The City Council of the City of Azusa met in regular session at the above time and place. Mayor Memmesheimer called the meeting to order and led Call to Order in the salute to the flag. Invocation was given by Rev. W. E. Moody of the Azusa Invocation Evangelical Methodist Church. Present at Roll Call: Councilmen: Ortuno, Johnson, Roll Call Teasley, Memmesheimer Absent: Councilmen: None Also present: City Attorney Williams, City En- gineer Kirkgaard, Supt. of Light and Water Smith, Supt. of Public Works Brusnahan, Fire Chief Madison, Police Chief Kendrick, and City Clerk -Administrative Officer Miller. Mayor Memmesheimer asked if there were any corrections Approval of or omissions to the minutes of the meeting of March 16. Minutes - March 16 and 20 Councilwoman Johnson stated that on page 1, after the resignation of Mr. Fawcett from Council and from the Azusa Agricultural Water Company Board of Directors, the following motion should be inserted: Councilman Johnson moved bhat Mr. Victor C. Jabson be appointed to fill the vacancy on the Council. After the following paragraph, whereby Mayor Memmesheimer suggested that nominations be held off until the first meeting in'April, Councilman Johnson asked that the following be included: Councilman Johnson withdrew her motion regarding the nomination of Mr. Jabson. Mrs. Johnson also stated that on page 8, the item re- lating to Resolution 3872, the word "publically" should be corrected to read "publicly". With no"further corrections or omissions, the minutes were approved as corrected. Mayor Memmesheimer asked whether there were any corrections to the minutes of the adjourned meeting of March 20th. With no corrections, the minutes were approved as written. The Administrative Officer stated that a place was set aside on the Agenda for nominations for a member of Council to replace Mr. Fawcett, if Council so desired. Councilman Johnson nominated Victor C. Jabson. Councilman Ortuno stated that he had teen asked to nominate the following: Cecil °" •and Vern Rueter. At this'' -time Mr. Romero appeared before Council and declinbd the nomination. Councilman Teasley moved that Stephen A. Paul be nomin- ated for Councilman. Moved by Councilman Johnson, seconded by Councilman Ortuno, and ordered carried that nominations for appoint- ment of Councilman be closed. The nomination of Victor C. Jabson was presented to Council for vote. Mr. Jabson failed to be appointed by the following vote: AYES: Councilmen: Johnson NOES: Councilmen: Ortuno, Teasley, Memmesheimer ABSENT: Councilmen: None Nominations for Councilman 228 CITY HALL. AZUSA, CALIFORNIA MONDAY, APRIL 6, 1959 L. The'name bf Vern Rueter was placed before Council for vgte as to appointment. Mr. Rueter failed to be appointed by th-,following vote: AYES: Councilmen: Ortuno, Johnson '-NOES: - -Councilmen: Teasley, Memmesheimer ABSENT: Councilmen: None At this time Councilman Ortuno inquired of the City Clerk as to�the cost to the City of a special election. Mr. Ortuno'was advised that such a Special Election could cost ,approximately $1,600 to $1,800. The name of Stephen A. Paul was presented to Council for -vote as•to appointment as Councilman. ,"Councilman Johnson said that before voting, she would .like`tw make the following statement: 11 "During Mr. Paul's tenure on the Planning Commission he,has voted for several projects involved in the ill-fated Van Tassel dump site and annexation, and special zoning for one person. Mr. Paul also voted to adopt the Planning Commission Resolution No. 68, which falsely states that they 'thereby adopt the required elements of a City Master Plan. Mr. Paul well knew that no such plan existed. In both cases on'the Planning Commission Mr. Paul either voted as he was told; or he didn't know what he was voting on. I do not want another City Council member who either votes as he is told't'o vote, or does not know what he is voting on, and I shall have to vote no." .Mr.