HomeMy WebLinkAboutOrdinance No. 653 ORDINANCE NO. 653 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ARTICLE IX, CHAPTER 2, (THE ZONING CHAPTER) OF THE AZUSA MUNICIPAL CODE BY THE ADDITION THERETO OF PROVISIONS RELATING TO PRECISE PLANS OF DESIGN. The City Council of the City of Azusa does ordain as follows: SECTION 1. The City Council does hereby find, determine and declare that the following amendments of the zoning ordinance have been duly initiated, that notice of hearing thereon has been duly given and published, that public hearings thereon were duly held by the Planning Commission and by the City Council and that the public convenience and necessity and the general welfare require that the following amendments be made. SECTION 2. The Azusa Municipal Code is hereby amended by the addition to Article IX, Chapter 2 thereof (zoning chapter) of pro- visions relating to precise plans and design, consisting of Sections 9230.80 to 9230.88, inclusive, reading respectively as follows: "SECTION 9230.80. PRECISE PLANS OF DESIGN. PURPOSE. It is hereby found and declared that it is impracticable or impossible to establish or apply uniform restrictions and regulations upon the subjects mentioned in Section 9230.82 for uses other than those permitted in the R-1 Zone because of the extreme variations in the size and shape of lots and parcels of land devoted to such other uses and in the nature of the uses and zoning of surrounding premises. The subjects mentioned in Section 9230.82, therefore, shall be regulated by precise plan of design to accomplish as nearly as possible a uniformity in the permitted use and enjoyment of property in any zone while at the same time imposing a uniformity of regulation and restric- tion to protect the use and enjoyment of surrounding properties to the same degree and extent generally provided by this Chapter. SECTION 9230.81. SAME. WHEN REQUIRED. No person shall commence any use for which a Conditional Use Permit is required or any use not permitted in the R-1 Zone, and no building permit shall be issued for any structure to be used for or in conjunction with any such use, until a precise plan of design covering the parcel or parcels to be so used shall be approved and adopted as herein provided. SECTION 9230.82. CONTENTS OF PRECISE PLAN OF DESIGN. Such precise plan of design shall specify and include: (1) The location, size, bulk, height and number of stories of all buildings and structures including signs, walls and fences. (2) The location, size and dimensions of yards, courts, setbacks, and all other open spaces between buildings and structures. (3) The location, dimensions and method of improvements of all driveways, parking areas, walkways and means of access, ingress and egress, and drainage. (Li ) The location, dimensions and method of improvement of all property to be dedicated to the public or to public utilities. -1- _, 1 (5) The general nature of the proposed use. SECTION 9230.83. ADOPTION OF. Any such precise plan of design may be rejected, adopted, modified and adopted, or adopted subject to conditions. Any such precise plan of design after adoption, may be amended in the same manner as a precise plan of design is first adopted hereunder. SECTION 9230.84. GROUNDS FOR REJECTION. If the proposed precise plan of design would substantially depreciate property values in the vicinity or would unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes or would adversely affect the public peace, health, safety or general welfare to a degree greater than that generally permitted by this Chapter, such plan shall be rejected or shall be so modified or conditioned before adoption as to remove the said objections. Otherwise, such proposed precise plan shall be approved. Modifications and con- ditions may be imposed only to the extent reasonably necessary in connection with the proposed use to remove the said objections, and to that extent may impose greater, but shall not permit Isser, restrictions than those imposed by this Chapter. SECTION 9230.85. PROCEDURE. Application for approval of a precise plan of design shall be made in such form as the Planning Commission shall prescribe. The procedurebut not the grounds) set forth in Sections 9231.21 through 9231.28 of this Code shall apply to the processing and approval or rejection of proposed precise plans of design. SECTION 9230.86. ADOPTION SUBJECT TO A CONDITION. A precise plan of design may be approved and adopted subject to the granting of a change of zone, a conditional use permit, a variance, or the approval of a final subdivision map, and the Planning Commission or City Council may require such a precise plan of design to be submitted prior to the granting or recommend- ing of a zone change, variance or conditional use permit . SECTION 9230.87. COMPLIANCE REQUIRED. No person shall violate or fail to comply with any adopted precise plan of design or any conditions or provisions thereof nor shall a building permit be issued for any structure which would violate or fail to comply with any a opted stprecprecise se pilanoof design for the parcel or parcels on which be located. SECTION 9230.88. DISTINCTION FROM OTHER PRECISE PLANS. The precise plans of design referred to herein are not to be confused with or considered to be 'precise plans ' as referred to in the Government Code of the State of California. " SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall publish the same as required by law.
