The City Council of the City of Azusa met in regular session at the above time and place. Deputy City Clerk Torrey called the meeting to order, and Call to Councilman Paul led in the salute to the flag. Order Invocation was given by Councilman Warren Teasley. Invocation Present at Roll Call: Councilmen: Paul, McLees, Johnson, Roll Call Teasley, Ortuno Also Present: City Engineer DS Stefano, Supt. of Light & Water Smith, City Administrator Caswell, Deputy City Clerk Torrey The Deputy City Clerk asked if there were any corrections in Approval In response to request of Council, both Mr. Henry E.Comstock, Complaint Jr., manager of Baker's Tacos, and Mr. Neal Baker, owner, against appeared before Council to answer the complaint of Mrs. Baker's Fountain, who owns adjacent property. Tacos Mr. Comstock, who stated he has been an Azusa resident for 4z years, requested that Mrs. Fountain's letter be read in full, and the City Administrator complied with his request. Mr. Comstock agreed that there had been some incidents In the past at his establishment, but now there are m9rp adults ff patronizing his business than previously and these has been a special officer on the premises from 10:00 P.M. to 2:00 A.M., and these incidents have lessened. Mr. Baker, of 1008 Pampas St., Rialto, California, stated he had attempted to purchase Mrs. Fountain's property but the cost was prohibitive. However, both he and Mr. Comstock agreed to construct a fence. City Attorney Williams entered the meeting at 8:10 P.M. Mr. William H. Hyer, attorney, whose office is at 665 Arrow- head, San Bernardinc, California, appeared before Council, and reiterated Mr. Comstock's statement that the situation has improved and some of the problems have been solved. the Minutes of September 5th meeting. Councilman McLees of Min_ requested a correction on page 2, second paragraph relative 9/5/61 V, to List of Association Members of Quarter Midget Association, to read: "All members of Council expressed satisfaction with the list of names, except Councilman Johnson and Council- man McLees". Councilman Johnson requested the following cor- rections: on page 6, relative to Employees Salary Survey, the words "wage situate" should be "wage situation"; on page 9, in the last paragraph under Complaint against Baker's Tacos, change "...activities around this place of business have been good..." to "...activities around this place of business have been better"; on page 10, in second paragraph, the motion "...and submit a report at the next regular meet- ing" should be "...and notify them to be present at the next regular meeting"; on page 9, third paragraph, referring to rates, the word "effected" should be changed to "affected". The Deputy City Clerk asked if there were any corrections in Approval ' the Minutes of September 11th Special Meeting. Councilman of Min. Paul requested a correction on page 2, second paragraph, 9/11/61 adding "recommended by Mr. Hamilton" after "...or some other qualified appraiser". The hour of 8:00 P.M. was set for Public Hearing on an appeal Pub,Hgr. to the granting of a Conditional Use Permit re Azusa Quarter re: Quart Midget Association. Councilman Johnson read in full her own Midget As statement addressed to Mayor Ortuno, dated September 18, 1961, as follows: "Mr. Mayor, I have a statement I wish to read for the .record. I intend to sit in this hearing, hear the evidence, and vote according to what I believe to be the best interest of the City of Azusa as a whole. The fact that I have signed one of the many protests against this race track does not relieve me of my re- sponsibility; and we also know that on almost every major issue all members of the City Council have taken positions for or against that issue and proceeded to vote on the final determination. In order to avoid argument and to develop the facts, I move that all testimony and statements be presented under oath." This motion was seconded by Councilman McLees but failed to carry by the following vote: AYES: Councilmen: McLees, Johnson NOES: Councilmen: Paul, Teasley, Ortuno ABSENT: Councilmen: None The Deputy City Clerk presented the Affidavit of Publication of Public Hearing and list of property owners who had been notified. Mr. John Sommer, of 930 Soldano, Azusa appeared before Council as spokesman for the -Quarter Midget"Association and requested that the Council grant the Planning Commission's decision. Councilman Johnson checked with Mr. Sommer regard- ing the number of children from Azusa who use the track and _ whose parents have Azusa addresses, and the result was approx- i M im t�l 17 children. Mr. S�ommerstated that $10,000 worth ofs-«:, '°`i has gone into the hack, &fiid it is impossible for the City of Azusa alone to support it. Mr. Lowell C. Johnson, of 154 So. Virginia, appeared before Council and read his statement in opposition, a copy of which is on file. Mr. Johnson then asked each Council member if he read the protest filed by him and also other material furnished to them, and each member answered in the affirma- tive. A paragraph from the National Safety Magazine was read by Mr. Johnson. He complained that the City was not repre- sented at the Planning Board hearing and questioned the vote of Commissioner Sal Leuvanos who was not a Commissioner at the time of the hearing. He also said that it remained to be de- termined if the Association was legally qualified to enter into a contract or lease agreement, and questioned whether the Association has sufficient insurance. 