manhole is an obsolete siphon style and the lateral to the property has a slight reverse fall. The City's action to correct this deficiency could contribute to finalizing this claim. Six Contractors were solicited with only two responding with proposals. However, the low bid is $800. 00 over the Government Code thus requiring formal bidding procedure. INJURIES: 1. BI - Lori Guzman. We have opened this reserve as a precaution to see if an actual bodily injury claim may be presented by the claimant. PROPERTY DAMAGE: 1. Sergio & Lori Guzman. We had previously reported to you that there were three areas to this claim, which we were working on in an attempt to resolve the entire claim of EN TIESACil Mr. & Mrs. Guzman. The actual property damage to the lagioNf,h:r;frelsIlence had been confirmed and we had $1,848.12. Regarding the broken 22 = 93 m: 40 sewer line, we had previously received a repair bid from Roto Rooter in the amount of $5,800.00 and we have now Y9Oa • Page Two — City. _ .City of Azusa _... . 91-63 Sergio & Lori Guzman W-7966RU PROPERTY DAMAGE(Con't) : received a second repair bid from claimant Guzman from Cardenas Construction Company in the amount of $14,890.00. We have contacted Pacific Construction and Interiors and asked them to inspect claimant's property and provide us with an estimate of their costs for repairing the damaged sewer line. They have provided us with a tentative above ground repair of $1,799.48 but have recommended that a complete sewer line leak detection be performed to determine the exact location of any leakage or broken sewer pipe under ground. Once this has been completed he would be able to provide us with a final bid for repairs to the sewer line system. In regards to the possibility of soil contamination under claimant's residence, we have received a bid from Pacific Construction and Interiors which came out to $1,087.45 for performing decontamination and deodorization under claimant's residence. As part of this process he has also recommended some soil testing to determine the area of contamination, if any and would assist us in handling any possible bodily injury claim. The cost for performing the soil testing and leak detecting would be $3 ,091.00. At the time of Pacific Construction and Interiors inspection of claimant's residence, a check was made of the City's sewer line and apparently is still backing up and may be leaking into the claimant's sewer line leading to their residence. ..had been advised by Rpblic Works Director, LouieWarni—that the City's 1netiay be at an improper angle resulting in any sewer backup to proceed down the claimant' -ewe line.-towards their residence. Pacific Construction and Interiors cost for performing this service would be be $4,178.45 plus their profit and overhead of $835.70 making a total of $5,014.50. Once this work is completed we should have a better understanding of what is required to repair the claimant's sewer line and any soil contamination which may need to be addressed. Once the testing has been completed we will hopefully be able to resolve claimant's claim, including the damage to the interior broken sewer line and any soil contamination in the area of $8,000.00 to $9,000.00. We are opening an expense reserve at this time in anticipation of possible expenses incurred on this claim. . WORK TO BE COMPLETED: 1. Perform deodorization and decontamination of soil under claimant's residence, along with soil and leak detection, with authority from City. 2. Confirm final amounts to resolve this claim. A previous plumbing company has suggested that the sewer pipe at the house and under the soil have been damaged by the "Back-Pressure" of the City of Azusa / County Sanitation Departments ' Line in the street as evidenced by the man-hole being filled with sewage at times when the leak is most noticeable at the Guzmans' home. (Please Note! ! ) If the City or the County does not rectify the on-going situation at the street, then all remedial work will most certainly be damaged again!
