HomeMy WebLinkAboutMinutes - August 23, 1960 - CCCITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 The City Council of the City of Azusa met in. adjourned regular session at :the above time, and place. Mayor Ortuno called the meeting to order at 7:30 P.M. Present at Roll Call: Councilmen: Paul, McLees, Johnson, Teasley, Ortuno. Also Present: Attorney Willard Decker, representing City Attorney Williams; Chief of Police Kendrick; Fire Chief Madison; Deputy City Clerk Administrative Assistant, George Caswell. Mayor Ortuno stated that this was the time and place set for the Public Hearing on the "Cloister" matter, and asked the Admini- strative Assistant whether he had notified the licensees, A. Keith Porchia and Gerald E. Brown, of the Hearing. The Administrative Assistant read the letter sent by registered mail August 16th, 1960, to each of the licensees notifying them of the Hearing, and produced a Post Office return receipt signed by Gerald Brown. Mayor Ortuno asked whether there was any .further proof that the licensees had received notice of Hearing. A signed statement from Chief of Police Kendrick was presented certifying that a True Copy of "NOTICE OF HEARING" was served to Arnold Keith Porchia by Officer John Moseley on August 16, 1960 at 3:30 P.M. , and that Arnold Keith Porchia acknowledged receipt of some by affixing his signature thereto. Mayor Ortuno stated that before continuing the hearing he felt he should state that some of the testimony to be given would of necess- ity contain offensive language, and that if anyone wished to leave, they might,do so at any time. The Mayor stated.that to start, Council would take any oral comp- laints from the audience plus any written complaints, and would continue with anything the defendents wished to present in their be- hal.f. The Deputy City Clerk announced that he had a petition,received in the office of the City Clerk August 10, 1960, signed by some thirty residents, business operators and property owners in the neigh- borhood of 517 N. Azusa Avenue, vigorously protesting the unsavory effect of the "Cloister" in the area. The Petition was read in full. Mayor Ortuno called on Police Captain Warren to testify. He was sworn in by Deputy City Clerk Caswell. The Attorney asked the licensees whether they had anyone to rep- resent them. Mr. Porchia replied that they did not. The Attorney 485 7:30 P.M. CALL TO ORDER ROLL CALL PUBLIC HEARING " CLOISTER " CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 then advised Mr. Porchia that he had the right to ask any any questions after the officer had made his statement. Captain Warren stated that the Police Department had conducted . an investigation of the "Cloister", and that the Department also had cont- acted several witnesses who can and desire to testify at this Hearing. Captain Warren then presented two photographs to Council showing the front and rear entrance to the "Cloister", and its location in the middle of private dwellings and business houses. Captain Warren advised Council that he had brought with him copies of incident reports taken from the Police Department files relative to the "Cloister". Council asked that he give a resume of the reports. These reports covered a period beginning the 17th of April continuing through the 17th of August. There was one report in April, two reports in May, three in June, eight in July and fifteen in August; a total of twenty-nine. The reports covered a wide range of complaints: loud noises; zone violation and business license violation; destruction of property; stealing; drinking; lewd acts; child abandonment; etc. The hours of complaints ranged from 8:29 A.M. (Juveniles sleeping in car) through 3:37 A.M..(Welcome Wash Burglar Alarm). jai 7:30 P.M. PUBLIC HEARING "CLOISTER" cont'd Captain Warren stated that he also had two reports submitted by Officer Maxson of his observations of activities about the outside of the "Cloister"; one from 9:10 P.M., August 15, to 4:30 A.M. Tuesday, August 16th; the second report covering activities observed at the rear of the " Cloister " between 9:00 P.M. August 16 to 5:00 A.M. August 17th. Captain Warren stated that Officer Roth had also prepared a report of his observations of activities occurring inside and outside of the "Cloister" between 9:20 P.M., August 16th, and 3:15 A.M., August 17th. Captain Warren stated that Officer Roth is not able to attend the Hear- ing, but that he had his report. He recommended that Council read the report to themselves because of the profane language contained therein. The report was also given to Mr. Porchia to read. Captain Warren stated he had no further evidence to present at this time but he did have witnesses if Council wished to call them. Mr. Porchia stated he would like to make it clear that they sold the "Cloister" to Mr. Glasier at the end of July and that most of the reports on profanity and immoral acts concerned events which took place after they had commenced the sale, and that he did not see these things happen. The Administrative Assistant asked Mr. Porchia if the transaction had be- come final when.the sale was made at the end of July as Mr. Glasier had come to the Office of the City Clerk for a Business License and had been advised that he was not eligible for a license until change of ownership had been completed. Mr. Porchia replied that as there was no liquor license involved, they planned to go through on a bi l l of .sale rather than escrow , and that Mr. Glasier had been operating since start of sale with Fred Smith as manager. Captain Warren stated that Mr. Porchia was not under oath. - 2 - CITY HALL CITY OF AZUSA TUESDAY,AUGUST 23, 1960 The Attorney advised Mr: Porchia that he would be given an opportunity of having anyone testify after Captain Warren had finished. Captain Warren then called Officer Guardado who was sworn in by the Deputy City Clerk, Officer Guardado testified.that at approximately 11:00 P.M., August 19, 1960, he was conducting surveillance from a build- ing directly West of Rex's Shoe Shop, thirty feet from the rear door of the "Cloister". He observed two male subjects pour liquid into a glass. One of the parties had a coca cola bottle. He took a botfle from under the seat of a 1956 Ford sedan, pour- ed 1/4 glass of liquid and put the bottle back in the glove comp- artment. A Police Officer came up from5th Streetand observed him.. The.Officer removed a bottle from the glove compartment and arrested .them for having liquor under the age of 21. Between the hours of 1:00 and 2:00 A.M., Officer observed Mr. Keith Porchia ride in from the North on a bicycle, enter the "Cloister", where he remained for 15 or 20 minutes, came out with two other male subjects, reached . into his pocket, took out a bottle that contained a green liquid, consumed the contents of the bottle between the three of them, then threw the bottle into garbage can. After tossing the bottle away, stayed outside for half an hour, went in to the club for about half an hour, came out and peddled away. That between 2:00 and 3:00 A.M. he observed three or fourmale subjects in the lot immediately to the South of the "Cloister " with containers in hands who attempted to hide when a police unit came up the alley. A little later he observed a car load of male subjects park in the vacant lot immediately to the rear of the residence South of the "Cloister". Three of the occupants got out of the car on the "Cloister" side and urinated on. the vacant lot. He further observedayoung girl approximately sixteen.years.df age come out of.the "Cloister" talking to a male subject. The officer could not hear the conversation, butthe girl was plead- ing with the man and making love. She stayed with him ten or fifteen minutes pleading, but to no avail: She went back into the club for about an hour and again came out to plead with another male. The male returned to the "Cloister" while the girl stood in the door. The male returned about three minutes later and handed the girl an unidentified object which she placed in her mouth. About thirty or forty minutes after putting the object into her mouth she appeared to be under the influence of an alcoholic beverage or barbiturate. She was then observed to go to an automobile and attempt to reach something from the driver's side but, unable to do so, walked to the rear, reached in and picked up a white sweater. She took something out of the pocket of the sweater and went into the club; She came out about an hour later with three men who appeared over the age of twenty- one and left with them and two other girls. Mayor Ortuno asked Mr. Porchia whether there were any questions he would like to ask. Mr. Porchia asked whether the girl was under the influence of a barbiturate and whether she received this from the fellow or the car. - 3 - 7:30 P.M. PUBLIC HEARING "CLOISTER" cont'd rm CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 7.30 P.M. Officer Guardado stated he thought it was from what the fellow had given her. Officer Frank Shomber was called upon to testify after being sworn in. The Officer stated that on August 17th at 8:00 A:M. he was de- tailed to the rear of the "Cloister" to check trash cans for any alco- holic containers he might find there. He stated that with the help of the Webster Disposal Company, he obtained the following bever- age containers which he placed on the table for viewing. Containers consisted of some twenty beer cans, one wine bottle and one rum bottle. The officer stated this was one mornings pick up.The morning immediately before they closed. Mayor Ortuno asked Mr. Porchia whether