HomeMy WebLinkAboutD-4 Staff Report - Filling Vacated City Council SeatSCHEDULED ITEM D-4 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: JEFFREY LAWRENCE CORNEJO, JR., CITY CLERK DATE: APRIL 6, 2020 SUBJECT: DISCUSSION AND PROVIDE DIRECTION REGARDING FILLING THE SEAT VACATED BY NEWLY ELECTED MAYOR GONZALES BACKGROUND: As a result of the March 3, 2020 election, Councilmember Robert Gonzales was elected as Mayor, leaving his Council seat vacant. Government Code Section 36512 states if a vacancy occurs in an elective office, the council shall, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. RECOMMENDATION: Staff recommends the City Council consider the following options and provide direction: 1)Set up an ad-hoc committee of 2 Councilmembers; 2) Appoint from Candidates that ran for Council; 3)Call a Special Election (Cost estimate $90,000.00) 4)Other – Council provide staff direction. ANALYSIS: State law requires the City Council to make a decision within 60 days. Historically the City Council has appointed the 3rd highest vote Candidate that ran for City Council that election year. In March 2005, Mayor Chagnon was elected as Mayor leaving her Council seat vacant, the City Council appointed Angel Carrillo to fill the remainder of her Council term. In March 2007, Mayor Rocha was elected as Mayor leaving his Council seat vacant. Due to a split vote the City Council decide to establish an ad-hoc committee to discuss their options provided by staff. At the March 26, 2007 City Council meeting, City Council appointed Robert Gonzales to fill the remainder of Mayor Rocha’s Council term.
