The City Council of the City of Azusa met in regular
session at'the above time and place.
Mayor Memmesheimer called the meeting to order and led
in the salute to the flag.
Invocation was given by Rev. Thelma McHenry, First Church
of Religious Science.
Present at Roll Call: Councilmen: Paul, Ortuno,
Johnson, Teasley, Memmesheimer
Also Present: Assistant City Attorney Decker,
Supt. of Public Works Brusnahan,
Rec. Dir. Dangleis, Asst. Fire

Mayor'Memmesheimer asked whether there were any cor-
rections -'to the minutes of the meeting of August 17th.
Councilman Johnson stated that on Page 1, the last
item relative.to a salary survey, the last sentence
should beicorrected to read that the survey be com-
pleted by March 1, 1960.
Councilman Johnson further pointed out that the first
item on page 3 relative to Mr. Brusnahan's expenses,
should be corrected to read, "Based on the mileage
Resolution currently in effect, mileage expenses would
be about $162.00."
With no'further corrections, the minutes were approved
as corrected.,
Mayor Memmesheimer asked whether there were any cor-
rections to the minutes of the meeting of August 25th.
With no -corrections, the minutes were approved as written.
Notice was given that the Personnel Board had approved
the following.job classifications: Administrative
Assistant'; Range 36 ($553-673); Administrative Secretary,
Range 27 $355-433); and Planning Technician, Range 35
($527-641 '
Moved by Councilman Teasley, seconded by Councilman
Paul that the qualifications for Administrative Assistant
be approved as recommended. This motion carried by the
following vote:

NOES:` Councilmen: Johnson
ABSENT: Councilmen: None
Moved by Councilman Teasley, seconded by Councilman
Ortuno that the classification of Administrative Secretary
be approved as recommended. This motion carried by the
following vote:

ABSENT: 'Councilmen: None
Moved by Councilman Teasley, seconded by Councilman
Ortuno, and ordered unanimously carried hhat the classifi-
cation of Planning Technician be approved as recommended.
Moved.by Councilman Teasley, seconded by Councilman Ortuno
and ordered unanimously carried that the City Attorney be
authorized to amend the Resolution defining the job posi-
tions and setting the respective salaries.

Notice was given that the Personnel Board had granted
the request of the Chief of Police that the present
eligibility. list for Police Sergeant be extended six
months from date of expiration. The list will now
remain effective until March 19, 1960.
It was recommended by the Department Head and the Per-
sonnel .Board. that Al Moon, Maintenance Man I, be advanced
to Step,4-of the salary range $355, effective September
13, '1959:

The•Planning'Commission recommended a change of zone
classification from R -lc to R-2 for property owned by
L. Flores, 113 Dalton Avenue.
Moved by Councilman Ortuno, seconded by Councilman Paul
and ordered carried that a public hearing be set for
October,5th before the City Council in regard to the
proposed zone change, and that the City Clerk be auth-
orized to make the necessary publication relative to
the change of zone.
Council•was notified that public hearings would be held
before the Planning Commission on Thursday, September
10th; relative to:
1) The rezoning to C-3 of the area on Sierra Madre
Avenue which is desired for a Mobile Home Park, and;
2) The proposed amendment to the Zoning Ordinance
relative,to on-site automobile parking requirements.

The hour -of 8:00 P.M. was set for public hearing on the Public hearing
proposed Ordinance adopting a "Fire Code" by reference. re Adoption of
The'adoption of this Code "as is" would ban the sale of Fire Code
fireworks in -the City.
It was°recommended by the City Clerk that inasmuch as
some of the'"Secondary Codes" were not available and on
file Inthis office as required, the hearing be continued
until the Council meeting of October 5th, and possibly
that the hearing be readvertised.
Representatives of the American Legion, Veterans of Protests heard
Foreign Wars, Knights of Columbus, League of United
-Latin American Citizens, and the Eagles Lodge, which
sell fireworks to raise funds for their organizations,
appeared before Council to protest the proposed ban on
the sale of fireworks. Those persons appearing before
Council were: C. -Romero, 330 N. Monte Vista; H. Carpenter,
115 S. Louise; J. Hernandez, 334 E. Foothill Blvd.; L.
Ashkenas, 112 S. Sunset; A. Fuller, from San Gabriel Valley
Daily Tribune; J. Roese, 605 W. First Street; W. Cass,
148.S. Vernon; and E. Griffith, 19321 E. Dornie, Glendora.
In addition, a letter of protest was submitted to Council
from Ralph Byrd, President of the Optomist Club of Azusa,
who lives at 3432 N. Ivar, Rosemead.
Mr..V. J. Tovatt, representative of Clippenger Fireworks
Suggested
Corporation, appeared before Council with the suggestion
restrictions
that perhaps the City of Azusa could set up restrictions
to fireworks
similar to those of the City of Torrance relative to the
sale
sale of fireworks. They are as follows:
1).Grant permits exclusively to charitable organizations;
2) Limit the number of permits granted in accordance
with the'population, for instance, one permit for each 5,000
people;' '
3) Grant permits only to those organizations which
have no other means of raising funds;
4) Require that, with the exception of the Veteran's
organizations; the money must remain in the City; and
5) Request that an audited report be submitted to the
City Clerk within 60 days after the sale of the fireworks.