he would care to question the report. Mr. Porchia stated that they were closed for a period of two weeks before Mr. Glasier opened the Cloister and named it the "Jester". He said that he had come to the Club after they were closed and he had found beer cans in the trash. Officer Lawrence Maxson was sworn in. His reports were given Council to read. Officer Maxson stated that he was on stake -out at the "Cloister" from 9:10 P.M., August 15th, to 4.30 A.M., August 16th, and again between 9:00 P.M. to 5:00 A.M., August 16th and 17th. The Officer read the log of events deleting the profane language. He cited numerous instances of loud mufflers; illegal parking; use of horn; loud music coming from open door of "Cloister"; use of foul language by males and females which in one instance was clearly heard 75 feet distant; and other offenses. Mr. Porchia was asked to look at the report, especially with regard to lewd language used. The Attorney asked to know the date of the "Cloister" business license. The Deputy City Clerk advised that application for li cense was filed April 12th, 1960, but that the actual license was not issued until July Ist, 1960; that it is a cafe license, and specifically noted it would be a violation of the Zoning Ordinance if theatrical performances or dancing were allowed. Mr. Joe Olivera of 511-1/2 North Azusa Avenue was sworn in before giving testimony. Mr. Olivera relate instances on the outside of their premises and those next to them being used as a urinal and a toilet by patrons of the club; frequent use of obscene language heard; disturbance caused by back- firing of cars. The Attorney asked when these events took place and Mr. Olivera replied in the past month or month and a half it had been almost cont- inuous, and that in August it occurred mostly after Midnight. He stated that he observed instances of intercourse on the premises of the yarn shop; that Friday nights and Saturday mornings were the worst - 4 - 442 CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 7:30 P.M. time for disturbances and loud noises; that he had seen patrons going from PUBLIC REARING and coming to the "Cloister" at 3:00 and 4:00 o'clock in the morning. "CLOISTER" cont'd The Attorney asked whether the disturbances and noises were sufficient to awaken the inhabitants of Mr. Olivera's household from sleep and was informedthat their home is approximately three (3) feet from the alley and it is not hard to imagine what a loud back -fire does to sleep. Mr. Olivera stated .that as long as the door :to the club was kept closed the music did not bother too much, but that the door was frequently left open. The name of Mr. & Mrs. Joseph Olivera was offered to appear on the petition. The next witness was Mrs. Virginia Skinner of 503 North Azusa Avenue. Mrs. Skinner stated that she had been disturbed quite a bit by the music and live orchestra noises.from the Club, had seen and caught people driving through her property leaving tire ruts in her yard; had seen people sitting in cars drinking from bottles; had seen people come out of the "Cloister" with highball glasses, fill the glasses up and return to the club again; had observed an obviously irate mother drive up and get her daughter from the Club. On another occasion .she was aroused by cars driving up right in front of her place. She got up and saw boys pounding on a car in which there was a young lady: She was trying to start the car and one fellow raised the hood and took something out of the motor. He kept using profane language: She -went to her door and turned the light on. He turned around and saw her and used quite a bit of profane language. He went to his motorcycle and took something from the saddle- bag which he placed under the hood of -the car and closed the hood. The girl then.drove away. Mrs. Skinner stated that she was again awakened that some night by the motorcycles tearing up and down in the vicinity. Mrs. Skinner was asked whether these actions occurred prior to the last month: She replied that they had and that live orchestra, drinking, profane language, etc., had been going on ever since the place opened, but that it got worse in the last month. Mr. Porchia stated that when he and his partner had the "Cloister" they checked the people who came in and if they were drinking they were not allowed in, and that if he saw them drinking in the cars he asked them to drive away. The Attorney asked Mrs. Skinner that if those drinking and making noise on the outside left, whether she could hear any.!disturbances inside .the place. She stated she could hear loud music and hollering whenever.the door was left open. Captain Warren asked Mrs. Skinner whether she had signed the first petition received in the office of the City Clerk, June 20th, stating :. what happened did happen