The City Council of the City of Azusa met in regular session at the above time and place • Mayor Ortuno called the meeting to order. Call to Order Councilman Memmesheimer spoke,on behalf of the San Gabriel Council of the Boy Scouts of America, Monte Vista District, Boy Scouts as a representative of Judge William M, Martin, District in attnd, Chairman,' who was unable to appear, stating that the purpose ' of the Boy Scouts with the Council at this meeting is to show j the people what scouting does, and the interest of scouting in public affairs and in City Administration and operation generally. Councilman'Memmesheimer,also requested that a member of a scout troop will be permitted to act as a stand- t in for each of the Councilmen -and othe'r'.City Officials, and would be in attendance -for approximately -one hour. Minutes The hour of 7:30 P. M. being the time set for the continued Pub Hr , public hearing on a proposed amendment to Article IX, Chapter (Cont.jre: 2 (Zoning Chapter) of -the Municipal Code re: provisions Right -of - for protection of Right -of -Way on Mapped Highways, the Way on Map - hearing was declared opened by the Mayor. This hearing had ped Hwys. been continued from the February 4th meeting at the request of. the Planning Commission for study of a revised draft of the proposed amendment. The City Clerk read a communication from the Planning Commission, which stated that the City Attorney and Assistant City Attorney having together revised the Mapped Highways Amendment to their mutual satisfaction, this revised amendment had now been approved by the Planning Commission, and submitted for Council consideration. ' No written communications having been received and there being no person desiring to speak regarding the proposed amendment, it was Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the hearing be closed. The City Attorney made suggestions of a few minor editorial revisions which would not change the general nature of the concept of the proposed amendment. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that thg changes suggested by the 258 1 1 259 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 18, 1963 Page 2 City Attorney be approved, and incorporated in the proposed Ordinance to be drafted. The Personnel Board submitted a communication recommending Transfer of approval of the request of Mrs. Helen Rice, Clerk -Trainee, Helen Rice, for transfer to the Police Department from the Personnel Clerk - Office, together with the signed approval of the Chief of Trainee,to Police, Personnel Clerk and Chairman of the Personnel Police Dept. Board, in conformance with Civil Service Rules and approved Regulations. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimol.sly carried that the transfer of Mrs. Helen Rice, Clerk -Train,•, to the Police Department, as recommended by the Personnel-joard, be approved. The Personnel Board submitted the recommended classification of "Estimator - Light and Water Utility" for Council approval, under salary range 25. Moved by Councilman Memmesheimer, seconded by Councilman McLees and unanimously carried that this item be tabled until next'Council meeting for further study. Classif.of Estimator Light & Water Utility (Tabled to 3/4/63•) The Department Heads and the Personnel Board recommended Step step raises and/or placing upon permanent status for the Raises following employees: Evelyn Sullivan Secy-Steno,Fire Dept. to Step 2 effective (permanent) 3/26/63 Willie Cain Pump -Operator -Repairman 5 3/1/63 Merlyn Bauman Mechanics Helper 2 (permanent) 3/24/63 Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the step raises as sub- mitted be approved. A communication was received from the Personnel Board, requesting that oral interviews for the position of City Administrator, scheduled for 3/11/63, be postponed at least one week, to allow time for the notice of interview to be received by the many applicants residing out of town or out of State. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the date for oral inter- views of applicants for the position of City Administrator be postponed until Tuesday, March 19, 1963. The Personnel Board recommended an amendment to the Rules and Regulations re: medical examinations, due to the fact that employees are now required to pass a medical examination prior to piobationary appointment. This amendment would delete the last two sentences under Rule X. Sec. 77 Page 22), headed "ObJective of Probationary Period", namely: "New employees of the Police Dept. will be required to pass a medical examination during their probation- ary period. The requirements of this medical examination are stated in the classification speci- fications for Patrolman." Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the recommendation of the Personnel Board be accepted. Date for oral inter- views re. Board was submitted to Council. Mthly.Report Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that this report be filed. The Treasurer's Financial Statement was submitted to Council Treas.Finan showing total Bank Balances as of January 31, 1963, as Statement '$499,459.66. Moved by Councilman Memmesheimer, seconded by Councilman McLees & unanimously carried that the financial statement be filed. A report was submitted by the Chief of Police, as requested Report by by Council at its last meeting, arising from a communication Chief of from the Lee School P.T.A. which requested a crossing guard Police to at 5th Street and Cerritos Avenue. This report, addressed City Engr. to the City Engineer, requested that a traffic count survey re: Crossing X be conducted at the intersection of 5th & Pasadena Ave., to Guard at 11v determine if a traffic signal is warranted at that location, Cerritos & ;y as stating that the installation of an electric signal at 5th Sts. C: --5th and Pasadena would enable a crossing guard to be moved CO to the Cerritos and 5th Street location. The Council was informed by the City Clerk that as soon as the City Engineer has made his traffic count survey, the report and recommenda- tion relative to the traffic signal will be submitted to Council. Moved by Councilman McLees, seconded by Councilman Memmesheimer and unanimously carried that this report be filed. The hour of 8:00 P.M. being the time set for Protest Hearing Protest Hrg. on the proposed annexation to the City of certain uninhabit- re:So.Annex. ' ed territory owned by Violet MOtt t et al., and designated as "Southerly Annexation Dist. #46 District #46", the hearing was (V. Ott) opened by the Mayor. The City Clerk presented the Affidavits of Proof of Publication of Resolution No. 4430, setting this date and time for the hearing of protest on this proposed annexation. There being no protests, either in writing or from any affected property owner in the audience, it was Moved by Councilman McLees, seconded by Councilman Memmesheimer and unanimously carried that the hearing be closed. A Resolution was presented declaring that a majority protest Res.4444 has not been made against the proposed Southerly Annexation declar. no District No. 46. maj.protest against Councilman Memmesheimer offered the following Resolution So.Annex entitled: #46 (V. TION DISTRICT NO. 46 TO THE CITY OF AZUSA. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that further reading be waived. A communication was received from the Park & Recreation Commission, recommending the full improvement of Dalton Ave., in front of Pioneer Park, to Sierra Madre Avenue, including all improvements.necessary to complete Dalton Avenue as a fully improved 60 foot street. The communication also referred to Resolution No. 309 of the Planning Commission which was.presented to the Commission and pertained to the improvement of Dalton Avenue in front of Pioneer Park. Mr Robert Kesler, 1217 N. Soldano, appeared before Council with the request that Dalton Avenue be closed off until Council decides to improve it, or remove the unmarked hump on this street which is hazardous to cars traveling over this road; Mr. Kesler also suggested that flashing lights be placed as a warning of the hump, or that some markings be put on the street. Motion passed by the following vote of Council: AYES: Councilmen: Cooney, Jackson, McLees, Ortuno NOES: Councilmen: Memmesheimer ABSENT: Councilmen: None There was a discussion regarding the opening of Alameda Discussion Avenue to Sierra Madre Avenue if that area should be re: opening developed, in which it was agreed by Council that any of Alameda plans of a street design should be presented to the Ave. to Council for their information and study. No action taken Sierra Madre on this subject., Ave. Notice was given that the Planning Commission, by Resolution Res. 309 - No. 309, recommended the widening and improvement of Dalton re: lmprvg. Avenue infront of Pioneer Park. The Planning Commission Dalton Ave. also submitted a request that Council authorize expenditure in front of of funds, for this improvement, if such funds have been Pioneer Pk. allocated in the present year's budget. ' CITY HALL AZUSA, CALIFORNIA 265 MONDAY, FEBRUARY 18, 1963 Page 5 The Boy Scouts of the San Gabriel Council, -Monte Vista District, left the meeting at 8:30 P.M. Mayor Ortuno thanks the boys for taking part in this civic program and express the hope that they might visit the Council meeting again, bringing their parents with them. The spokesman for the troop body said they would like to come to the first Council meeting in April. Notice was also given that the Planning Commission, by Res- olution No. 308, recommended "C-3" zoning upon annexation of additional area included in Annexation #47, owned by Robert Taylor, et al., said property located on Arrow Highway, west of Azusa Avenue; hearing before Council is to be set for 3/4/63. The monthly report of the Planning Commission for January was submitted to Council. Moved by Councilman McLees, seconded by Councilman Cooney M and unanimously carried that this report be filed. Fire Chief Madison submitted the resignation of Fireman m John Bokenko effective 2/23/63, and requested authorization to fill the vacancy from the present eligibility list, as soon as possible. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the rebignation of Fireman John Bokenko be accepted. Moved by Councilman Memmesheimbr, seconded by Councilman Cooney and unanimously carried that the request for filling the vacancy -of Fireman be granted. The annual report of the Fire Department for 1962 was submitted to Council. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that this report be filed. The City Engineer presented an Amendment of Grant of Easement from Emil H. Kreidt (predecessor in interest of Harry H. Klinder and Carolyn M. Klinder, as owner of the property, to the City, for acceptance and recordation. The owner wishes to build over an existing sewer easement over land at -the northwest corner of San Gabriel Avenue and 12th Street, and under the terms of the amendment to this easement, the owner will bear the responsibility of upkeep but allow the City to make Any excavations, repairs and . maintenance as necessary. Moved by Councilman Memmesheimer, seconded by Councilman McLees and unanimously carried that the Mayor be author- ized to sign this Amendment to Grant of Easement and that the same be recorded. The City Engineer requested acceptance by Resolution of Final Map and Title Sheet for Tract 27346, to be developed by John R. McCruden, et al., consisting of 39 lots, upon each of which four unit apartment buildings will be con- structed. In order to provide sewer service to this tract, about 1350 feet of offsite extension is necessary, of which approximately 950 lineal feet would be installed by the City at an estimated cost of $7500. The City Engineer sub- mitted three alternatives for this commitment: 1. Accept the obligation to install the 950' of offsite sewer, making transfers as necessary to make funds available. Require the developer to install the offsite at his cost, later to be reimbursed the $7500 as funds become available. 3. Require the developer to install the offsite sewer, at his sole cost, without reimbursement. The City Attorney explained that the funds must be encumbered now as the City incurs the debt this year, and the connection ' fee to the entire area must be set up, and as the fees are collected, pay the subdivider. After discussion, it was moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that the City Engineer and the City Attorney study the matter to decide the best method of handling the expense of the sewer connection fee. Moved by Councilman Cooney, seconded by Councilman Memmesheimer' 00 and unanimously carried that a transfer of $7500 be made from M the Light Fund to the General Fund to encumber the obligation Lt'" of installing the offsite sewer. The City Engineer requested confirmation by Council of the Storm Damage course of action to be taken re: storm damage to sidewalks to sidewalks within Tracts 26013 and 26356. in Tracts After discussion, it was moved by Councilman Memmesheimer, 26013 and26356 seconded by Councilman McLees and unanimously carried that this matter be referred to the City Attorney and City Engineer for further study and report. The City Engineer submitted a sketch, showing a lot split Re: Water which divides a parcel of a recorded record of survey into Main two parts, located at Newburgh Street and Donna Beth Avenue, Installation owned by Mr. W. V. Hales, requesting consideration of on Lot Split domestic water service as to whether or not the developer at Newburgh should install a water main across his frontage. City-'" St & Donna ' Engineer Lawrence submitted three alternatives: Beth Ave. 1. Require no water main installation, allowing west parcel to be served by the City, east parcel to be served by Azusa Valley Water Co. 2. Require 6" main across 420' frontage, with a cost of approximately $2,000 for the 6" main. 3. Require 8" main across 420' frontage, with the City to pay cost difference between 6" and 8" main (cost of 8' main approximately $2,500, with City CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 18, 1963 cost estimated at $500.00. Mr. W. V. Hales, of Hales Realty, 25039 Narbonne Avenue, Lomita, California, appeared before Council, asking that 170' of his property be split. Mr. Hales stated the parcel has been sold and he needs a building permit and therefore has to know Council's wishes regarding installation of a water main, as City water service is available on the west. ' side of this parcel and Azusa Valley Water Co. service is available on the east side. After discussion, it was moved by Councilman Jackson, seconded by Councilman Memmesheimer that the City Engineer's Alternate No. 3 be accepted, which requires an 8" main across the 420' frontage, with the City to pay the cost difference between a 6" and an 8" main, estimated at $500. Motion carried by the following vote of Council: 00 AYES: Councilmen: Memmesheimer, Cooney, Jackson, Ortuno NOES: Councilmen: McLees ABSENT: Councilmen: None mIt was pointed out by Council that a bond or cash deposit is required for the cost of the 6" main, which is approx- imately $2,000; also that any builder, large or small, should definitely be advised regarding the obligation to tie in with the City water system. 