Mayor Ortuno called the meeting to order. Present at Roll Call: Councilmen: Paul, Teasley, McLees; Ortuno Absent: Councilmen: Johnson Also Present: City Attorney Williams, City Admin- istrator Caswell, Superintendent of Light & Water Smith, Deputy City 'j Clerk Torrey, City Clerk Miller The City Council proceeded with the canvass of the votes of �7 the General Municipal Election held on April 10, 1962, in- cluding-the n- cluding the absentee ballots, by spot checking Voting Pre- �. cinctsj, 5, 11 and"14, and Absent Voters Ballots. Each i� member of the Council was givep a tally sheet on which to score the results. �.. A Resolution was .presented declaring the result of the election and the result of th4 canvass of .votes. Each Council member being aware o£;the results of the election, Councilman Teasley offered the following Resolution: A RESOLUTION OF THE CITY COUNCIL OF TH$ CITY OF AZUSA, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF AZUSA ON THE 10TH DAY OF APRIL, 1962, DECLARING THE RESULT THEREOF AND.SUCH OTHER 'MATTERS AS ARE PROVIDED BY LAW. ' WHEREAS, a regular general municipal election was held and conducted in the City of Azusa, County of Los Angeles, State of California, ori Tuesday, the 10th day of April, 1962, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast there- at, received and canvassed and the returns made and de- clared in time, form and manner as required by the pro- visions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, on the 17th day of April, 1962, at the hour of 7:30 P.M., the City Council duly assembled at its usual place of meeting and has canvassed the returns of said election and as a result of which, the City Council finds that the number of votes cast and the names of the persons voted,for, the office each person was voted for,and other matter, required by law to be as stated hereinafter; NOW, THEREFORE, the City Council of the City of Azusa, California, does resolve as follows: SECTIONJ1 That there were 14 voting precincts established for.the purpose of holding said election consisting of consolidations of the regular election precincts in the City ofi Azusa as established for the holding of state and county 'elections. 3.3 5 I 7:30 P.M. SECTION 3. That at said regular general municipal election, the.following measure was submitted to the electors of said City, to -wit: "Shall the Ordinance prohibiting the possession of certain coin games and similar machines and devices be adopted?" SECTION 4. That the whole number of votes cast in said City L�j (except absent voter ballots) was 29630 That the whole number of absent voter ballots cast in said City was 10 making a total of 2973 votes cast in said City. The City Council does declare and determine that: Edward A. Cooney was elected as Member of the City Council of said City for the full term of four years; Louis G. Memmesheimer was elected as Member of the City Council of said City for the full term of four years; 340 1 1 CITY HALL AZUSA, CALIFORNIA TUESDAY, APRIL 17, 1962 Hickory S. Jackson was elected as Member of the City Council of said City for the full term of four years; That as a result of said election, a majority of the qualified voters voting on said measure relating to possession of certain coin machines did vote in favor thereof, and that said proposition was carried, and shall be deemed adopted, ratified and effective. SECTION 7. The City Clerk shall enter on the records of the City Council.of said City, a statement of the result of said election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure; (6). The number of votes given in -the City to each person, and for and against each measure, 341 Page 4 SECTION 8. That the City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Section 11565 and Section 11568 of the Elections Code of the State of California, shall deliver to each of such persons so elected a certificate of election signed by him and duly authenticated; that he shall also administer to each person elected, the oath of office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in his office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. Tempore Chosen Mayor Ortuno nominated Councilman Cooney. (Cooney) Moved by Councilman Memmesheimer, seconded by Councilman Jackson and unanimously carried that nominations be closed. Councilman Memmesheimer requested that the records show that a unanimous vote was cast for Councilman Cooney as Mayor Pro Tempore, With no objections, the Mayor ordered that the unanimous vote be recorded. There being no new business scheduled, Mayor Ortuno brought Representa- before the Council the subject of the City being repre- tion at May- sented by various officials at the Maytime Band Festival, time Band held at National City on May 5th, at which time the Azusa Festival at High School Aztec Band will compete as in past years. Natl. City Mayor Ortuno also requested authorization of expenses in- on 5/5/62 curred by officials attending the Festival. ' Councilman Cooney stated that he would like to see the City represented at the Band Festival to be held at National City on May 5th, and would so move. The above motion was amended by Councilman Memmesheimer, who stated that he would like very much to see any members of the Council who had the time, or are willing to take the time, to represent the City at this Band Festival. Resolution was then passed and adopted by the above listed vote of Council and numbered Resolution 4331. The Honorable Albert H. Miller, Judge of Citrus Municipal Oath of Court, then administered the Oath of Office to the three Office ' new members of the City Council. The City Clerk presented a Certificate of Election to each of the successful candi- dates, upon determination that the affidavits of campaign expenses had been filed in the office of the City Clerk, as required. The City Clerk, presiding as Chairman, asked for nominations Mayor for Mayor. Chosen (Ortuno) Councilman Cooney nominated Councilman Ortuno. D'J t- Councilman Jackson nominated Councilman Cooney. Ci. The above motion was amended by Councilman Memmesheimer, who stated that he would like very much to see any members of the Council who had the time, or are willing to take the time, to represent the City at this Band Festival. 344 1 CITY HALL AZUSA, CALIFORNIA TUESDAY, APRIL 17, 1962 Discussion was held relative to the payment of expenses for staying overnight at the Band Festival. To clarify the amended motion, Councilman Memmesheimer said that any expenses entailed that will be presented to the City in the form of actual expenditures, including mileage ' and the cost of the trip, would be included, and further stated he would like to put a limited amount to this expend- iture not to exceed $50 per official. Councilman Jackson seconded the amended motion, which was, with no objection, upanimously carried. Mayor Ortuno.then added that a policy has been set by previous Council action that approval from the Council must be obtained for overnight trips and that itemized statements of expenses incurred be turned in within thirty days of the expenditure. Mayor Ortuno further reported that the San Gabriel Valley R, Symphony Association has appealed to Council for any assis- tance the City might be able to give them with next year's budget with regard to contributions to their fund. After further discussion, it was 345 Page 6 Moved by Councilman McLees, seconded by Councilman Memmesheimer and unanimously carried that the City support this activity, the manner and amount to be determined later. At 8:25 P.M., City Attorney Williams asked to be excused from ' the meeting. Mayor Ortuno reported that the Elks Club would like to sponsor Youth in Government Week during the month of May and has tentatively set May 1, 1962, as Youth in Government Day. After further discussion, it was moved by Councilman Memmesheimer, seconded by Councilman Jackson and unanimously carried that this Council look favorably upon the request of the Elks Club, and that a suitable date be arranged and the Elks Club notified so they may proceed with their program. Councilman Jackson recommended that the Elks Club coordinate this project through the school systems and that the City Department Heads be instructed to cooperate fully in making this project a success. Councilman Memmesheimer stated that in view of the totally unwarranted concern regarding the possible introduction of gambling in Azusa, he offers the following motion.- The City Council of the City of Azusa hereby disavows any attempt to legalize commercial gambling in thi's City and declares its Intention to maintain its opposition to such gambling. This City Council further asserts that there has never been ' the slightest intention on the part of any of its members to promote legalized commercial gambling in this City. The above motion was seconded by Councilman Cooney and unanimously carried. Moved by Councilman Memmesheimer, seconded by Councilman Jackson and unanimously carried that the meeting adjourn.
