HomeMy WebLinkAboutOrdinance No. 537 37/ V /3_ ORDINANCE NO. 537 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REGULATING THE SALE AND DISCHARGE OF FIREWORKS. The City Council of the City of Azusa does ordain as follows : SECTION 1. Notwithstanding the provisions of Ordinance No. 474, adopted and approved the 2nd day of August, 1954, fireworks may be sold and discharged within the City of Azusa on the 1st, 2nd, 3rd and 4th days of July of each year pursuant to the provisions of this ordinance and so long as the provisions of this ordinance shall be complied with. SECTION 2. No person shall sell or offer for sale any fireworks within the City on said dates except: a. By a regularly established place of business operating under a duly issued City business license and not operated or estab- lished for the principal purpose of selling fireworks, providing a permit is first obtained from the Chief of the Fire Department or the City Council as hereinafter provided. b. In a temporary stand or structure used for the dis- play and sale of fireworks operated and maintained by a recognized charitable, religious, civic or patriotic group or organization with the written permit of the Chief of the Fire Department or City Council as hereinafter provided. SECTION 3. No fireworks shall be sold or offered for sale or discharged within the City which are classified as "dangerous fireworks" as that term is defined by the Health and Safety Code of the State of California. SECTION 4. Permits for temporary stands for the display and sale of fireworks shall be issued by the Chief of the Fire Depart- ment only in accordance with the following provisions : a. Such permits shall be issued only to local charitable, religious, civic or patriotic groups or organizations. b. Application for any such permit shall be made in writing filed with the Chief of the Fire Department before the 10th day of June of the year for which the permit is requested and shall state the name of the applicant, its address, the location of the pro- posed stand, the name of the persons who will actually operate the stand on behalf of applicant, and a complete account of the proposed disposition of all gross proceeds of fireworks sold at the proposed stand. c. Each corporation, group or organization shall be limited to one permit per year and each permit shall be limited to one stand. d. Any such permit may contain any reasonable conditions and restrictions. SECTION 5. Upon written application for any permit mentioned in this ordinance, the Chief of the Fire Department shall make an investi- gation and if he finds that the proposed sale of fireworks will not -1- ,-T violate any law or ordinance or endanger the public safety, he shall issue such permit in writing. Otherwise he shall refuse to issue such permit. Any person aggrieved by the refusal of the Chief of the Fire Department to issue such permit may, within ten days after such refusal, appeal in writing to the City Council, and in such case, the City Council may issue or refuse such permit. SECTION 6. Safe and sane fireworks, as defined by the Health and Safety Code of the State of California, may be discharged within the City on July 1st, 2nd, 3rd and 4th of any year subject to all other laws and ordinances in force and effect with the exception of said Ordinance No. 474. SECTION 7. Ordinance No. 312, adopted June 4, 1934, is hereby repealed. SECTION 8. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than $500.00 or by imprisonment in the City Jail or County Jail of Los Angeles County for a period of not more than six months or by both such fine and imprisonment. SECTION 9. The City Clerk shall certify to the passage of this ordinance and shall publish the same as required by law. Passed and approved this 14th day of May , 1957.
