JOHNSON, DIRECTOR OF ADMINISTRATIVE SERVICES DATE: JANUARY 21, 2020 SUBJECT: ADOPTION OF UPDATED CITYWIDE SCHEDULE OF FEES AND CHARGES BACKGROUND: On January 19, 2016, the City Council adopted several resolutions approving certain adjustments to the City’s Schedule of Fees and Charges. In addition, the City Council authorized Staff to adjust the schedule of fees and charges annually based on the change in the Consumer Price Index (CPI) or 2%, whichever was greater. The Los Angeles Area CPI change from September 2018 through September 2019 was 3.0%. Consequently, Staff has adjusted the majority of fees by 3.0% consistent with previous instructions established by the City Council. These changes are ministerial in nature and no further action is required by the Council in order to complete these fee updates. As part of the fee update, Staff would like to make other modifications to the Schedule of Fees and Charges that fall outside of the parameters of the previous direction provided by the City Council. The proposed recommendations requests the City Council to adopt the fee modifications outlined in Attachment 4 which includes three tables: 1) New fees proposed; 2) Fees proposed to be modified by an amount other than the previously directed CPI adjustment; and 3) Fee proposed to be eliminated. RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1)Receive, review, and file the updated Citywide Fee and Charges Schedule; and 2)Open the Public Hearing, receive public testimony, and close the Public Hearing; and 3)Adopt Resolution No. 2020-C01, regarding various municipal activities and services, to be effective on January 21, 2020. 4)Adopt Resolution No. 2020-C02, regarding development project services fees, to be effective 60 days from January 21, 2020 (March 21, 2020); and APPROVED CITY COUNCIL 1/21/2020 Approved with Amendments Adoption of Citywide Fees and Charges January 21, 2020 Page 2 ANALYSIS: California Government Code 66000 allows public agencies to impose fees to recover the costs of providing various public services to the community. In an effort to keep current with the cost of providing services, the City Council authorized Staff to implement the recommendations and fee adjustment from the fee study on January 19, 2016. The City Council also directed Staff to annually adjust the City’s Schedule of Fees and Charges by the change in the Consumer Price Index - Los Angeles Area (CPI) with a minimum increase of 2% and a maximum increase of 5% for most fee categories. This provision allows City fees to keep pace with increased costs for services without having to conduct a complete study each year. The CPI change from September 2018 through September 2019 was 3.0%; consequently Staff has adjusted the majority of fees by 3.0%. There are several fees that fall outside the parameter of the previous direction provided by the City Council. Specifically, twelve (12) new fees are being proposed (Attachment 4, Table 1) to reflect new programs and/or to enhance the City’s ability to provide services. The new fees include: 1) Miscellaneous Collection Fees: S-106 f) - 24% assessed on all closed utility accounts that remain unpaid. The 24% fee is the cost that the Utility incurs when an account is written off to the collection agency. The fee will be assessed on all closed accounts that remain unpaid 20 days from the rendering of the final billing statement. 2) AMI Opt-Out Fees: - S-106 g) i One-time initial set-up charge - $75. Added fee per the Utility's Rules and Regulations pertaining to the new AMI meters, when customers opt out. 3) AMI Opt-Out Fees: - S-106 g) ii Monthly Opt-Out Fee - $10. Provided the option to not have an AMI meter installed at their location for an additional cost each month. 4) AMI Opt-Out Fees: - S-106 g) iii Monthly Opt-Out Fee (Low-Income) - $5. These fees are related to the costs of providing and reading disabled two-way radio communication meters. 5) Water System Development Fee S-131H f) Accessory dwelling units less than 750 Sq. Ft- $700. To recover cost of Engineer time and administrative assessment by Water master. 6) Water Capacity Fee S-131J: e) Accessory dwelling units less than 750 Sq. Ft - $300. One time impact fee to connect to the water system for Accessory dwelling units. 7) Police Section #79 - Fire Arm Storage Fee - Levy upon release of firearm - $50. AB2431 allows administrative fees to be charged for storage and processing of firearms. 8) Rental of Civic Center Auditorium S-48.1: F) Custodial Services - $40 per hour. Cleanup costs for facility use. 9) 23 (Building Section) Construction and Demolition Administrative Fees: All tenant improvements with a valuation of up to $25,000: and all residential additions - $68. This fee is established for recovery of staff time in reviewing documents mandated by the State of California's Green Building Standards Code. Effective January 1, 2011, California’s Green Building Standards Code, Section 4.408 and 5.408, required the diversion/recycling of at least Adoption of Citywide Fees and Charges January 21, 2020 Page 3 50% of the construction waste during most new construction projects. Subsequent amendments to the legislation have expanded the types of construction and increased diversion/recycling requirement to 65%. The proposed ordinance would require the owners or developers of certain construction or demolition projects within the City, which are greater than 1,000 square feet, to develop and adhere to a Construction Waste Management Plan (CWMP). 