prior to June 20th. She stated, that she had signed it. - 5 - 'a ': �. CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 7:30 P.M. The Deputy City Clerk read into the record the Petition which had been received in the Office of the City Clerk about 3:00 P.M. on June 20, 1960. This Petition was signed by some twenty-three people and had been referred to the Police Department for action by Council at the meeting of June 20th. Mrs: Ruth Mays of 506 North Azusa Avenue was sworn in. She stated that she had lived there all her life and that the reading of the Peti- tion clarified the point she wished to make. She said she wished to make it clear that the beer cans were there during the time.that Mr. Porchia operated the "Cloister" and that during the time it was first closed there was loud music going on all day long. Mr. Earl Norwood of 511 North Azusa Avenue wished to testify and was sworn in. He stated that he was not a resident, but he owned a store on the front of the lot and a house on the back. He said that he has spent quite a bit of money trying to keep the place up, and had picked up three times the amount of cans and broken bottles displayed, sometimes from the front steps. He said that he had been at this loc- ation for ten years and had never had any trouble until the " Cloister" opened. He testified that the cars made a race track out of this drive- way, parked in front of the store, and that the patrons of the club tramped down the flowers and shrubbery. He felt the club should not be in that part of the community at all. Mrs. Carrie Curtis of 515-1/2 North Azusa Avenue wished to testify and was sworn in. She stated that the back door of her apartment is near the back door of the Club and that she has heard weird screams coming from inside the club in the early morning hours. That she has seen young girls going in the back door at four in the morning; that there has been much back -firing of automobiles and loud motorcycles and that the patrons had made a toilet of her back yard. Mr. Ray Overman, owner of the Welcome Wash at 519 North Azusa Avenue wished to make a statement and was sworn in. He stated that he had owned the business two and a half years and that prior to .the opening of the "Cloister" everything had been peaceful and quiet. Since it had opened he has had to padlock all rest rooms because from evidence there could be no doubt of what was going on. That during the last three or four months customers who formerly came in at night have stopped coming and that his business is off about $50 per week. He related one incident of a young girl who came in from the club to use the mirror on his soap machine. She returned to the Club but was back in about an hour's time all "torn up" and that she made some four trips back and forth during the night. He stated that his burglar alarm had been damaged and that there was great disturbance in the area. Mr. Michael Newell of 536 North .San Gabriel Avenue wished to testify and was sworn in. He stated he moved into.the neighborhood the first part of July, and - 6 - PUBLIC HEARING "CLOISTER" cont» 446 CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 that when he first moved in, up until about a week or so ago he has had great difficulty sleeping due to the noise from patrons of the club; that he is a student and that the noise has interfered with his studies and that he does not feel it wise to leave his wife alone in the neighborhood. Miss Judy Peterson of 5104 Edenfield addressed Council. She said that the adults have stated they want the young people to move to a different part of town where they would not disturb anyone and she wanted to know where they were supposed to go at night. Mayor Ortuno replied that he urderstood that most of the young people did not care to go to the Recreation. Center and that other efforts in behalf of the teenagers had failed because the young people wanted to be on their own with noone to supervise them. After further discussion, Councilman Johnson stated that this is another problem and suggested that the Hearing be resumed. The Deputy City Clerk advised Mr. Porchia that all of the com- plaints had been heard and he could present any evidence or witnesses he wished in his behalf. Mr. Arnold Keith Prochia of 350 West Third Street, was sworn in. He stated that before he and his partner opened the "Cloister" he had gone to the Police Department and spoken to Captain Warren about what. they planned to do and it seemed to be alright. Then .they were informed that there was an Ordinance against theatrical performances in a commercial zone. He stated that his partner would stand at the front door and see that those coming in were properly dressed and not drinking. He said a number were turned away which made them angry and that no doubt those