The City Council of the City of Azusa met in regular session at the above time and place. Mayor Ortuno called the meeting to order and led in the salute Call to Ord to the flag. Invocation was given by Rev. 0. L. Swaim, First Assembly of God Invocation Church. Present at Roll Call: Councilmen: Paul, McLees, Johnson, Roll Call Teasley, Ortuno Also present: City Attorney Williams, City Engineer DS Stefano, City Administrator Caswell, Supt. of Light & Water Smith, Fire Chief Madison and City Clerk Miller. With no corrections, the minutes of the meetings of April 3 and April 17 were approved as submitted. It was requested by the Personnel Board that authorization be P.Bd. Conf. granted for two members of the Board to attend the Public Per- req, denied sonnel Association Western Regional Conference at Palo Alto, California, May 31, June 1 and 2, 1961, with accountable ex- penses of $100.00 each. Moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that the request be denied. A communication was received from the City Engineer and the Auth. to Superintendent of Light and Water recommending that authori- purch. Alt. zation be given to proceed with the purchase and installation & Check Vlv of an Altitude and Check Valve at Reservoir #2, which will increase the storage capacity by 2,500,000 gallons of water. Moved by Councilman McLees, seconded by Councilman Paul and unanimously carried that the recommendation for the purchase be accepted. A second communication from the Superintendent of Light and Auth. to Water and the City Engineer recommended the purchase of a purch. backhoe by the City, and set forth the various projects which backhoe could be accomplished with this machine, plus the advantages of ownership as opposed to rental or leasing of such equipment. Moved by Councilman McLees, seconded by Councilman Ortuno and unanimously carried that the recommendation for the purchase of the backhoe be accepted. Moved by Councilman McLees, seconded by Councilman Teasley and unanimously carried that the lowest of the informal bids pre- viously submitted be accepted and that the recommendation for the purchase of the backhoe from C. R. Cook, Baldwin Park, for Model 00401 at $6907 be accepted. The hour of 8:00 P.M. was set for Public Hearings on Substand- ard Structures. Pub. hrga. Subst.Str. Case #12 is a Substandard Structure located at 227 N. Alameda Case #12 Air -rue, which is owned by Mrs. Josephine Gomez. The City Clerk preeenTeJ the Affidavit of Publication and stated that no com- municat'ons had been received relative to this hearing. Mrs. Josephine Gomez, property owner, appeared before Council and stated that the building had already been demolished and the debris stacked for pick-up during Clean -Up Week. In view of this situaulon, the Resolution ordering demolition was held in abeyance for 30 days, and the hearing ordered closed. 350 i 353 CITY HALL AZUSA, CALIFORNIA MONDAY, MAY 1, 1961 Page 3 Moved by Councilman Paul, seconded by Councilman McLees and Bids auth. unanimously carried that the City Clerk be authorized to ad- vertise for bids for the fire station, bids to be opened on the 23rd day of June. A communication was received from Houston A. Snidow, Attorney Annex. req. representing the National Land Company, requesting proceedings be initiated by the City for the annexation of an area located on South Azusa Avenue, north of Newburgh Street, with a C-3 zoning to be established upon annexation. Moved by Councilman Teasley, seconded by Councilman McLees and unanimously carried that the request be referred to the Planning Commission for a report as to the desirability of such an annexation. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that authorization be granted for the pre- paration of a legal description to be forwarded to the Boundary Commission. The Chief of Police requested that Policewoman Marjorie Hunter Pol.Conf. be authorized to attend the Women Peace Officers' Association denied Conference in Sacramento May 22 -24th with accountable expenses Hunter not to exceed $100. Moved by Councilman Johnson, seconded by Councilman Teasley that, in the interest of consistency, the request be denied. Motion carried by the following vote: AYES: Councilmen: McLees, Johnson, Teasley, Ortuno NOES: Councilmen: Paul ABSENT: Councilmen: None A communication from the Planning Commission requested recon- Planner sideration of the previously denied request to allow expenses req. for Mr. Poppelreiter, City Planner, to attend the National Conference of Planning Officials, in view of the fact that expenses for this trip are budgeted, and requesting determination of Council policy relative to the budget. Council members re- quested that a copy of the minutes be forwarded to the Commission. In view of the action of Council on previous requests for travel Acct.Dir. authorization, the Accounting Director withdraw his request for req.with- attendance at the Municipal Finance Officers Association Confer- drawn ence. The City Administrator reported that a letter had been received Comm. re: from the Division of Highways stating that authorization had Gas Tx Fds. been granted to use gas tax funds for project 55, the improve- ment of Pasadena Avenue. A communication was received from Emmett A. Tompkins, Attorney, Tompkins relative to the San Gabriel Valley Municipal Water District and comm. re: the progress necessary