HUNT, CHIEF OF POLICE DATE: JULY 15, 2019 SUBJECT: APPROVAL OF A MEMORANDUM OF UNDERSTANDING BETWEEN AZUSA PACIFIC UNIVERSITY (APU) AND THE CITY OF AZUSA REGARDING REPORTING AUTHORITY AND OTHER RESPONSIBILITIES FOR RESPONSES AT AZUSA PACIFIC UNIVERSITY BACKGROUND: Azusa Pacific University (APU) and the City of Azusa have had a long-standing relationship. APU has contracted with the City for the past five (5) years for a full-time police officer to serve as a University Resource Officer (URO). While the presence of a URO has been beneficial to both parties, there are times when the Azusa Police Department must respond to calls for additional services on the campus of APU. Given those occurrences, APU and the Azusa Police Department have met to discuss a memorandum of understanding (MOU) to clarify the responsibilities of the parties when the Azusa Police Department is called out to APU. RECOMMENDATION: Staff recommends the City Council take the following action: 1)Approve the attached MOU to clarify the authorities and responsibilities of the Azusa Police Department for calls for service on the campus of APU and authorize the City Manager or Chief of Police to execute the MOU on behalf of the City subject to any non-substantive changes made by the City Attorney ANALYSIS: The proposed MOU clarifies the responsibilities of the Azusa Police Department when it is called out for service on the campus of APU. It 1.Describes the types of crimes that the Police Department will handle on behalf of APU; 2. Describes the types of crimes that will be handled by APU’s campus police department; APPROVED CITY COUNCIL 7/15/2019 Azusa Pacific University MOU July 15, 2019 Page 2 3. Describes procedures for reporting sexual violence crimes; 4. Provides a standard mutual indemnification provision; 4. Contains other authorities, reporting and investigation requirements; and 5. Authorizes both agencies to provide mutual assistance. The MOU is meant to carry-over into additional school years, but may be terminated by any party with thirty (30) day written notice. FISCAL IMPACT: There is not General Fund impact from this MOU as it merely establishes guidance and responsibilities for calls for service. Prepared by: Reviewed and Approved: Stephan E.
