The City Council of the City of Azusa met in regular session
at the above time and place.
7:30 P.M.
Mayor Ortuno called the meeting to order and led in the salute
to the flag.
Invocation was given by Mr. Dean Klarr, Assistant Minister of
the First Presbyterian Church.
Present at Roll Call: Councilmen: Memmesheimer, Jackson,

There being no correcticns, the minutes of the adjourned
meeting of June 8th and the regular meetings of July 2nd
and 16th, 1962, were approved as submitted.

A Resolution was prepared re: Intentlon to vacate a portion

Councilman McLees offered the following Resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLAR-
ING ITS INTENTION TO VACATE A CERTAIN PORTION OF ROOSEVELT
STREET.
Moved by Councilman McLees, seconded by Councilman Jackson
and unanimously carried that further reading be waived.

that the Resolution be adopted. Resolution passed and
adopted by the following vote of Council:

A recommendation was submitted by the Planning Commission
that the City Council initiate the necessary action to
acquire and maintain Palm Drive -as a City street, together
with a report by Harold L. Johnson, then Acting City
Engineer, that the street is substandard partly due to the
two rows of palm trees which allow only 20' of paved roadway.
Mr. Burton Gentle, 560 E. Jubuedly Dr., appeared before
'Council in favor of the City acquiring Palm Drive. Acting
as spokesman, he stated that the residents on this street
would like the palm trees (which are on private property)
to remain. Mr. Gentle also stated that Palm Drive dead -
ends at part of his property, and he would be willing to
put in the minimum cul• -de -sac required by the City, with
a 21' street leading into the caul -de• -sac.
The City Planner informed Council that the Commission feels
that 20' paving on Palm Drive would be satisfactory due to
its historic element.

After discussion, it was moved by Councilman Jackson,seconded
by Councilman Memmesheimer and unanimously carried that the
City Engineer be instructed to make a survey and report to
Council the estimated cost of acquiring Palm Drive as a City
street, and submit a recommendation, as near as possible to
standard requirements by taking maximum width., with specifi-
cations and diagrams.

also complained of the drainage problem on his property

because of this subdivision, which caused dirt and debris
to be washed down on his property,
It was suggested that the City Engineer, City Administrator
and Mr. Vallentine get together to work out a solution to
this drainage problem.
Moved by Councilman McLees, seconded by Mayor Ortuno and
unanimously carried that Resolution 262 of the Planning
Commission be filed.
After study and report by the Chief of Police, the City
Attorney and the Police Chairman, City Attorney Williams
redrafted the Ordinance relative to Carnivals, changing
the $5.00 service charge to $2.00 and also exempting mem-
bers of any local organization., which contracts for or
sponsors such traveling shows, from payment of this ser-
vice charge.
Councilman Memmesheimer offered for first reading the
revised Ordinance entitled^
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA
AMENDING THE PROVISIONS OF THE AZUSA MUNICIPAL CODE RE-
LATING TO CIRCUSES, CARNIVALS AND TRAVELING SHOWS.
' Moved by Councilman Memmesh.eimer, seconded by Councilman
Jackson and unanimously carried that further reading be
waived.
Mr. W. A. Baxley, president of the Azusa Junior Chamber
of Commerce, residing at 232 N.. Edenfield, appeared be-
fore Council and heartily endorsed this redrafted
Ordinance, except for the fingerprinting and photograph-
ing requirement.

salary increase granted to employees, effective July 1, 1962.

Nicholas F. Poppelreiter, submitting his resignation as Planner
City Planner, to become effective between August 20th and Poppelreiter
31st, and stating he has accepted an appointment as Assis-
tant City Administrator for the City of Commerce.

and unanimously carried that the resignation of City Planner
Poppelreiter be accepted with regret, and that a letter of

City Engineer Lawrence submitted a recommendation for an
extension of 30 days time on Pipeline Job, Project No. 335
(Soldano Avenue water line), as requested by the contractor,
D. K. Moran Pipeline Co., because of delay in pipe delivery
and difficulties with utilities.
Moved by Councilman McLees, seconded by Councilman Jackson
' and unanimously carried that the requested extension be
granted.
A communication was received from Kenneth J. Swisher, re-
questing permission for a sewer easement along City prop-
erty to furnish sewer service for the convalescent home at
214 W. Paramount. l:t was poin.*_gid out that the Public Works
Superintendent has approved this _ewer easement.

tom. A recommendation of the Committee appointed to study the
s, extension of the Trash and Rubbish Contract was submitted
by Superintendent of Public Works Brusnah.an, as follows;
a) A new contract be written as of September 1, 1962,
for a period of 7 years;
b) All provisions of ourren.t contracts for trash and
garbage to remain i,t full effect;
c) Contract would be paid at $1..15 per unit per month;
' d) The cost per unit would be adjusted as the percent-
age change in Bureau of Labor Cost: of Living Index
in September, 1964, and yearly thereafter.
e) A disaster clause to protect City to be placed in
contract.
Mr. B. Hartunian of Western Disposal Company appeared be-
fore Council , stating that these recommendations are agree-
able with him, and that the consumer price should be current
as of date of execution of the agreement, but no change to
be made until 1964•. Mr. Hartunian also stated that he would
like the count of pickups to be figured every 90 days instead
of every 6 months.
After discussion, .it was moved by Councilman Jackson,
seconded by Councilmar McLees and unanimously carried that
the City Attorney be instructed to draw up the agreement
with Western Disposal Company, based on the recommendations
of the Committee, with the addition of a clause that a pick-
up count be figured every 90 days,.
A Resolution was prepared approving the report of the Street
Superintendent on the cost of weed abatement according to
the report of Public Works Superintendent Brusnahan dated
August 6, 1962.
Councilman McLees offered the following Resolution entitled¢

