1 ORDINANCE NO. 4147 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF 3 CALIFORNIA OF INTENTION TO VACATE THAT CERTAIN ALLEY, 24. FEET WIDE, IN TRACT NO. 14072, OF 4 THE CITY OF AZUSA, AS SHOWN ON A MAP RECORDED IN BOOK 282, PAGES 20 AND 21 OF MAPS, RECORDS OF LOS ANGELES COUNTY, CALIFORNIA, LYING BETWEEN 5 THE NORTHERLY PROLONGATION OF THE WESTERLY LINE OF LOT 16 OF SAID TRACT NO. 14072 AND THE EASTERLY BOUNDARY OF SAID TRACT NO. 14072, AND SETTING THE 7 TIME AND PLACE FOR HEARING ALL INTERESTED PARTIES OR PARTIES OBJECTING TO THE PROPOSED VACATION. 8 The City Council of the City of Azusa does hereby ordain 9 as follows: 10 Section 1. Notice is hereby gi;ren that the City Council 11 of the City of Azusa intends to vacate(all of that certain alley, 12 24 feet wide, in Tract No. 14072, of the City of Azusa, as shown 13 on a map recorded in Book 282, pages 20 and 21 of Maps, records 14 of Los Angeles County, California, lying between the Northerly 15 prolongation of the Westerly line of Lot 16 of said Tract No. 16 14072 and the Easterly boundary of said Tract No. 14072, 17 reference to the maps on file -in the office of the City Clerk 18 being hereby made for particulars.) 19 Section 2. The City Council does hereby fix the hour of 20 7:30 o'clock P. M. on April 7th, 1952, at the Council Chambers, 21 in the City Hall, City of Azusa, County of Los Angeles, State 22 of California, as the time for hearing all persons interested 23 in or objecting to the proposed vacation. 24 Section 3. The City Clerk is hereby directed to cause a 25 copy of this ordinance to be published in the Azusa Herald 26 and Pomotropic, a weekly newspaper of general circulation, 27 published in the City of Azusa, not less than fifteen days 28 prior to April 7th, 1952, and to cause Notices of Vacation 29 to be posted conspicuously along the line of the alley 30 proposed to be vacated, said notices to be placed not more than 31 300 feet apart and not less than three notices shall be posted. 32 Said notices shall state the passage of this ordinance and the -1- 1 time and place of hearing above set forth, said notices to be post d 2 pursuant to the provisions of Section 8322 of the Street and 3 Highway Code of the State of California, and shall contain the 4 information required therein. 5 Section 4. The City of Azusa does hereby reserve and 6 exempt from vacation the permanent easements and the right 7 from time to time to construct, maintain, operate, replace and/or 8 remove pipe lines, cables, wires, poles and other equipment 9 and facilities for the operation of telephone and electric 10 lines and for the transportation of electric energy, water, 11 and other utilities. 12 Section 5. The City Council hereby determines that the 13 public convenienceand necessity requires the reservation of 14 the easements and rights of way, for the purposes enumerated 15 herein, and any and all proceedings taken pursuant to this or 16 dinance are taken subject to such reservations and exceptions. 17 Section 6. That the alley herein referred to is being 18 vacated and proceedings hereunder are pursuant to the provisions 19 of Division 9, Part 3, Chapter 2, of the Street and Highway 20 Code of the State of California. 21 Section 7.
