The City Council of the City of Azusa met in regular session at
the above time and place.
Mayor Ortuno called the meeting to order and led in the salute
to the flag.
Invocation was given by Rev. Ben Paroulek, First Presbyterian
Church.

Mayos Ortuno as)ced permission of Council to appoint Marilyn
Torrey as Actif►g City Clerk until James Miller returns to his
job,,because of the great necessity for a City Clerk at
present. The question arose that a member of Council should be
appointed as City Clerk Pro Tempore for this meeting, and
action was postponed until the City Attorney could be consulted.

of June 22nd meeting. Councilman requested a correction Min.
on page 1, relative to Exams. Date, to read: "Councilman McLees 6/22

The Miemtes of June 22nd meeting were approved as corrected.
Mayor Ortuno asked if there were any corrections in the Minutes App.of
of June 23rd meeting. Min.

Council the request of the Personnel Clerk that a correction be 7/5
made on page 6, relative to Letter from Personnel Board re:
salary increase, to read as follows: "A recommendation was
received from the Personnel Board, due to a request for salary
increase by the Employees Association, that the Council grant
a salary increase to employees amounting to one-step of their
present salary range..."
Police Chief Kendrick requested a correction on page 6, rela-
tive to Appointment of R. PareaA changing the spelling of said
Ruth B. Pares, to "Ruth B. Peres .
The Minutes of July 5th meeting were approved as corrected.

A communication was received from Police Chief Kendrick, re- Appt.
questing confirmation of appointment of Clinton C. Collins, C. C.
Jr., who is on Eligibility List XVI, as a Probationary Police Colllns,Jr
Officer.
Moved by Councilman Paul, seconded by Councilman McLees and
unanimously carried that Clinton C. Collins, Jr., be appointed
as Probationary Police Officer at Step 1, effective August 1,
1961.
A communication and request from Police Chief Kendrick, rela-
tive to vacations for Police Officers, was again presented
to Council.
Police Chief Kendrick appeared before Council, pursuant to
their request, and stated that Police Officers are paid time -
and -one-half for working on the 11 to 13 annual holidays.
Chief Kendrick stated that he is not asking for extra pay
for his department, but requests the polioy of 4 days off
annually in lieu of time -and -one-half for Police Officers
who work on the 11 to 13 holidays, and this policy would
not cost the City any more under present budget. These
four days off could be added to vacation days or taken at
another time, all subject to Police Chtef's determination.
Moved by Councilman Paul, seconded by Cguncilman McLees and
unanimously carried that the Police Deps4rtment shall, in lieu
of full days paid for legal holidays, be given 4 days time
off annually, subject to the determination of the Police Chief.

The monthly report of the Engineering Department was presented
to the Gnuncil.
Moved by Councilman Paul, seconded by Councilman Johnson and
unanimously carried that the report be filed.
The Treasurer's Financial Statement for the month of June was
presented to Council, showing total Bank Balances as of
June 30, 1961 -- $647,294.68.
Moved by Councilman Teasley, seconded by Councilman Paul and
unani�nou-)ly carried that the report be filed.
The hour of 8:00 P.M. was set for continuance of public hear-
ing re: proposed amendment to Code to allow Rest Homes in R-1
Zone with Conditional Use Permit, as recommended by Planning
Commission, Resolution No. 204. With no written communication
having been received, and no one in the audience wishing to be
heard in regard to this matter, it was

