The City Council of the City of Azusa met in regular session at the above Call to Order time and place. Mayor Ortuno called the meeting to order and led in the salute to the flag. Invocation was given by Reverend Paul Farrell, First Christian Church. Invocation Present at Roll Call: Councilmen: Paul, McLees, Johnson, Teasley, Ortuno. Roll Call Also Present: City Attorney Williams, City Engineer Di Stefano, Fire Chief Madison, Assistant City Administrator Crothers, Deputy City Clerk Torrey. Mayor Ortuno asked if there were any corrections in the Minutes of August Approval of 7th meeting. Councilman Paul requested the following corrections: on page Minutes 8/7/61 3, line 4, correct the misspelling of Councilman_Paul's.name; on page five, LC. the last line on the page, relative to Resolution 4217, to read: "of receipt M of notice of Public Hearing"; on page 9, relative to 1st reading Ordinance re Speed Limit, the first line to read "Councilman Paul". Councilman Johnson requested the following corrections: on page 9,relative to Resolution 4210, the wording to be changed, beginning onthe third line, to:"Mr. Quinn has agreed to attend all meetings with compensation of $25.00 for each meeting attended, of which Azusa shall pay one-third, with Alhambra and Monterey Park paying two-thirds, and with a limitation of not more than two meetings per month"; on page 10, the vote on motion relative to Civitan Club request for appropriation, to be changed to read. "AYES: Councilmen Paul, Teasley, Ortuno, NOES: Councilmen : McLees, Johnson"; also on page 10, relative to letter from S. Fraijo aequesting purchase of City, owned property in Azusa Foothill Citrus Company Tract to be changed Yo"City owned ' property in the Azusa Land and Water Tract "; on page 11, relative torequest for appointment of four firemen, the motion to read: "...seconded byCouncil- man Teaslgy.... "; also on page 11, relative to Leave granted to R. Perea, after " due to illness", add "without pay". The Deputy City Clerk announced that the public hearing on appeal to the Quarter Midget granting of a Conditional Use Permit re: Azusa Quarter Midget Association Racetrack Hrng. is to be held at the next regular meeting on September 5th at 8:00 P.M. set for 9/5/61. and that. Notice of Public Hearing has been published. After discussion with members of the Association, it was moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that the Quarter Mid t As$o4i9t1on give to Council a list of all home and business addresses of 'embers prior to the next regular meeting of Council. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the Public Hearing on this appeal be set for the next regular meet- ing of Council on September 5th, 1961, at 8:00 PoM. A communication from the Personnel Board was presented to Council requesting Police Dept. that the City Attorney be instructed to prepare a Resolution amending Civil Vacations Service Rules and Regulations, Section 85, Paragraph 1, relative to vacation (Tabled ) period with pay for Police Officers. Personnel Clerk McKinney appeared before Council and explained that the wording in the Rules and Regulations should be the same as those adopted by Council at a previous meeting. 1 CITY HALL AZUSA, CALIFORNIA MONDAY, AUGUST 21,1961 7:30 P.M. Moved by Councilman McLees, seconded by Councilman Teasley and unani- mously carried that the City Administrator submit the old and new policy on Police Officers' vacations, for comparison, and that this matter be tabled to the next regular meeting. The hour of 8:00 P.M. was set for continuance of Public Hearingon•anappeal to the Planning Commission's recommended Variance on O. J. Conforti's ' property located at 312 N. Azusa Avenue, in order to construct apartments without parking area. The Deputy City Clerk presented four written protests to the building of the apartments, and stated that a statement of withdrawal of protest had been received from Mr. Joe Alva. Mr. Conforti appeared before Council and stated there is enough parkingarea for twelve cars. He also stated that the garage on the property was built large enough for storage space for tenants in the apartments. Mr. Conforti said'he_ will move the garage after the apartments are built. lf: Cr: Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the Variance be granted for a period of one year, and to expire at the end of one year unless, at that time, the garage is moved, and, in that. event, the Variance will remain in effect. With no other person in the audience wishing to be heard in regard to thismatter, and.no written protests having been received regarding this Variance, it was moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be closed. The Hour of 8:00 P.M. was set for Public Hearing on an appeal to the denial of Zone Change from R-3 to C-3, for property on West side of Citrus Avenue, south of Big Dalton Wash, made by G. Hoffman and D. Warsaw. The Deputy ' City Clerk presented the Affidavit of Publication and the list of property owners who had been notified. A report was presented to Council from the Planning Commission, showing that the Commission has determined that the proposed Zone Change does not meet the requirements for approval as set forth in the Zoning Ordinance. Norman Slatter, of 18502 East Laxford Road, appeared before the.Council and presented a petition containing 39 signatures, in opposition to the Zone Change, and stating their objections, with the request to follow the recommendation of the Planning Commission. The Deputy City Clerk read the petition in full. Mr. Slatter stated that a Bowling alley is not needed in that area since there are three Bowling alleys within a six mile