who were not allowed inside created much of the disturbance on the outside; that at times there were different officers in the club checking and all the reports on the inside appeared to be in their favor. That perhaps when Mr. Glasier took over he did not have the proper supervision. He asked that Council notice on the first complaint the main objection to the opening of the "Cloister" was the noise, not so much immoral activities. Mr. Porchia stated that after he closed, he checked the trash cans just for his own satisfaction and that he found beer cans in them and that Miss Judy Peterson told him she had seen residents of the area put beer cans in the Cloister barrels. Miss Peterson corroborated -this statement. The Administrative Assistant asked Mr. Porchia whether he would go through his opening and closing dates step by step as he had referred so frequently to these times. Mr. Porchia stated that he did not have the dates. Mr. Porchia was asked who owns the "Cloister" at the present time and he replied that he is the owner. That he did not complete the sale to Mr. Glasier, although Mr. Glasier did take management for approximately the past three weeks. - 7 - 447 7:30 P.M. PUBLIC .HEARING "CLOISTER" cont'd tie CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 7:30 P.M. The Attorney asked Mr. Porchia whether Mr. Glasier was employed by him or what sort of contract they had, whether there was anything in writing, or whether he had attempted to make an assignment of the license. Mr. Porchia replied that Mr. Glasier had never been employed by him, and that they had planned the sale on a part payment down and then so much a week and that Mr. Glasier could take over and oper- ate the club as his own. Mr. Glasier had not signed the contract as he had to get a transfer of lease from the landlord. Mr. Porchia said there was no stipulated agreement on the license. Councilman Johnson asked Mr. Porchia how many restrooms were in the club and he replied there were two in compliance with the Health Law. She then asked him what signs were over the doors and was told "His" and "Hers". Councilman Johnson stated that she understood it was "Coed". Captain Warren asked Mr. Porchia whether he had heard the testimony of Officer Guardado and recalled hearing him say he observed Porchia ride a bike up to the club, August 20, go in, and a little later come out with two men and ,drink from a bottle which he took from his pocket. Mr. Porchia said he thought he did remember the incident and on quest- ioning; by Captain Warren stated that.they were drinking Rum and that it was possible that the green bottle on display could be the one he had tossed into the Club trash container. Captain Warren asked Mr. Porchia whether he had any knowledge of narcotics being in the "Cloister". Mr. Porchia replied that there was oneinstance when he was standing in the front door he observed a young man pass what looked like marijuana and that he had colled the Police Department, butdidn't know whether they had found anything or not, and that he had done this in an effort to cooperate with the Police. On questioning from Council, Mr. Porchia stated when they had the jam sessions they would sometimes stay open to 4:00 or 5:00 A.M. on Friday and Saturday nights. Mr. Fred Dana Smith stated he would like to speak as Manager for the "Cloister". He gave his address as 831 East Alosta Avenue, Glendora. He stated that he was place in charge of management when the club reopened and that he worked for Joe Glasier. That it was his under- standing that Mr. Glasier had bought the place and that it was in Escrow, and that the business license was regular. Mr. Porchia explained that Mr. Smith did not know that the transaction was being handled on a Bi II of Sale and there was no necessity of change of license until sale had been completed. Mr. Smith stated that after listening to all the complaints he would think the Club was a terrible place if he had not been behind the counter and seen for himself what went on inside. He stated that from the time the Club reopened under his management until it closed they had about four thousand customers by cash register count, and that those who came in looked up to the place and thought it was just the thing Azusa needed; and that they started to take membership cards and that better than seventy percent of these members were over twenty- _ 8 - PUBLIC HEARING "CLOISTER" cont'd 450 CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 one, and of the members they had, only three girls were around fourteen. That especially after all the newspaper publicity the place had, people were coming from Pasadena, Lo Puente, Downey, Anaheim and some from Los Angeles. In answer to questions from Council, Mr. Smith stated he opened the place as a restaurant and