54 55. CITY HALL AZUSA, CALIFORNIA MONDAY, SEPTEMBER 18, 1961 Page 3 Mr. Victor Jabson, of 222 So. Virginia, appeared before Council in opposition to the granting of the Conditional Use Permit, because of excessive noise and dust conditions, plus the fact that 75% of cars parked at the track were owned by non-residents of Azusa. He suggested that a better place can be found for this racing which would be far away from residential areas. Mr. Ivan Turnmire, of 118 So. Virginia, appeared before Council, ' stating that because of the noise and dust condition, plus traffic congestion, he and his family can't enjoy staying at home on week -ends. Mr. Ernest Lingren, of 848 W. 1st St., appeared before Council, stating he is not againstracing,but when this racing starts, he and his family have to leave their home in order to get away from the noise. Mr. H. B. Light, who lives at Duell and Vernon, appeared before Council, stating that during the time his wife lay dying, which M. was nearly a year and a half, there was no relief from the noise from the track bothering her day and night, and it is absolutely a nuisance. Mr. Ed Peterman, of 114 Barbara, co -paster of Friends Community Church, appeared before Council. He defined the word "nuisance" as anything which is injurious to health,or is indecent or sensi- tive to senses, or objectionable. On behalf of himself and his church, he protests this racing, primarily because of the noise. Speaking in favor of quarter midget racing, Mr. Lee Hughes, of 2523 Bloomdale Ave., Duarte, chairman of the Board of Governors of the Western Quarter Midget Racing Association, appeared be- fore Councii. He named the various tracks in operation and the places where they operate. Mr. Hughes also mentioned that Mr. Sith, State•Safety Engineer for State Safety Department of the State of California, has approved of,Quarter Midget Racing as set up, and stated the various precautions taken for safety. He presented the official rule book of Western Quarter Midget Racing Association to the Council, but stated that the Azusa group is not a member of the Association. Mr. Lowell C. Johnson spoke again, in rebuttal, and read parts of "National Safety Council Policy on Miniature Motor Vehicles", a copy of which is on file. Mr. Johnson also read "Suggested . Guideposts for Implementing Statement No. 2" and "Safety Policy on Miniature Motor Driven Vehicles", and a copy of each is on file. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be closed. Moved by Councilman Teasley, seconded by Councilman Johnson and unanimously carried that the City Attorney study the.comments and legal technicalities brought up at this hearing, and report back to Council at the next regular meeting. The hour of 8:00 P.M. was set for Public Hearing on protests to annexation to the City of certain uninhabited territory described herein and designated "Easterly Annexation District No. 42". The Deputy City Clerk presented the Affidavits of Publication and list of property owners who had been notified. With no written communication having been received, and no one in the audience wishing to be heard in regard to this matter, it was Pub.Hrg. re: East. Councilman Teasley offered for first reading the following 1st Rdg.Oi Ordinance relative to approving the annexation of certain re: Annex. uninhabited territory designated Easterly Annexation Dis- No. 42 trict No. 42: Moved by Councilman Teasley, seconded by Councilman Paul and -unanimously carried that the City Engineer°s recommendation be accepted and contract be awarded to Pomona Valley Sewer Co., low bidder, for $11,785.25, and that bid bonds and cashier's check be returned to the unsuccessful bidders. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXATION OF CER- TAIN UNINHABITED TERRITORY DESIGNATED EASTERLY ANNEXATION DISTRICT NO. 42 TO THE CITY OF AZUSA. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that further reading be waived. Bids were received in the office of the City Clerk on Thurs- Bids - day, September 14, 1961, at 10:00 A.M., for construction of Sewer Maii Sewer Main Extension in Sierra Madre Ave. Present at the Ext. in bid opening were Mayor Ortuno, City Engineer Di Stefano and Sierre City Clerk Miller. The Deputy City Clerk presented the Madre Ave CL Affidavit of Publication to Council and stated that four bids had been received as follows: Bidder Total Bid Pomona Valley Sewer Company $11,785.25 Chino, California Sanitary Pipeline Co., Inc. 16,274.00 Santa Ana, California R. J. & S. W. Shacklett, General 18,579.00 Engineering Contractors, Inc. Pomona, California Joe's Plumbing (Incomplete forms - Azusa, California left out Jacking Item) The City Engineer recommended that the contract be awarded to Pomona Valley Sewer Co., low bidder, although the low bid is 7% higher than estimated. Moved by Councilman Teasley, seconded by Councilman Paul and -unanimously carried that the City Engineer°s recommendation be accepted and contract be awarded to Pomona Valley Sewer Co., low bidder, for $11,785.25, and that bid bonds and cashier's check be returned to the unsuccessful bidders. The Planning Commission recommended that the Council approve a street width of fifty feet instead of the required fifty- four feet, in order to permit nine slightly larger lots in Tract 24542 at southeast corner of Third and Pasadena. The City Planner presented map to Council and described the property, stating that parkway would be deleted in order to reduce the street width. Moved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the recommendation of the Planning Commission be accepted. Notice was given that the Planning Commission, by Resolu- tion No. 214, granted a conditional variance permitting one additional dwelling unit on a lot in the "R-1" Zone, and deeding to the City for street purposes the northerly 10 ft. of the property described as Portion of Lot 1, Azusa Foot- hill Citrus Company Tract, to Sam Fraijo. The Superintendent of Public Works recommended that a Resolu- tion'be prepared establishing repavement policies and fees of the City to be the same as those of the County Road De- partment. M The Superintendent of Public Works also recommended the