unanimously carried that the hearing be closed.
The Plamning Commission submitted their recommendations that
the Council direct the City Attorney to prepare an Ordinance
amending Municipal Code Seption 9208.10 (e) to include "Rest
Homes" as defined in Section 9100.3. It was stated that
amendment of this Section will provide sufficient control to
guard against abuses, as this Section provides for public
hearings and other procedures usual to granting Conditional
Use Permits.
Moved by Counselman Teasley, seconded by Councilman Paul and
unanimously carried that the City Attorne prepare an amend-
ment to Municipal Code Section 9208.10 (e) to include Rest
Homes as defined under Section 9100.3.
Councilman Johnson offered for second reading the following
Ordinance entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMEND-
ING THE AZUSA MUNICIPAL CODE AS AMENDED BY ORDINANCE N0.663
RELATING TO THE OFFICE OF CITY ADMINISTRATOR, PRESCRIBING
THE QUALIFICATIONS THEREOF, AND ESTABLISHING THE POWERS AND
DUTIES OF SAID OFFICE.
Moved by Councilman Johnson and seconded by Councilman
McLees that further reading be waived, with,Councilmen
Paul, Teasley and Ortuno voting "No".
Councilma:4 McLeed read the Ordinance in full.
Cite Administrator presented a communication to Council
fra2 Veteraps of Foreign Wars, dated July 12, 1961, in
oppo,ltion to above Ordinance as proposed.
Coughlin of Azusa Post No. 8070, Veterans of Foreign
mars, appeared before Council, stating that the matter of
the proposed Ordinance had been taken up at their meeting.

Cal Garnett appeared before Council as a representative of the
City'Employees Association. He stated that at the July 5th
meeting of said Association, 75 or 80 City Employees voted
their objection to the Ordinance as proposed, and have engaged
Mr. Kemby to represent them in their objection.
Don Kemby, attorney for City Employees Association, appeared
before Council, giving as his office address Suite 9101 215 H.
5th Street, Los Angeles 13. Mr. Kemby stated that at the rq-
quest of City Employees Association, he examined'Section 2404(e)
and also appropriate laws relative to this Ordinance with refer-
ence to rights of employees being impaired. He further stated
that it is his opinion and conclusion that the Council has no
authority to pass the proposed Section 2404 (e), as it would be
void and illegal as it now stands, and in order to be effective
would have to be referred to the vote of the people. Mr. Kemby
concluded that if the Council elects to enact this Ordinance as
stated, the Association will test the validity of this Ordinance
before a court of competent jurisdiction.
Councilman Paul suggested a change in Section 2405 of this
Ordinance,relative to Jurisdiction, by inserting a provision
that nothing in this Ordinance shall be interpreted as prohibit-
ing a Department Head from associating with, seeking advice from,
or giving information to a member of the City Council.
Moved by Councilman Paul, seconded by Councilman Teasley and
unanimously carried that the Ordinance be amended.
P. M. Kunou, retired Azusa Police Lieutenant, appeared before
Council, stating that we are running into a proposition that
will again cause difficulty among employees, as the people of
this City voted approximately 600 majority to maintain Civil
Service Ordinance as it is. He further stated that Section
2404 (e) by-passes the City Personnel Board and deprives all
of all rights, including right of appeal to City Council.
Moved by Councilman Teasley, seconded by Councilman Paul and
unanimously carriled that this Ordinance be tabled until the
next regular meeting and until the City Attorney has had time
to examine the comments made by the attorney for the City
Employees Association regarding Section 2404 (e), as to its
effect on Civil Service.
City Administrator requested determination of Council relative C. of C.
to renewal of Chamber of Commerce Agreement (Promotional) as Agmt.

Moved by Councilman Paul, seconded by Councilman Teasley and
unanimously carried that copies of Chamber of Commerce Agree-
ment be made for consideration of Council relative to renewal
of existing type of agreement with changed figures or prepara-
tion of a new agreement according to budget.
City Administrator presented request of Chamber of Commerce
relative to July, August and September statement (lot quar-
terly payment).
Moved by Councilman Paul, seconded by Councilman Teasley and
unanimously carried that payment for first quarter to Chamber
of Commerce be authorized.