served soft drinks and sandwiches at regular prices; that one couldn't charge patrons admission to sit there and listen to the juke box. That the young people would come and stay for half an hour or so and then go: That some of the parents came to this location to observe what was going on. That one lady around 70 brought her two daughters and stayed until 4:00 A:M. Captain Warren asked Mr.. Smith to reconsider his belief that the "Cloister" was a wholesome environment for teenagers in view of his own conduct at the Club on the night of August 16th, as stated in the report of Officer Roth. Mr. Smith was given a copy of the report to refresh his memory, but stated he had no recollection of what he and Joe Malone talked about that night outside the "Cloister", and could not remember the type of language used. Mr. Smith denied the report of the Officer relative to his behavior inside the club with a young girl on the night of August 16th, but did admit kissing her. Mr: Smith was asked by Captain Warren whether he remembered a patron turning the juke box down at 1:30 A.M. the morning of August 17th and telling hime to "Turn that God damn thing up where it belongs". Mr. Smith stated he didn't think he had said it. Captain Warren asked him whether he remembered the question- Council- man Johnson had asked Mr. Porchia with reference to the signs over the restrooms, and he now asked Mr: Smith what the signs read. Mr: Smith replied, "Men's" and "Coed". Mayor Ortuno asked whether anyone else wished to testify. Miss Dolly Stevens of 942 North Orange was sworn in. She felt that the City had made no provision for the entertainment of the older teen age group; that they were not welcome at the Rec- reation Center which catered primarily to the younger group; that there was simply no place for them to go to dance and to have a good time; that the "Cloister" had provided a good place for young people to go, especially when it first opened. Council was sympathetic to the needs of this age group and discussed with Miss Stevens just what type of place she felt might be the answer. Mayor Ortuno advised that Officer Sinclair had been trying to get a committee together to work out a suitable place and means of entertainment for this age group. Councilman Teasley agreed they would do all they could to help work the situation out. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the Hearing be closed. - 9 - 451 7:30 P.M. PUBLIC HEARING "CLOISTER "cont'd 652 CITY HALL AZUSA, CALIFORNIA TUESDAY, AUGUST 23, 1960 Mr. Paul Sanderson of 5620 Glenfinnan Avenue appeared before Council and asked to speak. He stated he had no evidence to present, merely remarks. He said he came here in June and that the "Cloister" was the first place he found to go to meet people and make friends. That the Club was run by younger people for young people just the way they liked it. That young people like to drink and there is no way to stop them and.that the smart teen- ager isn't going to get into trouble. Mayor Ortuno stated that Council would hold decision until per- haps the next meeting, and that in the meantime they would try to work out a solution that would be to everyone's satisfaction. The Mayor asked that the matter of purchasing the Sandoval prop- erty be given consideration at this time. The Deputy City Clerk read in full the letter dated August 21,1960, received from Mr. Sandoval stating that he would sell the property at 601 North Angeleno Avenue to the City for the sum of $11,500., if the City agrees to pay expenses already incurred by his attorney, Houston A. Snidow, in representing him in this transaction. Councilman McLees asked to know the cost of the attorney's fees. The Administrative Assistant advised that he had called Mr.Snidow and explained that the City Council would be interested to know what expenses had been incurred, but was advised by Mr. Snidow that this was a matter between his client and himself and that he would not discuss it with anyone representing the City. Mr. Sandoval was present at this meeting and stated that he did not know what the attorney fee would be. Attorney Decker advised that Mr. Sandoval should confer further with his attorney before making any decisions. As Mr. Sandoval had previously stated he already lost too much time from work trying to reach his attorney, Mr. Decker said he would be happy to go to Mr. Snidow and see what he wants to do and what he would recommend for a settlement. Mr: Sandoval also agreed that he would attempt to contact Mr. Snidow the next day. The Deputy City Clerk stated that he had two Resolutions.The first fixing the amount of money necessary to be raised by taxation for the fiscal year beginning July I, 1960 and the other fixing therates. He stated that if Council wished, the rate could stay the same as last year, $1.45. Councilman Johnson asked whether the Library allocation of .18p could be increased if the rate remained the some and was advised that 20� had been allowed. The Administrative Assistant stated that if Council wished to leave . the rate at $1.45, they could follow previous procedure and, at the end of the year,transfer amounts from the General Fund to meet the needs of the Park and Recreation, Library and Retirement Funds. 