HomeMy WebLinkAboutOrdinance No. 579 ,`1,x,0 ORDINANCE NO. 579 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REGULATING AUCTION SALES, CLOSING OUT SALES, FIRE SALES AND CERTAIN OTHER SALES. The City Council of the City of Azusa does ordain as follows : SECTION 1. No person shall operate, conduct or hold any auction sale, closing out sale, going out of business sale, bankrupt stock sale, creditor's sale, forced sale, insolvency sale, receiver's sale, insurance sale, removal sale or sale of goods damaged by fire, smoke, water or otherwise, unless there shall have been issued and shall be in effect a permit from the City Council of the City of Azusa so to do as in this ordinance provided and unless all provisions and con- ditions of such permit are complied with. SECTION 2. Application for any permit required by this ordinance shall be filed with the City Clerk in writing, shall be signed and verified by the applicant, and shall set forth the following: (1) The name and address of the applicant. (2) The location of the proposed sale. (3) The nature of the occupancy at such location. (4) The nature of and reason for the proposed sale. (5) A full, true and correct inventory or statement setting forth the amount, quantity and description of the goods, wares, merchandise and personal property to be sold at such sale. (6) The- dates upon or during which the proposed sale is to be conducted. SECTION 3. The City Council may, after such investigation as it deems necessary, grant or refuse to grant the permit. The City Council shall refuse to grant any such permit if it shall determine that the granting of the same or the conduct of the proposed sale would be contrary to the preservation of the public peace, health, safety, morals or welfare of the City or its inhabitants. If such permit is granted, the City Council may impose such terms, conditions and restrictions upon the operation and conduct of the sale, not in conflict with any paramount law, as it may deem necessary or expedient to protect the public peace, health, safety, morals or welfare of the City or its inhabitants. SECTION 4. Any permit issued pursuant to this ordinance shall authorize the conducting of the respective sales therein permitted upon the days mentioned in the application, provided, however, that all sales made under such permit must be made within a period of thirty consecutive days including and following the first day of sale specified in the permit. If the sale is not completed within said thirty-day period, the City Council may grant an extension or extensions not exceed- ing in the aggregate an additional period of thirty days, but no such permit shall be valid for a longer period than a combined total of sixty. days. SECTION 5. No person conducting, operating or holding any such sale shall use or make public any false, fraudulent or misleading advertising with respect to such sale. -1- i Slaw SECTION 6. No person conducting, operating or holding any such sale shall add any property or any item of property to the stock of personal property set forth in the inventory contained in the application or shall sell any item at such sale not listed in said inventory. SECTION 7. Any person, firm or corporation violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed Five Hundred Dollars or by imprisonment in the City Jail or County Jail of the County of Los Angeles for not to exceed six months, or by both such fine and imprisonment. SECTION 8. The City Clerk shall certify to the passage of this ordinance and shall publish the same as required by law. Passed and approved this 4th day of August , 1958.
