CITY HALL AZUSA, CALIFORNIA MONDAY,AUGUST 7, 1961 7:30 P.M.
The City Council of the City of Azusa met in regular session
at the above time and place.
Mayor Ortuno called the meeting to order and led In the salute
to the flag.
Invocation was given by Councilman Warren Teasley.
Present at Roll Call: Councilmen: Paul, McLees, Johnson,
Teasley, Ortuno.
Also Prosent: City Administrator Caswell, City
Attorney Williams, City Engineer
Di Stefano, Police Chief Kendrick,
Deput? City Clerk Torrey.
Mayor Ortuno asked if there were any -corrections in the
minutes of July 17th meeting. Councilfnan MSLees requested
a correction on page 1 relative to Approval of Minutes of
June 22nd, to read: "Councilman Paul requeated a correction
on page 1, relative to Exams. Date..." Councilman Johnson
requested a correction on page 51 relative to a letter from
Superintendent of Light and Water Smith on overtime policy:
the motion should read that the letter be filed. Councilman
Johnson requested two corrections on page 6, relative to
motion on Resolution 211 of the Planning Commission on variance
for two apartments: motion should read that this decision be
appealed; and relative to San Gabriel Valley Symphony request,
the spcllir..g of Mrs. Waggonback's name should be corrected
from. (Waggoner" to Mrs,
Councilman Johnson requested
two corrections on page 102 relative to Consideration of
Highwa? 39: delete the words "if or when in Court on this
matter'; and relative to Adjournment of Meeting, the motion
should read that Council adjourn this meeting to an executive
session for a personnel matter.

City Attorney Williams presented to the Council additional Ordinasioe
information on the civil action filed by Southern Californiaire Handbill
Assoc. Newspaper, Inc., va. City pf Az4sa, et at., to obtain \ 26,be•.
a preliminary injunction restraining toe City of Azusa from avended. 1
enforcing section of the Municipal Code relative to distrib-
ution of handbills. The hearing scheduled for 9:30 A.M. on
August 7th, at the Los Angeles Courthouse, for a preliminary /
injunction prohibiting the defendants from enforcing Sections
4300 through 4306 of the Municipal Code, has been postponed
to September 18th. The City Attorney suggested that an( amended
Ordinance be prepared exempting legitimate, bona fide, genuine
newspapers, and allowing distribution pf second class mattdr aa.
the premises only to those who have agreed to this distrioutiog,
or made such a request, in writing. Council authorized the CVW
Attorney to prepare amended Ordinance. -
The City Attorney reported that he had studied the comma is

regarding Section 2404 (e). The City Attorney suggested J
rewording of this Section.2404 (e) and�has presented his
rewording over the phone and by mAil tp Mr. Kemby, It read
as follows:

employees, other than departm@nt heads, who are under his

the Council regarding proposed Ordinance on coin games. Mir.Qoin Games

Creacent Drive and 11th Street, arising from operations
of the Altamont Corp. on West 10th Street, west of Vernon.
Russell Dodd, of 1010 N. Vernon, appeared before Council
to explain further about the noise of blowing hornk between
the hours of 4:00 and 6:00 A.M. from the men leaving the
Altamont Corp. Mr.Dodd also mentioned that very temporary
work had been done to alleviate the dust by throwing in a
little gravel in one spot, which does not comply with the
Ordinance for M-1 Zone. There is a further complaint about
a barking dog belonging to the corporation and this dog is
out all night, creating another nuisance.
