SUBJECT: 2019 REFUSE AND ORGANICS RATE ADJUSTMENT PUBLIC HEARING
BACKGROUND:
Th e City has an Exclusive Franchise Agreement with Athens Services (Franchised Hauler) for refuse
collection and recycling services. Each year refuse rates are adjusted to reflect changes in the cost of
doing business and pass through changes in disposal costs. In addition, the Franchised Hauler may
request a rate adjustment due to extraordinary increases in operating costs arising out of new laws,
mandates or other conditions affecting costs (e.g., landfill cost, insurance). On July 16, 2018, the City
Council approved organics rate structure for commercial customers to comply with AB 1826 (Mandatory
Commercial Organics Recycling), and this organics rate structure will also be adjusted pursuant to the
proposed action. Additionally, pursuant to Proposition 218, all refuse and organics rate adjustments must
be approved at a public hearing with a notice to the public 45 days in advance of the hearing. The
recommended actions consist of opening the Public Hearing, receiving public testimony, closing the
Public Hearing, and adopting Resolution No. 2019-C24 to i) approve the annual refuse and organics rate
effective retroactive to July 1, 2019, and ii) approve certain exemptions for AB 1826.
RECOMMENDATION:
Staff recommends the City Council take the following actions:
1) Open the Public Hearing, receive public testimony, and close the Public Hearing;
2)Adopt Resolution No. 2019-C24 approving the annual refuse collection and organic waste
recycling rate adjustment for Athens Services effective retroactive to July 1, 2019; and
3)Approve an exemption procedure to exempt businesses and multifamily complexes on a case-
by-case basis from the requirements of the law if they meet the criteria specified under
AB 1826.
ANALYSIS:
Refuse from residential and commercial properties in the City is collected by Athens Services and taken
to Athens’ Material Recovery Facility (MRF) where most recyclable materials are separated and

recycled. The residual non-recyclable waste is then transported by Athens to Mid-Valley Landfill in the
City of Rialto. The green organic materials are delivered directly to Recycled Wood Products in the City
of Pomona for composting and mulching.
Refuse rates are comprised of four components: (1) processing/disposal fees; (2) service fees; (3)
franchise fees; and (4) AB 939 fees. Residential rates include a fifth component: customer service
charges (since the City bills residential customers directly). Each year refuse rates are adjusted to reflect
changes in the cost of doing business, as measured by fluctuations in the Consumer Price Index (CPI),
published by the U.S. Department of Labor, Bureau of Labor Statistics, for the Los Angeles, Long Beach,
Anaheim area and to account for increases in disposal costs. The CPI from January 2018 to January 2019
is 3.15%.
Pursuant to the City’s franchise agreement with Athens, disposal costs are passed through to the
ratepayers automatically. The cost of disposal at the Mid-Valley Landfill where the City’s waste is
disposed of is anticipated to increase from $31.26 to $32.49 per ton. There was also a significant increase
in green waste processing and diversion services fee beginning November 2018 from $25.89 to $47 per
ton due to the implementation of AB 1594 (Green Waste Diversion Bill). Per AB 1594, green materials
used as Alternative Daily Cover (ADC) will no longer be considered as diversion as of January 1, 2020.
Jurisdictions must have plans/programs to divert green materials from landfill or risk not being able to
meet its AB 939 diversion goal. The additional green waste processing cost was not included in the FY
2018-2019 rates; however, the higher cost is included in the FY 2019-2020 rates.
As approved by the City Council in 2016, minimum wage law adjustments were approved on a phase-in
basis, and the current year minimum wage adjustment is 0.67%, which will be applied to this adjustment
period. In addition, starting with the FY 2015/16 rate adjustment period, an incremental transportation
cost was added to per ton disposal costs to help Athens recover the increase in transportation costs to
divert waste to Mid-Valley after the closure Puente Hills Landfill in 2013; this portion of the disposal
cost is subject to CPI as well. Athens is not requesting any other rate adjustments due to extraordinary
increases in operating cost at this time.
The proposed FY 2019/20 rates are summarized below in Table 1.