imously carried that this matter be tabled until this information
is received.
A Special Light Agreement between the City of Azusa and McKeand
Plumbing was presented to Council for approval and signature.
Moved by Councilman Paul, seconded by Councilman Teasley and
unanimously carried that this Agreement be approved and signed.
A Resolution was presented to Council, approving the above
Special Light Agreement.
Councilman Paul offered the following Resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING
AGREEMENT FOR ELECTRICAL DISTRIBUTION FACILITIES AND ENERGY BE-
TWEEN THE CITY OF AZUSA AND McKEAND PLUMBING AND AUTHORIZING THE
MAYOR TO SIGN AND THE CITY CLERK TO ATTEST SAME.
Moved by Councilman Paul, seconded by Councilman Teasley and
unanimously carried that further reading be waived.

the Resolution be adopted. Resolution passed and adopted by the

A comMTLhication was received from Clyde E. Tays, dated July 10,
1961, tendering his resignation as Journeyman Lineman in the
City of Azusa Light & Water Department, effective Friday,
July 7, 1961, and stating his reasons for resignation.
Clyde E. Tays appeared before Council and stated his reasons
for resigning, which included stand-by time and a pay raise of
$85. per month at his new job.
Moved by Councilman Johnson, seconded by Councilman Teasley
And unanimously carried that Mr. Tays' resignation be accepted.
A communication was received from Superintendent of Light &
(dater Smith, dated July 13, 1961, requesting Council's con-
sideration of continuance of overtime policy as in the past,
as over 90% of the Department's overtime 44s been on an
emergency basis.

The monthly report of the Light & Water Department was sub-
mitted to Council.
Moved by Councilman Teasley, seconded by Councilman Paul and
unanimously carried that the report be filed.
Councilman Teasley requested that the City Administrator
furnish Council with a report at the next meeting, and at
every meeting during this critical season, of the condition
of the water wells in this City. Councilman Teasley stat9d
thRt he had attended the Dry Year Water Conference held in ,
Los Argeles on July 13th, which disclosed the critical short-
age of water all over the State of California. A discussion
was held, during which Superintendent of.Light & Water Smith
reported that No. 3 Well is ahead Of Ito time, as water level
is lol,rr than this time last year.

Moved by Councilman Teasley, seconded by Councilman Paul and
unanimously carried that the City Administrator furnish this
report of the condition of the water wells in Azusa and also
give complete information on all of City's water resoArces
every month during this critical season.
Councilman Teasley further informed Council relative to the
City of Azusa District and suggested that we bhould reappraise
our situation on this water problem in the San 13abriel Valley,
and that the facts and figures bfought out at this Governor's
Council were very startling. He urged Council to reappraise
water situation as fAr as the districts are concerned. Administrator
reported Mr.Stockberger resigned last meeting ESGVMWD; Mr.Kern apptd. _
Notice was given that the Planning Commission, by Resolution Res.210
No. 210, requested a Conditional Use Permit for operating a re: 1/4
Quarter Midget Racetrack. Consideration of their AgreeMent was Midg..Tra
also requested. (tabled
Robert Cochran, of 110 So. Virginia, Azusa, appeared before
Council relative to above Resolution. He stated that this
recommendation is out of order legally; that the Planniqng Com-
mission gave the residehts twenty days from July 6th withih
which to appeal in writing, and the twenty days -are not up
until after July 26th. Mr. Cochran recommends that this be
stricken from the records and consideration of this Agreement
ehn ld not be taken up by Council after after July 26th.
Moved by Councilman Johnson, seconded by Councilman Paul and
unanimously carried that no action be taken on this Resolution
until twenty days after July 6th.
Resolution No. 211 of the Planning Commission, approving -vari-
ance of 0. J."Conforti to construct two apartments without pro-
viding the required two parking spaces, was presented to
Council.
Moved by Councilman Paul, seconded by Teasley and
unanimously carried that this be appealed.
Notice was given that the Planning Commission, by Resolution
No. 212, approvedtentative tract map No. 26715 for A. Wilson
on property east of McDaniel Tract on Sierra Madre Avenue.
The monthly report of the Planging Commission was presented
to the Council.
Moved by Councilman Johnson, seconded by Councilman Teasley
and unanimously carried that the report be filed.
Mrs. Francis E. Tyck, Women's Chairman of Azusa Committee of
San Gabriel Valley Symphony Association, introduced Mrs. T.L.
Waggonback from Glendora to the City Coun1. Larry
Straight was unable to be present. Mrs. "%president
of the San Gabriel Valley Symphony Association, addressed the
Council relative to cultural advantages to all of the commun-
ity. As the Association is non-profitable and depends on
donations, they would appreciate a contribution.
It was the consensus of the Board that this request be studied
for action at the next meeting.
A communication was received from the City Administrator rela- Improve.
tive to the County's proposal to construct a drainage ditch, ditch on
which will be an underground conduit, on Gladstone between Gladston
Cerritos and Pasadena Ave., if the City would agree to install by Court