SIT establishment of the position of Construction and Maintenance Mechanic with immediate recruitment to fill said position. X XMoved by Councilman Paul, seconded by Councilman Teasley and unanimously carried that the City Administrator make an in- vestigation of these requests from the Supt. of Public Works and bring in recommendations on these two items. Superintendent of Public Works Brusnahan presented the re- quest of Wayne Loyd, Street Department Foreman, to carry over one week of his vacation to next year in order to make a trip to the East without loss of pay, with the recommenda- tion that Council authorize this carry-over of vacation time. ' After a discussion, it was moved by Councilman Teasley that Mr. Loyd be granted the privilege of using one week of this year's vacation next year. Motion died for lack of a second. The monthly report of the Public Works Department was pre- sented to Council. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that the report be filed. The Azusa City Employees Association submitted a request that the Council grant Mr. Garnett one day (Friday, Octo- ber 13th) with pay, to attend annual conference of Calif. League of City Employees at Disneyland Hotel, held Octo- ber 12th to 15th, inclusive. Moved by Councilman Paul that the request be denied. Motion died for lack of a second. A Resolution was prepared accepting a Grant of Easement ' for utility purposes from Steve R. and Angie C. Duran. Policy Councilman Johnson offered the following Resolution ' entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTAB- LISHING THE POLICY OF THE CITY WITH RESPECT TO OVERTIME. No. 4233• The City Administrator presented a report and recommendation re overtime policy. The City Administrator submitted a recommendation re: New Re: New Sewer Connection Fees,that consideration be granted to those Sewer Con. who have already secured a building permitrp for to Septem- Fees ber 1, 1961, and also stating that those not connected to (Notify the sewer should be sent a notice that as of September 1st Sewer this connection fee exists. After a discussion, the City Contr. Administrator made a further recommendation that sewer con- of fee) tractors be notified that all new construction should be connected to the sewer system. Moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that the recommendation of the City Administrator be accepted: to notify sewer contractors of the charge of $3.00 per foot connection fee. The City Administrator notified the Council in writing Mtg. re: that the Sub -Committee on Property Taxation will hold an A.B. 77 interim committee hearing on proposed Assembly Bill 77 (Hegland) (Hegland),requiring municipally owned gas or electric 9/21 & 9/22 utilities to pay School District Taxes, said meeting to Moved by Councilman Paul, seconded by Councilman McLees L^ that the Resolution be adopted. As several cities are sending representatives to this hearing and the City of Azusa would be directly affected, the City Adminis- trator brought to the Council's attention that the City of Azusa might wish to have representation at this hearing. Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the City Administrator attend this hearing in San Diego as a representative of the City of Azusa. Mayor Ortuno stated that the Council is opposed to this Assembly Bill 77. The City Administrator notified Council by letter that Mr. Clark Ewing, of Bradbury, has been engaged to make appraisal of proposed site for 600,000 gallon steel tank reservoir omC^ on Mr. Henry Van Ginkel's property, and that work should be completed and report ready for Council at its next regular meeting on October 2nd. Relative to salary survey of City Employees, the City Admin- istrator stated that the findings are being compiled and will be presented to the Council at the next regular meeting. A letter was received, dated September 9, 1961, from Paul ' Spencer, co-chairman, inviting members of Council to attend the Third Annual Dinner honoring Assemblyman Ronald Brooks Cameron, to be held on October 10th at 7:00 P.M. at the South Hills Country Club in West Covina, with donation of $25.00 per person. Relative to White's Ambulance Service Contract, the City Administrator submitted a recommendation that the City Council direct him to negotiate with the County for ambu- lance service and submit results for approval of Council. Gz, A letter was received from Azusa Citizen's Committee for Decent Literature, giving the aims and purposes of this com- mittee and inviting the Council to participate in a program on the matter of indecent and obscene literature. The com- munication included notification of the first meeting to be held on October 27th from 7:00 to 9:00 P.M., at the Azusa Library Auditorium, and requested the name of the representa- tive of the Council who will attend these meetings. Moved by Councilman Teasley, seconded by Councilman Johnson ' and unanimously carried that the communication be filed. A Civil Defense Progress Report, dated 9/18/61, was received from Fred G. Becker, Director of Azusa Civil Defense, show- ing the growth of our Civil Defense Program. The Civil De- fense Director has requested that Civil Defense may acquire the entire Scout Hall for its varied activities. At this time, there was no action taken by Council. A letter was received from J. Lonnie Crumpler, general con- tractor in Glendora, dated 9/14/61, requesting permission to construct a marquee on proposed new building at 141 E. Foot- hill, said marquee to extend 6' over the City's sidewalk, and also requesting requirements from a Fire Zone 1 to a Fire Zone 2 or 3 to enable this marquee to be constructed with wood and plaster instead of metal'and plaster. The City Ad- ministrator stated that Fire -Chief Madison has no objection to this, but does not feel we should change the fire zone.
