Roll Call CLOSED SESSION NOTICE TO THE PUBLIC FOR CLOSED SESSION Prior to going into closed session the City Council will convene in the Auditorium serving as Council Chambers to take public comment on the closed session items only. General public comment will be provided for during the regular portion of the meeting beginning at 7:30 P.M. 1. CONFERENCE WITH LEGAL COUNSEL – SIGNIFICANT EXPOSURE TO LITIGATION - Pursuant to California Government Code, Section 54956.9(d)(2)/(e)(1). One Potential Case 2/3/2020 - 2 - 7:30 P.M. - REGULAR MEETING OF THE CITY COUNCIL, THE SUCCESSOR AGENCY, THE PUBLIC FINANCING AUTHORITY. NOTICE TO THE PUBLIC FOR REGULAR MEETING In compliance with Government code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Foothill Blvd.; copies for public view are at the Azusa City Library - 729 N. Dalton Ave., Azusa Police Department Lobby - 725 N. Alameda Ave., and the City of Azusa Web Page www.ci.azusa.ca.us. Persons who wish to speak during the Public Participation portion of the Agenda or on a Public Hearing item, shall fill out a card requesting to speak and shall submit it to the City Clerk prior to 7:30 P.M.; cards submitted after will not be accepted. A. PRELIMINARY BUSINESS 1. Call to Order 2. Roll Call 3. Flag Salute 4. Invocation – Pastor Dale Winslow, Foothill Community Church 5. Closed Session Report by the City Attorney CEREMONIAL 1. The following Police Officers will be sworn into office: Tommy Avila, Lieutenant; Bertha Parra, Sergeant; Steve Spahr, Corporal, Lauren Ferrari, Corporal, Jesse Landa, Corporal. 2. Canyon City Foundation Volunteer of the Year. B. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items within the subject matter jurisdiction of the council/agency board that are not listed on this agenda or are listed on this agenda as an item other than a public hearing item. Members of the audience will have the opportunity to address the city council/agency board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the council/agency board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. The council/agency board will respond after public comment has been received. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments shall be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes. C. REPORTS, UPDATES, AND ANNOUNCEMENTS FROM STAFF/COUNCIL 1. Presentation on L.A. County’s new voting system, Voting Solutions for All People (VSAP). 2/3/2020 - 3 - D. SCHEDULED ITEMS 1. PUBLIC HEARING - INTRODUCE FIRST READING OF DRAFT ORDINANCE FOR CODE AMENDMENT NO. 246 – CODE CLEANUP FOR CHAPTER 88 OF THE AZUSA MUNICIPAL CODE (DEVELOPMENT CODE). RECOMMENDED ACTION: 1) Find the requested project exempt from the California Environmental Quality Act (CEQA); and 2) Open the Public Hearing, receive public testimony, close the public hearing; and 3) Wave further reading, read by title only and introduce Ordinance No. 2020-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA APPROVING CODE AMENDMENT NO. 246 TO AMEND VARIOUS SECTIONS OF CHAPTER 88 OF THE AZUSA MUNICIPAL CODE (DEVELOPMENT CODE) E. CONSENT CALENDAR The Consent Calendar adopting the printed recommended actions will be enacted with one vote. If Councilmembers or Staff wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. 1. MINUTES OF THE REGULAR MEETINGS OF JANUARY 21, 2020. RECOMMENDED ACTION: Approve minutes as written. 2. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED JANUARY 15, 2020 THROUGH JANUARY 30, 2020. RECOMMENDED ACTION: Adopt Resolution No. 2020-C04 allowing certain claims and demands and specifying the funds out of which the same are to be paid. 3. HUMAN RESOURCES ACTION ITEMS. RECOMMENDED ACTION: Approve the Personnel Action Requests in accordance with the City of Azusa Civil Service Rules Section 5.7.5 and applicable Memorandum of Understanding(s). 4. FINDING OF PUBLIC BENEFIT TO THE COMMUNITY AT LARGE FOR RECOMMENDED EXPENDITURES APPROVING A REQUEST FROM AZUSA HIGH SCHOOL’S JROTC. RECOMMENDED ACTION: Approve an expenditure in the amount of $200 to the Azusa High School JROTC to fund educational trips to historical sites around Los Angeles and to purchase new color guard equipment for use when they represent the City of Azusa at various functions; and Make a finding that the community at large will receive a public benefit from the expenditure of funds for the recommended item. 2/3/2020 - 4 - 5. SELECTION OF UNDERWRITER FOR PROPOSED PENSION OBLIGATION BONDS. RECOMMENDED ACTION: Authorize Staff to engage services with BofA Securities to serve as Underwriter for financing of the City’s proposed Taxable Pension Obligation Bonds. 6. APPROVAL OF THE FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE AZUSA UNIFIED SCHOOL DISTRICT (AUSD) FOR THE USE OF THE CIVIC AUDITORIUM TO CONDUCT, BROADCAST AND RECORD THE AUSD BOARD OF EDUCATION MEETINGS. RECOMMENDED ACTION: Approve and authorize the City Manager to sign the First Amendment to Memorandum of Understanding with the Azusa Unified School District for the use of the Civic Auditorium for the purpose of recording and broadcasting on the City’s PEG-TV Channel a limited amount of Board of Education meetings. F. SECOND READING ORDINANCES 1. SECOND READING OF ORDINANCE AMENDING CHAPTER 14 OF THE AZUSA MUNICIPAL CODE ADDING ARTICLE XVIII, CONSTRUCTION AND DEMOLITION WASTE RECYCLING AND DIVERSION. RECOMMENDED ACTION: 1) Read by title only, second reading and adoption, Ordinance No. 2020-01: SECOND READING OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING CHAPTER 14 OF THE CITY OF AZUSA MUNICIPAL CODE, ADDING ARTICLE XVIII, CONSTRUCTION AND DEMOLITION WASTE RECYCLING AND DIVERSION G. SUCCESSOR AGENCY RELATED BUSINESS. 1. RESOLUTION AUTHORIZING PAYMENT OF WARRANTS BY THE SUCCESSOR AGENCY DATED JANUARY 16, 2020 THROUGH JANUARY 30, 2020. RECOMMENDED ACTION: Adopt Resolution No. 2020-R04 allowing certain claims and demands to be paid out of Successor Agency Funds. H. ADJOURNMENT.
