The City Council of the City of Azusa met,in regular session
at the above time and place.
Mayor Ortuno called the meeting to order and led in the salute
to the flag.
Invocation was given by Warren Teasley, member of the Planning
Commission.
Present at Roll Call: Councilmen: Memmesheimer, Cooney,
Jackson, McLees, Ortuno
Also Present: City Attorney Williams, City Engineer

With no corrections, the Minutes of"the meeting of December 17,
1963, were approved as written.
MThe hour of 7:30 P.M. being the time set for continued public
N hearings on Debt Limit Report and on protests or objections
44 !Resolution of Intention No. 4384), re: Improvement of
mrasadena Avenue and other streets under the 1911 Act Assess-
ment District #1961. The hearings were declared opened by
Mayor Ortuno.
After a short discussion regarding the proposed assessment
district, the City Attorney explained that the time had
elapsed enabling further continuance of the hearings on debt
Amit report and protests and it is no longer possible to keep
the matter open.
Moved by Councilman Memmesheimer, seconded by Councilman McLees
and unanimously carried that proceedings be abandoned re:
Improvement of Pasadena Avenue and other streets designated
as 1911 Act Assessment District # 1961.
The hour of 7:30 P.M. being the time set for a Rublic hearing
on the proposed zone change upon annexation to 'C-2" on pro-
perty on the south side of Gladstone Street between Donna Beth
and Azusa Avenues, known as Annexation District No. 46 of pro-
perty owned by Mrs, Violet Ott. The hearing was opened by
Mayor Ortuno.
?he City Clerk presented the Affidavit of Proof of Publication
of Notice of this public hearing, together with an analysis and
recommendation for said zone change by the Planning Commission,
conditioned upon the dedication of a 20 foot deep strip of
land fronting on Gladstone Street for street widening purposes.
Mr. John H. Ott, 5740 N. Oak, Temple City, appeared before
Council and spoke in favor of the requested zone change, stating
that it is agreeable to the applicants to the dedication of
said 20 foot strip for street purposes, upon annexation.
No written communication having been received, and no other
person in the audience wishing to speak on this matter, it was:

unanimously carried that the hearing be closed.

unanimously carried that the City Attorney be instructed to
prepare the necessary ordinance rezoning the Ott property to
C-2, effective upon annexation.

The hour of 7:30 P.M, being the time set for public hearing
on the proposed zone change from "R -lc" to "R-3" on property
at the northwest corner of 12th Street and San Gabriel
Avenue, owned by Harry H. Klinder, the hearing was opened
by Mayor Ortuno.
The City Clerk stated that a portion of this property was
sold to Mr. Klinder by the City, for which a check has been
received after the close of escrow.
The City has dedicated part of this property for widening of
12th Street. The City Clerk also presented the Affidavit of
Proof of Publication of Notice of Public Hearing, together
with an analysis and recommendation from.the Planning Commis-
sion for zone change as requested.
Mr. H. H. Klinder, 7246 N. Ben Lcm3nd, Glendora, appeared
p� before Council and stated he is the new owner of this property,
C'7 and submitted for Council's inspection the elevations of the
%• proposed apartment house proposed to be erected on this pro-
perty.

to consider an amendment to Article IX, Chapter 2 (The Zoning
Chapter) of the Municipal Code relating to provisions for a
Deep Lot Zone in "R -le" zoned areas of the City:
The City Clerk presented the Affidavit of Proof of Publication
of Notice of Public Hearing, together with a report and the
proposed amendment from the Planning Commission.
Mr. R. V. Ragan, 201 S. Vernon, appeared before Council to
speak in favor of rezoning these deep lots.
Mr. Julian Campa, 448 W. 3rd Street appeared before Council
in favor of this Deep Lot Amendment, except that he objects
to the clause that lots cannot be sold separately, but must
remain in one ownership, as he felt that at a future time he
might wish to sell the rear half of his lot.
Mr. Jens Solem, Chairman of the Planning Commission, residing
at 809 W. Paramount, appeared before Council, with a further
explanation of the proposed amendment to the Municipal Code
re: residential development in deep lot areas.
City Planner Barry Eaton presented a map, showing the original
house with 100! depth, with each sub -lot having a 50' depth,
which can only be connected by garages.
Mr. W. w. Kloepfer, 428 W. Duell, appeared before Council,
stating his deed restriction does not permit additional
dwelling on his lot, to which the City Attorney replied that
the City does not take any part in the deed restrictions.