•Paul mas appointed to Council by the following vote: '._AYES:' Councilmen: Ortuno, Teasley, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Council agreed to adjourn until 7:30 P.M. on Tuesday, April` -7th, at which time Mr. Paul will be sworn in to ,the office of member of the City Council. Bid's{were;opened in the office of the City Clerk on Friday, April 3rd, in answer to Notice Inviting Bids for -labor on installation of water pipe, three fire hydrants, and valves in Tract No. 18063. Lump price bids, which were opened in the presence of Councilman Teasley, the City Engineer, Superintendent of Light and Water, and City Clerk, were received from the follbwing:- C. V. Plummer $1,783,75 Royal Pipeline Construction 1,994,60 D. K. Moran 2,140"74 Industrial Pipeline 2,369.80 S. E. Pipeline Constr. Co. 2,450.68 `•'The 'Azusa.Water Department submitted the amount of $l,650.,00. -Councilman-Johnson moved that the bid for pipe line -installation be awarded to C: V. Plummer. This motion ..,died for lack of a second. Moved by -'Councilman Ortuno, seconded by Councilman Teasley, that the matter be tabled. Paul appointed as Councilman Consideration of bids Pipe installa- tion (Tract 18063) i N CITY HALL, AZUSA, CALIFORNIA MONDAY, APRIL 6, 1959 Bids were opened in the office of the City Clerk on Briday, April 3rd, in the presence of Councilman Teasley, the City Engineer, Superintendent of Light and Water, and the City Clerk, as set forth in the 'Notice Inviting Bids for the erection of light standards. Bids received and lump prices were: C. T. & F., Inc. $ 990.00 Steiny & Mitchell, Inc. 2,092.00 Paul Gardner Corporation 2,705.00 The cost of doing the project as submitted by the Azusa Light Department was $435.60. Moved by Councilman Ortuno, seconded by Councilman Teasley, and unanimously carried that consideration of the bids be tabled. The Personnel Board at its meeting of March 25th sub- mitted the following recommendations for Council -aonsideration: It was recommended by the Personnel Board that the length of time necessary to reach the maximum pay step be decreased from 5 years to 3J years. 231 Page 3 Erection of light standards (Tract 18063) The Personnel Board further recommended to Council, after a study'of average salaries paid in many Southern Calif- ornia cities, that salary ranges in various classifications be corrected in order to bring the salaries up to the average of cities which received salary increases in 1958 and.the early part of 1959. Copies of the suggested changes were.presentbd to Council for their consideration. The Personnel Board further stated that surveys indicate that the Azusa Fire Department is working longer hours for less pay than the averages of comparable departments. It was the recommendation of the Board that an attempt be made to work out a suitable schedule whereby the inequality in working hours could be corrected. It was.redommended by Mayor Memmesheimer that a committee composed of the following persons be appointed to study the recommendations of the Personnel Board and report to Council at their meeting of May 4th: Councilman Warren Teasley, Chairman; Councilman Anthony Ortuno, Vernon Holmes, Earl Philleo, Rufus Ogilvie, Charles Gaines, and City Clerk -Administrative Officer James Miller.. Moved by Councilman Johnson, seconded by Councilman Teasley, and unanimously carried that the recommendation ,of the Mayor be accepted. The Council had previously asked recommendation from the Personnel.Board on the request of the City Engineer to employ a Civil Engineering Aide at Step 3 of the salary range. A communication was received from the Personnel .Board stating that it had not been the practice of their Board to recommend the step at which an employee should be hired.: --Moved by Councilman Johnson, seconded by Councilman Teasley, -and unanimously carried that authority be given to appoint a Civil Engineering Aide at the first step of the salary range. It was requested that Agenda Item 15a, the letter from the Employees' Association be brought up at this time .while representatives from the Association were in the audience. The Association requested that the City con- tribute towards the expense of a representative to the Personnel Bd. recommendations Committee to study Persdnnel Board recommen- dations Authority to appoint Civil Engr. Aide at step 1 Emp. repre. to attend Confere 'in:.Fresnocon April 10-12 232 ^ 233 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 6, 1959 Page 4 California League of Cities Employees Association Con- ference in Fresno on April 10, 11, and 12. Expenses, to be accounted for, were estimated at $75.00. The City Attorney was questioned as to the legality of the City