Authorize Communications Site Lease Agreement_ApprovedE-6 AZUSA I (.UT A �.· .. ur, CONSENT CALENDAR TO: HONORABLE CHAIRPERSON AND MEMBERS OF THE AZUSA UTILITY BOARD FROM: MANNY ROBLEDO, DIRECTOR OF UTILITIES Cjvv'f'.-, DATE: OCTOBER 28, 2019 SUBJECT: AUTHORIZE A COMMUNICATIONS SITE LEASE AGREEMENT WITH LOS ANGLES REGIONAL INTEROPERABLE COMMUNICATIONS SYSTEM AUTHORITY BACKGROUND: The Los Angeles Regional Interoperable Communications Authority (LA-RICS) is interested in leasing a small portion of Azusa Light & Water's (ALW) Heck Reservoir property to locate a cellular/radio communication facility, which will enhance wireless communication service to the Mountain Cove and Azusa Canyon areas. The proposed action will lease approximately 651 square feet of unimproved land to LA-RICS for a period of five years, including three 5-year optional extensions, at a monthly rental rate of $2,300 per month with a 3% per year escalation rate. RECOMMENDATION: Staff recommends the Utility Board take the following action: 1)Approve the Communications Site Lease Agreement with the Los Angeles Regional Interoperable Communications System Authority; and 2)Authorize the Mayor to execute the Communications Site Lease Agreement, in a form acceptable to the City Attorney, on behalf of the City. ANALYSIS: LA-RICS was established for the purpose of coordinating governmental services to establish a wide-area interoperable public safety communications network. LA-RICS seeks to continue to build out public safety grade Long Term Evolution (LTE) broadband communications for first responders, who are part of LA-RICS, in the Mountain Cove and Azusa Canyon areas. In this UB-46 Approved Utility Board 10/28/19 regard, they have expressed interest in installing a cellular/radio communication facility on ALW’s Heck Reservoir property located at 2000 San Gabriel Canyon Road, Azusa, California. Following receipt of appropriate federal approvals from the Department of Commerce’s National Oceanic and Atmospheric Administration Grants office and National Telecommunications and Information Administration, this LTE site will be incorporated into the federal First Responder Network Authority’s (FirstNet) National Public Safety Broadband Network, which is operated by FirstNet’s contractor, AT&T, Inc. and its subsidiary, New Cingular Wireless PCS, LLC. LA-RICS has submitted plans to lease approximately 651 square feet of ALW property for ground equipment, an emergency power generator, and a cellular/radio communications tower. The approximate location is shown in Exhibit “A” of the agreement, and the exact location and description of facilities is under review by the Azusa Planning Commission, and will be attached in place of Exhibit “A” of the Agreement once approved. The initial term of this Agreement is 5 years, commencing upon the completion of the construction of the facilities, or 12 months after the date of which the Agreement has been executed by the parties, whichever is earlier. The rent commencement date shall be January 15, 2020; provided, however, rent shall accrue unpaid until the facility is fully constructed and the agreement is assigned to AT&T, at which time the rent shall be due and payable retroactively back to the rent commencement date and monthly thereafter. The Agreement shall automatically be extended for three additional five year periods, unless notice of cancellation is given by the lessee. FISCAL IMPACT: Upon assignment of the Agreement to AT&T, AT&T shall pay the City of Azusa an annual amount of $27,600, in equal monthly installments of $2,300 per month, retroactive back to January 15, 2020. Annual consideration shall be increased by 3% each year throughout the term of the Agreement and any extensions or renewals thereof, effective on each anniversary of the commencement date. Revenue from this Agreement will be deposited in Water Fund 32.
