The City Council of the City of Azusa met in regular session at the above time and place. Mayor Memmesheimer called the meeting to order and led Call to Order in the salute to the flag. Invocation was given by Councilman Warren Teasley. Invocation Present -at Roll Call: Councilmen: Paul, Ortuno, Roll Call Johnson, Teasley, Memmesheimer Also present: City Attorney Williams, Acting City Engineer Holzhauer, Supt. of Light and Water Smith, and City Clerk -Administrative Officer Miller. Mayor.Memmesheimer asked whether there were any correct- Approval of ions to the minutes of the meeting of September 8th. Minutes 9/8/59 Councilman Johnson stated that on page 2, relative to the -appointment of a temporary Personnel Clerk, she had stated she felt the City should appoint a qualified Personnel Clerk rather than a Steno -Clerk, and asked that the motion b'e;corrected to read: "Moved by Councilman Johnson, se- conded by Councilman Teasley, and ordered carried that the Administrative Officer be authorized to appoint a Personnel Clerk_on,a part-time basis." With no further corrections, the minutes were approved as corrected. Mr.'W. C. Holzhauer, L. Frederick Pack & Associates, Report on appeared before Council in his capacity as Acting City plans for Engineer.• Industrial St Mr.,Holzhauer stated that he had been working on plans improvements for the improvement of Industrial Street and Georgia .Place and that the plans included the widening of the west side.of Georgia Street 6 feet and widening the north and south sides of Industrial Street 6 feet each. These plans also include the installation of water lines, gas lines, gutters, and the relocation of power poles. Moved by Councilman Teasley, seconded by Councilman Ortuno and.ordered carried that Council approve the preliminary planning by the Engineer and authorize the preparation of a cost estimate for the work to be done. The City. Engineer requested permission to relocate the Relocation of light.standard at the intersection of Foothill and light standard Georgia Avenue, and also to reconstruct the curb radius at -this location. It was pointed out that reconstruct - .ion of this curb return would make it safer for trucks turning onto Foothill Boulevard. Moved by Councilman Paul, seconded by Councilman Ortuno, and'ordered carried that permission be granted for the relocation of the light standard and the curb return construction. The Engineer stated that, in accordance with Council Cleaning of request, he had contacted the Flood Control District Little Dalton relative to the cleaning of the Little Dalton Wash. Wash reported He reported that the weeds had been cut in the wash itself, and the Flood Control District had agreed to spray the wash to relieve the mosquito nuisance. Moved by.Councilman Ortuno, seconded by Councilman • Teasley, and ordered carried that the City Engineer again contact the Flood Control District asking that the weeds be removed from their right-of-way in the area of the Little Dalton Wash. Due to the urgency of this matter, the Engineer stated that he had given authorization for the'Flood Control District to proceed with modification df the plans, and agreed that, subject to Council approval, the-03tydwould assume the financial responsibility for its pro -rated share of the cost. Moved by Councilman Ortuno, seconded by Councilman Teasley and 6rdered carried that Council confirm the action of the City Engineer. The City Clerk stated that he had once again contacted the State Highway Department expressing the disapproval of the City officials to the plan of constructing a curbed median in the center of Foothill Boulevard throughout the entire City. Moved by Councilman Teasley, seconded by Councilman Ortuno, and ordered carried that the City Administrator contact Mr. Gillis of the Division of Highways stating the,Councills opposition to the erection of a curbed median anywhere on Foothill Boulevard within the City limits. Notice wasrgiven that the Planning Commission had re- commended a change of zone from R -lc to C-3 for the premises'at 1005 W. Gladstone, also known as Lot 181, Tract 13824. Moved-by.Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that a public hearing in regard -to the proposed zone change be scheduled for the•Council meeting of October 5th2 and that the City Clerk be authorized to make th9hecessary publications. Council was notified that a Parking Variance had been granted to 0. John Conforti reducing the number of parking spaces required at 455 S Irwindale Avenue which is the south 2 of Lot 25, and Lots 23 and 24, Block 4, Tract 8507- A Parking and Setback Variance was granted to C. B. Stratton,for Lots 7 & 8, Block 2, Tract 8507, 218 South Motor Avenue. .A report was received from the Committee selected to .study, the controversy between the Quarter -Midget Assoc- iation'and those persons opposed to the racing. The -':Committee reported that the Association has agreed to erect a'noise-deadening type of fence around the track, .to keep the off -ramp damp during the races, and to eliminate noise -amplifying devices from the engines. The'racing