to complete the contracts between the Wtr. Dist. four cities and the District, and the District and the State of California. Moved by Councilman McLees, seconded by Councilman Teasley and unanimously carried that the matter be referred to the City Engineer and the Superintendent of Light and Water for further study and discussion, and that they contact Mr. C. S. Reed, representative to the District from this area. Members of Council were given copies of a communication ad- C.D. Comm. dressed to Fred Becker, Director of Civil Defence, from the Executive Civil Defense Office relative to a proposed Auxiliary Police Force. San Case #13 Gabriel Avenue, which is owned by Harold Cockrell. The City Clerk presented the Affidavit of Publication and stated that no communications had been received relative to the hearing. There being no persons in the audience wishing to be heard, it was Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be closed. Councilman Johnson offered the following Resolution entitled: Councilmen: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DETERMIN- Res. 4170 ING AND DECLARING THAT A CERTAIN STRUCTURE OR BUILDING IS AN demolish. Moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that further reading be waived. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that further reading be waived. Members of Council were advised that a progress report for the Prg, rpt. area north of Sierra Madre Avenue is expected from the James M. due-Montg. Montgomery Company next week. Notice was given by the Superintendent of Light and Water that Pipe instal the installation of 840 feet of 6" water lines on North San Gabriel, south of Sierra Madre, had been completed. The approved plans for the Fire Station were presented to the Council. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the plans and specifications be approved and adopted. The City Administrator reported that he had been contacted by Handbill Mr. Bob Beck, Azusa Herald, relative to the Handbill Ordinance. Ord. disc. Mr. Beck reported that, although their paper was abiding by the regulations, there were other advertising papers still being distributed in the yards of homes, and presented pictures to support his claim. After considerable discussion on the situation, it was felt that the Ordinance should be amended to exempt the newspapers currently subject to a post office order as second class matter and delivered to paid subscribers, and to those persons who personally accept them. It was requested that May 26th be proclaimed as Poppy Day in Proc, re: the City. Poppy Day Moved by Councilman Teasley, seconded by Councilman McLees and unanimously carried that the Mayor be authorized to sign the Proclamation. A communication was received from the Park and Recreation Com- Constr. at mission recommending immediate construction of the concession Gladstone stand -announcers booth and rest rooms at Gladstone Park, in Park auth. the interest of public convenience and sanitation. The estimated cost of such a building is $2,700.00. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that the recommendation of the Commission be accepted and the City Clerk authorized to advertise for bids. Moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that further reading be waived. Due to the unification of the School District, an Ordinance was prepared relative to appointments to the Park and Recre- ation Commission, one of whom is selected by the School District. CERTAIN SECTIONS OF THE AZUSA MUNICIPAL CODE RELATING TO THE Ord. re: PARK AND RECREATION COMMISSION. Pk.Comm. The City Attorney made reference to the League communications relative to Municipal liability and governmental immunity. Res.4172 Wms. to Pk. Comm. Moved by Councilman Johnson, seconded by Councilman McLees and Cncl. unanimously carried that Council endorse the League stand in support support of Senate Bill No. 1031, and the City Administrator S.B.1031 authorized to direct letters to the committee members in support of the bill. Moved by Councilman McLees, seconded by Councilman Paul and unanimously carried that the letter be filed. Ltr. of commend. 358 CITY HALL AZUSA, CALIFORNIA MONDAY, MAY 1, 1961 A cormunication was received from the Los Angeles County Epilepsy Society requesting permission to solicit funds in the City during the month of July,1961. Moved by Councilman Teasley, seconded by Councilman McLees and unanimously carried that the request be referred to the Chief of Police. Page 6 Notice was given of a public hearing to be held before the Planning Commission on May 17th relative to a proposed variance for reduced lot sizes in 3 lots of Tentative Tract 26013 on the north side of Sierra Madre Avenue. Upon questioning, the City Attorney explained that a variance is for the purpose of bringing an unusual circumstance to the general degree or use level enjoyed by others in the locale. Members of Council received copies of communications relative to Assembly Bill 2728, Multipurpose Districts, and; Assembly Bill 2442, Court Consolidation. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the City Administrator be authorized to write all parties concerned expressing opposition to the two bills. Mayor Ortuno stated that he would like to have confirmation of the appointment of Mr. M. E. McKay to the Personnel Board upon the expiration of the term of Mr. Hickory Jackson.
