DETACH, CITY MANAGER, Jl DATE: JANUARY 16, 2007 SUBJECT: REQUEST FOR EXEMPTION FOR AZUSA UNIFIED SCHOOL DISTRICT FROM A PROVISION OF THE AZUSA PACIFIC UNIVERSITY DEVELOPMENT AGREEMENT REGARDING CHARGES TO USERS OF THE APU EVENT CENTER OR PROPOSED PERFORMING ARTS FACILITY RECOMMENDATION . It is recommended that the City Council approve a request for exemption for Azusa Unified School District (AUSD) from a provision of the Azusa Pacific University Development Agreement regarding charges to users of the APU Event Center or Proposed Performing Arts Facility. BACKGROUND In the 2005 Development Agreement between the City of Azusa and Azusa Pacific University there is a provision that the University "charge and remit to City a charge of fifty cents ($0.50) on each and every ticket sold for entry to the APU Event Center or proposed Performing Arts Facility, provided, however, that such obligation to charge and remit such ticket charges shall not apply to (1) Owner's regular season sporting events, (2) events featuring APU faculty and/or students, including drama and musical performances; (3) meals; (4) events held by non-profit charitable organizations which use Owner's event facilities free of charge and donate all proceeds to a charitable organization; and (4) events held by the City of Azusa." Although the last category may have intended to include the Azusa Unified School District as part of City of Azusa events, the Development Agreement was not explicit in providing this exemption for the AUSD. Since it was never staff's intent to impose any further financial impositions on the school district's activities, staff is �p /`/ recommending that the school district be specifically exempt from this fifty-cent charge on their activities conducted at Azusa Pacific University. FISCAL IMPACT It is anticipated that a negligible fiscal impact would be incurred as a result of this exemption for the school district.