10) 23 (Building Section) Construction and Demolition Administrative Fees: All tenant improvements with a valuation of $25,001 to $50,000, and all single family residential new constructions - $100. This fee is established for recovery of staff time in reviewing documents mandated by the State of California's Green Building Standards Code. Effective January 1, 2011, California’s Green Building Standards Code, Section 4.408 and 5.408, required the diversion/recycling of at least 50% of the construction waste during most new construction projects. Subsequent amendments to the legislation have expanded the types of construction and increased diversion/recycling requirement to 65%. The proposed ordinance would require the owners or developers of certain construction or demolition projects within the City, which are greater than 1,000 square feet, to develop and adhere to a Construction Waste Management Plan (CWMP). 11) 23 (Building Section) Construction and Demolition Administrative Fees: All tenant improvements with a valuation greater than $50,000; all multifamily, commercial, and industrial projects, and all other projects - $135. This fee is established for recovery of staff time in reviewing documents mandated by the State of California's Green Building Standards Code. Effective January 1, 2011, California’s Green Building Standards Code, Section 4.408 and 5.408, required the diversion/recycling of at least 50% of the construction waste during most new construction projects. Subsequent amendments to the legislation have expanded the types of construction and increased diversion/recycling requirement to 65%. The proposed ordinance would require the owners or developers of certain construction or demolition projects within the City, which are greater than 1,000 square feet, to develop and adhere to a Construction Waste Management Plan (CWMP). 12) 10 (Community Improvement Section) Impound and Storage Fee (Non-Automobile) - Actual Costs. Cost of removal of unlawful property such as containers/roll of operated and illegally staged in the Azusa jurisdiction and storage fees. There are eighteen (18) proposed fees that will increase more than the 3.0% CPI (Attachment 4, Table 2): 1) Temporary Meter Rental Services S-112: a) Meter Fee (Per each meter) - from $130 to $200. To recover the actual cost of meter which has gone up in price. Typical hydrant meters are installed for longer than 12 months. 2) Temporary Meter Rental Services S-112: b) Deposit - from $1,000 to $1,200. To recover the actual cost of meter which has gone up in price. 3) New Water Service Installation S-114: a) 3/4" to 1" Deposit - from $3,500 to $4,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 5) New Water Service Installation S-114: c) 4" Deposit - from $7,500 to $8,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 6) New Water Service Installation S-114: d) 6" Deposit - from $9,500 to $10,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 7) Fire Service Installation S-131C: a) 4" Deposit - from $7,500 to $8,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 8) Fire Service Installation S-131C: b) 6" Deposit - from $9,500 to $10,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 9) Fire Service Installation S-131C: c) 8" Deposit - from $10,500 to $11,000 . To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 10) Fire Service Installation S-131C: d) 10" Deposit - from $11,500 to $12,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 11) Fire Service Installation S-131C: e) 12" Deposit - from $12,500 to $13,000. To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 12) Water Disconnection From The Mainline (Deposit) S-131B (from $3,200 to $3,500) – To account for cost of materials such as copper and brass fittings as well as paving asphalt for installation. 13) Annual Backflow Device Inspection Review S-116: Water Improvement Inspection (Per Hour) - from $134 to $140. To recover Inspection labor costs. 14) Annual Backflow Device Inspection Review S-116: Will-Serve Letter - from $27 to $30. To recover inspection and engineering labor costs. 15) Water System Development Fees S-131H: e) Park - Flat Fee - from $3,770 to $4,000. To recover cost of engineering labor time and higher administrative assessment by Water master. 16) Water System Annexation Fees S-131I: d) School - from $3,600 to $4,000. To recover cost of engineering labor time and administrative assessment by Water master. 17) S-131I Water System Annexation Fees: e) Park - from $1,650 to $2,000. To recover cost of engineering labor time and administrative assessment by Water master. 18) Booking Services S-072A - from $135 to $150. Per Government Code 29550-29550.3, agencies are allowed to recover actual administrative costs associated with processing individuals through jail. There is one (1) proposed fee that will be eliminated (Attachment 4, Table 3): Adoption of Citywide Fees and Charges January 21, 2020 Page 5 1) Accident Report Investigation S-025 - from $20 to $0. Obsolete due to lack of assessment of this fee in several years. FISCAL IMPACT: The adoption of the proposed fee schedule is anticipated to allow cost recovery of various City services without depleting the City’s funds, and are contingent on the timing of various development projects and municipal activities. Schedule of Fees and Charges (Municipal Activities and Services) City of Azusa ADMINISTRATIVE PROCESSING COSTS 43 -1- Attachment 2 RESOLUTION NO. 2020-C01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING AND ADOPTING A REVISED SCHEDULE OF FEES AND CHARGES FOR VARIOUS MUNICIPAL ACTIVITIES AND SERVICES WHEREAS, under the police power granted by Article XI, Section 7 of the California Constitution, the City of Azusa is authorized to impose reasonable service fees for a variety municipal benefits and services; and WHEREAS, the City Council of the City of Azusa previously determined that the users of these services should be charged fees to recover the City's expenses for providing these services; and WHEREAS, the City Council previously adopted Resolution No. 2019-C02, which established fees for various municipal activities and services; and WHEREAS, the City Council has determined that in order to continue providing effective services for the public welfare, it is necessary to adopt a revised Schedule of Fees and Charges which sets forth fees for City services; and WHEREAS, based upon evidence provided, the City Council hereby determines that the proposed fees cover, but do not exceed, the reasonable cost of providing the services for which the fee is charged; and WHEREAS, the City Council has determined that the proposed Schedule of Fees and Charges is statutorily and categorically exempt from the requirements of the California Environmental Quality Act since citing these fees fit within the statutory exemptions for local agency decisions involving the adoption and collection of rates, tolls and other charges, pursuant to Public Resources Code Section 21080(b)(8) and Section 15273 of the California Environmental Quality Act Guidelines. