Approval to Amend Rule No. 17 - Allowing the Resale of Electricity for Charging Electric Vehicles_ApprovedUB-5 Approved Utility Board 06/24/19 Amendment of Rule No. 17 June 24, 2019 Page 2 3.Where the customer is the owner, lessee, or operator of a multifamily accommodation and electricity is sub metered and resold to tenants at the same rates that the Utility would charge for the service if supplied directly; or This does not permit third party owned electric vehicle fueling stations to be compensated for providing electricity used to charge electric vehicles. By amending Rule No. 17 with the following additional exception, the electric vehicle charging station owners/operators will be allowed to recover their cost of electricity while providing this much needed service: “Where the Customer has ownership or control of a public access electric vehicle charging station and resells the electricity necessary to fuel electric vehicles to recover the Customer’s costs of providing the service to fuel electric vehicles. Customers are required to comply with applicable City of Azusa parking requirements and standards.” FISCAL IMPACT: The proposed amendment of Rule No. 17 is expected to increase electrical sales within the City, which will have a positive fiscal impact on the ALW budget because existing distribution facilities will be more fully utilized. The retail revenue produced by the increased vehicle charging is expected start out low; however as more electric vehicles are purchased, the revenues will likely increase over time. Prepared by: Reviewed and Approved: Paul Reid Manny Robledo Utility Programs Specialist Director of Utilities Reviewed and Approved: Sergio Gonzalez City Manager Attachments: 1) Resolution No. 2019-UB-07 2)Electric Utility Rule No. 17 UB-6 1 RESOLUTION NO. 2019-UB-07 A RESOLUTION OF THE UTILITY BOARD / CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING ELECTRIC UTILITY RULE NO. 17 “SUPPLY TO SEPARATE PREMISES AND RESALE” ALLOW THE RESALE OF ELECTICITY FOR CHARGING ELECTRIC VEHICLES WHEREAS, pursuant to Section 78-37 of the Azusa Municipal Code, the Utility Board / City Council is required to adopt rules and regulations governing the operation and services provided by the Azusa Light & Water Department; and WHEREAS, the City of Azusa owns and operates an electric utility that provides electricity to over 16,500 metered accounts; and WHEREAS, the City of Azusa has a comprehensive program to promote electric vehicle charging infrastructure; and WHEREAS, electric vehicle charging will help attract such businesses to the City of Azusa; and WHEREAS, electric vehicle charging for existing customers of Azusa Light & Water will help them expand their operations in the City of Azusa; and WHEREAS, the expansion of electric vehicle charging activity inside the City of Azusa is vital to the local economy and provides jobs to residents of Azusa; NOW, THEREFORE, THE UTILITY BOARD/CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: 1.That the Electric Utility Rule No. 17 “Supply to Separate Premises and Resale”, attached hereto as Exhibit A, is hereby modified and included in Azusa Light & Water Rules and Regulations. 2.That Electric Utility Rule No. 17, attached hereto as Exhibit A, shall become effective on July 1, 2019. 3.The City Clerk shall certify the adoption of this Resolution. EXHIBIT A ELECTRIC UTILITY RULE NO. 17 SUPPLY TO SEPARATE PREMISES AND RESALE A.SEPARATE METERING: Separate premises will not be supplied through the same meter, except as may be specifically provided for in the rate schedule. B.OTHER USES OR PREMISES: A customer shall not use electricity received from the Utility upon other premises nor for other purposes than those specified in his application or in the rate schedule applied. C.RESALE OF ELECTRICITY: A customer shall not re-sell electricity received from the Utility to any person, except: 1.Where energy is purchased at rates specifically applicable to resale service; or 2.Where the charge to tenants is absorbed in the rental for the premises or space occupied; or 3.Where the customer is the owner, lessee, or operator of a multifamily accommodation and electricity is sub metered and resold to tenants at the same rates that the Utility would charge for the service if supplied directly; or 4.Where the Customer has ownership or control of a public access electric vehicle charging station and resells the electricity necessary to fuel electric vehicles to recover the Customer’s costs of providing the service to fuel electric vehicles.