radius. I PAGE 2 Public Hearing Variance (Conforti) Public Hearing Appeal to Zone Change (Hoffman/Warsaw) Denied. Robert Kesler, of 1217 North Soldano, appeared before Council in opposition to the Zone Change. Mr. Kesler stated that the bowling business has been over- built'in the last one and a half to two years, and that the bowling alleys have increased by 21%, while the bowlers have increased only by 18%, which means that bowlers have to bowl at least twice a week in order that these establishments break even. He also stated that some bowling businesses are in bad shape financially and there was a report of another bankruptcy today. He stated that he is in agree- ment with the Planning Commission's decision. Al Vela,draftsman, appeared before Council and spoke in favor of the Zone Change. Mr. Vela stated that a person goes into business to stay in business. He also stated that although the population is 213,OOO,there are only 126 bowling lanes in the area. PAGE 3 presented a picture of the proposed bowling alley to Council, and stated he has a map showing the proposed parking area and how the building will be located on the property. Moved by Councilman Johnson, seconded by Councilman Teasley,and unani- mously carried that the hearing be closed. ' Mr.Thorgrimsen, of 18513 Gallorno Drive, appeared before Council stating he would welcome a bowling alley with its lights instead of "Peeping Toms", > dragging of cars, etc. Lights would not bother him but the noise would -Nothing- ° but business could be put in this triangle because of size of the area, and he would welcome it. Mr. Vela told Council that the owners of this property are very responsibleand outstanding businessmen. kf: Moved by Councilman McLees that the recommendation of the Planning Commission be denied and that the request for a Zone Change be granted. Motion carried by the following vote of the Council: AYES: Councilmen: Paul, Johnson, Teasley, Ortuno NOES: Councilmen: McLees ABSENT: Councilmen: None Miss Ruth Cain, Azusa Librarian, introduced Miss Dolly Simon of Madras, Dolly Simon ' India, to the Council. Miss Simon, who is a graduate of the University of from India as Madras, India, and holds a Master degree in political science, will spend Senior Library one year at the Azusa Library as Senior Library Worker. Miss Simon told worker. the Council that she is very grateful for this opportunity; that everyone had been so kind, and that she will take back to her country plenty of experiences in America. The Personnel Board presented to Council a request that the City Attorney be Time of Medical instructed to prepare a Resolution amending the Rules and Regulations pertain- Exams (Tabled) ing to physical examinations. Personnel Clerk Joan McKinney appeared before Council and stated that at the April ;3rd'meeting, Council took no action relative to physical examinations, except to order that the recommendation of the Personnel Board be filed. Mrs. McKinney stated that it was moved by the Personnel Board at their meeting of August 8th, that candidates for position of Fireman or Police Officer, who have been certified and placed on the eligibility list, must pass a physical examination within ten days ptior:to-probationa,ryvppoiritmerit. Moved by Councilman Johnson, seconded by Councilman Paul and unanimously carried that the recommendation be returned to the Personnel Boord.for further study re: miscellaneous employees. The Personnel Board presented to Counci l a recommendation that members of the Police Department, upon being assigned to detective and investigative duties and while working out of uniform, shall be granted an additional compensation of $25.00 per month. Department Report Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the report be filed, Bids were received in the office of the City Clerk on Thursday,August 10th, Bids -Gang 1961, at 10:00 A.M� , for a Five -Gang Mower for the Park Department, Mower ' Present at the bid opening were Councilman Teasley, City Engineer Di Stefano, Superintendent of Public Works Brusnahon, City Administrator Caswell, and Deputy City Clerk Torrey. The (Deputy City Clerk presented th Affidavit of Publication and stated that bids had been received from the following: Bidder Total Bid B. Hayman Company,Inc.,for Worthington Tractor Model "F $5,451.00 plus 4% Toro Company, Inc., for Toro Five Unit Parkmaster . $5,840.00 plus 4% After discussion of the bids, it was moved by Councilman Teasley, seconded by Councilman Poul'and unanimously carried that the recommendation of the Public Works department and the City Engineer be accepted, to award the contract to B. Hayman, Company, Inc., for Worthington Tractor Model "IF low bidder, and to return the cashier's check to Toro Company, the other bidder. A recommendation was received from the City Engineer with a request for approval of plans and specifications for construction of a 600,000 gallon ' Steel Reservoir, Water Transmission Main and related work, and authorization for the City Clerk's'officeft advertise for bids, bid opening scheduled for September 28th, and action to be taken on bids at the Council meeting of October 2nd. A recommendation was received from the City Engineer with a request for Funds for authorization and appropriation of funds for work not included in the Contract extra work on on Fire Department Headquarters building. The Planning Commission submitted a study of setbacks on Azusa Avenue, Set -backs on recommending that no change in the present policy be made. Discussion Azusa Avenue followed. X A recommendation was received from the City Engineer that the plans .and., Storm Drain specifications be approved on