S. Helicopters of Long Beach. The Chief of Police for Baldwin Park has offered the services of this helicopter to our city on an "as needed basis. " The City of Baldwin Park has agreed that on calls involving "officer needs help" and "vehicle pursuits", they will make every attempt to immediately send the helicopter to our city for assistance. The helicopter would stay as long as needed. For this service, Baldwin Park will not charge us. For other calls-for-service, such as party dispersals, area checks for lost or missing children, rooftop checks of buildings, yard checks for suspects, felony car stops, aerial photographs for court preparation, etc. , there would be a minimum charge of $55. This charge would include up to eighteen (18) minutes of air time. Any additional time on that call would be charged at the rate of $18. 50 for every 1/10th hour (6 minutes) . As part of their program, I have used asset seizure funds to assist in the purchase of a necessary radio for the aircraft. Our share of this cost came to $371. As a result of this, Baldwin Park will credit Azusa with two (2) hours of air time (or about seven (7) responses) . Time is charged from the departure from Baldwin Park and the return to their city. A copy of the Agreement for Contract Services has been reviewed by the City Attorney and is ready for signature by the Mayor, upon approval by the City Council. Although the cost of helicopter use is expensive to the cities that utilize this service, I find that the offer from Baldwin Park is extremely reasonable. AGREEMENT FOR CONTRACT SERVICES CITY OF BALDWIN PARK THIS AGREEMENT FOR CONTRACT SERVICES is made and entered into this 021j( day of Ate , 1994, by and between the CITY OF BALDWIN PARK, a municipal corporation ("BALDWIN PARK") , and CITY OF AZUSA, a municipal corporation ("CITY") . 1. Scope of Services and Contract Sum. BALDWIN PARK currently has available for police services a Robinson R-22 Beta Helicopter for approximately ten (10) hours per week. BALDWIN PARK and CITY wish to have the helicopter available for limited service in CITY while the helicopter is onsite in BALDWIN PARK. Accordingly, BALDWIN PARK shall provide limited helicopter service to CITY as follows : Service Charge Officer Needs Help -0- Vehicle Pursuit -0- As Needed Calls (including party dispersals, roof $185 . 00/hour top checks, searches, etc. ) All charges shall be charged in 1/10th of an hour increments or portion thereof, with a minimum charge of $55 . 00 . 2 . Privileges and Iamnunities From Liabilities. All the privileges and immunities from liability, exemptions from laws and rules, and all pension, relief, disability, workers compensation and all other benefits granted the Baldwin Park police force performing its functions within the territorial limits of Baldwin Park shall extend and apply to such police force performing its functions within the territorial limits of CITY, and while traveling to and from CITY under and by virtue of this contract. 3 . Indemnity. CITY agrees to indemnify, defend, and hold harmless BALDWIN PARK and its officials, employees, agents, contractors, or subcontractors against any and all actions, claims, damages, or liabilities, including legal costs and attorneys' fees, whether or not suit is actually filed, and any judgment rendered against BALDWIN PARK and/or its officials, employees, agents, contractors, or subcontractors that may be asserted or claimed by any person, firm, or entity, arising out of or in connection with the performance by BALDWIN PARK, its agents, employees, contractors or subcontractors, of the services of this Agreement . 4. Discretion of BALDWIN PARK. Notwithstanding any other provision hereof, the provision of helicopter service under this Agreement shall be within the sole discretion of the BALDWIN PARK Police Chief or his designee. In no event shall BALDWIN PARK be liable for the failure to provide service. 5. Termination of Agreement. This Agreement is immediately terminable, with or without cause, by written notice from the Chief of Police from either city. - 2 - IN WITNESS WHEREOF, the parties have executed and entered into this Agreement as of the date first set forth above.
