HomeMy WebLinkAboutOrdinance No. 520t ORDINANCE NO. 520 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, CREATING THE POSITION OF ADMINISTRATIVE OFFICER OF SAID CITY, PRESCRIBING THE DUTIES THEREOF, AND DEFINING THE POWERS INCIDENT TO SUCH POSITION. WHEREAS, it appears that the administrative affairs of the City of Azusa, for which the City Council is responsible, may be handled more expeditiously and with better results through an officer acting on its behalf, whose duty it would be, subject to the control of the City Council, to: (a) Attend to such administrative affairs between meetings of the City Council; (b) Correlate and coordinate various municipal activities; (c) Compile data and prepare reports relating to the affairs of the City government, for the information and guidance of the City Council; and (d) Generally to act as agent for the City Council in the discharge of administrative duties; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. There shall be and there is hereby created in the unclassified service of and for the City of Azusa, California, the position of Administrative Officer. Such Administrative Officer shall be appointed by, and shall serve purely in an administrative capacity under the general supervision and control of the City Council. SECTION 2. Subject to the general supervision and control of the City Council, the said Administrative Officer shall have the following powers and duties, to-wit: • (a) To execute such administrative affairs of the City as may be referred to him or placed in his charge. (b) To attend meetings of the City Council with the duty of reporting on or discussing any matter concerning the affairs of the departments, services or activities under his supervision upon which the City Council should be informed. ( c) To represent the City Council in coordinating the administrative functions and operations of the various departments, divisions, properties and services of the City government, and on its behalf carrying out the policies, rules and regulations and ordinances adopted by it relating to the administration of the affairs of such departments, divisions, properties and services. (d) To analyze the functions, duties and activities of various departments, divisions, properties and services of the City government, and of all employees thereof, and to make such recommendations to the City Council with reference thereto as in his judgment will result in the highest degree of efficiency in the overall operation of the City government. -1- (e) To cause to be prepared and submitted to him by each department, division or service of the City government, itemized annual estimates of expenditures required by any of them for capital outlay, salaries, wages and miscellaneous operating costs; to tabulate the same into a preliminary consolidated municipal budget and submit the same to the City Council before its first regular meeting of June of each year with his recommendations as to such changes which he deems advisable. (f) To be responsible for the administration of the budget after its final adoption and to keep the City Council informed with respect thereto. (g) As agent for the City Council to supervise the expenditures of all departments, divisions, properties or services of the City government and to act as purchasing agent for the purchase of all supplies, goods, wares, merchandise, equipment and material which may be required for any of such departments, divisions, properties or services. (h) To develop and organize necessary public improvement projects and programs and to aid and assist the City Council and the various departments in carrying the same through to successful con- clusion. (i) To serve as public relations officer of the City government and to follow through and endeavor to adjust all just com- plaints filed against the City and any employee, department, division or service thereof. (j) To cooperate, within lawful limits, with all com- munity organizations whose aims and purpose it is to advance the spiritual and material interests of the City and its people and to provide them, within lawful limits, with assistance through the City government. (k) To make and keep up to date, an inventory of all property, real and personal, owned by the City and to recommend to the City Council the purchase of new machinery, equipment and supplies whenever in his judgment the same can be obtained at the best advantage, taking into consideration trade-in value of machinery, equipment, etc. , in use. (1) To receive and open all mail addressed to the City Council at the City Hall and give immediate attention thereto to the end that all administrative business referred to in said communications and not necessarily requiring Councilmanic action, may be disposed of between Council meetings; providing that all actions taken pursuant to such communications shall be reported to the City Council at its next regular meeting thereafter. (m) To perform such other and further duties pertaining to his position as the City Council may, from time to time, reasonably require. SECTION 3. That subject to the general control of the City Council and in cooperation with said various Commissioners, the Adminis- trative Officer shall act as the agent for the City Council in the discharge of its administrative functions but shall not exercise any policy-making or legislative functions whatsoever nor attempt to com- mit or bind the City Council or any member thereof to any action, plan or program requiring official Councilmanic action. It is not intended by this ordinance to grant any authority to, or impose any duty upon said Administrative Officer which is specifically vested in or imposed -2- by general law or valid City ordinances in any other City Commission, board, department, officer or employee, other than the City Council. SECTION 4. The Administrative Officer shall secure a corporate surety bond to be approved by the City Council, in such sum as may be determined by the City Council, which shall be conditioned on the faithful performance of the duties imposed on the Administrative Officer as herein prescribed. The bond fee is to be paid by the City of Azusa. SECTION 5. The City Council shall appoint the Administrative Officer for an indefinite term and may remove him by a majority vote of the Council. The City Council, in removing the Administrative Officer, shall use its uncontrolled discretion and its action shall be final. SECTION 6. The compensation to be paid to the Adminis- trative Officer shall be fixed and determined from time to time by resolution of the City Council, which compensation shall be in full satisfaction for payment of all services performed and rendered by the Administrative Officer. The Administrative Officer shall also be reimbursed for and shall be allowed traveling, hotel and incidental expenses reasonably incurred when absent from the City on official City business, but no reimbursement or allowance shall be made except upon an itemized claim duly presented to and approved and allowed by the City Council. Any such absence shall be subject to the approval in advance by the City Council. SECTION 7. The City Clerk shall certify to the adoption of this ordinance, and its approval by the Mayor of said City, and shall cause the same to be published once in the Azusa Herald and Pomotropic, a newspaper of general circulation, within fifteen days after the date of its passage, and that said ordinance shall become effective and in full force and effect, thirty days from and after the date of its final passage.
