The City Council of the City of Azusa met in adjourned session at the above time and place. Mayor Ortuno called the meeting to order. Call to Order Present at Roll Call: Councilmen: Paul, McLees, Johnson, Roll Teasley, Ortuno Call Also Present: Assistant City Attorney Decker, City Administrator Caswell, Superintendent of Light and Water Smith, Deputy City Clerk Torrey In response to Mayor Ortuno's inquiry regarding anyone in the Re: Louis audience wishing to appear before the Council, Mr. Ed Peter Francis appeared before Council with the request for Council approval Amend, u7 of a petition re: Louis Francis Amendment measure on subversive Measure C'y activities. No action was taken at this time. U_ ;Z' Mrs. Mary Ecker, 141 Ranburn, appeared before Council with a Re: Trash m complaint regarding trash pick-up. Mrs. Ecker stated that pick-up she has to clean up trash the men dump on her property when complaint they empty her trash cans and that the cans are ruined from rough handling. Moved by Councilman Teasley, seconded by Councilman Johnson and unanimously carried that this matter be referred.to the City Administrator for investigation. The hour of 7:30 P.M. was set for three Public Hearings on Pub.Hrg. zone change from R-3 to C-3 for property at Alosta and Ben re: zone Lomond Avenues, owned by John Daniel, Robert Kyle, and change Charles Johnston, respectively. The Deputy City Clerk pre- to C-3 sented the affidavits of publication and lists of property (Alosta & owners who had been notified, and read in full a communica- Ben Lomond) tion which had been received with each application for zone change by the Planning Commission, which communication is now on file in the City Clerk's Office. Notice of Protest, containing 49 signatures, was received by the Planning Com- mission on February 21st, and was read in full by the Deputy City Clerk. A petition of protest to.the extension of Hanlin Avenue, Traymore Avenue, Calera Street, Oakbank Avenue, and Galanto Avenue, and a request for a continuous 6 ft. block wall fence between the end homes and any further improvements, was received by the Deputy City Clerk at the Council meeting, which petition contained 85 signatures. The following persons appeared before Council in protest to zone change aforementioned or to certain street extensions: William Thurston Leland Betts G. H. Skinner c/o Real Estate office of Ward Sanford in Pasadena With no other written communications having been received and no other person in the audience wishing to be heard in regard to this proposed zone change, it was Moved by Councilman Teasley, seconded by Councilman Paul and unanimously carried that the hearing be closed. ulJ An analysis and report by the Planning Commission, relative CJ to the above zone change, was read in full by the Deputy City Clerk. � After a discussion regarding g ng precise plan of design and street extensions, it was Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that the recommendation of the Planning Commission, to change zone from R-3 to C-3 for the three parcels at Alosta and Ben Lomond, be accepted. It was further moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that Council re- serve the right to review the Precise Plan for this project. In regard to this matter, the Assistant City Attorney pointed out that the final approval still rested with the Planning Commission, as per the Ordinance of Precise Plan. Councilman Johnson offered for first reading the following Ordinance amending the Municipal Code to rezone the afore- mentioned three parcels at Alosta and Ben Lomond: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMEND- ING THE AZUSA MUNICIPAL CODE TO REZONE CERTAIN PROPERTY. (Alosta and Ben Lomond). Moved by Councilman Johnson, seconded by Councilman McLees and unanimously carried that further reading be waived. Page 2 A Resolution was prepared declaring that a majority protest has not been made against proposed Easterly Annexation Dis- trict No. 43, which is the Quail Valley Country Club property. Councilman Paul offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FIND- ING AND DECLARING THAT A MAJORITY PROTEST HAS NOT BEEN MADE AGAINST EASTERLY ANNEXATION DISTRICT NO. 43. Moved by Councilman Paul, seconded by Councilman Johnson and unanimously carried that further reading be waived. Moved by Councilman Paul, seconded by Councilman Teasley that the Resolution be adopted. Resolution passed and adopted by the following vote of Council: 301 1st Rdg. Ord.amend. Councilman Johnson re -introduced for first reading the follow- ing Ordinance approving the annexation of certain uninhabited territory designated Easterly Annexation District No. 43: 'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE.ANNEXATION OF.CER- TAIN UNINHABITED TERRITORY DESIGNATED EASTERLY ANNEXATION DISTRICT NO. 43 TO THE CITY OF AZUSA. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that further reading be waived. The Planning Commission presented a report on the proposed prezoning to R-3 of Lots 1, 2 and 3,located at the southwest corner of 5th Street and Rockvale Avenue, owned by Mrs. R. F McKinlay, with the recommendation that if there is any de- velopment pending, the proposed R-3 zone would be proper for this property. CC Based on that recommendation, an Ordinance was prepared amend- ing the Municipal Code to rezone certain property subject to annexation, owned by Edwards Theatres, Inc., and Mrs. McKinlay. Councilman Johnson offered for first reading the following Ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMEND- ING THE AZUSA MUNICIPAL CODE TO REZONE CERTAIN.PROPERTY SUB- JECT TO ANNEXATION (Edwards Theatres and McKinlay). Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that further reading be waived. A Resolution was prepared determining that a certain structure at 409 N. Alameda (Substandard Structure Case No. 73), -is an unsafe building and should be abated. Councilman Johnson offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DETERMIN- ING AND DECLARING THAT A CERTAIN STRUCTURE IS AN UNSAFE BUILD- ING AND A PUBLIC NUISANCE AND THAT THE SAME SHOULD BE ABATED. Moved by Councilman Johnson, seconded by Councilman Teasley and unanimously carried that further reading be waived. Moved by Councilman Teasley, seconded by Councilman Paul that the Resolution be adopted. Resolution passed and adopted by the following vote of Council: AYES: Councilmen: Paul, McLees, Johnson, Teasley, Ortuno NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution 4325. Mayor Ortuno gave a report to Council on the 75th Anniversary Diamond Jubilee Committee, stating it would take approxi- mately $5,000, most of which is self-supporting, in order to put on a full program with full decorations. As Mr. Jack Benny is Honorary Mayor of the City, a letter was written to him, inviting him to be the Grand Marshal for the parade. It was suggested by Council that the Mayor follow up this letter by visiting Mr. Benny personally to invite him. 303 1st Rdg. (reintro.) Ord.approv- ing East- . erly Annex.
