The City Council of the City of Azusa met in sgular session at
the above time and place.
Mayor Ortuno called the meeting to order and led in the salute Call to

The hour of 7:30 P.M. being the time set for a public hearing
on the proposed zone change upon annexation -to Zone "C-3", for
that 'portion of Southerly Annexation District #4'j, located on
Cr the north side of Arrow Highway (being 2 parcels) with a front-
age of approximately 155 feet from a point 150 feet to the

The City Clerk presented tha Affidavit of Proof of Publication
of Notice of this public hearing, together with an analysis
and recommendation by the Planning Commission that property
be zoned "C-3" upon annexation.
No written communication having been -received and no one in the
audience wishing to speak on this matter, it was moved by
'Councilman Gooney, seconded by Councilman Memmesheimer and
unanimously carried that this hearing,'be closed.
Moved by Councilman Cooney, seconded by Councilman McLees and
unanimously carried that the zone change to "C-3" upon annexation
be approved and that the City Attorney prepare the necessary
Ordinance. '
A recommendation was received from'the Park and Recreation P&R recom.
Commission for the construction of an bff-street parking lot for constr.
at Pioneer Park, in accordance with the Master Park Plan, of off

Notice was given that the Planning Commi;sslon, by Resolution
No. 310, recommended approval of Zone. Change from "R -lb" to
"R-3" for property located at 1325 N. Azusa Avenue, between
Azusa and San Qabriel Avenues, south of Sierra Madre Ave.,,
owned by Perry H. Freeman; public hearing before Council
has been set for 3/18/63.
Notice was also given that the Planning Commission, by
Resolution No. 311, denied request of Carmen Mosqueda fore
variance for grocery stoke in "R-3",zone at 319 N. Soldana
Avenue, An appeal to the denial of variance having been
received, the public hearing before Council has been
set for March 18, 1963.

Notice was also given that the Planning Commission, by Res. 313 -
Resolution No. 313, denied the request of Rodeffer denying zone
Industries, Inc., for a zone change:from "W" to "M-2" on change from
a 33 -acre portion of the Azusa Spreading Grounds, north "W" to "M-2"
of the American Cyanamid plant.
Notice was further given that the Planning Commission, by
Resolution No. 314, denied the request of Rodeffer Indus-
tries, Inc., for, a Conditional Use Permit for rock -process -
Going operations in the proposed "M-2" zone on the 33-aore
portion of the Azusa Spreading Grounds north of the
Gi. American Cyanamid plant.
m Notice was also given that the Planning Commission, by
Resolution No. .315, initiated prezoning proceedings for
proposed Annexation No. 48, property located at the N.W.
corner of Azusa Avenue and Arrow Highway, owned by R.
Taylor.
Moved by Councilman Cooney, seconded by Councilman
Memmesheimer and unanimously carried that the legal
description for proposed Southerly Annexation #48 be
forwarded to the Boundary Commission.
'Notice was further given that the Planning Commission, by
Resolution No. 316, initiated proceedings for proposed
Annexation No. 49, of property located at the S. W. corner
of Gladstone Street and Vincent Avenue.
Moved by Councilman McLees, seconded by Councilman Cooney
and unanimously carried that the legal description for
proposed Southerly Annexation #49 be forwarded to the
Boundary "Commission.
A report was submitted by the City Engineer that the
Los Angeles County Sanitation District has requested
permission to establish a cesspool pumper dumping manhole
in the sewage treatment plant on First Street west of
Virginia Avenue.
City Engineer Lawrence informed Council that, if approved,
this would be the only dumping center outside of Whittier
Narrows, and therefore there would be considerable traffic.
Moved by Councilman Jackson, seconded by Councilman McLees
and unanimously carried that permission be denied.
The City Engineer submitted a request for the adoption of
a Resolution requesting the Los Angeles County Sanitation
District reserve funds in the 1963 budget for extension cC
an adequate sewer from present terminus north of Arrow
Highway to First Street in Azusa.
Councilman McLees offered the following Resolution entitled:

City Clerk Miller stated that an easement has been requested
t.. from, but never signed by the Corps of Engineers. However,
Gz, Mr. Fred Heyden had stated he had received permission from the
Corps to use the land along the levee on the west side of the
River for road purposes, and he was creating a hauling road-
way for use by the gravel and rock trucks on this property.
Mr. Don Kehler, 3321 Fish Canyon Road, Duarte, appeared
before Council, as a representative of Duarte residents in
the audience, and requested the enforcement of Resolution
No. 3546, adopted by the City of Azusa in 1956. Mr. Kehler
also stated that any violation of this Resolution would be
cause for the revoking of the Conditional•Use Permit.
'Mr. Fred Heyden, of 422 So. Orange Grove, Pasadena, appeared
before Council, and stated that he contracts for the trucks
through a truck broker and that loading and hauling never
started before 6:30 A.M.; also, there has never been an attempt
to use the river -bed road except under two emergencies, one
of which was for thousands of tons of large rook needed for
repairs to Harbor damage at Redondo Beach, due to.the recent
storm.
William H. Lancaster, Mayor of Duarte, appeared before Council
and stated he was not aware of an emergency and that Duarte
Council is concerned because they cannot stop operation of
trucks on the City streets.
Mr. Heyden had asked Duarte for aid in getting permission
to use the roadway,now paved, constructed in the river -bed.
Mayor Ortuno asked if the Council wished to join in the
request to the Corps of Engineers, allowing the use of the
San Gabriel River bed road, adding support to the requests
of the City of Duarte and of Mr. Hayden.
Moved by Councilman Memmesheimer, seconded by Councilman
Cooney and unanimously carried that the City request permis-
sion from the Corps of Engineers to use the road formerly
' used in the construction of Flood Control Project completed
in the San Gabriel River bed.
Mayor Ortuno presented a letter from the Duarte Development
Committee of the Duarte Chamber of Commerce, asking for the
Mayor's support and permission to use his name.on a letter-
head stating "Citizens Supporting Development of the Santa
Fe Dam Recreation Area". This Committee has been formed
for "renewed" interest in development of a public County
golf course and recreation area within the Santa Fe Dam,:
located in the San Gabriel Valley.
Mayor Ortuno stated that for sometime the City had hoped
that the County would help with a golf course in the Spreading
Duarte Ch.

Grounds; however, there would still be need r several
golf courses in the area, and,this Santa Fa Dam area would
not hurt the City!s plans. He also said they may start
developing this area for recreational needs other than a
golf course.
Moved by Councilman Memmesheimer, seconded by Councilman
'Cooney and unanimously carried that the Mayor be permitted
to use his discretion in support of this project.
Mayor Ortuno stated he will personally endorse this
development.

The proposal from Bechtel Corp. for performing engineering
services in connection with the proposed So. California
Edison Company's 661CV Sub -station, including the possible
serving of all customers within the present corporate
limits of the City, at a cost to the City of $12,800, was
tabled from the 2/18/63 meeting.
Moved by Councilman Cooney, seconded by Councilman McLees
and unanimously carried that this item be lifted from the
table.
With further reference to this item, a letter from So.
California Edison Co., containing its engineering recom-
mendations, was submitted to Council, together with a
recommendation from Supt. of Light & Water Smith.
The Edison Co. estimates that the cost of Foundations,
aving and sub -surface structures would be approximately
$p 15,000, and $20000 for the grading work, plus $4,500 for
the grounding bank, making a total of $21,500 to be paid
by the City.

After discussion, it was moved by Councilman McLees, seconded
by Councilman Cooney that the recommendation and proposal of
the Edison Co. be accepted.

Councilman Memmesheimer and Jackson stated they voted "No" on
the above motion because they felt that the.Edison Co. should
absorb the cost.
Moved by Councilman Memmesheimer, seconded by Councilman
Jackson that the Council consider further the proposals as
submitted by Bechtel Corp. and what possible data is to be
furnished by the City, with any revision and information
pertinent to the studies to be made, as set forth in the
proposal by Bechtel.

Supt. of Light & Water Smith submitted, for :juneil's
approval, a letter granting permission to Southern Calif-
ornia Edison Co. to serve electrical energy'to property
located at 414, 406 and 400 Grantland Drive; 990 Gaillard
St:; 409, 415 and 419 Fairvale Ave., all in Tract 27825,
City of Azusa.

Council to approve the classification of Estimator, Light & classif. of
Water Utility, as such estimator is needed in order to Estimator -
fulfill the Joint Pole Agreement. No action taken on this L.&W. Util.
letter.
The Personnel Board submitted the recommended classification
of "Estimator - Light & Water Utility" for Council approval,
under Range 25, tabled from 2/18/63 Council meeting.
Moved by Councilman Cooney, seconded'by Councilman McLees
and unanimously carried that this item be -lifted from the
table.
Moved by Councilman Memmesheimer, seconded by Councilman
Jackson and unanimously carried that the classification of
"Estimator - Light & Water Utility" be approved, and that
the Personnel Board establish an eligibility list for this
classification.
Supt. of Public Works Brusnahan submitted a written request
' for clarification and authorization to employ highly trained
personnel on a very limited basis, as needed. Supt.
Brusnahan also stated that several times in past years
Council has authorized the employment of journeymen union
workers at union scale on a temporary basis, to perform
necessary special skilled jobs, and it was his Department's
impression that this was a general authorization to provide
for unusual circumstances and subject to budget limitations.
Moved by Councilman Jackson, seconded by Councilman
Memmesheimer that the Supt. of Public Works be authorized
to employ trained personnel, temporarily as needed under
unusual circumstances for two weeks limited period at
union scale.

