HomeMy WebLinkAboutMinutes - September 25, 1962 - CCCITY HALL AZUSA, CALIFORNIA TUESDAY, SEPTEMBER 25, 1962 The City Council of the City of Azusa met in adjourned session at the above time and place. Mayor Ortuno called the meeting to order and led in the salute to the flag. 53 7:30 P.M. Present at Roll Call: Councilmen: Memmesheimer, Cooney Jackson, McLees, Ortuno Also Present: City Attorney Williams, City Administrator Caswell, Superintendent of Light & Water Smith and City Clerk Miller. Call to Order Roll Call Mayor Ortuno stated the first item on the agenda was the con- Re: Exec. sideration of the City Administrator Ordinance. The Mayor Session asked the City Attorney to clarify an issue on the Executive Session held prior to this meeting, as some of the members of Council felt it might be considered an illegal meeting. The City Attorney stated that the City Council is entitled to meet in an executive session where no decisions are to be made. The Brown Act provides that the City Council shall not deliberate, reach a decision or agree to a decision at any other than a public meeting; however, it does not state that the City Council cannot meet for the sake of obtaining information in a private session, and this is particularly true on personnel matters. Mr -Williams said he felt that this meeting was not a violation of the Brown Act. Councilman Jackson stated that this was not strictly a personnel matter, as this was in reference to a proposed Ordinance. He felt that since no personnel matters were considered at this meeting, this might be construed to be an illegal meeting, and he disagreed with the City Attorney on this matter. In response to the request of the Mayor for anyone in the Re: City audience to address the City Council on the presently effective Administrato City Administrator Ordinance, the following persons appeared Ordinance before Council and spoke in opposition to said present Ordinance: Mr. Thomas R. Ranburn Avenue The following persons appeared before Council and spoke in favor of the present City Administrator Ordinance: Mr. James M. Judy Office at 135 W. Foothill Blvd. Mr. Ray Boyer 1143 No. Dalton Avenue Mr. Warren Teasley 126 No. San Gabriel Avenue 'Mr. William A. Baxley 232 No. Edenfield Avenue Mr. Frank Pollock, 1040 No. Azusa Avenue, appeared before Council, stating he has been coming to Council meetings considerably since 1958, but complained of the inability to hear what is going on at the Council table. He suggested that more people would come to the meetings if they were able to hear the comments and actions. Councilman Cooney remarked that he believed this matter of the City Administator Ordinance should go before the people and that a Special Election should be called. 54 1 55 - The City Administrator requested approval of appointment of Mel Bauman as Mechanic's Helper, which was tabled from 9/17/62 meeting. Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that this subject be lifted from the table. 'Moved by Councilman Memmesheimer, seconded by Councilman Cooney and -unanimously carried that this request be granted. The City Administator presented a request from Warren M. Dorn, Supervisor of the Fifth District, Los Angeles County Board of Supervisors, for a suitable resolution or letter to be sent to the Board of Supervisors, commending Maury Wills, star Dodger baseball player, for his achievements. The commendation should be forwarded for presentation to Mr.'Wills on September 28th, to be included in a large scrap book to be presented to him at a suitable ceremony in the Hearing Room of the Board of Supervisors. Moved by Councilman McLees, seconded by Councilman Jackson and unanimously carried that such a resolution be prepared and forwarded for presentation to Maury Wills. App't. Mel Bauman as Mech. Helper (approved) Res. or letter of commendation to Maury Wills for his achieve- ments. The City Attorney pointed out that Council is not prohibited 00 from amending a submitted Ordinance, but is prohibited from Cr amending an initiative Ordinance. Gz4 A recess was called by Mayor Ortuno at 10:04 P.M., and at Recess 10:10 P.M. the Councilmen were re -seated and the meeting resumed. Roelle, in West Covina. reception A letter of appreciation was sent to the Mayor and Council Ltr.apprec. members from the Azusa Unified School District to the crew from Azusa of the Light & Water Department, commending them for their Unif.School emergency cooperation during the time of a recent power D.ist.to L&W shortage at the Azusa High School. Moved by Councilman McLees, seconded by Council Cooney and unanimously carried that the,letter be filed. A letter of appreciation was sent to the Council and City Ltr. of Administrator Caswell from the Guadalupe Society for their apprec.from cooperation re: Queen's Coronation by the Society at the Guad.Soc.re: Band Shell on September 14, 1962. A representative from the Junior Chamber of Commerce Jr.Ch.Com. appeared before Council, requesting permission for use of granted perm. garage and engine room area in the old Fire Station for the to use old purpose of constructing their float for the Diamond Jubilee Fire Sta. to Parade. Constr.float for D.J.Parade Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that permission be granted. Mr. Hartman of Leeds, Hill & Jewitt requested a policy Leeds,Hill & statement regarding the intention of the City to serve Jewitt req. all of the corporate City limits with water from the City intention to Water Department. serve City area & any new Moved by Councilman Memmesheimer, seconded by Councilman annex thru Jackson and unanimously carried that at this time it is the City Water intention of the City to serve all of the City area, and Dept. any new annexations that might become part of the City In the future, through the City Water Department. The City Clerk reminded Council of the Annual Conference Advance of the League of California Cities, especially regarding Reservations 'hotel reservations. Councilman Memmesheimer stated that for L.C.C. authority should be given to the City Clerk to send in Conference advance registrations for those who are going to attend. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the City Clerk be given authority to prepare the necessary warrant for pre -registration of those planning to attend the League of California Cities Conference. Mayor Ortuno thanked all those present at this Council meeting and expressed the wish that all will return to subsequent meetings and invite their friends.