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa, California does hereby find, determine and declare as follows: SECTION 1. A doption of Schedule of Fees and Ch arges. The City Council approves and adopts the Schedule of Fees and Charges (the "Schedule"), which is attached hereto as Exhibit "C" and incorporated herein by reference. The adopted fee schedule shall supersede any fees and charge schedule previously adopted. SECTION 2. Findings. The City Council finds that the fees and charges set forth in the Schedule attached as Exhibit "A": (1) have a reasonable relationship with the City's costs in providing and maintaining those services and facilities; and (2) are necessary to enable the City to continue providing and maintaining the services and facilities to which they relate. AYES: COUNCILMEMBERS: TBD NOES: COUNCILMEMBERS: TBD ABSTAIN: COUNCILMEMBERS: TBD ABSENT: COUNCILMEMBERS: TBD ___________________________________ Jeffrey Lawrence Cornejo, Jr. City Clerk APPROVED AS TO FORM: ___________________________________ Marco Martinez City Attorney Best Best & Krieger, LLP Attachment 3 RESOLUTION NO. 2020-C02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING AND ADOPTING A REVISED SCHEDULE FOR CERTAIN DEVELOPMENT PROJECT FEES AND SERVICE CHARGES WHEREAS, under the police power granted by Article XI, Section 7 of the California Constitution, the City of Azusa is authorized to impose fees, charges and rates for certain municipal services; and WHEREAS, in addition to the authority granted by the California Constitution, Chapter 8 (commencing with section 66016) of Division 1 of Title 7 of the California Government Code establishes a procedure for adopting fees or service charges for development projects; and WHEREAS, pursuant to Resolution No. 2019-C01, adopted on January 22, 2019, the City currently imposes development related fees upon applicants to recover the costs of staff time, inspection, copying costs and other expenses related to the review and processing of applications for property development; and WHEREAS, many of the City's current fees charged for development services no longer reflect the actual cost of providing such services; and WHEREAS, Government Code sections 66016 and 66018 provide that the City may adopt new development fees or increase existing fees after providing notice and holding a public hearing; and WHEREAS, notice of a public hearing on the establishment of new and revised fees was published in accordance with provisions of section 6062a of the California Government Code; and WHEREAS, notice of public hearing was mailed to all interested parties who filed a written request for a mailed notice with the City, or a waiver of notice was obtained; and WHEREAS, on January 21st, 2020, at the time and place specified in the published and mailed notices, the City Council held a public hearing as required by law to allow oral or written presentations prior to levying new development fees or service charges and prior to approving an increase in existing development fees or service charges; and WHEREAS, at least ten (10) days prior to the commencement of the hearing, there was made available to the public a report containing the cost, or estimated cost, of providing the service for which the fee or service charge will be levied, and the revenue sources for providing such services; and WHEREAS, based upon evidence provided, the City Council hereby determines that Attachment 3 the development services fees set forth in the Schedule of Fees and Charges attached hereto and incorporated herein by reference will not exceed the estimated reasonable cost of providing the property development services for which the fee is charged; and WHEREAS, the proposed fees are statutorily and categorically exempt from the requirements of the California Environmental Quality Act since these fees fit within the statutory exemptions for local agency decisions involving the adoption and collection of rates, tolls and other charges, pursuant to Public Resources Code Section 21 080(b) (8) and Section 15273 of the California Environmental Quality Act Guidelines. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa, California does hereby find, determine and declare as follows: SECTION 1. Adoption of Schedule of Fees. The City Council hereby approves and adopts the Schedule of Fees and Charges attached hereto as Exhibit "C" and incorporated herein by reference. The adopted fee schedule shall supersede any fees and charge schedule previously adopted. SECTION 2. Repeal of Prior Resolution. Resolution No. 2019-C01 is hereby repealed in its entirety. SECTION 3. Findings. The City Council finds that the fees and charges set forth in the Schedule attached as Exhibit "A": (1) have a reasonable relationship with the City's costs in providing those services; and (2) are necessary to enable the City to continue providing the services to which they relate. SECTION 4. Effective Date. This Resolution shall become effective sixty (60) days from its adoption.