curbs and gutters at a rough estimate -of $2,000, which is less
than the $12,000 suggested previously. If Council is interested
in Courty's proposal, the trees would have to be taken out before
permission is given to the County to proceed.
Moved by Councilman Teasley, seconded by Councilman Paul and
unanimously carried that the City Administrator report back to
Council the cost to the City for removal of the trees.
A proposed Agreement between City and County relative to Gladstone
Recreation Program was presented to Council for approval.
Moved by Councilman Teasley, seconded by Councilman Johnson and
unanimously carried that the Mayor be authorized to sign the
Agreement.
City Administrator presented to Council an Agreement between
County and City relative to traffic signal at Gladstone and
Lark Eller, with an estimated expenditure of $5,625 to be
charged to County Aid to Cities.
Moved by Councilman Teasley, seconded by Councilman Paul and
unanimously carried that this Agreement be approved and the
Mayor be authorized to sign the same.
A Resolution was prepared establishing City employee comple-
ment and amending Resolution No. 4131.
Councilman Teasley offered the following Resolution entitled:

A communication was received from the City Administrator,
requesting approval of his vacation for period of August 14th
to September 5th.
Moved by Councilman Johnson, seconded by Councilman Teasley
and unanimously carried that the above request be granted.
The Fire Station Headquarters bonds and agreement were sub-
mitted to Council and City Attorney for -approval.

where higher stresses are used, allowing thinner walls and
permitting economy in construction, a continuous inspector
must be present at all times, lir. D1 Stefano'further stated
that this new building is designed in the way which requires
continuous inspection on masonry, pre -stressed concrete,
concrete and welding.

City Administrator reported considerable discussion about set- Re:

Moved by Councilman Teasley and seconded by Councilman Paul
that the Fesolution be adopted. Resolution passed and adopted
by the following vote of Council:
AXES: Councilmen: McLees, Paul, Teasley, Ortuno
NOES: Councilmen: Johnson
ABSENT: Councilmen: None and numbered Res. No. 4206.
Moved ry Councilman Teasley that the City Planner be removed Amended
from the jurisdiction of the City Administrator and placed Res.4204
within the jurisdiction of'the City Engineer, and that a
portion of the Steno -Clerk be added under Engineering De-
partment, which would amend Resolution No. 4204 adopted at
this meeting.,
After a discussion by the Council, it was

unanimously carried that Resolution No. 4204 be rescinded.
Moved by Councilman Johnson, seconded by Councilman Teasley
and unanimously carried that further reading of this Amended
Resolution be waived.
Moved by Councilman Johnson and seconded by Councilman
Teasley that this Amended Resolution be accepted. 'Resolu-
tion panned and adopted, with changes, by the following
vote of Council:
AYES: Councilmen: McLees, Paul, Johnson, Teasley, Ortuno
NOES: Councilmen: None
ABSENT: Councilmen: None
Relative to Highway through town, Councilman McLees suggested Consid.of
it would be well,for all of Council to keep in mind, � highway 39
that consideration should be
given to Highwaq 39 going north on Alameda Ave. and south on
San Gabriel Ave., in the future, leaving what is now Azusa
Ave. for leisurely shopping.
