The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Mayor Rocha called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: GONZALES, MACIAS, ALVAREZ, ROCHA ABSENT: COUNCILMEMBERS: CARRILLO ALSO PRESENT Elected Officials: City Clerk Cornejo. Staff Members: City Manager Gonzalez, City Attorney Martinez, Chief of Police Bertelsen, Neighborhood Services Coordinator Quiroz, and Chief Deputy City Clerk Garcia. PUBLIC COMMENT None given. CLOSED SESSION The City Council recessed to closed session at 6:30 P.M. to discuss the following: 1. CONFERENCE WITH LEGAL COUNSEL – SIGNIFICANT EXPOSURE TO LITIGATION - Pursuant to California Government Code, Section 54956.9(d)(2)(e)(1). One Potential Case REGULAR SESSION Mayor Rocha called the meeting to order at 7:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT Elected Officials: City Clerk Cornejo. Staff Members: City Manager Gonzalez, City Attorney Martinez, Chief of Police Bertelsen, Director of Economic and Community Development Marquez, Director of Community Resources Carpenter, Director of Utilities Robledo, Director of Public Works/City Engineer Delgadillo, Director of Information Technology and Library Services Graf, Police Captain Grant, Planning Manager Munoz, Building Official Meyers, Assistant Planner Flores, Police Lieutenant Sandoval, Police Lieutenant Avila, Police Sergeant Parra, Police Corporal Spahr, Police Corporal Ferrari, Police Corporal Landa, Neighborhood Services Coordinator Quiroz, and Chief Deputy City Clerk Garcia. The Pledge of Allegiance was led by Mr. Joe Perez. The invocation was given by Pastor Dale Winslow, Foothill Community Church. CLOSED SESSION REPORT The City Council reconvened at 7:30 P.M.; City Attorney Martinez announced the following regarding Closed Session: Item 1 – All members were present with the exception of Councilmember Carrillo, City Council heard a presentation from Staff and legal counsel, no further reportable action. CEREMONIAL 1. The following Police Officers were sworn into office: Lieutenant Tommy Avila, Sergeant Bertha Parra, Corporal Steve Spahr, Corporal Lauren Ferrari, and Corporal Jesse Landa. 2. The Canyon City Foundation presented the Volunteer of the Year awards. PUBLIC COMMENT Mr. Meshal Kashifalghita introduced himself to state that he is running for the U.S. House of Representatives. Ms. Jule Arevalo addressed the Council to express concerns about Councilmember Gonzales; stated that she had previously met with City Manager Gonzalez and former Chief of Police Hunt, regarding her allegations; and stated that she would provide documentation, in support of her allegations, to City Staff. *No documents were provided. Ms. Vivian Alderete, Azusa Woman’s Club President, addressed the Council to state that the General Federation of Women’s Clubs along with the Azusa Woman’s Club do not condone bullying in any form; she also announced that their venue is being provided for a candidate’s forum; and expressed her wishes that the City and Azusa Woman’s Club can work together. Mr. Greg Benton, Canyon City Church, requested that the City Council consider drafting and enacting a rent control ordinance; stated that rent control ordinances enacted by the County do not impact the City; and provided information about rent increases in Azusa. Mr. Jorge V. Rosales commented on Item E-5 regarding Pension Obligation Bonds, commended Staff for the negotiation of the bonds and making an effort to save the City money; he expressed his full support of Measure Z which would keep the generated revenue within the City; and encouraged everyone to vote yes on Measure Z. Ms. Teresa Wilson expressed concerns regarding an increase in development of the mountain and canyon; and stated the need to keep the canyon clean. Mayor Rocha provided information about the canyon clean-up events and how to participate. City Manager Gonzalez responded to public comments stating that anyone having issues with rent control can contact the Community Development Department for information on how to access the Housing Rights Center’s resources. REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL 1. Presentation on L.A. County’s new voting system, Voting Solutions for All People (VSAP). Mr. Phil Verbera, Los Angeles County Registrar-Recorder Office representative, provided information about the new voting system. Chief Deputy City Clerk Garcia added that voting centers will be located at the Azusa Woman’s Club, Memorial Park, and Valleydale Park. Voting in the City of Azusa will take place from February 29 – March 3. Mr. Verbera stated that Los Angeles County takes an estimated 3-4 weeks to fully tally the results of the election; there are 5.4 million voters in Los Angeles County; voters are able to vote on their home ballot at any voting center within the County; and local contests will be placed at the beginning of the ballot with the presidential primary at the end of the ballot. Mayor Pro-Tem Alvarez