hours agreed upon were: the 2nd and 4th 'Siturday•of each month from 3:30 to 9:30 P.M. during Daylight'Saving Time, and the 2nd and 4th Sundays of each month from 1:00 to 6:30 P.M. during Standard Time. It was also recommended that the Association be granted use of the track on Tuesday evenings following regular racing days from 7:00 to 8:30 P.M. for practice and training., ,The Committee further recommended that a 3 -man committee be appointed by the City Council to see that all promises of the Association are carried out, and that the Agree- ment be extended for a one-year period. Moved by Councilman Teasley, seconded by Councilman Ortuno-that the City Attorney be authorized to prepare 'an Agreement with the Quarter -Midget Association setting forth the recommendations of the Committee, said agree- ment to be effective until August 31, 1960. S. Reed, and R. Cochran be appointed as a for Quarter - '3 -man committee to determine that all the stipulations Midget 'seitforth'in the agreement be kept by the Association. Moved -by Councilman Ortuno, seconded by Councilman ,.Teasley and unanimously carried that the recommendation of the Mayor be accepted. -Moved -by Councilman Teasley, seconded by Councilman ,Ortuno that inasmuch as the Agreement will not be pre- sented to Council before the next scheduled racing date, ­September.'27th, the Quarter -Midgets be given permission to race from 1:00 to 6:30 P.M. on that date. The cost of improvements to be installed in the area at the northeast section of the school grounds would be borne °. by the' City. ,Moved by Councilman Paul, seconded by Councilman Ortuno, recommendation be forwarded to the newly -formed ,that•this Capital.Improvement Committee to establish priority and �be'set up as a capital itnprovenent. This motion carried by the following vote: AYES:- Councilmen: Paul, Ortuno, Johnson NOES: Councilmen: Teasley, Memmesheimer ABSENT: Councilmen: None In accordance with Council request, the City Attorney prepared an amendment to the Resolution relative to departmental complements, adding the positions of Ad- ministrative Assistant, Administrative Secretary, and Planning Technician. Councilman Ortuno offered the following Resolution Res. 39492- entitled: Re Dept complements 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION I OF RESOLUTION NO. 3597 AND THE CLASSIFICATION PLAN BY ADDING CERTAIN POSITIONS TO THE CITY -EMPLOYMENT. Moved by Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that further reading be waived. Moved by Councilman Ortuno, seconded by Councilman Teasley that the Resolution be adopted. Moved by Councilman Ortuno, =Teasley, -and ordered carried waived. •Moved,by Councilman Ortuno, Teasley that the Resolution was then passed and adopted Council`: seconded by Councilman that further reading be seconded by Councilman be adopted. Councilmen: None and,numbered Resolution No. 3950• In accordance with Council request, the City Attorney prepared an Amendment and Extension of Ambulance Service Agreement until July 31, 1960. Moved by Councilman Ortuno, seconded by Councilman ,Teasley and unanimously carried that the extension of .Agreement be approved and the Mayor and City Clerk "authorized to sign same. The Administrative Officer stated that he had received a reply to'his letter to the Pacific Electric Railway Company in which the Railway agreed to abandon the -tracks-on Ninth Street and pay the City the sum of $10;000. for which the City would pave the area. Moved by Councilman Ortuno, seconded by Councilman Teasley and unanimously carried that the Agreement be approved and the Mayor and City Clerk authorized to sign. The -Railway Company stated that they were also interested in the opening of Orange Avenue and the abandonment of the crossing at Enid Avenue. They stated that they would expect the "State Plan of Apportionment" to be used as a basis for the new crossing. Under this plan, the muni- cipalipy pays all costs for the opening of the crossing, including whatever signal protection may be required by the Commission. Council authorized the City Attorney, Acting City Engineer and Administrative Officer to proceed negotia- tions'with the Railway along the lines suggested. The tabled matter of the question of Council's position relative to an easement for road purposes over the Corps of Engineers land along the west levee of the river was again presented to Council. Moved by Councilman Ortuno, seconded by Councilman Paul and ordered carried that the matter be raised from the table.: Councilman Johnson stated that there was a conflict of interests, inasmuch as the Assistant City Attorney has a personal interest in the Canyon City Rock Products Co. 453 Page 4 Res. 3950 - Re stand-by time in L & W Dept Ambulance agreement extended to 7/31/60 Pacific Elec Rwy Agrmnt approved Admin Off to contact Corps of Engrs re easement 0 ww! � CT,TY HALL AZUSA, CALIFORNIA MONDAY, SEPTEMBER 21, 1959 ,,Moved by Councilman Teasley, seconded by Councilman Ortuno that the Administrative Officer contact the Corps of Engineers advising them that the City is desirous of obtaining a