contributing for such a Conference, and advised Council that in view of the fact that the subject matter of the meeting would be of benefit to City employees, such ex- penses -could be authorized. Mayor Memmesheimer recommended, in view of the Attorney's ruling, that one member be authorized to attend the Con- ference and be granted one day paid leave, plus itemized expenses not to exceed $75.00. Moved by.Councilman Ortuno, seconded by Councilman Teasley, and unanimously carried that the recommendation of the Mayor be accepted. As a point of information, notification was given by the Street lighting Light Department that the street lighting on Foothill report Blvd. has bean completed from Orange Avenue to the east City limites. The hour'of 8:00 P.M. was scheduled for public hearings Public hearing, on the following: zone change - 428 N. San A",change of zone from P to C-2 of the property located Gabriel (Wade) at 428 N. San Gabriel Avenue. The request, by Mr. R. Wade, was to allow a pharmacy to be constructed at this 'address. The City Clerk presented the Affidavit of Publication, and,stated that notices had been sent to all property owners involved. He stated that no protests had been received at the office in regard to proposed change. There being no persons in the audience wishing to speak for or against the change, it was moved by Councilman 'Ortuno; seconded by Councilman Teasley, and unanimously carried that the hearing be closed. Moved by Councilman Teasley, seconded by Councilman Ortuno, and unanimously carried that Council accept the recommendation of the Planning Commission for C-2 zoning, and -that the City Attorney be authorized to draw the necessary Ordinance. The second hearing scheduled was in regard to Southerly Public hearing, Annexation District No. 35, located at 5244 Azusa Avenue So. Annex. between Gladstone and Arrow Highway, and petitioned for Dist. #35 by J. S. Higgins. The City Clerk presented the Affidavit of Publication, stated that notices had been mailed to the property owners involved, and that the Clerks office had re- ceived no protests. There were no persons in the audience wishing to speak for or against the annexation. Moved by Councilman Johnson, seconded by Councilman Teasley, and ordered carried that the hearing be closed. An -Ordinance was presented relating to this annexation. Councilman Ortuno offered for its first reading the 1st reading following Ordinance entitled: Ord. approving So. Annex. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, Dist. #35 LOS,ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "SOUTHERLY ANNEXATION DISTRICT NO. 35" TO THE CITY OF AZUSA. Moved by Councilman Ortuno, seconded by Councilman Johnson; and'unanimously carried that further reading be waived. Second reading can be held on April 20th. 234 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 6, 1959 The last hearing scheduled for this meeting was to establish appropriate zoning of proposed Southerly Annexation District No. 34, located on Lark Ellen Avenue from the Wash to Arrow Highway, requested by the Larwin Corporation. The Cir Clerk presented the Affidavit of Publication and list•of names of property owners within 3001 to whom notices had been sent. He further stated that no written protests had been received. Mayor Memmesheimer asked whether there were any persons in the audience wishing to address Council in regard to this zoning matter. 11 Mrs. Julia Drake, 12717 E. Newburgh, stated that they had petitioned to the County to build a library in this area, and would much prefer the library to industry. Mr. H. G. Humphrey, 5221 N. Vogue, inquired as to the type of businesses which would be allowed in a C-2 zone. Mrs.'Carl Hensey, 5226 N. Hyacinth, stated that she lived across the street from the school and felt that a shopping area would mean more traffic and be a definite hazard to r -the' school children. Mrs.'John Orris, 18016 Arrow Highway, appeared to speak in'favor of a commercial zoning at this location. Mr.;Milton Brownsberger, District Superintendent of the Gladstone School District, inquired as to what types of businesses might be allowed in the area, stating that he "was not in favor of repair garages, or anything else which -mightbecome a "hang-out" for school children. Mrs. Frank Porter, 17009 E. Orkney, spoke