Due to new business developments requiring more refuse capacity and service level, 6 cubic yard
commercial bin services have been added to the rate schedule. These rates will be approved upon request
by the business requiring additional capacity. Two businesses are currently subscribed to this service.
In October 2014, Governor Brown signed AB 1826 (Mandatory Commercial Organics Recycling),
requiring all commercial customers (businesses and multi-family dwellings with 5 units or more) to
recycle their organic waste on and after April 1, 2016, depending on the amount they generate each week.
Organic waste includes food waste, green waste, landscape and pruning waste, nonhazardous wood
waste, and food-soiled paper waste that is mixed in with food waste. Effective January 1, 2019, all
commercial customers that generate 4 cubic yards or more of commercial solid waste per week shall
arrange for organic waste recycling services. In order to comply with AB 1826, the City Council
authorized Athens Services to charge a monthly rate in implementing a commercial organic recycling
program for businesses that are required to implement an organic recycling program. These rates were
approved effective July 1, 2018 and are adjusted by CPI percentage change (3.15%).
The proposed FY 2019/20 rates are summarized below in Table 2.

On July 16, 2018, the City Council adopted Resolution No. 2018-C48 for automatic adjustments for rates
July 1, 2019, and each July 1 thereafter for a five-year period, without complying with Proposition 218
procedures subject to a maximum of 5% annually. However, due to the increase in overall cost of
disposal and recycling, rates increased from 3.58% to 8.54% for residential and commercial customers;
therefore, a public hearing is required. The Public Hearing Notice was mailed on May 24, 2019 and
advertised in the local newspaper on June 13, 2019.
AB 1826 Exemption Process
AB 1826 requires businesses and multifamily complexes that generate a specified amount of solid waste
per week to arrange for recycling services and for jurisdiction to implement a recycling program to divert
organic materials from businesses subject to the law. AB 1826 allows jurisdictions to exempt businesses
and multifamily complexes on a case-by-case basis from the requirements of the law if they meet the
criteria specified under AB 1826. In order to be exempted, a business must submit an Exemption Form
(Attachment 5) and provide supporting documentation to exemption request. An Athens representative
will conduct a site visit and perform a waste assessment to determine service levels, and any potential
exemptions. Photo documentation and a report, along with supporting documentation, will be provided to
the City before issuing a letter of exemption to a business or multifamily complex. It must be noted that if
after January 2020 CalRecycle determines that the State did not reduce statewide disposal of organic
waste by 50%, a jurisdiction will no longer be allowed to grant exemptions to businesses that generate
one (1) cubic yard of organic waste per week.
FISCAL IMPACT:
The fiscal impact of the proposed rate adjustment will vary by customer class: single family residential
rates will increase 6.78% or $1.76 per month; multi-family bin rates will increase 4.37% or $0.98 per
month; and commercial rates will increase 3.58% to 8.54% depending on the service level.

The bases and reasons for the proposed trash rate changes are set forth in a report available at the City Clerk’s office at 213 E.Foothill Boulevard
in Azusa which may be reviewed by any interested person. Proceeds from this rate adjustment will be used to pay Athens Services for trash
collection and recycling services. Recycling services include processing all waste collected in Azusa through a material recovery facility where
all glass, plastics,metal and paper products are removed and recycled. Other portions of the trash rate include City fees,such as 10% franchise
fee, AB 939 or Recycling fee,billing fee, and fee to make up for non-payments. These fees are used by the City to administer the trash hauling
contract, comply with the California Integrated Waste Management Act of 1989, and cover customer service and billing costs.
At the time of the public hearing, the City Council will hear and consider all protests and objections concerning the proposed trash rate
adjustments. Upon conclusion of the hearing, the City Council will consider, and may adopt, the proposed trash rate adjustments. If written
protests against the proposed rate adjustments and fee schedule are not presented by a majority of owners of the identified parcels upon which
the rates and fee schedule are proposed to be imposed, the City Council will be authorized to impose the rates and fee schedule.

LA PRESENTE SE NOTIFICA que de acuerdo al Artículo XIII D de la Constitución de California, el Consejo Municipal de la Ciudad de Azusa
llevará a cabo una AUDIENCIA PÚBLICA para considerar ajustes de tarifas de los servicios de recolección y reciclaje de basura para facturas
hechas el o después del 1 de Julio del 2017. Esta notificación se enviará por correo al propietario registrado de cada parcela identificada sujeta
a tarifas de basura. Dicha AUDIENCIA PÚBLICA se llevará a cabo en la reunión ordinaria del Consejo Municipal de la Ciudad de Azusa el
LUNES, 19 DE JUNIO DEL 2017, a las 7:30 P.M., o tan pronto como sea posible a partir de entonces, en el Auditorio Cívico, 213 E. Foothill
Blvd., Azusa. El Consejo Municipal considerará la adopción de una lista de tarifas de recolección y reciclaje de basura a partir del 1 de Julio del