road easement over their property. This motion carried by the following vote: AYES: Councilmen: Paul, Ortuno, Teasley, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None .The Treasurer's Financial Statement as of August 31, 1959, ,was presented to Council. The statement shows Bank Balances. -exclusive of Investment Account, $551,026.47; Treasury Bills, $400,000.00; Bank Balance, representing earnings to date, $39,o47.75; or a total of $990,254.22. Moved by Councilman Ortuno, seconded by Councilman Paul, .and ordered carried that the report be filed. A statement in the amount of $60.00 was received for membership dues in the East San Gabriel Valley Planning Committee for the fiscal year 1959-60. Moved by Councilman Ortuno, seconded by Councilman Paul, and,ordered carried that authorization be given for payment of the dues. 455 Page 5 Treasurer's Statement filed Membership due; for ESGV Planng Comte authorizE Council members were reminded of the League of California LCC Board Cities Board meeting to be held on October 1st at the mtg 10/1/59 Rodger -Young Auditorium. A communication was received from the office of Super- visor Bonelli stating that, based on an opinion of the judiciary committee, the establishment of a branch of the Citrus Court in this City is not feasible. Mayor Memmesheimer stated that he would like Council permission to pursue this matter further. Moved by Councilman Ortuno, seconded by Councilman Teasley, and ordered carried that permission be granted. Council members were invited to attend a luncheon on Wednesday, September 30th, sponsored by the Los Angeles County Coordinating Council on employment of the phy- sically, handicapped. Notice -was given of a Civil Defense Area "D" dinner meeting to be held on Tuesday, September 29th, at the Dinnerhorn Restaurant. The'Los Angeles County Heart Association requested .permission to hold their annual Heart Fund campaign ir,February, 1960. Moved by Councilman Ortuno, seconded by Councilman Teasley and ordered carried that the request be re- ferred to the Chief of Police with power to act. Mr. Sid Frenkel from the Azusa Herald appeared before Council to inquire whether Council was interested in obtaining a full page ad in their three newspapers for the Golden Days Issue of the paper. 'Moved by Councilman Johnson, seconded by Councilman Paul that Council not advertise in the Azusa Herald 'special -issue. This motion failed to carry by the following vote: AYES:' Councilmen: Paul, Johnson NOES: Councilmen: Ortuno, Teasley, Memmesheimer ABSENT: Councilmen: None Mayor Memmesheimer stated he felt this should be a joint effort between Council and the Chamber of Commerce, and asked that a recommendation be received from the Chamber prior to the next Council meeting. Councilman'Johnson moved that the Resolution be amended to delete the car mileage allowances. This motion died for.lack of a second. Moved by Councilman Teasley, seconded by Councilman Ortuno that the Resolutim be adopted. Resolution was then passed and adopted by the following vote of the Council: AYES: Councilmen: Paul, Ortuno, Teasley, Memmesheimer =ES: Councilmen: Johnson ABSENT: 'Councilmen: None and numbered Resolution No. 3951• Councilr^members were reminded of the Mayor's Safety Mayor's Safety Committee meeting on September 24th. mtg 9/24/59 CouncilmanPaul asked that the Administrative Officer P A system check -further into the possibility of obtaining a requested for sound system for use in the Auditorium. Auditorium Councilman Johnson recommended that the City retain City to approve additional Building Inspectors from the County to work addl County 'with the City Fire Department in setting up a program Bldg Inspectors of;inspecting all buildings in the City which appear to payment be substandard and do not comply with the Building Code. After inspection and recommendation, the buildings will have to be brought up to code or demolished. Moved by Councilman Ortuno, seconded by Councilman Paul, and ordered carried that approval be given for payment to additional County Building Inspectors for the purpose of instituting a corrective and rehabilitation program 'of substandard structures. Councilman Teasley brought up the subject of applying Stucco of stucco to the exterior of the Public Works Building, P. W. Bldg. stating that the City had received a bid some time ago to be for this work, investigated Moved by Councilman Teasley, seconded by Mayor Memmes- heimer that the Administrative Officer contact the bidder to determine whether he would still be willing to stucco the Public Works Building for the price which he previously quoted. Motion carried by the following vote: -AYES: 'Councilmen: Ortuno, Johnson, Teasley, Memmesheimer NOES: Councilmen: Paul ABSENT.: Councilmen: None Councilman Teasley stated that he had been contacted Complaint re by various business firms on Azusa Avenue asking that bicycles on -the Ordinance prohibiting bicycle riding on the side- sidewalks walks -be enforced, Moved'by•Councilman Johnson, seconded by Councilman Adjournment Ortuno,and ordered carried that the meeting adjourn.
