Mayor Ortuno called the meeting to order and led in the salute Call to C to the flag. Invocation was given by Councilman Teasley. Invocatic Present at Roll Call: Councilmen: Paul, McLees, Johnson, Roll Call Teasley, Ortuno Also Present: City Attorney Williams, Supt. of Light & lister Smith, Fire Chief Madison, Acting Administrative Officer Caswell, and City Clerk Miller With no corrections the minutes of the meeting of January 30th App.of ml were approved as submitted. 1/30 Mayor Ortuno asked whether there were any corrections to the 2/6 minutes of the February 6th meeting. Councilman Johnson stated that on page 3, item 1, no action had been taken by Council relative to the paving of the railroad tracks on Azusa Avenue. with no further corrections, the minutes were approved as amended. The Treasurer's Financial Statement for the month ending Treas.Fir. January 31, 1961, was presented to Council. Stmt. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the report.be filed. The monthly report of the Personnel Board was presented to P.Bd. Councilman Teasley stated that, in accordance with Resolution I No. 4085, he requested that the Accounting Department be asked to compensate the Engineering Assistant for acting as City Engineer during the time this position is vacant. 262 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 20, 1961 Page 2 Tr, was requested that this payment be retroactive to the date of Mr. Schulte's resignation, January 13, 1961. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the matter be tabled until later in the meeting when the Attorney has had an opportunity to study the Resolution. r The following persons were certified as eligible for employment Auto-Mech as Automotive -Mechanic: elig.list Robert E. A communication was received from the Personnel Board request- Ltr. re: ing an opinion from the City Attorney as to what action could temp. emp be taken relative to temporary employees who had worked longer than the time alloted under the Civil Service regulations. It was pointed out that one department head had been advised that an employees 90 day working period had been exceeded and an explanation requested of the department head, but no response received. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the Department Head be directed to appear before the Personnel Board. An Employee Evaluation recommendation from the firm of Emp.eval.' Griffenhagen-Kroeger was submitted to Council for their form tabl. consideration. Moved by Councilman Teasley, seconded by Councilman McLees and unanimously carried that the matter be tabled two weeks for study. The hour of 8:00 P.M. was set for public hearing on proposed Pub. hrg: Easterly Annexation District No. 40, which comprises the E.Annex.4t Foothill Shopping Center. The City Clerk presented the affidavit of.publication of notice of the hearing, and stated that notice had been given to the Azusa Foot -Hill Citrus Company, owner of the property. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the affidavit of publication be ac- cepted and filed. The City;Clerk further stated that no pro;este had been re- ceived in his office relative to the proposed annexation. There being no persons in the audience wishing to protest the annexation, it was Moved by Councilman} McLees, seconded by Councilman Teasley and unanimously carried that Council make a finding that proper notice had been given and no protests filed; therefore that is not a majority protest against the Annexation. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be closed. Mi. Don McKellar of the Azusa Foot -hill Citrus Ranch, appeared before Council to express his thanks and appreciation for the cooperation of the Council. 264 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 20, 1961 Page 3 Councilman Teasley offered for its first reading the following 18t rdg. Ordinance relative to the Annexation, which also makes a find- Ord. re: ing that the property is in a C-3 zone: Annex. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED EASTERLY ANNEXATION DISTRICT NO. 40 TO THE CITY OF AZUSA. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that further reading be waived. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the matter of compensation for the Assistant City Engineer be raised from the table. It being the opinion of the City Attorney that compensation could be given for the period the Assistant acted in the ab- sence of an Engineer, it was Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the Assistant Engineer be compensated for the period he was Acting City Engineer at the first step of the City Engineers salary range. The hour of 8;00 P.M. was also set for public hearing on the appeal of Council for the Conditional Use Permit recommended by the Planning Commission for a Wrecking Yard on Loren Avenue. The City Clerk presented the Affidavit of Publication and stated that proper notices had been given to those persons involved by reason of proximity to the location. Mr. Ed Vega, one of the owners of the proposed Wrecking Yard, appeared before Council to speak in favor of the permit. Copies of communications addressed to the Planning Commission in opposition to the Use Permit were given to Members of the Council. There being no persons in the audience wishing to be heard in opposition to the granting of the permit, it was Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the hearing be closed. Moved by Councilman Paul, seconded by Councilman Teasley that the Conditional Use Permit be denied. Motion carried by the following vote: AYES: Councilmen: Paul, Johnson, Teasley NOES: Councilmen: McLees, Ortuno ABSENT: Councilmen: None Councilmen were advised that the first Planning Commission�� hearing on the General Plan is scheduled for March 15th. Hearings are scheduled for the Council meeting of March 6th on Precise Plan Amendments; Hillsi a Dev6lcp went (2); and Dancing in C-2 zones. The monthly report of the Recreation Department was submitted to Council. Moved by Councilman Johnson, seconded by Councilman Paul and unanimously carried that the report be filed. 266 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 20, 1961 A communication was received from the Park and Recreation Commission supporting the beautification plan of the Woman's Club Committee and recommending that the City assist in this project wherever possibl-. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that the Woman's Club be notified of the assistance of City Departments in the Beautification Program. A communication from the Park and Recreation Commission re- commended that in lieu of transplanting approximately 80 palm trees at this time to allow for the signalization and chan- nelization of Foothill Boulevard, the money which would be used for this purpose be set aside for future beautification plans. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that Council agree to the recommendation of the Commission if there is money available. The monthly reports of the Police and Humane Departments were submitted to Council. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the reports be filed. Authorization was requested by the Chief of Police for Juvenile Officer Sinclair to attend the Twelfth Annual Training Conference in Anaheim March 22 -24th, with account- able expenses of approximately $75.00. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that authorization be granted. The monthly report of the Fire Department was presented to Council. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the report be filed. It was reported that the cost of installing Fire Detectors in the Public Works Building would amount to 1350.00 plus $50.00 per year maintenance. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the City Administrator be authorized to have the fire detectors - installed in the Public Works Building and the necessary funds appropriated from the Light Fund. The Acting Administrative Officer requested an appropriation of $20,000.00 to cover the Architect's fee and other expenses in connection with the plans and specifications for the new Fire Station. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the appropriation of $20,000.00 be authorized. The monthly report of the Public Works Department was submitted to Council. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the report be filed. 268 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 20, 1961 The Assistant Engineer reported, relative to Mr. Leland's complaint about the water standing on his property in the vicinity of Vernon and Foothill, that a temporary improve- ment could be made by constructing a storm drain in the vicinity of McKeever and the street could be repaved to a better level at a later date. Moved by Councilman McLees, seconded by Councilman Paul and unanimously carried that the temporary improvement be authorized. 2-64 2 &.3 Page 5 ,,-Imp. aut] drain F.H.& Mc] It was reported by the Engineering Department that the cost Sewer re4 of sewer installation on Jubuedly DrAve was prohibitive and held the road inaccessible. Following discussion on the matter, it was decided to hold this matter in aberrance until a later date. The Assistant City Engineer reported that he had received gime ext. only one petition thus far for the proposed 1911 Act, and 1911 Act that this contained only 5% of the needed signatures. It petitions was recommended that the deadline for return of these petitions be extended. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the deadline for returning petitions for the proposed 1911 Act be extended to May lst. It was reported that the Engineering Department is going to follow up on the dangerous intersections in town, which were determined by a recent survey, and if no response results from a communication by the Engineering Department, the matter will be turned over to the Police Department for en- forcement. /Dangerous Inter. Notice was given that the Public Utilities Commission had P.U.C. authorized the construction of a grade crossing on Orange auth. Avenue at the Pacific Electric tracks and required the closing grade of the Enid Avenue grade crossing upon completion of Orange X-ing Avenue. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the Street Department be authorized to proceed with the construction of the Orange Avenue cross- ing on a minimum standard basis. The Assistant Engineer reported that the Citrus Union High School District had indicated their desire to construct curbs and gutters along Baseline between Cerritos and Rockvale, and agreed to finance this construction up to the amount estimated by the Assistant Engineer if the City would pay for any deficit above the estimated cost. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the Assistant City Engineer be auth- orized to negotiate an Agreement with the School District subject to the conditions stipulated. The monthly report of the Light and Water Department was submitted to Council. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that the report be filed. Agmt.witr. School Dist. autt L&w rep The superintendent of Light and water submitted four plans, App.Plan along with the estimated cost of each, for serving water to re: water the area north of Sierra Madre Avenue. After discussion on service the proposals by the water Superintendent, Assistant Engineer, 270 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 20, 1961 Page 6 proposed developers who estimated the approximate number of homes to be constructed, and the City officials, it was felt that there was no alternative but to use Plan 1, which at this time would amount to approximately $11,000.00. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the City Administrator be authorized to advertise for bids for Plan 1 as submitted, with the ex- ception of the bank, as soon as the plans are available. A Resolution was prepared authorizing the cancellation of covenants and agreements relative to parking, with Dar In- dustrial Leasing, Inc. Councilman Johnson offered the following Resolution entitled: Res. 414 Cancel.0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AUTH- y & Agmt. ORIZING THE EXECUTION OF A CANCELLATION OF COVENANTS AND Dar Ind. AGREEMENTS. Moved by Councilman Johnson, seconded by Councilman Teasley that further reading be waived. Motion carried unanimously. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that further reading be waived. The City Attorney also prepared an Ordinance relative to the lot rdg. proper meeting place of Council. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that further reading be waived. Mayor Ortuno stated that he had an Ordinance which changed the title of Administrative Officer to City Aoinistrator. Councilman Johnson stated that she would like to introduce the following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE BY CREATING THE OFFICE OF CITY AD- MINISTRATOR, PRESCRIBING THE QUALIFICATIONS THEREOF, AND ESTABLISHING THE POWERS AND DUTIES OF SAID OFFICE. lot rdg. Azusa Subst. Avenue (Substandard Structure Case No. 4) appeared before Case #4 Council and stated that he had made arrangements with a local hrg. contractor to work out plans for renovation and repair of the cont'd. premises. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be continued to March 20th. Notice was given of the League of California Cities Board of Misc. Directors Meeting to be held March 2nd at Rodger Young Aud. Council members were invited to attend a film entitled "American Field Service Story" to be shown at the Azusa High School on March 1st. A communication was received from Leo Nasser, Civic Parking Association, requesting reconsideration by the City of the purchase of parking lots in the 700 block of North Azusa Avenue. Mr. Nasser was advised that this matter would have to be con- sidered at the time of budget sessions. An invitation was extended to Council to attend the dedication of the new Civic Center at Colton. A. communication was received from the City of Alhambra request- ing opposition of Assembly Bill 127 relative to the Brown Act.