El producto de este ajuste de la tarifa será utilizado para pagar a Athens Services por los servicios de recolección y reciclaje de basura. Los

Las bases y las razones de los cambios propuestos de la tasa de

cada semana. Los desechos orgánicos incluyen desechos de alimentos, desechos verdes, desechos de jardinería y poda, desechos de madera no peligrosos
y desechos de papel manchado de alimentos que se mezclan con los desechos de alimentos. A partir del 1 de enero de 2019, todos los clientes comerciales
(empresas y viviendas multifamiliares con 5 unidades o más) que generan 4 yardas cúbicas o más de desechos comerciales sólidos por semana harán
arreglos para servicios de reciclaje de desechos orgánicos.
Para implementar el Programa de Reciclaje de Productos Orgánicos en la Ciudad, Athens Services, el concesionario franquiciado de basura de la Ciudad,

RESOLUTION NO. 2019-C24
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, APPROVING THE TWENTY-THIRD AMENDMENT
TO THE EXCLUSIVE FRANCHISE AGREEMENT WITH ARAKELIAN
ENTERPRISES TO AMEND THE REFUSE RATES AND ADOPT THE
MONTHLY ORGANIC RECYCLING FEES FOR PERIOD OF JULY 1,
2019 THROUGH JUNE 30, 2020
WHEREAS, on October 2, 2000, the City Council of the City of Azusa, approved
an Exclusive Franchise Agreement with Arakelian Enterprises, Incorporated (Contractor), for
refuse collection and recycling services ("Original Agreement"); and
WHEREAS, the Franchise Agreement allows for increases in solid waste collection rates
due to increasing costs, including but not limited to the following: (i) solid waste disposal
charges at landfills (so called “tipping” fees), (ii) fuel costs, (iii) AB 939 and other statutory
recycling and diversion compliance costs (including recycling facility fees), (iv) other
operational costs in providing solid waste collection services, as well as (v) the annual
percentage increase in the Consumer Price Index, all Urban Consumers, for the Los Angeles-
Anaheim-Riverside Statistical Area, as determined by the United States Department of Labor
Statistics, or its successor (“CPI”); and
WHEREAS, the current level of solid waste collection and disposal service rates
(hereinafter collectively referred to as “rates”) is insufficient to recover the total costs of
providing said service; and
WHEREAS, the City proposes to increase its solid waste service rates in an amount that
corresponds to the amount necessary for the collection, conveyance, recycling and disposal of
solid waste via the City’s Franchise Agreement with Athens Services. Therefore, the City
Council finds, with respect to the revenue derived from the solid waste rates, that (1) there is a
reasonable relationship between the use of the rates increased herein and the services for which
they are imposed; (2) the revenue derived from the increased rates does not exceed the amount
necessary to provide the services; (3) the increased rates shall not be used for any purpose other
than that for which the rates are imposed, including but not limited to, solid waste pick-up,
transportation, recycling and disposal, facilities and equipment maintenance, capital projects and
financing, and billing and account management; (4) the increased rates do not exceed the
proportional cost of the services attributable to each parcel served; and (5) the increased rates are
not levied for general governmental purposes; and
WHEREAS, pursuant to California Proposition 218 (California Constitution Article
XIIID, Section 6), at least 45 days prior to the hearing on this Resolution, the City has mailed,
postage prepaid, a notice of the public hearing on the proposed solid waste rate increase to the
property owner of each identified parcel upon which the increased rates are being proposed, and
WHEREAS, said notice identified: (1) the amount of the increased rates to be charged;
(2) the basis upon which the rate increase was calculated; (3) the reason for the rate increase; and
(4) the date, time, and location for the public hearing on the rate increase; and
WHEREAS, on July 15, 2019 at 7:30 p.m., the City Council conducted a duly noticed
public hearing at which time all those wishing to be heard were afforded an opportunity to be