Mr. W. T. Russell, 1445 S. Aspan, appeared before Council in

the house because of the large lot, which he has improved and
includes a swimming pool.

Mr. Robert Smith, 1235 N. Alameda Avenue appeared before
Council and asked for a delay to 2/4/63 for protest hearing
date on the variance, as the residents need more time to
prepare a presentation for Council.
'Moved by Councilman Memmesheimer, seconded by Councilman
Jackson that the hearing date for the protest on the variance
to Coral Investment Incorporated be set for February 4,
1963. Motion failed to carry by the following vote of

Mr. John J. Chapman, Attorney, appeared before Council as
a representative of Coral Investment, Incorporated in opposi-
tion to any delay in this matter and respectfully requested
that the hearing date remain as of 1/21/63. In answer to
the question of Chairman Jens Solem of the Planning Commis-
sion relative to the necessity of requesting another petition
Mr. Chapman stated he agrees that the petition rendered does
apply and will apply to this particular hearing, and he will
so submit it in evidence.

by Councilman Memmesheimer and unanimously carried that the
Council endorse the new Cerritos Avenue alignment through
Rainbow Country Club property, and authorize the City Engineer
to proceed with the preliminary study.
After further discussion, it was moved by Councilman Cooney,
seconded by Councilman McLees and unanimously carried that
Vernon Avenue north of Foothill Boulevard to 11th Street

by Councilman Cooney and unanimou:>ly carried that building per-
mits be granted to Mr. Kendall, assuming all other requirements
have been met, and that the City Engineer attempt to arrive
at a satisfactory agreement with Mr. Kendall regarding the
drainage problem.
'Mr. Kendall further stated there is a water line running
across his property, which line is owned by the Azusa Water
Company, and asked if the City would allow him to use this line
temporarily.
Mr. John Spradlin, 18809 Tudor, Covina, Superintendent on Mr.
Kendall's building project, appeared before Council and
mentioned the chargee quoted for hooking up to the City water
and the meter charge.

t'- extend the water line to the curb line of Mr. Kendall's
property, for hook-up to the City water system by said
developer.
The City Engineer submitted an additional request for City
participation in providing sewer service in the vicinity of
Arrow Highway and Cerritos Avenue by consideration of payment
by the City of approximate3y $5500.00 for the entire service
on the north side of Arrow nigh:•,ay with one crossing, instead
of $2100.00 for the tap fee alone. Mr. Lawrence also asked
if the $3.00 frontage charge should be applied to sponsors
of the reimbursement district and to future "Connectors".
After discussion, it was moved by Councilman Jackson, seconded
by Councilman McLees and unanimously carried that the City
pay approximately $5500.00 for the tap fee plus the cost of
sewer for 315' of frontage, and that the $3.00 frontage fee
not be charged to the sponsors but to future connectors.
A communication was received from the Chief of Police, request-
ing authorization of attendance at an all zones meeting of
the Chiefs of Police and Sheriffs, caller. by the Attorney
General, to be held at Fresno on February 7th and 8th, 1963,
with exper.ses to be paid by the City.
Moved by Councilman Mrmmesheimer, seconded by Councilman McLees
and unanimously carried that the Chief of Police be authorized
to attend the all zone:: meeting, with reimbursement of actual
expenses plus mileage.
A resolution was presented requesting the San Gabriel Valley
Municipal Water District to adopt a policy re: calling an
election for annexation to the Metropolitan Water District
and also requesting continuation of April 1, 1963 deadline
for said annexation.
