HomeMy WebLinkAboutA- 5 Proposed Ordinance regarding the City Administrator's Compensation Benefits 4,,, , Law Offices of BEST BEST&KRIEGER LLP June 1, 19 8 MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY ATTORNEY VIA: JOE HSU, ACTING CITY ADMINISTRATOR RE: PROPOSED ORDINANCE REGARDING THE CITY ADMINISTRATOR'S COMPENSATION AND BENEFITS The City Council is in the process of selecting and entering into a contract with a new City Administrator. In reviewing the City's existing rules and procedures regarding the City Administrator position, we found that the Azusa Municipal Code provides that the City Administrator shall receive the same vacation, sick leave, retirement and other employee benefits that other employees are entitled to. We understand that it is the City Council's desire to negotiate a contract with its new City Administrator without the tie in to the existing employee benefits. The proposed ordinance will amend section 2-88 of the Azusa Municipal Code by providing that the City Administrator's compensation and benefits shall be set by the City Council by resolution or in a negotiated contract. The ordinance will also require that the city administrator's contract be approved by resolution of the city council. Finally,the ordinance provides that the City Administrator's compensation and benefits shall not be tied to automatic amendments or increases which apply to other city employees that negotiate memoranda of understanding, unless such automatic amendments or increases are expressly provided for in the City Administrator's contract. The City Council is asked to introduce the proposed ordinance and waive further reading. If the Council takes such action, the ordinance will be presented for adoption at the regularly scheduled city council meeting on June 15, 1998. a0Olin/o,7 /7/W � eX47 If ORDINANCE NO. 98-o9 AN ORDINANCE OF THE CITY OF AZUSA, CALIF RNIA AMENDING SECTION 2-88 OF THE AZUSA MUNICIPAL CODE CONCERNING THE CITY ADMINISTRATOR'S COMPENSATION AND BENEFITS THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 2-88 of the Azusa Municipal Code is hereby amended in its entirety to read as follows: "Sec. 2-88. City Administrator Compensation and Benefits. The city administrator shall receive as compensation and in benefits those amounts and benefits that the city council shall from time to time establish and set forth by resolution or set forth by a contract entered into between the city and its city administrator. The city administrator's contract shall be approved by resolution of the city council. The city administrator's compensation and benefits shall not be automatically amended or increased in accordance with formulas or memorandum of understanding which apply to a group of other city employees, unless such automatic amendments or increases are expressly stated in the city administrator's contract with the city. SECTION 2. The entire Azusa Municipal Code shall be amended by deleting all references to"city administrator" and replacing them with"city manager." SECTION 3. This Ordinance shall be in full force and effect thirty(30)days after its passage. SECTION 4. A summary of this Ordinance shall be published in the manner required by law.