congratulated the officers that were sworn in; congratulated the volunteers that were honored; wished everyone safe travels during the President’s Day weekend; and stated that he would like to see the Woman’s Club thrive. Councilmember Macias congratulated the police officers on their new positions; congratulated the volunteers that were honored; expressed his appreciation of Mr. Kashifalghita being in attendance, expressed his concerns regarding the cost of the State of the City event as it was not budgeted and expressed his desire for it to be brought before the Council for consideration. Councilmember Gonzales announced the annual Casino Night on February 21 at the VFW Post 180, proceeds will benefit youth sports programs. PAGE TWO – 2/3/2020 Councilmember Carrillo congratulated the police officers on their promotions; congratulated the volunteers that were recognized; and announced that sign-ups for the Azusa National Little League are taking place at Memorial Park. Mayor Rocha announced that the meeting would be adjourned in memory of Mrs. Nellie Valdivieso, lifelong Azusa resident; congratulated the police officers on their promotions; congratulated the volunteers that were recognized; announced that Ms. Linda Kaminski, Azusa Unified School District Superintendent, and Ms. Xinolin Cruz-Gonzalez, CSBA President, will be honored by Assemblywoman Blanca Rubio for making a change in education; thanked the volunteers that assisted with helping an elderly gentlemen clean-up his yard; announced the Azusa Community Resource Fair on February 8; and asked that everyone keep the service men and women in their daily prayers. SCHEDULED ITEMS PUBLIC HEARING – INTRODUCE FIRST READING OF DRAFT ORDINANCE FOR CODE AMENDMENT NO. 246 – CODE CLEANUP FOR CHAPTER 88 OF THE AZUSA MUNICIPAL CODE (DEVELOPMENT CODE) Planning Manager Munoz presented the Item stating that the Proposed Ordinance for Code Amendment No. 246 is a code cleanup for Chapter 88 of the Azusa Municipal Code which is also known as the Development Code; Land Use Policy 12.1 of the General Plan and Chapter 88.51 of the Development Code allow City Staff to annually review the Development Code to ensure consistency; and an overview of the proposed Code Cleanup was provided. It was noted that Page 2, Article 2 of the Staff Report should read Exhibit A, not Exhibit C. Mayor Rocha declared the hearing open. City Clerk Cornejo read the affidavit of proof of publication published on January 24, 2020, in the San Gabriel Valley Tribune. Public Comment None. Moved by Councilmember Gonzales, seconded by Mayor Pro-Tem Alvarez and carried by unanimous vote of the Council to close the Public Hearing. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE Councilmember Macias offered Ordinance No. 2002-02 entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA APPROVING CODE AMENDMENT NO. 246 TO AMEND VARIOUS SECTIONS OF CHAPTER 88 OF THE AZUSA MUNICIPAL CODE (DEVELOPMENT CODE) Moved by Councilmember Macias, seconded by Councilmember Gonzales, and carried by unanimous vote of the Council to find the requested project exempt from the California Environmental Quality Act (CEQA); and waive further reading, read by title only and introduce Ordinance No. 2020-02. Resolution No. 2020-C04 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The Human Resources Action Items, in accordance with the City of Azusa Civil Service Rules Section 5.75 and applicable Memorandum of Understanding(s), were approved as follows: Merit Increase and/or Regular Appointment: K. An expenditure in the amount of $200 to the Azusa High School JROTC was approved to fund educational trips to historical sites around Los Angeles and to purchase new color guard equipment for use when they represent the City of Azusa at various functions; and a finding was made that the community at large will receive a public benefit from the expenditure of funds. 5. Staff was authorized to engage services with BofA Securities to serve as an Underwriter for financing of the City’s proposed Table Pension Obligation Bonds. 6. The City Manager was approved and authorized to sign the First Amendment to Memorandum of Understanding with the Azusa Unified School District for the use of the Civic Auditorium for the purpose of recording and broadcasting on the City’s PEG-TV Channel a limited amount of Board of Education meetings. SECOND READING ORDINANCES SECOND READING OF ORDINANCE AMENDING CHAPTER 14 OF THE AZUSA MUNICIPAL CODE ADDING ARTICLE XVIII, CONSTRUCTION AND DEMOLITION WASTE RECYCLING AND DIVERSION Councilmember Gonzales offered Ordinance No. 2020-01 entitled: ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING CHAPTER 14 OF THE CITY OF AZUSA MUNICIPAL CODE, ADDING ARTICLE XVIII, CONSTRUCTION AND DEMOLITION WASTE RECYCLING AND DIVERSION Moved by Councilmember Gonzales, seconded by Councilmember Macias and carried by unanimous vote of the Council to adopt Ordinance No. 2020-01.