453 7:30 P.M. REMARKS RE: "CLOISTER" SANDOVAL PROPERTY RESOLUTIONS PRESENTED CITY HALL AZUSA, CALIFORNIA, TUESDAY, AUGUST 23, 1960 Mayor Ortuno asked whether Council had considered raising the cost of rubbish collection, as the City collects only 50� for rubbish and paysout $1.38 for rubbish and garbage service. He stated that this had been done in behalf of public relations, but that it was poor business, and .that .it would be of great help if the charge was raised to $1.25.. He.felt that consideration should be given to raise the rate to $1.25. Councilman Johnson asked for a breakdown of the Funds. Mrs. McKinney stated.that she had i ust talked with the Chairman of the Personnel Board and that the Board would proceed with their plans rather than wait for clarification. A letter from Elizabeth Moreno requesting permission to hold a wedding REQUEST FOR dance at the Armory September 10th, was read. WEDDING DANCE (Moreno) Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the request be referred to the Police Depart- ment with power to act. - 12 - M, CITY HALL AZUSA, CALIFORNIA .TUESDAY, AUGUST 23, 1960 Councilman Johnson stated that she thought all present were weary and that it would not be to the best interest of anyone to continue with the important matters. Moved by Councilman Johnson, seconded by Councilman McLees that the meeting be adjourned. The Deputy City Clerk stated that he would like to have the Council's blessing before adjournment. That, as Council knew, he was conducting affairs in the absence of Mr. Miller, and that while he is Deputy City Clerk, he would like Council blessing on his actions administrative - wise. Councilman Teasley and Paul stated he had their blessings. Mayor Ortuno asked that before adjourning the problem that faces the Accounting. Department be given consideration. He stated that every- thing the Department does between July Ist and the end.of:the year' is going to have to be done over unless we take some action on the salary increases. That if we wait until the survey is completed, all increases will have to be refigured. Councilman Johnson stated there was a motion on the table. Mayor Ortuno said he would like to have Council vote the motion be returned and voted down so that the matter of salaries could be taken care of. The motion to adjourn failed to pass by the following vote of the Council: AYES: Councilmen: Johnson, McLees NOES: Councilmen: Paul, Teasley, Ortuno ABSENT: Councilmen: None Councilman Johnson bade Council goodnight at 11:20 P.M. and left the meeting. Mayor Ortuno stated that at a previous meeting Council had given a half range increase straight across with two exceptions. That he would like to ask Council to consider giving a half-step range to those for whom the Personnel Board recommended no change. That those whom the Personnel Board recommended receivng a half range, receive a half range. Those the Personnel Board recommended receive one range or more, make it a full range. This would be a five percent raise for the time being, retro- active to July Ist. If this were done the Accounting Department could complete their work instead of having to go back when the survey is acc- omplished. Councilman McLees stated he felt this matter should be held until all members of Council are present. Mrs. McKinney addressed Council and stated that she would like Council to be aware of the difficulty the Personnel Board is having in obtaining qualified linemen because of the low range of pay. She told Council she had advertised for one month for a journeyman lineman. That out of ten - 13 - 7:30 P.M. DISCUSSED She further stated that the man who passed is reluctant to start at the first step. Applicants assume that an apprentice starts at the first step, not a journeyman. Mrs. McKinney pointed out that the starting pay is $2.56, and $3.12 is the top, while Anaheim starts at $3.29. Mayor Ortuno felt we should start linemen about $3.29 and just have the one range. The Administrative Assistant advised Council that he had received a ANNEXATION certificate from the Secretary of State completing the Annexation of NO. 38 COMPLETEI "Easterly Annexation District No. 38". The Administrative Assistant advised that we now have the Surety Bond APPROVAL MAP for Tract 824401 and submitted the final subdivision map of Tract 24401 TRACT $24401 to Council for action.
