The City Council of the City of Azusa met in regular session at the above time and place. Mayor Ortuno called the meeting to order and led in the salute to Call to the flag. Ord. Invocation was given by Rev. Gerald Meyers, Azusa Evangelical Invocatic Methodist Church. Present at Roll Call: Councilmen: Paul, McLees, Johnson, Roll Cal. Teasley, Ortuno Also present: City Attorney Williams, Acting Engineer Sennewald, Supt. of Light & Water Smith, Administrative Officer Caswell and City Clerk Miller With no corrections, the minutes of the meeting of March 6th were App, of approved as submitted. Min. 3/6 & 3/20 Mayor Ortuno asked if there were any corrections to the minutes of the March 20th meeting. Councilman Paulstated that on page 4 relative to the Clean -Up Campaign Committee, Councilman Teasley should be shown as a member of the committee instead of Councilman McLees. Councilman Johnson stated that on page 9 relative to the fencing of the ditch at Pioneer Park, the recommendation was intended to signify that all open ditch area which is City property should be fenced, rather than that which is within the City limits. With no further corrections, the minutes were approved as amended. The report of the City Treasurer for the month of February was Tress. presented to Council as follows: Total Bank Balances as of rep. February 28, 1961, after all receipts and disbursements for the month, $580,239.18. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the report be filed. Council members were advised of an amendment to the Civil Service Amend. tc Rules and Regulations whereby any employee, with the exception C.S. RegE of Safety Members, must pass a physical examination within 60 re: phys. days after his probationary appointment. Firemen must pass a exams physical examination prior to appointment (after certified for employment) and Police Officers must pass a physical examination prior to oral interview. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the communication be filed. The following persons were certified for employment on Civil C.S. Alex Stenman Fresno Robert Lawrence West Covina tied Moved by Councilman Teasley, seconded by Councilman McLees and unanimously carried that the list be filed. Councilman Teasley recommended that Council interview the in- dividual candidates at the earliest possible date in an execu- tive session. The Personnel Clerk stated that she would pro- vide the candidates applications for perusal by Council. . 314 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 3, 1961 Moved by Councilman Teasley, seconded by Councilman Johnson and unanimously carried that the matter be tabled in order that the applications may be studied. The Acting City Engineer stated that he had a map showing the proposed City addresses at the recently annexed Foothill Shopping Center which had been made up to comply with the City numbering system. Moved by Councilman Johnson, seconded by Councilman Teasley _and unanimously carried that the Engineering Department be authorized to establish a City numbering system for the Foot- hill Center, allowing the stores a 1 -year grace period for the change -over. 315 Page 2 F.H.Cen address Mr. Sennewald reported that the Owl 4X Sewer Line has been taken Info. r over by the County, which now furnishes the City with slight Owl 4X additional facilities at no added cost, since there are a limited Sewer number of connections available. It was recommended that the Council approve a Master Maintenance Master Agreement of Signals, which would be a blanket Agreement for all Maint. existing and future signals. Agmt. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that a Master Agreement be approved. The Acting Engineer presented plans for the proposed Foothill Plans o; Sewer, which he estimated to cost $4000.00, and stated that it F.H.Swr would require the approval of the County Sanitation District to be and the State Highway Department. submitt Moved by Councilman McLees, seconded by Councilman Paul and unanimously carried that the plans be submitted to the agencies for approval. A sewer easement in the vicinity of Thirteenth Street and San Sewer e: Gabriel Avenue was,presented for the consideration of Council, S.O. Avi with the report that there would be small maintenance cost on this sewer. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the sewer extension and easement be accepted. It was reported that the City of Covina was acting on the award App.bidi of the bid for the installation of signals at Cerritos and Arrow, signal and recommended that, as a formality, the City Council authorize Arr. & the awarding of the bid. Cerritos Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that Council approve the acceptance of the low bid of $12,484.00 for signal installation. The Superintendent of Public Works requested authorization for Exam.Aut the Personnel Board to hold an examination for Maintenance Man Maint.ME (Street) to fill an existing vacancy. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the request be granted. Council confirmed that a request of this type, to fill an exist- ang vacancy, is automatic and does not need Council approval. The hour of 8:00 P.M, was set for public hearing on Substandard Hrg. Structure Case No. 7, owned by Anita Moldup. This building is Subst. located at 830 N. San Gabriel Avenue, and was recommended for Case #7 demolition by the Building Inspector. 