1 Mr. Dwight Kendall, developer of the trailer park on Glad- stone Street at Enid Avenue, appeared before Council relating to the use of Azusa Valley Water Company service at his trailer park. Mr. Kendall asked permission to immediately hook on to the existing water line across the property without cost to anyone. After discussion, it was moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried to rescind the action taken by the Council at the January 7, 1963, meeting. It was also moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that permission be granted Mr. Kendall to obtain water service from the Azusa Valley Water Co. upon the presentation by Mr. Kendall of a letter to the City, stating that in consideration for this consent, that when, and if, City water is available adja- cent to Mr. Kendall's property on his side of the street, he will connect and pay the usual charges of the City for meter and connection fees. There was a discussion regarding the City's policy for future developments. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the Mayor appoint a Committee to study determination of duties and designation of authorities re: City Planner, City Engineer and Superintendent of Light & Water. Mayor Ortuno appointed Councilman McLees (Chairman of the Commission for Light & Water Department) and Councilman Cooney (Chairman of Finance Department), as members of said Committee. Superintendent of Light & Water Smith submitted a proposal from Bechtel Corporation for performing engineering services in connection with the -proposed So. California Edison Co.'s 66KV Sub -Station, including the possible serving of all , 259 Page 7 Dwight Kendall granted permission to use service of Azusa Vall. Water Co. Committee appt'd to study determ. of duties & desig.of auth. re: City Planner, City L &r. & Supt. Proposal from Bechtel Corp.re:prop So.Cal.Edsn. 66KV Sub- O C4 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 18, 1963 customers within the present corporate limits of the City, for a cost to the City of $12,,800. After discussion, it was the opinion of the Council that another meeting should be held with the Edison Co. and the Committee appointed to study this situation. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that this matter be tabled until the next Council meeting and that the Committee meet and report additional information to Council. A report was submitted by the Building Inspector re: Sub- standard Structure Case No. 75, property at 1038 N. Sunset, owned by George Taussig. The report reads that Building Inspector Whisler had asked Mr. Taussig to furnish the City with a satisfactory program for either redevelopment or demolition of the premises and was informed in reply that they agreed to this procedure and would reply with a proposal for rehabilitation. Matson, Used Cars, for permission to hold a public. automobile auction on March 2, 1963, at 1:00 P.M., at their place of business, 1169 W. Gladstone Street, by Gail Adams, auctioneer, with a further request for a "rain check" in case'of inclement weather. Moved by Councilman Cooney, seconded by Councilman Memme- sheimer and unanimously carried that the request be granted to hold this auction on March 2nd, but no "rain -check" will be given unless no auction is held. A request was received from the First Baptist Church of Azusa to use'a house trailer as the custodian's residence on the church property at 423 N. Azusa Ave. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the'request be denied on the grounds that a permit cannot be legally issued to park a house trailer on'any land within the,City for residential purposes. A communication was received from Assets Reconstruction Corp., Ltd., requesting pro -ration of sewer connection charges be considered for one of their,buyers, who is purchasing some property to build a factory building on the east end of First Street in Tract 8507 in Azusa. Moved by Councilman Cooney, seconded by Councilman Memme- sheimer and unanimously carried that the request be denied. Moved by Councilman Cooney; seconded by Councilman McLees and unanimously carried that the request -be granted to initiate pre -zoning of this property and to include the additibnal•adjoining property depending upon necessary . valuations. A communication was received from Standard Accident Insurance Company re: claim of Geraldine Kinsey for injury received on 9/25/62, which claim had been forwarded to the'City's insurance agent, Clyde Blanchard & Associates, in compliance with Council's request. This letter informed Council that a formal denial of this claim may be sent to the law firm of McAlpin & Anderson,•in Covina, and thereupon Standard Accident Insurance Company will take over and handle the claim. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the claim of Geraldine Kinsey be denied and that a copy of a letter stating Council's'deftiAl of the claim be sent to the insurance carrier, and attorneys as requested. The City Clerk submitted the Departmental Monthly Reports. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that these reports be filed.