in favor of a library'at that location, rather than a shopping site. ,,-,With no one else wishing to speak in regard to the pro- posed zoning on considered Southerly Annexation District No. 34, it was moved by Councilman Teasley, seconded by Councilman Ortuno, and unanimously carried that the hearing be' closed. The City Attorney stated that he had prepared an Ordinance in regard to this hearing. Councilman Ortuno offered for its first reading the :following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ORDINANCE NO. 535 SO AS TO REZONE CERTAIN PREMISES. Moved by Councilman Ortuno, seconded by Councilman Memmesheimer, and unanimously carried that further reading,be waived. Councilman Johnson asked that the City Attorney in- vestigate E zoning in regard to lot size protection. Moved by Councilman Johnson, seconded by Councilman Teasley, and ordered carried that the City Attorney be instructed to investigate C zoning restrictions as to size of lot in -case of lot split. Mayor Memmesheimer asked whether there were any persons .in the audience who had anything they wished to bring before Council which was not on the Agenda. Mrs. Betty Byler, 139 S. San Gabriel Avenue, appeared to inquire of Councilman Teasley as to the qualifications of Mr. Stephen A. Paul, newly appointed Council member. Councilman Teasley stated that, in his opinion, Mr. Paul was very well qualified to serve as a member of the City Council. Mr. Paul is Treasurer of a successful company in the City and a registered Mechanical Engineer. 235 Page 5 Public hearing; zoning of proposed So. Annex. Durfee Road, E1 Monte, Mr. O.Costill appeared before Council to request permission to en- addresses close approximately 460 square feet of his building, Council which is located in the 300 block on North Alameda Avenue. The building, which was acquired by Mr. Costill in'1949,'was granted a variance to allow for the operation of a sewing factory at that location, and upon the adoption of,'the'�Zoning Ordinance, became a non -conforming use, as the,,area is zoned R-3. Moved by Councilman Johnson, seconded by Councilman Orturio,_and ordered carried that the Administrative Officer.check the records to determine whether Mr. •-Costill'has a variance which is in effect at this time, and report to Council. Councilman Ortuno asked Mr. Costill to consider the acqui- 6ition of additional property for the purpose of off-street -parking for employees. The -City Engineer reported that Gilfillan Brothers have Gilfillan requested an extension of their parking lot lease, which Bros. lease runs until June 30, 1960, until February 28, 1962. The extension 1962 date would coincide with the expiration of their other building leases. Moved by Councilman Johnson, seconded by Councilman Teasley, that the request be granted and the Mayor and City Clerk be authorized to sign the lease. This motion ca rried-unanimously. Authorization Public Works to attend the Institute was given at the last Council Officers Inst. meeting. Moved by Councilman Teasley, seconded by Councilman Ortuno, and unanimously carried that the Superintendent of Public Works be advanced $125.00 for attendance at the Conference, expenses to be accounted for. The'Chief of Police requested authority to attend the Chief of 39th Annual California State Peace Officers' Conference Police to in San Jose on May 24-27, attend Peace Moved by Councilman Ortuno, seconded by Councilman Officers Conf Teasley, and ordered carried that the request be granted, with mileage to be paid as per Resolution No. 379+, and that he be reimbursed for expenses. The,,Chief of Police further requested that Officer Ray Off. Guardado Guardado be authorized to attend the 6th Annual Check to attend Ck. Investigation Training Institute in Fresno on April 16-17. Investigation Moved -by Councilman Ortuno, seconded by Councilman Training Inst. Teasley, and ordered carried that Officer Guardado be authorized to attend the Conference with an accountable expense advance of $80.00. Authority was requested to increase the complement of No action on the Police Department by one additional man to release request for one member from patrol duty to serve as a part-time add'1 patrolmaj safety officer and part-time juveline officer. No action was taken on the request at this time. . 