315 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 3, 1961 The City Clerk stated that he had received no communications in regard to this matter. There being no persons in the audience wishing to be heard, it was Moved by Councilman Teasley, seconded by Councilman Johnson and unanimously carried that the earing be closed. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the recommendation of the Building Inspector be accepted and the City Attorney authorized to prepare a Resolution ordering the demolition. Public Hearing was also scheduled for Substandard Structure Case No. 8, a building located at 838 N. San Gabriel Avenue, which is owned by Mr. J. Madrigal. This Building was also recommended for demolition. 317 Page 3 Case The City Clerk stated that he had received no communications relative to this matter, and there were no persons in the audience wishing to be heard. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be closed. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the recommendation of the Building Inspector be accepted for the demolition of the building and the City Attorney authorized to prepare the necessary Resolution. The Superintendent of Light and Water requested determination Water of Council policy relative to charging for the extension of mains the 6" water mains on the east and west sides of San Gabriel ext. Avenue between 13th Street and Sierra Madre. It was reported that there are several duplexes scheduled to be built in this area. Moved by Councilman McLees, seconded by Councilman Paul and unanimously carried that an Agreement be entered whereby the first developer will be charged the entire fee and then receive refunds as others hook onto the sewer and are assessed their share of the cost. The Superintendent of Light and Water reported that the cost Estimi for the purchase of electrical distribution facilities east of Citrus Avenue from the Southern California Edison Company would be $100,000.00, or approximately $209. per customer. Council members were advised, in accordance with Council So.Ca] policy, that the Southern California Edison Company had been Ed. tc granted permission to serve electrical energy at,244 S. Gen.P] It was requested by the Police Chief that Resolution No. 2644 relative to the erection of boulevard stop signs at the Santa Fe tracks on San Gabriel Avenue and Pasadena Avenue be rescinded subject to the approval of the Public Utilities Commission. It was pointed out that San Gabriel Avenue is now a State highway and the Pasadena Avenue Railroad signalization will soon be complete. Moved by Councilman Paul, seconded by Councilman Teasley and :aranimously carried that the Attorney be authorized to prepare a Resolution rescinding Resolution No. 2644. 318 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 31 1961 The 1960 Annual Report of the Police Department was submitted to Council. Moved by Councilman Johnson, seconded by Councilman Paul and unanimously carried that the report be filed. 319 Page 4 P.D. report The Ordinance relative to procedure for approval of precise plan of design was presented for its second reading. Mayor Ortuno inquired as to whether Mr. Caswell had ever resigned from his Civil Service position as Administrative Assistant. Mr. Williams stated that he had, in effect, resigned with acceptance of the Administrative position, as no person could hold two jobs. Mr. Williams further stated the main purpose of a formal letter of resignation would be to ask that he remain on the eligibility list. 321 Ord. 670 re: speer limits Mr. Caswell stated that he would submit his resignation, and then requested that an examination be held for the position of Administrative Assistant. Moved by Councilman Teasley, seconded by Councilman Johnson and Asst.Adm. unanimously carried that the Personnel Board be authorized to exam auth, advertise and hold an examination for the position of Administrative Assistant. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that further reading be waived. Motion to adopt failed to carry by the following vote of Council: AYES: Councilmen: McLees, Johnson NOES: Councilmen: Paul, Teasley, Ortuno ABSENT: Councilmen: None Councilman Teasley then presented the following statement which he requested be read into the record: 322 r CITY HALL AZUSA, CALIFORNIA Teasley Statement MONDAY, APRIL 3, 1961 Page 6 323 "In view of the persistence of those promoting this City Teasley Administrator Ordinance in re -introducing it again and again, Stmt. in spite of the fact that we have already voted against its adoption, I would like to make a statement making clear my reasons for opposing it. One fact stands out very clearly: the proponents of the measure have never made a case for it. They have never at any time shown exactly how the City might gain by its adoption. They have never detailed precisely any real weakness in our City's present business structure which might be remedied by creating a City Manager, or an Administrator with strong City - Manager powers. The vague argument that we could in this way improve the City's business management tends to create a false