Mayor Ortuno submitted to Council a letter of resignation
from Ellen Maroahek, probationary Secretary -Steno in the
Administration Department, effective 3/8/63.

' The City Clerk presented a request from Peter Samoian for Relocation
permission to relocate a house from 1618 Santo Domingo, to 135 N.
Duarte, to 135 N. Azusa Ave. The City Clerk read the Azusa Ave.
particulars of the application for relocation building P.Samoian
permit and submitted a photograph of the building to Council (denied)
for examination.
Mr. Peter Samoian, the applicant, appeared before Council,
and stated he is a real estate broker and he intends to use
the upper part of the building for his office. Mr. Samolan
also stated there is a 2 -car garage underneath the apartment
which has 602 square feet of living space!, and that the build-
ing is 5 or 6 years old.

After discussion, it was moved by Couneilma, Aemmesheimer,
seconded by Councilman Cooney and unanimo:.z.Ly carried that
the relocation permit be denied, as the square footage of
the building is less that the amount required for a single
building which must have at least 1,000 square feet.
A communication was received from B. L. Felix, 330 So.
' Vernon Ave., asking for clarification of sewer connection
fee on his property which he purchased in 1953, then sold
the same in 1955, holding a second mortgage on it, and two
years later had to repossess the property, and pay off the
taxes and the first mortgage.
Moved by Councilman Memmosheimer, seconded by Councilman
Jackson and unanimously carried that, under the City's
policy, exemption of a sewer connection fee would not
apply in this case, as continuous ownership of the prop-
erty has not been maintained since 1954, and that the
owner be so notified.
The City Clerk -notified Council that the contract for gas-
oline for City vehicles expired on February 28, 1963, and
that an, extension of the agreement with Richfield 011
Corp, to supply the City with gasoline through 4/15/63
is acceptable by the Company. The City Clerk requested
authorization to advertise for next year's supply of
gasoline, if desired by Council.

and unanimously carried that the extension of agreement with
Richfield 011 Corp. to supply the City with gasoline
through 4/15/63 be signed.
Moved by Councilman McLees, seconded by Councilman Jackson
and unanimously carried that the City Clerk be authorized
to advertise for next year's supply of gasoline, with bids
to be opened on 3/29/63 at 10:00 A.M.
A communication was received from the Valleydale School
P.T.A. protesting weeds and othe:conditions of property
on Lark Ellen Blvd. across from the school; the owner of
the property has been contacted re: clean-up.

Memmeshbimer and unanimously carried that the Supt. of
Public Works proceed under the Weed Abatement program.
A communication was received from E. N. Theiss of Edgewood
Furniture Co-, 750 W. Foothill Blvd., requesting permission
to conduct a going -out -of -business sale at the earliest
possible date, to be handled by the present management.

A communication was received from the Retarded Children's
Association of San Gabriel Valley, requesting solicitors
permit to contact local business firms re: sale of.advertis-
ing for their fund-raising drive in the form of a Fashion
Show at Bullock's in Pasadena, on May 23, 1963. ,

A communication was received from Faith, Weiss and Holland,
attorneys for Mrs. Margaret Fountain of 335 E. Foothill Blvd.,
requesting action on this formal complaint by Mrs.Fountain
against Baker's Tacos, against Neal Baker, owner of the
franchise of Baker's Tacos, and against Henry Comstock,
the present manager. Mrs. Fountain lives next door to
Baker's Tacos, and her complaints include constant harass-
ment of unusually loud noises and racket over a length
period of time, trash thrown on her property, fights on a
number of occasions, plus various other undesirable activities
until midnight or later.

After discussion, it was moved by Councilman Cooney, seconded
by Councilman Jackson and unanimously carried that this matter
be referred to the Police Department for recommendation,
requesting a report of any improvement or if steps should be
taken for terminating the business license.
A communication was received from W. A. Baxley, president
of the Azusa Junior Chamber of Commerce, requesting Council's
endorsement of a "Seat Belt Clinic" on April 6th and 20,
1963, which will install free, as a public service, seat
belts in every car in the Azusa area. The Junior Chamber
of Commerce also request permission to display a banner,
with assistance from the City, approximately 150 feet east
of Azusa Avenue on Foothill Blvd.
Moved by Councilman Memmesheimer, seconded by Councilman
McLees` and unanimously carried that permission be granted
to the Azusa Junior Chamber of Commerce to hold a "Seat
' Belt Clinic" from April 6th to 20th, and that the Light
Department be instructed to assist in the hanging of the
banner, which project is endorsed by Council.
Notice was received from the Department of Alcoholic
Beverage Control of an application for off -sale beer and
wine license by Eloise E. T. Spiegel (La Tienda - 300
Dalton Ave.).