1 Authority was requested for the Personnel Board to hold an examination for patrolman, as no names which are eligible for appointment remain on the current list. This motion carried by the following vote: AYES: Councilmen: Ortuno, Teasley, Memmesheimer NOES:_' Councilmen: Johnson ABSENT: Councilmen: None Authorization was requested by the Chief of Police to purchase five new vehicles, including one additional unit'to be used by investigators. It was suggested by the'Administrative Officer that bids call specifically for Ford cars, as the Police Chief desires Fords to be u'sed•,for police work. It was the feeling of the Council that the additional unit was not needed by the Police •-Department at this time. Moved by Councilman Ortuno, seconded by Councilman Teasley, and unanimously carried that the Administrative Officer be authorized to advertise for bids for four Ford police units, specifications to be furnished by the Chief of Police. Authorization was requested for the City Attorney to sign Tax Cancellation for Highway purposes, Authority -No.,42165, and Erroneous Assessment of Taxes, Authority No. 883. Moved by Councilman Johnson, seconded by Councilman Ortuno, and ordered carried that the Attorney be author- ized to sign the tax cancellations. This was the time scheduled for the second reading of the Ordinance rezoning to C-3 Southerly Annexation District No. 35. At the•previous meeting the City Attorney had been in- City Engr. to structed to prepare a Resolution initiating Annexation submit new 'District'no. 32; however, it was determined in recent boundaries for talks with representatives of the County that the bound- So. Annex. arie6 as approved were with the stipulation that Covina Dist. #32 annex Arrow Highway to the center of the street. Dis- cussion with representatives of the City of Covina indicated that they do not intend to annex Arrow Highway, and since this would leave a corridor less than 200 feet wide, Azusa'a annexation would then be illegal. Moved by Councilman Teasley, seconded by Councilman Ortuno, and ordered carried that the City Engineer pre- pare new boundaries to be submitted to the Boundary Commission, including that portion of Arrow Highway immediately between Annexation No. 32 and the City of Covina, approximately 360 feet long. A Road Deed was received from Frances E. and Iral J. Roller for a 12j foot strip of land on Cltrus Avenue. This strip is to be used by the County in widening and improving Citrus Avenue at the southeast corner of Gladstone and Citrus. Councilman Johnson offered the following Resolution Res. 3876 - entitled: Accepting A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Grant Deed, F. E. and ACCEPTING A GRANT DEED AND DIRECTING THE RECORDATION I. J. Roller THEREOF. Moved by Councilman Johnson, seconded by Councilman Teasley, and ordered carried that further reading be waived. Moved by Councilman Johnson, seconded by Councilman Teasley, that the Resolution be adopted. Councilman Johnson offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING RESOLUTION NO. 3597 WITH RESPECT TO POSITIONS IN THE RECREATION DEPARTMENT. Moved -by Councilman Johnson, seconded by Councilman Ortuno, and ordered carried that further reading be waived.. -Moved.by Councilman Johnson, seconded by Councilman Ortuno, that the Resolution be adopted. An Ordinance was prepared fixing the zoning of Southerly -Annexation District #32, said Ordinance to become ef- fective,upon the Annexation of the property. Councilman Johnson offered for its first reading the following•Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ORDINANCE NO. 535 SO AS TO REZONE CERTAIN PREMISES. Councilwoman Johnson mentioned a bill by Senator Dahlwig and twenty-five other senators which would bring the _State Highway Department under the control of the legis- lature. ' The'Administrative Officer spoke of a bill whereby the State would pay 25% of the rental or lease receipts to the City of property acquired for freeway purposes lying within the City to overcome the loss of taxes. Band Revues to be held in National City on April 25 to attend and 26, and Mayor Memmesheimer requested authority to band revue attend the revue and other activities as a representa- tive of the City of Azusa. Councilman Johnson stated that she felt this was not proper expenditure of the taxpayers money.