impression. This impression is that the City at present lacks business manage- ment. This is not true. The City Council has functions as the general management, and administers through the departmental managers. The fact that this management has been, and is, good, is evidenced by the fact that the various services rendered by the City of Azusa to its people are in many cases superior to the services rendered by other comparable cities in this general area. While, so far as I can see, the City would gain nothing by the adoption of this sort of an Ordinance, we could well suffer a considerable loss. First, it is usual for a City -Manager -type office to cost substantially more in salaries and appurtenances. This is the experience of those Cities using this kind of a set-up. Second, and more important, we would lose much of the free and untrammeled relationship between department heads and the Council. This could be a serious loss. The keen and loyal in- terest manifested by cur department heads in their work, and the fine initiative that springs from it, is of great value. This interest and initiative could well be stifled by extending the powers of a City Manager or so-called Administrator over those department heads. Third, it has been noted by thoughtful observers that there is presently a dangerous tendency on the part of elected officials to delegate their powers to non -elected individuals. I think we should resist this tendency. To assign tasks to as Administrator is one thing; to delegate powers is altogeth different. We members of this Council were elected by the people to manage the City's business, and given the power to do the job. We should do the job ourselves. We should retain the power. Moved by Councilman McLees, seconded by Councilman Johnson and unanimously carried that the purchase order be approved. Council members received copies of a communication from Donald L. Comm. Johnson, 1041 E. Gaillard, relative to trash charges, street Johnson address changes and the Ordinance on handbill distribution. Karpman Also presented was a communication from Donald S. Karpman, 717 E. Glen Lyn Drive, protesting the trash charge increase. A letter was received from Edward F. Taylor, Water Attorney, enclosing a statement of services rendered and outlining future plans in regard to water litigation. E. Taylor ltr. George Caswell, Administrative Officer, requested permission to Caswell to accept an invitation from the Southern California Edison Company attd. mtg. to visit their Big Creek Hydro -Electric facilities in the San Joaquin Valley on April 26, 27 and 28, 1961. Moved by Councilman Teasley, seconded by Councilman Johnson and unanimously carried that the request be granted. A memorandum was received from Superintendent Brusnahan submitting Estimate o] three plans for the fencing of the ditch at Pioneer Park and the ditch fence estimated costs. Moved by Councilman McLees, seconded by Councilman Paul and un- animously carried that Plan No. 2, a 6 -foot chain link fence with extended barb wire at the top, which is estimated to cost $2,800.00, be approved subject to the Park and Recreation Commission approval, and that authorization be given for the fence to be erected as soon as possible. Tl.e Administrative Officer reported that he had received proposals from several Consulting Engineering firms relative to the water pro- blems in the area of Sierra Madre Avenue, but that none of the firms would submit a straight dollar figure cost for the work. 328 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 3, 1961 Moved by Councilman Paul, seconded by Ccu ncilman McLees and unanimously carried that the Administrative Officer contact the firm of James Montgomery and Company for a survey of the proposed water system north of Sierra Madre Avenue. A claim for damages was received from John Gray, 525 Crescent Drive, resulting from a sewer back-up. L.C.C. mtg Board of Directors meeting to be held Thursday, April 6th, at Rodger Young Auditorium. Notice was given that the Certificate from the Secretary of State Certificat on Easterly Annexation District No. 40 (Foothill Shopping Center) from Secy. had been received on March 30, 1961. of State Annex.40 Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the Certificate be filed. It was authorized that the period from April 11-14, 1961, be Bus. Show proclaimed as Business Show Week. Wk. 4/11-1 Moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that the Mayor be authorized to sign the Proclamation. A communication was received from the Board of Supervisors Co.Wa.Ord. of a hearing to be held April 20, 1961, relative to proposed amendments to the County Water Ordinance. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the communication be referred to the Water Department. Moved by Councilman Teasley, seconded by Councilman Paul and Vincent, unanimously carried that Vincent Di Stefano, No. 1 on the DiStefano eligibility list, be appointed as City Engineer at Step 4 of City Eng. the salary range as soon as he is available for appointment. ® Step 4 Councilman Paul offered the following Resolution entitledt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING Res.4163 CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH Bills & THE SAME ARE TO BE PAID.
