Mrs. Selma Duckat, 3341 Druid Lane, Los Alamitos, appeared before Council as a representative of the principals who propose to construct the Ice -Skating Rink, and spoke in favor of the zone change, and further outlined the proposed plan and drawings for the development. No written communications having been received and there being no person desiring to protest, it was: Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman McLees, seconded by Councilman Cooney and 'unanimously carried that the property as described be pre -zoned to "C-3", as recommended by the Planning Commission, with the understanding that a 10' depth along Arrow Highway be dedicated for street purposes as required'in'the best interest4 of the City. and that the City Attorney be directed to prepare the necessary Ordinance for this zone change upon annexation as recommended by the Planning Commission. Rink development, located on the north side of Arrow Highway, to C-3 for west of Azusa Avenue (Mrs. Selma Duckat, applicant), the part of hearing was declared opened by the Mayor. Annex.#47- Duckat The City Clerk presented the Affidavit of Proof of Publication of Notice of this public hearing, together with an analysis and recommendation by the Planning Commission that pre -zoning to C-3 upon annexation be granted to the property as requested. The City Clerk presented the Affidavit of Proof of Publication of Notice of this Public Hearing, together with a report of the City Planner on the application, a copy of the conditions imposed in the Variance by the Planning Commission and a revised Plot Plan of the proposed apartments which included the one and one-half to one parking ratio imposed by the Commis- sion, as a condition of the variance. Mr. John J. Chapman, attorney, who resides at 409 E. 11th Street, Azusa, appeared before Council as a representative of Coral Investment, Inc., and presented an artist's rendering of the pro- posed Garden Apartments, and explained various features of the construction. Mr. Chapman submitted a petition, which he stated containing approximately 1,296 signatures, and titled as follows: "We, the undersigned citizens, tax payers, residents, and Mbusinessmen and women of the City of Azusa, -strongly urge t'" approval by the official City Government of the presently �y proposed deluxe one story apartment to be located on the Cn south east side of Azusa Avenue, said development being' m proposed by Coral Investment, Inc. Among the many reasons that we urge approval of this development is that such a development as proposed would, without question, not only be a beautiful structure and accordingly a substantial asset to our City but in addi- tion would afford a marked amount of tax revenue for our City and at the same time constitute the type of deluxe apartment housing that would enhance the beauty of the City and be an upgrading development particularly in regard to 'the proposed location of the development." Mr. J. R. Watkins, 1325 N. Soldano, appeared before Council as spokesman for opponents to the variance and quoted Section 9231.26 of the Municipal Code, add stated that he desires that this variance be declared null and void. The following persons appeared before Council and spoke in opposition to the granting of the variance to permit the pro- posed development: Mr. George Dye 322 E. Montello Dr., Azusa Mr. Paul Risler 356 E. Montello Dr., Azusa Mr. Glen Hart 1219 N. Pasadena Ave., Azusa Mr. R. F. Kemple 1138 Alameda Ave., Azusa Mr. A. W. Belikow 323 E. Montello Dr., Azusa Mr. Robert Lloyd 1444 Nob Hill Dr., Azusa Mrs. Milla Boczar 1218 N Alameda Ave., Azusa Mr. Al Bellerue 1225 N. Dalton, Azusa Mr. F. Barthe 1122 N. Holmar, Azusa A petition, bearing approximately 364 names, was submitted by Mr. R. F. Kemple entitled: "The undersigned, all residents of the City of Azusa, take this opportunity to inform the Azusa City Council that we are unalterably opposed to the change in zoning concept as related to the property bounded by Azusa Avenue on the west, Sierra Madre Avenue on the north, and 13th Street on the south. A variance to allow non - single -family residential dwellings or apartment type dwellings to be constructed on this property is contrary to the Master Plan and is considered to be not in the Community's interests because it would destroy the single family dwelling atmosphere now established in.the area of North Azusa east of Azusa Avenue. Dalton, Azusa Mrs. Alene Carpenter 1240 N. Alameda, Azusa Moved by Councilman Memmesheimer, seconded by Councilman McLees and unanimously carried that the hearing be closed. Moved by'Councilman Jackson, seconded by Councilman Memmesheimer that the variance to construct one-story "Garden Apartments", requested by Coral Investment, Inc., be denied. Motion carried 0o by the following vote of Council: M AYES: Councilmen: Memmesheimer, Cooney, Jackson Ortuno NOES: Councilmen: McLees p� ABSENT: Councilmen: None m Mayor Ortuno further stated, in explanation of his vote on this subject, that he voted "Aye" in order to go along with the majority and not because he believed he voted correctly, as he still feels that the Planning Commission treated this to the utmost and that the variance should be granted for Garden Type of apartments. Brusnahan of the Public Works Department, stating that the records in this instance show that three hours were spent with two men, a truck, a loader and a scraper, for a total charge of $45.00 for cleaning Mr. West's los, which would indicate that sufficient supplemental work of undetermined nature was done to justify this charge. Supt. Brusnahan suggested that a photo and account of what caused any, extraordinary expense on a lot should be kept to justify the , charges, even though all lots are properly posted. Smith regarding the request of Southern California Calif.Edison Edison Co. to serve the City at 66,000 volts rather than the Co.serving 'Water 12,000 as now served, and a report of a meeting held on 1/29/63 City with with representatives of the Edison Co. and of the City. Supt. 66,000 volts Smith also submitted a copy of a letter from the Edison Co., (Bechtel confirming this request and estimating the cost to the City Corp.to for changing to 66,000 volts. The Edison Co. advised they submit desired to serve the City's sub -station at 66,000 volts by proposal June 1, 1964, and suggested they install at their expense all & survey) 66,000 volt equipment, excepting'for grading of the site and foundations which will be provided by the City at a location contiguous to the Azusa sub -station on the,north. Supt. After discussion, it was moved by Councilman McLees, seconded by Councilman Memmesheimer and unanimously carried that the recommendation of the Superintendent of Light & Water be 'approved, to have a complete survey made by Bechtel Corp: Discussion was held regarding the gentlemen's agreement between Glendora and Azusa with respect to the City boundary lines.
