Approve the NOC for CIP W-351 Sunset Ave Water Main Replacement_APPROVEDUB-8 Approved Utility Board 09/23/2019 ANALYSIS: ALW’s Water Division has a capital improvement program to replace water mains that are undersized and/or beyond their useful life. Water Division Engineering designed project W-351 to replace 650 linear feet of failing water main on Sunset Avenue from Fifth to Sixth Street. A mandatory pre-bid meeting was held on December 17, 2018. Bids for this project were received and opened by the City of Azusa Clerk’s office on January 7, 2019. On January 28, 2019, the Utility Board awarded a contract to Bonadiman Water, Inc. (BWI) of Riverside, California to install 650 linear feet of 8-inch ductile iron water main, including 2 new fire hydrants, 22 new services, tie-in connections, abandonments, new appurtenances, and pavement replacement, for a bid amount of $270,350.00. A standard ten percent City-controlled contingency of $27,035 was established for the project. A pre-construction meeting was held on March 19, 2019. Staff issued the Notice to Proceed on April 2, 2019, with a start date of April 15, 2019 (as requested by BWI). Per the 45 calendar day construction timeframe stipulated in the contract, this established a project end date of May 30, 2019. The contract completion date for all work was July 26, 2019. Several delays, including those imposed by BWI, caused the project to end after the scheduled project end date of May 30, 2019. These delays included an inefficient means and methods of construction and performing work that was unnecessary for the completion of the project. Further delays to this project were caused by BWI failing to schedule work with their subcontractors in an efficient manner and an added requirement by the City of Azusa Public Works Department (Public Works) requiring ten days between asphalt restoration and pavement markings (striping). On July 26, 2019, BWI completed all work per the plans and specifications. Due to the additional Public Works requirements for pavement restoration quantities, the project was completed at $10,666.40 over the base bid cost of $270,350.00. The total final contract price is $281,016.40. On September 5, 2019, the City received a claim letter from BWI requesting a time extension and additional costs resulting from alleged extra work due to differing site conditions in the amount of $158,650.63 (excluding amounts claimed that are currently being withheld as retention). The claim largely mirrors a prior claim submitted by BWI and subsequently retracted following the issuance of a claim rejection letter by the City Attorney’s office. Staff is proceeding with evaluating this “new” claim in accordance with statutory claim resolution requirements. FISCAL IMPACT: The Sunset Avenue Water Main Replacement Project was assigned to the Water Division’s Capital Improvement Program budget Account No. 32-80-000-721-7145/72115A, for an amount not to exceed $297,385, which included a 10% contingency.