Assistant Fire Chief E. Mendenhall appeared before Council
and presented Captain J. Littlefield, representing Fire
Chief Madison. Captain Littlefield stated Chief Madison's
opposition to the adoption of an amendment which would
allow the salezof fireworks, but stated if there was to be
such an'amendment, he was requesting that consideration be
given_to the Zoning -and Building Laws. Captain Littlefield
also stated that,, if the hearing were continued to the
meeting of October 5th, Chief Madison would be in town and
would himself appear before Council at this hearing.

hearing-bercontinued to October 5th at 8:00 P.M.
A letter was received from C. V. Romero requesting per-
mission to address Council regarding the situgtion
existing in the Little Dalton Wash, Mr. Romero pre-
sented :a petition signed by numerous residents of the
area of•the Little Dalton Wash complaining about the
nuisance of mosquitoes breeding in the area because of
the water in�the storm drain. Mr..Romero stated that
the•Health Department had been contacted relative to
this matter,,and had advised the residents that there
was no'mosquito�abatement program_in•the area, and this
matter would have to be referred to the City or the
County.Flood Control District. It was suggested by Mr.
Romero that the City ei#her ask the Flood Control District
to clean the ditch, or that they obtain permission from
the District for the City to clean the drain.
Moved by Councilman Teasley, seconded by Councilman
Johnson and ordered carried that the matter be referred
to the Engineering Department with the request they con-
tact;the,Flood Control District relative to the situation.

The Department presented a preliminary
estimate; for the 1950-59 Assessment District 1911 Act.
The total was estimated at $35,253.00. The City Clerk.-
stated

ready shortly.
The Engineering Department presented an estimate of the
cost of the sewer line on the east side of Azusa Avenue.
The estimate submitted was $5,501.00.
Moved by.Couneilman Ortuno, seconded by Councilman Paul
and ordered -carried that the Engineering Department be
authorized to prepare Plans and Specifications for
sewers to.be.installed on the east side of Azusa Avenue,
bid open&hg:to be scheduled for October 2nd, and Council
action at the.meeting of October 5th.
At this time the City Clerk introduced Mr. 0. Rebholz,
representing the firm of L. Frederick Pack & Associates.
It was recommended by the Park and Recreation Commission
that a contract be established with the School District
for -a -School -Park site development at the Powell School
for,the purpose'of developing a combination park and
school playground site. It was estimated that the cost
of.labor'to the City of Azusa would be between $600-$1000.
Moved'by Councilman Johnson, seconded by Councilman Paul
and ordered carried that the matter be tabled until the
next.Council meeting for further study.
It was recommended by the Park and Recreation Commission
that John Dangleis be authorized to attend the Institute
for Recreation and Park Administration at the Asilomar
Conference Grounds, Pacific Grove, California, from
NOV. 29 -Dec. 4th. This will be in lieu of attendance
at the League Conference in San Francisco next month.

A Resolution was prepared accepting Grant of Easement
for utility purposes from Jesse S. and Marjorie L.
Higgins. This is at the trailer park being con-
structed on South Azusa Avenue (Southerly Annexation
Dist. 7#35).

The City Clerk stated that he had been contacted by
the Corps of Engineers inquiring whether the City was
still interested in obtaining an easement for road pur-
poses'.over the property owned by the Corps of Engineers
along the west levee of the San Gabriel River.
Moved•by Councilman Johnson that the matter be indef-
initely tabled, since the Assistant City Attorney,
present tonight, has a personal interest in the Canyon
City Rock Products Company which this roadway is to
benefit. This motion died for lack of a second.
Moved by,Councilman Johnson that before any money is
spent, we obtain a firm commitment from the State Highway
Department permitting the proposed road to intersect
Foothill Blvd. west of the San Gabriel River bridge. This
motion died for lack of a second.

and ordered carried that the matter be tabled until the
next Council meeting when Attorney Williams is expected
to be present.
Notice was given that a Resolution had been received
from the City of Huntington Park endorsing support of
a World's Fair in the Los Angeles area in 1963-64.
Moved by Councilman Johnson, seconded by Councilman
Paul; and ordered carried that the correspondence be
filed. 1
Council was notified that a check in the amount of
$2742.75 had been received from the Redevelopment
Agency, thus closing their account and dissolving
the, Agency.
Moved by,Councilman Paul, seconded by Councilman Ortuno
and ordered carried that the Administrative Officer
acknowledge the return of the funds.