The City Administcator stated he will find out the limita-
tions to building a 5' wall irstead of a 6' wall and have
the Ci.ty Engineer endeavor to adjust the differences as
soon as possible.
' It was agreed that Mr. Tscharner and City Administrator
Caswell meet with Mr. Whisler, the Building Inspector,
regarding height of the wall.
A communication was received from the Deacons Club of
Azusa, requesting permission to hold a Jamaica (Spanish -
type bazaar) on August 25th and 26th, 1962, at the Parish
Hall grounds, 4th. and Dalton..
Moved by Councilman McLees, seconded by Mayor Ortun.o and
unanimously carried that permission be granted.
The City Administrator submitted a sketch of the proposed
landscaping for the new Fire Station for examination. by
Council members. The approximate cost of this landscap-
ing is $3,000 to $3,500, if done by lo;al people in the
Public Works Department, which estimate includes sprinkler
system and labor,.
Moved by Councilman Memmesheimer, seconded by Councilman
Jackson and unanimously carried that the plan for landscap-
ing of Fire Station be accepted, and that the Public Works
Department be authorized to provide the necessary plants
and take care of the planting.
' A communication was received from Marvin Lustiger, presi-
dent of National Land Compar..y, re•questIng. the City initiate
proceedings to annex approximately 621 a.ares of property
located between Azusa and Donna Beth. Avenues, north of
Newburgh St., provided C-2 or 0-3 zoning is granted upon
annexation. On April 20, 1961, Mr., H. A. Snidow, the
attorney representing the National Land Co., requested
this annexation with zone change to C-3, and proceedings
had been started at that time as "Southerly Annexation

As requested, Mr. Bud Latta appeared before Council relative

The City Administcator stated he will find out the limita-
tions to building a 5' wall irstead of a 6' wall and have
the Ci.ty Engineer endeavor to adjust the differences as
soon as possible.
' It was agreed that Mr. Tscharner and City Administrator
Caswell meet with Mr. Whisler, the Building Inspector,
regarding height of the wall.
A communication was received from the Deacons Club of
Azusa, requesting permission to hold a Jamaica (Spanish -
type bazaar) on August 25th and 26th, 1962, at the Parish
Hall grounds, 4th. and Dalton..
Moved by Councilman McLees, seconded by Mayor Ortun.o and
unanimously carried that permission be granted.
The City Administrator submitted a sketch of the proposed
landscaping for the new Fire Station for examination. by
Council members. The approximate cost of this landscap-
ing is $3,000 to $3,500, if done by lo;al people in the
Public Works Department, which estimate includes sprinkler
system and labor,.
Moved by Councilman Memmesheimer, seconded by Councilman
Jackson and unanimously carried that the plan for landscap-
ing of Fire Station be accepted, and that the Public Works
Department be authorized to provide the necessary plants
and take care of the planting.
' A communication was received from Marvin Lustiger, presi-
dent of National Land Compar..y, re•questIng. the City initiate
proceedings to annex approximately 621 a.ares of property
located between Azusa and Donna Beth. Avenues, north of
Newburgh St., provided C-2 or 0-3 zoning is granted upon
annexation. On April 20, 1961, Mr., H. A. Snidow, the
attorney representing the National Land Co., requested
this annexation with zone change to C-3, and proceedings
had been started at that time as "Southerly Annexation

Jackson and unanimously carried that the Engineering De-
partment prepare the necessary details re: annexation of
' above property, such as legal descriptions, etc., and also
include as much adjoining property as necessary.
The City Clerk informed Council that copies of Proceedings
of Mayors' and Councilmen's Institute, held in Sacramento
on May 20-22, 1962, are now available from League of Cali-
fornia Cities at $3.00 per copy.

Jackson and unanimously carried that a copy of the Pro-
ceedings should be ordered for each Council member.

tr Mayor Ortuno presented to Council a communication received
=z. from the City of Irwindale, extending an invitation for
Council members to attend the 5th Anniversary Celebration
of Irwindale, to be held August 11th, 1962, at 7:00 P.M.,
at the Irwindale Baseball Park, including a doubleheader
ballgame. As none of the Council members is able to
attend this celebration, Council suggested that a letter
of regret be sent to the City of Irwindale.
Mayor Ortuno stated the following Committee was appointed,
upon request of Council, to make arrangements for the
dedication ceremonies of the new Fire Station, including
' refreshments, etc., on Sunday, October 14, 1962: Fire
Chief Madison, Chairman; Cornelius Reed, Ira Calvert,
S. A. Paul, L. G. Memmesheimer and Mayor Ortuno.
The Committee has, in turn, appointed the Firemen's
Auxiliary; with the addition of Mrs. L. A. Memmesheimer,
who is co-chairman with Mrs. Marlow Madison.
A communication was received from Mr. Stanley G. Detwiler,
763 W. 5th St., relative to stoppage in the sewer line.
The City Attorney stated that the lateral goes beyond the
curb line; also that the City maintains the lateral and
the resident maintains the sewer connection.
After discussion, it was moved by Councilman Memmesheimer,
seconded by Councilman Jackson and unanimously carried
that s definite policy be set to determine the location
of the break point between lateral and sewer, and that
this be investigated by the City Administrator.
Mr. Al Bellerue, 1225 N. Dalton, submitted an open letter
to Council, objecting to certain books in the Children's
Section of the Azusa Public Library, particularly those
on the Constitution and alleged promotion of Metro form
' of government.
City Attorney Williams stated that the Library operates
under the State Education Code and that the Library Board
is responsible to the people of the City. The City
Attorney further stated that the Council only appoints
the Library Board who, in turn, is responsible for the
operation of the Library.