Storm Drain Bond Issue Project 406, and that Bond Issue the District be permitted to occupy and use public streets in the City of Azusa Project 406, to construct, operate and maintain said installations. CALIFORNIA MONDAY,AUGUST 21,1961 PAGE 6 Mrs. Dorothy Bruce, Account Clerk, was asked if there was any basic incompatibility between Sr. Account Clerk -and, -Deputy City Treasurer as Mrs. Johns prepared the warrants for payment. It was stated that the warrants were prepared by machine. Moved by Councilman Johnson, seconded by Councilman Paul and U unanimously carried, that the Administrator contact the Auditors in order to have their comments as to any incompatibility, and report their findings at the next regular meeting. The Treasurer's Financial Statement for the month of July was presented to City Treasurer Council, showing total Bank Balances as of July 31, 1961 - $599,348.35. Statement for July Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the report be filed. L= The Ordinance pertaining to the amendment of the Municipal Code by adding Ordinance re cv' thereto provisions creating the Office of Director of Finance, was presented Director of (; for its second reading. Councilman Teasley offered for 2nd reading, the following Ordinance entitled: Ordinance ' 1676 re AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA Speed Limit AMENDING SECTION 3200.68 OF THE AZUSA MUNICIPAL CODE REDUCING THE SPEED LIMIT ON CERTAIN STREETS. Moved by Councilman Paul, seconded by Councilman Teasley that the Ordinance be adopted. The monthly report of the Light and Water Department was submitted to the Light & Water Council. The Light and Water Department informed the Council of the resignation of Resignation of Harry H. Bush, Journeyman Lineman, as of August 18th, 1961. H. H. Bush Lineman Moved by Councilman Paul, seconded by Councilman McLees and unanimously carried that the resignation be accepted. A letter was presented to Council from the Azusa City Employees Association Letter from requesting that employees be granted an increase in wage and incorporating City Empl. the results of a survey in other cities showing that Azusa employees wage Assoc. re wage scale is from one to over three pay ranges low. After discussion, it was suggested by the Council that the Committees study the wage situation and get together with the Department Heads concerning this. It was stated by Councilman Teasley that Cal Garnett is presently thinking of retiring on February 28th, 1962. After a discussion , it was moved by Councilman Teasley, seconded by Council- man Paul and unanimously carried that the matter of Water Foreman be referred to the City Administrator. The monthly report of the Fire Department was submitted to Council. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the report be filed. Water Foreman Fire Dept. Monthly report The monthly report of the Los Angeles County Building Department was submitted L.A.County to Council. Bldg. Report Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the report be filed. 16 1 CITY HALL AZUSA, CALIFORNIA MONDAY, AUGUST 21,1961 Substandard Structure Cases 042 through 058 were presented to Council, for their informations �� 7&� The Assistant City Administrator notified Council of a request from Charles W. Winegarner of Christian Youth Against Communism, for a change from August 31st to September 12th for use of the Auditorium. 17 PAGE 9 Substandard Structures 142 through 158 (Visual present- ation ) Moved byCouncilmon Johnson, seconded by Councilman Paul and unanimously Christian Youth ' carried that the request be granted. Against Comm. (Sept. 12th ) The Assistant City Administrator reported that on informal bid had been received on capacitors from Westinghouse, which varies at least $100.00 Bid on higher on each item from the bids of the other two companies, and the Capacitors Light and Water Department recommends that we accept the General (G. E. Bid) Electric quotation. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously L� carried that the bid of General Electric Company be accepted. M ;J., The City Engineer reported a letter was written to the owner and occupant of Altamont Corp. Altamont Corporation relative to violation correction within 30 days, with re:violation completion within 90 days. Mr. Di Stefano also reported that he received a phone call from Altamont in which they stated they will set the chain link fence back 50 feet and not occupy this 50 feet except for ingress and egress. A Resolution was presented to Council, fixing the amount necessary to be raised Resolution No. by taxation. 4219 fixing Funds re Tax. Councilman Teasley offered ',the following Resolution entitled: ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION FOR THE FISCAL YEAR BEGINNING JULY 1, 1961. The Deputy City Clerk read the Resolution in full. Moved by Councilman Teasley, seconded by Councilman Johnson that the Resolution be adopted. A Resolution was presented to Council, fixing the rules of taxes and levyi ng Resolution No. same. 4220 re: Fixing Tax Rates Councilman Teasley offered the following Resolution entitled: ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FIXING THE RATES OF TAXES AND LEVYING TAXES FOR THE FISCAL YEAR BEGINNING JULY 1, 1961. The City Engineer stated that his department had received right-of-way freeway maps, and they were on file for perusal at the Engineering Department office from 8:00 A.M. to 5:00 P.M. Councilman Teasley submitted a poster to conserve water which .he Nod ' brought from Sacramento, entitled, "Don't be a Gutter-Flooder". These posters are placed on car bumpers and on door knobs of those who may be Gutter-Flooders.