heard, and at which time the City Council considered any and all written protests concerning the
proposed solid waste rate increase; and
WHEREAS, the City did not receive written protests from a majority of the identified
parcels that would be subject to the proposed rate increase; and
WHEREAS, all other prerequisites to the adoption of this Resolution have occurred.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Azusa,
California, does find and declare the:
SECTION 1. Based on the written and verbal evidence presented to the City Council,
the amounts of the solid waste service rates, as set forth in Exhibit “A” and Exhibit “B”, attached
hereto and incorporated by reference herein, are hereby approved and adopted by the City
Council of the City of Azusa. The solid waste collection service and organics recycling rates set
forth herein shall become effective July 1, 2019, retroactively.
SECTION 2. Pursuant to Section 21080(b)(8) of the Public Resources Code, and Section
15273(a) of the Guidelines for the Implementation of the California Environmental Quality Act
(“CEQA”), review under CEQA is not required because the City Council action increasing solid
waste service rates is for the purpose of (i) meeting solid waste collection and disposal operating
expenses, (ii) purchasing or leasing supplies, equipment, or materials for the solid waste
collection and disposal services, and (iii) obtaining funds for capital projects necessary to
maintain solid waste collection and disposal service. This action is also exempt pursuant to
Sections 15061(b)(3) and 15378(b)(4) of the CEQA Guidelines because it involves the creation
of a government funding mechanism that does not involve any commitment to any specific
project which may result in a potentially significant physical impact on the environment. The
City Clerk is hereby directed to file a Notice of Exemption with the County Clerk within five (5)
days following the date of this Resolution.
SECTION 3. The City Clerk shall certify to the passage and adoption of this Resolution;
shall cause the same to be entered in the Book of Resolutions of the City of Azusa; and shall
make a record of the passage and adoption thereof in the records of the proceedings of the City
Council of said City in the minutes of the meeting at which the same was passed and adopted.
SECTION 5. This Resolution shall take effect immediately.
SECTION 6. If any section, sub-section, sentence, clause, phrase or portion of this
Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions of the
Resolution. The City Council hereby declares that it would have adopted the Resolution and
each section, sub-section, sentence, clause, phrase or portion thereof, irrespective of the fact that
any one or more sections, sub-sections, sentences, clauses, phrases or portions to be declared
invalid or unconstitutional.

This twenty-second Amendment to the Exclusive Franchise Agreement is
entered into this 15 th day of July 201 9 by and between the City of Azusa, a
municipal corporation ("City") and Arakelian Enterprises, Inc., a California
Corporation ("Contractor").
Effective July 1st, 2019, the attached rate schedule shall replace Exhibit A of the
Existing Exclusive Franchise Agreement approved on October 2, 2000.
MONTHLY ORGANIC WASTE RECYCLING RATES
T he Monthly Organic Waste Recycling Rate Schedule (Exhibit B) for businesses
that generate 4 cubic yards of commercial solid waste under AB 1826 threshold to
arrange for organic waste recycling services .

AB 1826 EXEMPTION PROCESS
Effective July 1, 2019
Per AB 1826, jurisdictions can exempt businesses and multifamily complexes on a case-by-case
basis from the requirements of the law if commercial customers (businesses and multi-family
dwellings with 5 units or more) meet any of the following criteria:
1.Lack of sufficient space at a multifamily complex or business to provide additional
organic material recycling bins.
2.The current implementation of actions (such as food donation) that result in the
recycling of a significant portion of organic waste.
3.Limited-term exemptions for extraordinary and unforeseen events.
4.The business or group of businesses does not generate at least one-half of a cubic yard
of organic waste per week.
5.The business or group of businesses does not generate at least one cubic yard of organic
waste per week, if the local jurisdiction provides CalRecycle with information that
explains the need for this higher exemption (see following Note**)
Note: If after January 2020 CalRecycle determines that the state did not reduce statewide
disposal of organic waste by half, a jurisdiction will no longer be allowed to grant exemptions to
businesses that generate 1 cubic yard of organic waste per week.
Process for Exemption:
1. An applicant must submit AB 1826 Exemption Application Form.
2.An Athens representative will conduct a site visit and perform a waste assessment to
determine service levels, and any potential exemptions.
3.Photographs will be taken of the customer location that illustrates the need for an
exemption.
4.After the site visit with the customer, the Athens representative will include the reason
for the exemption as part of their report, along with any supporting documentation.
5.A letter of exemption will be issued to the customer.
6.If the applicant is self-hauling, a self-haul form must be submitted annually by March 31
for the prior calendar year (January 1 through December 31).
Athens Services will review the applicant’s subscription level annually to determine if the
applicant continues to qualify for the exemption. All photo documentation and documents will be
maintained by Athens Services with the customer files.
